4 Introduction Your HOA The Willow Trace Home Owners Association (HOA) is established by and operates under the Willow Trace Covenant Restrictions and our by-laws. The HOA is run by a Board of five Willow Trace property owners who serve two-year terms. Election of Board members takes place at the annual meetings of the HOA held in February. The Covenants (Page 27, Sec. 8.1) establish the Architectural Control Committee (ACC), consisting of three members appointed by the Board to approve or disapprove various improvements or other matters dealing with the appearance of the community. The day-to-day operations of the HOA are handled by our Property Manager, Charlene Rice of HOA Community Management, LLC. Much of the Home Owner Association s responsibilities deal with routine items like paying the electric bill for our streetlights and maintaining the entry. The Board is also charged with maintaining the community s character and quality. This is done for the benefit of the residents and helps to maintain property values. Where the Covenants do not make specific mention of items, the Board has the power to establish guidelines to maintain uniformity, safety and uphold the common interests of the community (Page 10, Sec ). These must be communicated to the community, which is normally done through The Willow Branch, our community newsletter. The following pages are intended to serve as a guide to some of the more common concerns of residents. The page and section references relate to the Covenants as they appear in the copy on file with the Greenville County Register of Deeds. This guide does not cover all of the materials found in the Covenants, nor is it intended to replace the Covenants. 5 EXTERIOR IMPROVEMENTS TO HOUSE & PROPERTY General Policies No building, fence, wall, outbuilding, landscaping, pool, athletic facility or other structure or improvement shall be erected, altered, added onto or repaired upon any portion of the property without prior written consent of the ACC. (Page 27, Sec. 8.2) Repair or replacement of windows, doors, siding, shutters, roofs, or other exterior aspects of the house must match in appearance the materials used by the original builder, unless ACC approval is obtained prior to the modification. ACC must provide written response within 30 days of the receipt of a request, or the approval shall be deemed to have been granted. (Page 27, Sec. 8.4) Improvements must be substantially completed, including cleanup within 3 months of their being started, unless the ACC or the Board grants additional time. There should be no deviation from approved plans without ACC approval. (Page 28, Sec. 8.5) Additions or Renovations Involving the Exterior of the House A home addition or a major exterior renovation (adding a porch, a hot tub, an in ground pool, etc.) which involves electrical or plumbing should involve a licensed contractor, or must be inspected by the appropriate governmental departments. The ACC may ask for the name of the contractor or require copies of the inspection documents as part of the approval process. Parking Pads (Page 27, Sec. 8.2) Parking pads must have prior written ACC approval. Parking pads must be added to the side of the driveway away from the front of the house unless that placement is deemed inappropriate by the ACC. Parking pads may not redirect the flow of run-off water. (Page 29. Sec. 9.4) Detached buildings (Page 34, Sec ) All detached buildings have prior written ACC approval. 3

6 Detached buildings must be of same exterior materials as the house or other materials approved by ACC. Detached buildings may not be larger than 10% of floor area of main dwelling and may not exceed 1 story in height. Fences (Page 35, Section 12.12) Fences must have prior written ACC approval. No wall, fence or hedge shall be erected between street and front corner of the house. Maximum fence height is 6 feet. No chain link fences permitted. Wood or vinyl is recommended. Fence (plantings) may not obstruct sight distance at intersections. (Page 34, Sec. 12.8) Pools (above ground and in ground) and Pool Fences Pools (except children s wading pools less than 2 ft in depth) must have prior written ACC approval. (Page 27, Sec. 8.2) Pool fences must be at least 5 feet in height & have self-closing mechanism. (Page 35, Sect b) Gutters Gutters must be white, and match the appearance of those installed by the builder. Water from gutters must flow with the normal drainage of the property. Gutters meeting the above criteria do not require ACC approval. Chimneys (Page 37, Sec ) New chimney installations must have prior written ACC approval. Chimneys must be completely enclosed and materials used must be compatible with dwelling. Exterior Finishes and Doors (Page 37, Sec ) Exterior finishes for additions, home remodeling, and detached buildings must have prior written ACC approval. Replacement front doors may be wooden (or a door finished to appear as wood) without ACC approval. Replacement front doors may have windows. Full-view storm doors (those which permit the main door to be seen) may be installed without ACC approval. 4

7 Antenna, Satellite Dishes & Solar Collectors (Page 36, Sec ) Must have prior written ACC approval. Television or radio antennas must be screened from view. Satellite dishes must be less than 40 inches in diameter. While it is preferred that satellite dishes be screened from view, they are allowed to be located where visible from street if installer provides written documentation that the visible location is necessary for proper reception. Solar energy devices must be installed in ways that they are not visible from the street. (Page 39, Sec ) Roofs (Page 38, Sec ) Roofs on houses, garages and constructed out buildings shall be of composition shingles, matching those on the house. Non-shingled roofs when they are a pre-manufactured house addition (examples: an aluminum porch or glass roofed sun-room), a decorative home addition (example: a copper roof to a bay-window), or a decorative yard building (example: a wood shingled gazebo) may be approved by the ACC on an individual basis. Garages (Page 38, Sec ) Garage doors must be white. They may have small windows in them. Garage additions and new detached garages must have prior written ACC approval. Garages may not exceed 18 foot in height at highest ridge point of roof. Garages may not appear to be converted to living space. A garage door must remain, regardless of garage usage. Replacing Porch Posts and Railings Wooden porch posts may be replaced with matching vinyl or aluminum posts without ACC approval. Replacement posts may be round, as long as they are white, solid, and 6 inches in diameter. Other post and railing replacements or additions require prior written ACC approval. 5

8 Setback Lines (Page 38, Sec ) Structures must adhere to setback lines on recorded community plat. ACC may approve variances for specific reasons. Window Treatment No foil, reflective film or similar treatment shall be placed on windows or glass doors. (Page 37, Sec ) Damaged or window treatments deemed unacceptable by the ACC which are visible from the street must be replaced. "#$%#&%'%()%'*+)',#&%'-./0 Please do not assume that because someone else has done something similar or even exactly like what you wish to do that it is acceptable. There may be conditions you are not aware of, and it is possible that the HOA may be in the process of having that resident modify the changes he has made or return the property to its original condition. It is always best to check with our Property Manager regarding the need of ACC approval before you modify your property. COMMON PROPERTY, ENTRY MARKERS & TRESPASSING Entry The HOA maintains easements on the properties that border Taylor s Road for the entry to our community. Residents and their children should not trespass on the entry property nor climb on the entry markers. Common Property All property in Willow Trace is owned by specific homeowners. There is no common property owned by the Association. The areas under the power lines that run through Willow Trace and the areas bordering Boling Creek (sometimes called Marrow Bone Creek), the center of which forms a boundary of several Willow Trace lots, are owned by residents. Crossing through these areas is trespassing, and should not be done without the owner s permission. Parents are asked to inform children that these areas are not for play or passage without permission of the owner. 6

9 YARDS & LAWNS Unkempt Lawns (Page 36, Sec ) Lawns must be kept mowed. Grass or weeds may not exceed 6 inches in height. If a homeowner is contacted regarding the need to mow a lawn he has ten days in which to comply. Failure to mow within the allotted time may result in the lawn being mowed by the Association at the homeowner s expense and a fine. (Page 11, Sect ) No more that 10 percent of a yard area may be converted to decorative ground cover. Front of House Plants (Page 36, Sec ) (See diagrams on page 8.) Shrubbery in front of windows without porch: o Shrubbery in front of windows must be maintained at a height lower than the bottom of the window. o Individual topiary shrubbery must be maintained at a height covering no more than the bottom " of the window. Shrubbery in front of windows with porch (with or without railing): o Shrubbery in front of porch windows must be maintained lower than the height of the railing or maintained below a height of 38 inches above the porch pavement. o Individual topiary shrubbery in front of porch windows must be maintained at a height of no more than 45 inches. Shrubbery beside front-of-house windows or porch may not cover more than 1/3 the width of the window. Vines: o Vines on trellises by windows are acceptable if maintained within the shrubbery guidelines. o Vines on porch railings and posts are acceptable. o Vines may not grow along or on roofs or above windows. Shrubbery or trees may not block visibility of the front door from the street. Shrubs along community sidewalks or curbs must be maintained at less than 3 ft. in height. Shrubs and trees must be maintained so sidewalks and curbs are clear. Special designs for front-of-house porch or window plantings require ACC approval, and must be maintained within approved guidelines. 7

If the original tree dies or must be removed, a replacement tree must be planted. o The replacement tree in the same location may be of a different o variety without ACC approval. Placing the new tree in a different location requires ACC approval. Removal of trees behind and/or to the side of the house does not require ACC approval and does not require replacement. 8

11 Additional Plants and Beds for Plants (Page 27. Sec. 8.2) Planting of additional or replacement plants in existing beds does not require ACC approval. Planting of new trees or shrubs, or adding new landscaped beds for decorative perennials or annuals which can be seen from the street requires ACC approval. Window ledge boxes, porch railing boxes, and hanging baskets are acceptable. Potted plants that are less than 3 ft wide are acceptable, even if they go above the shrubbery height guidelines. These planters must be removed if they become unsightly. Plants or fence may not obstruct sight distance at intersections. (Page 34, Sec. 12.8) Low growing plants or vines adjacent to the mailbox do not require ACC approval. Garden Hardscape and Flags Garden statuary not exceeding 3 feet in height does not require ACC approval. Garden structures (trellises, tall statuary, arbors, gazebos, etc.) over 3 feet high and visible from the street require written ACC approval. (Page 27. Sec. 8.2) Small decorative flags flown from small flagpoles mounted on house or in ground or attached to mailbox posts do not require ACC approval. They must be removed when they become worn or unsightly. Flagpoles attached to the house, extending at an angle to the house, and not exceeding 8 feet in length, and not extending above the height of the house do not require ACC approval. Other flagpoles require ACC approval. (Page 27. Sec. 8.2) Edging of existing beds does not require ACC approval. Canvas Canopies Temporary canvas canopies do not require ACC approval as long as they are in the rear of the house. A permanent structure to support a canvas canopy requires ACC approval. (Page 27. Sec. 8.2) When a canopy becomes damaged or unsightly it must be removed or replaced. In Ground Irrigation Systems do not require ACC approval. 9

12 Clotheslines or clothes hanging devices are not permitted. (Page 37, Sec ) Signs, Balloons, Ribbons (Page 33, Section 12.4) Signs may not be displayed in the yard or on the residence, with the following exceptions: o For Sale/Rent/Lease signs, 2x3 ft. or less, for that property (not for other items). o Temporary signs for a political candidate, party or proposal (which must be removed following the election). o Security signs may be displayed in shrubbery beds near the o residence. Temporary signs for a yard or garage sale being held at that residence. These may only be displayed while the sale is in progress. No signs of any nature may placed in the community s entry, the easement along Taylors Road, or attached to sign posts or lampposts within the community. Any sign so posted will each incur a $50.00 per day fine to the homeowner responsible for the sign. Balloons, ribbons or other items may not be attached to items in the entry, to street signs or lampposts in the community. They may be temporarily displayed on ones own property or mailbox. Small Welcome plaques on the front of house do not require ACC approval. Recreational and Maintenance Equipment (Page 38, Sec ) Recreational equipment such as basketball goals, swing sets, trampolines, swimming pools, sports courts, either permanent or temporary, shall not be placed where they are visible from the street without prior written consent of the ACC. The ACC will not approve the permanent installation of athletic equipment in the front yard or attached to the front of a house Non-permanent recreational equipment should not be left in the front of the house when not in use. For safety reasons, basketball goals may not be located in the street, and should be located a minimum of 10 feet from the street. Maintenance equipment (shovels, rakes, lawn mowers, wheelbarrows, ladders etc.) should not be stored where they are visible from any street in the community. 10

13 MAILBOXES & POSTS See Covenants page 37, Sec

14 ANIMALS & PETS Keeping of Livestock or Poultry is prohibited. (Page 34, Sec. 12.6) Commercial Breeding of animals is prohibited. (Page 34, Sec. 12.6) Dogs, Cats and Generally Recognized Household Pets (Page 34, Sec. 12.6) Animals must be kept within enclosed areas. ( Invisible fencing is acceptable). Leash laws of Greenville County should be observed in Willow Trace. When pets are exercised in the community, the owner is responsible to clean up pet droppings. (Page 32. Sec 12.1) Chain link animal pens must be completely enclosed in an approved privacy fence. (Page 35. Sec 12.12) Doghouses (and other pet accommodations) in yards are subject to ACC approval, and should be placed in non-visible areas of the yard. ' PARKING General Policies Approved Parking Resident s vehicles should be parked in garages, on driveways or on paved parking pads. (Covenant amendment, March 2001.) Not Approved Parking Residents should not park in the street, on the grass or other non-paved areas, or straddling the curb (half on the grass or sidewalk/half in street). Street Parking Short-term, overflow guest parking along the curb is permitted only when the driveway is full. For example: once the driveway is full, guests for dinner or a party at your home may park in the street. Residents may temporarily park on the street while cleaning the garage, work is being done on the yard, etc. Residents may not regularly park on the street. Resident A resident is anyone living in a house in Willow Trace. If a house is rented or leased; or if friends or family are temporarily living in a Willow Trace house, they are considered residents. The HOA 12 '

15 holds the homeowner responsible for the parking of any resident of that house. A resident (compared to a house guest) is defined as a person who has lived in the house for 10 days. Trailers and Recreation Vehicles (Page 33, Sec. 12.5) Trailers, boats, motor homes, and other recreation vehicles may not be openly parked in the community. They may be kept in a garage or an ACC approved, enclosed area. Commercial Vehicles Company vehicles (those with logos or specialized equipment) which are the normal transportation of a resident may be parked in the garage, driveway or paved parking pad. (Page 33, Sec. 12.4e) Vehicle Size Vehicles that would not fit within the garage of the house may not be parked in the community (except when making deliveries or pick-ups). Dismantling or Assembling of Vehicles No dismantling or assembling of motor vehicles, boats, trailers, recreational vehicles or other machinery or equipment shall be permitted in any driveway or yard (Page 34, Sec. 12.5). Temporary work on a vehicle (completed within a 24 hour period) may be done on the driveway, other wise the vehicle must be enclosed in the garage. Traffic Violations If anyone parks in such a way that it blocks traffic or access to a driveway, mailbox or other service, it is a traffic violation, not a matter for the HOA. Notify the police. The vehicle can be ticketed and even towed away. THE WILLOW BRANCH ' The Willow Branch is the newsletter of the Willow Trace HOA. It is published periodically and contains information regarding Willow Trace. 16 MISCELLANEOUS ITEMS Trash and Trash Receptacles (Page 34, Sec. 12.7) Trash or refuse may not be stored outside of clean/sanitary containers. Trashcans should not be kept in the front of the house or on the driveway. If possible they should be kept in an area that is not visible from the street. Trashcans should be at the curb less than 24 hours on the day of trash collection. Businesses (Page 31, Article 10) Residences or portion of residences may not be used as a business if it involves the attendance of any person other than the residents of the dwelling. A residence may not become a business which serves as a place of employment of any person not a resident of the dwelling. Items Kept Outside The following items, if kept outside, should always be placed behind the house and stored as inconspicuously as possible: woodpiles, gardening & lawn equipment, children s play equipment such as bicycles, wagons, skate boards, etc Holiday Decorations should not be left up more than 30 days after the holiday. (Page 39, Sec ) Temporary structures may not be used as a residence. (Page 32, Sec. 12.3) Window AC units / fans should not be installed in visible windows of a residence. Yard Sales (Garage Sales) (Pages 30-31, Article 10.) Homeowners may have one yard sale in a six month period. If the community has a community wide yard sale, this shall count as one of the yard sales for all residents for that year. Yard sales may only take place on a single Friday and/or Saturday, during daylight hours. Signs about individual yard sales may be placed in the yard of the one holding the sale (or the yards of residents that give permission for the 14

17 placement of such signs). No signs may be attached to community sign or lampposts or displayed in the entry. Signs may only be displayed in the community during the time the yard sale is being held. Items to be sold may only be displayed on your property or the property of residents that give permission for you to use their yard. Items may not be placed in the entry. NUISANCES To help maintain peaceful and enjoyable living within Willow Trace, the Covenants grant the Board wide powers of interpretation when it states No noxious or offensive activity shall be carried on upon any Lot, nor shall anything be done which may become an annoyance or nuisance to the neighborhood (Page 32, Sec. 12.1). The Board has, at this point, invoked this statement to deal with loud music, late night loud parties, dog excrement, resident s dogs roaming the neighborhood, and a few individual infractions. If you feel a nuisance is being caused by one of your neighbors, and it does not fall under the purview of a county or state agency, contact our Property Manager. COVENANT VIOLATIONS Homeowners who notice a violation of a Covenant should report it to the HOA. This should be done by completing a Covenant Violation Complaint Form available on the HOA Community Management and the Taylors Willow Trace websites and submitting it to the Property Manager. (See Contact Information on the inside front cover.) 15

18 FINES IN WILLOW TRACE ' The Covenants give the HOA Board the power to enforce the Covenants and polices through various means. Some HOAs restrict the use of community facilities (pool, club house, golf course, etc.) Since we do not have those amenities the Willow Trace HOA has used fines to enforce the Covenants and policies of the community. ' If someone is deemed not to be in compliance with a Covenant or policy a notification is sent from HOA Community Management regarding the issue. This often results in compliance. If the matter is not resolved within a reasonable amount of time, a second notification is sent. This notification informs the homeowner that a fine will be issued if compliance is not met within a reasonable amount of time. On the rare occasion that compliance is still not achieved, the Board issues a $200 fine, which may be repeated monthly until compliance is achieved. The Board has made two exceptions to this procedure: Signs placed in the entry or on sign or lamppost is an automatic $50 fine. Not mowing within ten days of notification that the lawn needs mowing can result in an automatic fine. In the past some homeowners claimed they did not understand notifications from HOA Community Management. For several years the Board s policy was to remove such fines. Today the fine remains if the only claim for its removal is language difficulties. The objective of a fine is compliance with the Covenants and policies.
