1 Camden Lakes HOA Covenants Restrictions, ARC Standards, Board Rules & Regulations Summary The list of Rules below guides the Camden Lakes Community on most common modification requests and use of amenities. It is not intended to be all inclusive. Any external alterations or additions to Parcels require an Application for Approval by the ARC. Any alterations or additions to Parcels must be performed by licensed and insured contractors. Restrictions Use (RED) are rules covered by the Covenants and can only be amended by a 2/3 vote of the homeowners. ARC Standards (in purple, below RED) are rules adopted by ARC and can be amended and rescinded, from time to time, by resolution of the Board of Directors. Rules and Regulations (all in black) are rules adopted, amended and rescinded, from time to time, by resolution of the Board of Directors. 1. Exterior Colors Paint No exterior color on any structure shall be permitted that would be inharmonious or incongruous with the reminder of the Neighborhood. (Section 9.8) a. Paint colors must comply with color combination packages offered by Pulte b. Color combinations must vary from the units surrounding the properties c. No spraying of paint will be permitted. d. ARC applications are always required even if original colors are maintained. e. Landscaping All areas not covered by structures, walkways, paved parking facilities or areas approved by the Association to be left in their natural state shall be maintained as lawn or landscape areas to the pavement edge of any abutting streets or driveways, as applicable, and to the waterline of any abutting lakes, canals, or surface water management areas. All lawn and landscaped areas shall be kept in good and living condition. (Section 9.9) a. No homeowner, without prior approval by the ARC or the board may cut, alter or modify landscape materials located in common areas, between Units, or within easement areas. b. Any removal for replacing or addition of originally planted trees are subject to the ARC approval. b1. The tree must have a trunk diameter of 2 when installed and are most likely to be available at nurseries in 15 or 25 gallons containers. b2. The eleven (11) trees listed below are suitable for planting in Camden Lakes front yards to replace an Oak tree. They are native to SW Florida and at maturity they all have a 20 spread as required by Collier County. They also provide shade throughout the year. Any alteration, involving shape, size, or mulch (currently coco brown), requires previous approval by the ARC. d. Applications will require: d1. Survey depicting location of existing plantings with respect to property lines and existing improvements. d2. Drawing illustrating placement of proposed landscaping (on survey submitted.) d3. Description of proposed landscaping including type, height and quality of planting materials. d4. Applicant is responsible for maintaining and trimming all landscape materials approved by the ARC. e. No landscaping materials may encroach on neighboring Units or common areas. f. Irrigation System: No homeowner may adjust, impede, or alter any component of the irrigation system (whether impacting own parcel, neighbor s parcel or a common area.) This includes the clock mechanism, rain gauges or anything impacting the volume and/or direction of irrigation water flow. 3

4 3. Fences No wall shall be constructed on any parcel. Owners may install fences, subject to specifications adopted by the ARC. (Section 9.15) a. All fences must be black or bronze in color and made of Aluminum or Wrought Iron material b. Cannot exceed 48 in height. c. The front gate to the fence must be wide enough to allow for the landscaper s mowing equipment (48 inches.) d. Fence sections should be installed with a 2 vertical separation between the bottom of the fence and the ground beneath to allow for appropriate turf maintenance, also a horizontal separation of no more than 4 offset from each side of the fence line including between individual pickets is required. e. Fences are permitted to go to the perimeter wall and must have gates installed at the rear section of the yard on both sides to allow for county and landscaper access. f. Fences may not be installed further than 25 from the rear corner of the home towards the roadway. g. All fences must meet all state and local code requirements. h. Fences are not permitted on the lake view lots or where one home backs up to another. I. Invisible Fences are prohibited in Camden Lakes Community. 4. Solar Collectors/Panels The ARC must approve the location of the materials used in the construction of solar collectors. (Section 9.14) Piping fasteners and frames to solar panels must be painted to match the adjacent exterior structure color, i.e. roof, wall or trim. 5. Antennas and Satellite Dishes Antennas and satellite dishes are prohibited, except the ones designed to receive television broadcast signals (reception device) provided that the reception device is located so as not to be visible from outside the unit or is located on the side or rear yard of the parcel. (Section 9.11) Dishes are to be screened, with hedge planting (following existing patterns) restricting view from the street, common areas or other units 4

Storm ARC shall have the authority to adopt hurricane shutters specifications, which may include color, style, time periods in which shutters may be kept closed and other factors deemed relevant by the ARC. Laminated glass and window film architecturally designed to function as hurricane protection which complies with the applicable building code, maybe used in place of hurricane shutters, except that reflective window coverings are prohibited. (Section 9.15) a. Only removable shutters will be permitted on the front of the properties to maintain integrity of window/door frames and decorative lintels. b. Roll down shutters, in neutral color, may be permitted on the side of properties, since it is not visible from the street, and back of the properties (lanais.) c. Roll down shutter boxes should not be over seven (7) inches in depth (e.g., Nautilus brand) d. Accordion shutters are not permitted. e. All attached hardware must be painted in the color of the house. f. Specifications, placement and dimensions of rolling down shutters and hardware must be included and clearly indicated for each window on the application form. Pictures and catalogs should also be included. g. The shutters maintenance and replacement, if damaged or begin to discolor, is the responsibility of the homeowner. h. Storm can be installed after a tropical storm is named and removed no later than seven (7) days after named tropical storm is no longer a threat. 7. Exterior Lighting Exterior lighting of a parcel shall be accomplished in accordance with a lighting plan approved in writing by the ARC. (Section 9.16) a. Original models of outdoor wall light fixtures in the front of the house (garage) should be maintained. b. In the case of lack of availability of similar replacement fixtures, alternative models will require: b1. Height - cannot exceed 22 b2. Depth - cannot exceed 7. The entire light unit plus the wired unit cannot exceed 10 from the wall. b3. Width - cannot exceed 7 b4. Material color must be black b5. Pictures of the new fixtures must be included in the ARC Application Form for approval. c. Light Bulbs should be soft white. Colored bulbs (red, green, etc.) are only admissible during holidays. 8. Garages No garage shall be converted to residential use or used other than as originally designed by the developer. (Section 5.5) Garage doors must be kept closed except when a vehicle must enter or exit the garage. (Section 9.7) 5

6 All garage doors may only remain open when being used, otherwise doors shall remain closed. 9. Signs No sign nor advertisement of any kind, including without limitation those of realtors, contractors, and sub-contractors shall be erected within the neighborhood without the prior written consent of the board of directors, if not in conformance with Camden Lakes Rules and Regulations document. (Section 9.2) Realtors and Private Sellers: a. Signs for sale or rent are not allowed inside of the community b. Open Houses may only be held on Sundays from 1:00 to 4:00 pm c. Only 3 open house signs will be permitted. One outside indicating the community has an open house; one upon entrance to the community indicating the direction of the open house; one at the open house d. All open house signs must be collected at the of the open house e. Provided notification is given to the property manager no later than 12:00 pm the Friday before the requested open house. The community gate will be open Sunday, from 1:00-4:00 pm. Please note, unless the required notification is provided to the property manager, the gate will not be open on Sunday. f. Failure to follow the procedure above or trying to circumvent the protocol will result in the revocation of the privilege of the realtor/private seller to post any signage in the community. 10. Pets and Animals No animals, livestock or poultry of any kind shall be raised, bred or kept on any Parcel, except that a reasonable number of dogs, cats and other usual and non-exotic household pets may be kept (except for pit bulls, wolf hybrids, or other dogs prone to or exhibiting aggressive behavior), provided they are not kept, bred or maintained for any commercial purposes. All animals shall be contained on the Owner s Parcel and shall not be permitted to run freely. (Section 9.6) a. A reasonable maximum number of animals for a household is three (3) if in compliance with all restrictions in section 9.6 of the use restrictions in the governing documents. b. Pets may not be tied up outside under any circumstances. c. All pets (dogs) must be leashed always unless in a fenced yard which prevents the pet from escaping. d. Pet waste shall not be kept in any area outside of the property. All residents must clean up after their pets. 11. Clothes Drying Area/Clotheslines No outdoor clothes drying area or clotheslines are permitted. (Section 9.18) 12. Flags and Banners All flags and banners of any type will not be allowed outside of a property, except for a portable, removable official United States Flag or official Flag of the State of Florida in a respectful manner, or on Armed Forces Day, Memorial Day, Flag Day, Independence Day, and Veterans Day, a portable, removable US Army, Navy, Air Force, Marine Corps or Coast Guard 6

7 Flag. The permitted flags shall not exceed 4.5 x 6. (Section 9.11) 13. Garbage and Recycling Containers All garbage and recycling containers must be walled -in or placed in sight-screened or fencedin area so that they shall not be readily visible from any adjacent streets or Units. (Section 9.12) 14. Roof The color of the roof tile shall not be changed nor, shall other roofing material or styles be substituted. (Section 9.8) 15. Front Door and House Address Numbers No owner shall make or permit the making of any alterations or additions to his Parcel, or in any manner change the exterior appearance of any portion of the Unit, without first obtaining the written approval of the ARC, which approval may be denied if the ARC determines that the proposed modifications or alterations would adversely affect, or in any manner be detrimental to the Neighborhood, in part or in whole. Any glass, screen, (Section 5.1) a. Only Non-visible retractable door screen, in the front of the property, will be allowed. The color has to match existing door frames. b. Any changes in glass doors/inserts must be pre-approved by the ARC and must include adequate hurricane protection. Applications should include pictures and/or catalogs. c. House Numbers Address: c1. Original wall numbers address in the front of the house, by the garage, should be maintained. c2. In the case of lack of availability of similar replacement numbers, alternative model will be a Vertical 5-Line Wall Address Plaque with the specifications below:. Model/Style - Richmond. Plaque size 23 H x 4 W. Number s size is 4 with a width of stroke at 0.5. According to Florida Fire Prevention department.. Numbers Font - same as the original, or close enough to the original. Material metal. Plaque color background in black with numbers in gold. Plaque location and orientation in the wall Same location of the original numbers address with Vertical orientation. To guarantee uniformity/homogeneity the Plaques can be order by the board at the resident s cost. 16. Play Structures a. Play structure will be allowed on the outer lots which face a wall or preserve area. b. All structures must be approved prior to installation. c. Play structure visible from the street will required mature landscape to shield. d. Play Structures must be kept in good repair always or they may be required to be removed. e. Wood, aluminum or plastic structures will be permitted, but are subject to size and location prior to installation. 7

8 17. Screen Enclosures a. Screen enclosures will only be permitted in the rear of the home and cannot exceed the width of the house. b. Identify colors including colors for screening, aluminum framing, and door kick plates. 18. Driveway Expansion a. Survey indicating location of proposed installation. b. Pavers and pattern must match existing driveway. c. May expand up to a maximum of 5 feet on the walkway side, but driveway cannot block the front door. d. Must finish to the street (beyond sidewalk.) 19. Generators a. Natural gas generators may be permitted on a case-by-case basis, after written approval by the Collier County. b. Owner must submit an ARC Application with a photo of the generator, specifications (generating capacity e.g., 20 KW, dimensions, color, noise levels), and the location of installation must be clearly on-site plan (including distance from property limits, closest wall, neighboring unit and windows) and a copy of the Collier County approval. c. If approved generator must: c.1. Be installed on a concrete slab (like AC units.) c.2. Be screened, with hedge planting (following existing patterns), restricting view from the street, common areas and other properties. 20. Excavation Homeowner is responsible for notifying the property manager and ensuring identification of irrigation and utility lines prior to commencing any lot excavation. 21. Soliciting Soliciting for any commercial purpose or any solicitation by non-residents (for any purpose) is strictly prohibited 22. Mailbox Structure No signs or other posted material may be affixed to the mailbox structure 23. Holiday Decorations a. The Board of Directors will set up a committee to put up all decorations in the common areas with the Board approval. Only the Board, via decorations committee (or their authorized vendor) may add, amend or alter items affixed to the common areas including gates and clubhouse. b. Individual residents may decorate their own homes starting after Thanksgiving and all decorations, including the colored exterior lighting fixtures, must be removed no later than 14 8

9 days after the end of the holiday. Residents are asked to decorate in a tasteful manner, being respectful and considerate of your Neighbors. 24. Porch, Front and Back Yards Decoration These are outside spaces. Even though they are part of an individual resident s property, this still can be seen by neighbors and reflect the appearance of the entire community as well. Definition of Yard and Decoration Decorating: Make (something) look more attractive by adding extra items or images to it. Synonyms: ornament adorn trim embellish garnish furnish accessorize. Yard House: The grassy area right outside a house is a yard. A yard is often surrounded by a fence or marked by shrubs or other plants. a. Plant containers may not contain dead plants or weeds. b. Seating and plant containers made of ceramic, concrete, terracotta like lightweight planters made of fiberglass, resin or fiberstone are good options. c. Plastic stackable or folding beach chairs are not allowed on the Porch or on the Front Yard. d. All Yard Decorations must be made of durable materials such as concrete, ceramic, wood or metal. All must be well maintained and in working order. e. Yard Decorations may be in the front and back yards within landscaped beds only, not in grass areas, so as not to interfere with yard maintenance. f. Yard Decorations may not exceed 24 (twenty -four) inches in any dimension, except at appropriate times of the year celebrating that specific event. Any Yard Decoration larger than the dimension specified here will need an ARC application. g. Fountains must be well maintained. Inoperable fountains may not contain standing water. h. Birdbaths are not allowed, since it contains standing water. i. Bird feeders are not allowed. Northern bird feeders supplement the nutritional requirements for birds from Fall to Spring. Feeders, however, they are not necessary in Southwest Florida where foods sources are plentiful all year round. Besides bears and deer, rodents, mice and palm rats are attracted to the feeders where they easily feed on the bird feed in the feeder and seeds that drop to the ground. These rodents attract snakes that eat mice and rats. j. Plant containers with edible plants should be left indoor or in the lanai as it may attract critters and other pests. k. Signs, other than security notices, are not permitted. Section 9.2 from Declaration of Covenants Conditions and Restrictions. l. Holiday Decorations must be removed no later than 14 days after the end of the holiday. 25. Gym/Fitness Room Use of the Gym/Fitness room is governed by Rules and Regulations posted in the Gym/Fitness room. 26. Use of the Clubhouse or the Gazebo/Lawn area a. Use of the clubhouse or Gazebo/lawn area is subject to the contract required by the Board of Directors. 9

10 b. The application Form for the rental agreement is available on the GRS website Parking within Camden Lakes Community a. Without exception, all residents must park in their garage or driveway. Residents shall not park on the street. b. No resident shall park in any of the three guest parking areas except when collecting mail or visiting the pool c. Guests must park in the guest areas if available. Otherwise, parking for guests are permissible on the road (even year -even side address; odd year odd side address.) If staying overnight, the vehicle must be moved to a guest designated area or resident s driveway d. No street parking is allowed within twenty (20) feet of a corner or a curve by any vehicle. e. Parking is not allowed in front of the clubhouse 28. Basketball Court a. The court is to be used for basketball and not for any other purpose. The basketball court may not be used for bike riding, skateboarding, nor any activity that might harm the paved surface or the basketball hoop. b. Basketball hoops on an owner s property driveway will be permitted during daylight hours but must be stored within an enclosed garage overnight every night. No outside storage will be permitted. 29. Lakes The lakes may not be used for recreation of any type, including fishing and swimming. 30. Swimming Pool and Related Areas a. The Swimming pool hours are from dawn to dusk. b. The Swimming pool deck and fire pit shall be open until 11:00 pm. c. There is no lifeguard. People using the Swimming pool do so at their own risk. d. Children under the age of 14 must always be attended by an adult. e. Residents may not engage in any activity that could be harmful to themselves and/or others. f. Residents must accompany any guest in the pool area. At all times residents may not loan their access fobs to guests. Residents remain responsible for the conduct of their guests. g. Residents must ensure they do not interfere with the use and enjoyment of the pool for others. Residents may not have so many guests accompany them, such that the presence of guests monopolizes the pool area. h. Pets are not permitted in the pool area, unless they are certified as assistive companions. I. The Fire Pit may not be used for cooking of any type. J. Use of the swimming pool and pool area are subject to the requirement that all residents must clean up any messes, garbage or food debris they have caused or left. The entire area is Community Space and must be well maintained. It is everyone responsibility to leave the areas in clean condition. k. Residents after using the grill are responsible for cleaning it and turning off the gas, using both the burner knobs and the timer below. 10
