Please be aware that this item will require a large part of the time available for the meeting. In detail: Section 1 contains 25 sheets already noted by the ATEX Standing Committee in the past. These sheets shouldn t need further discussion, if no serious concerns were raised by Member States. Section 2 contains 4 sheets already noted in the past, too, but dealing with issues which should rather be subject to considerations of the Standing Committee. These sheets should be evaluated whether they are suitable to become consideration papers. Whatever results this evaluation will bring, they should be withdrawn by ExNBG, because then published by the SC or considered as not appropriate. Section 3 contains 9 sheets not yet noted, but again dealing with issues which should rather be subject to considerations of the Standing Committee. They should be treated as those in section 2. Shearman Date: 18/06/03 Date of application: Signature: Extension of EC-Type Examination Certificate in the case of (a) different categories or (b) mixes of equipment and protective systems Question: Which conformity assessment procedures have to be performed in the case of different categories within one product or mixes of equipment and protective systems according to Article 1.3 b? Answer: If a product is made of parts which are assigned to different conformity assessment procedures it will be up to the manufacturer to decide how these parts and the whole product shall be placed on the market. The manufacturer can decide to realise the appropriate conformity assessment procedures for each part or for the whole product, even if he decides to place the product as an entity on the market. In the case of separate conformity assessment procedures for each part of the assembled equipment (called assembly in the ATEX guidelines), the manufacturer of that assembly may presume conformity of these pieces of equipment and may restrict his own risk assessment of the assembly to those additional ignition and other relevant hazards, which become relevant because of the final combination. If additional hazards are identified a further conformity assessment of the assembly regarding these additional risks is necessary. This ExNB Interpretation/Clarification Sheet has the sole purpose of clarifying the application of the EN Standards and/or of the requirements of Directive 94/9/EC and related documents. It does not in any way change the content of the standards and/or of the requirements. 26 - 2 - If the manufacturer explicitly asks a notified body to assess the entire product, then that conformity assessment procedure has to be applied, which covers the highest requirements. The involved Notified Body shall include into the EC-type examination all aspects of the product. Existing conformity declarations of the manufacturer for parts of the product should be considered. The Notified Body should inform the manufacturer about the possibilities of separate conformity assessment procedures for each part of the assembly as pointed out by the ATEX guidelines in table 1. ANNEX Example: Vapour recovery pump for petrol stations (a) The pump is sucking the petrol vapour-air mixture from the atmosphere and is conveying it in pipe-work attributed to zone 0. Accordingly it is connected at its inlet and outlet to a potentially explosive atmosphere classified as zone 0. The pump itself is placed in a zone 1 environment. With regard to the inlet and outlet connection the pump then has to comply with the requirements for category 1 equipment. The corresponding EC-type examination (equipment) has to be carried out by a Notified Body. With regard to the remaining (outer) body and integrated parts of the pump the Notified Body includes the necessary category 2 assessment into the certification, even if there are only nonelectrical ignition sources to be considered. Both categories shall be indicated in the EC type examination certificate and in the marking. For those category 2 parts of the pump, which show only non-electrical ignition sources and which are placed separately in the market for which the technical documentation has been communicated to a Notified Body the EC declaration of conformity (for equipment) or a written attestation of conformity (for components) of the manufacturer aresufficient. (b) Often the pump is expected to prevent the passage of a deflagration flame from the inlet to the outlet connection as typical vapour recovery pumps contain flame arresters in the inlet and outlet pipe. In this case the pump simultaneously may qualify as a protective system (in-line deflagration arrester). A Notified Body after having carried out a corresponding assessment of the flame arresting capability may then issue a separate EC-type examination certificate for the pump as protective system. In case that both aspects (equipment and protective system) have been assessed by the same Notified Body, only one EC-type examination certificate might be released. Answer: Yes. Since conveying equipment is covered by the Directive 98/37/EC for machinery, a risk assessment has to be performed including the risk of explosion independent of the question whether the equipment is matter of Directive 94/9/EC. When performing this risk assessment it will become evident that although parts of the described equipment are outside the scope of Directive 94/9/EC during normal operation (pressure oscillates between too low and too high values in relation to "atmospheric conditions") some parts or spaces still are under the scope and that the whole equipment during start and shut down is under the scope, at least. So both of the following examples fall under the scope of Directive 94/9/EC. 30 - 2 - ANNEX Examples: 1. Vapour recovery pump for petrol stations The pump is sucking the petrol vapour air mixture from the atmosphere and is conveying it into a zone 0 pipe. Accordingly it is connected at its inlet and outlet to a potentially explosive atmosphere. It is itself placed in a zone 1 environment. Accordingly all outer parts of the pump are connected to a hazardous area. It is the aim of all the protections measures of the pump to avoid the ignition of all connected hazardous areas, no matter if the ignition sources are inside or outside the pump. 2. Vacuum pump sucking from a vacuum container and conveying the mixture into a pressure vessel or pressure line In this case the inner parts of the pump are not connected to an atmospheric environment, and accordingly only the outer parts of the pump are covered by both ATEX regulations. Answer: If a gas detector incorporates a measuring function for explosion protection in the sense of directive 94/9/EC it shall be assessed as safety-related device according to annex II, clause 1.5 EOTC/01/009 also applies. For example, a portable gas detector that is intended to be used to detect the presence of an explosive atmosphere prior to the opening of a flameproof enclosure that contains energised electrical circuits, is being used as a safety-related device. Annex 8, question 12 of the ATEX-guidelines concludes that: 1. Measuring equipment is within the scope. 2. Measuring equipment has to be safe with respect to explosion protection and the measuring function also requires assessment. 3. This measuring function can be used for the evaluation of potentially explosive atmospheres or for control of ignition sources within the equipment itself. Answer: A) EC-type examination The technical documentation (according to annex III, clause 3) that shall be submitted for that part of an EC type examination of a gas detector which deals with the measurement performance (measuring function for explosion protection in the sense of directive 94/9/EC, Annex II, paragraph 1.5.5), shall include a complete set of design and manufacturing drawings, a detailed description of the software operation and identification. B) Supervision of the production It is the manufacturer's obligation to ensure that each equipment to be placed on the market is identical with the type tested. To confirm the regular operation of the measuring function of a gas detector the following checks, if applicable, on all relevant parts of each gas detector are necessary 1. input and output functions, e.g. operation of displays, LEDs, alarms and push buttons, 2. sensitivity, 3. software version. In addition, the manufacturer shall perform the following tests on a sample basis by either performing the tests in accordance with harmonized standards or by other technically equivalent procedures: 4. response time, 5. calibration curve, 6. response to other gases, if applicable, 7. long-term stability, 8. any other check that is considered necessary to confirm the measuring function is in compliance with the applicable standards (for example, effects of temperature or humidity). Some NB's circulate lists of certificates issued on a regular basis, other NB's publish the list on a web-site, others sell copies and some wait until a request is made. The Standing Committee would like NB's to agree a common practice to be adopted by all NB's. In addition, although not a requirement of the directive, the Standing Committee has asked if the "relevant information" could be made available to other interested parties. This leads to the following questions and answers: Q1 What is included in the "relevant information" as quoted in Annex III Clause 7, Annex IV, Clause 6 and Annex VII Clause 6? A1 Q2 "Relevant information" is the minimum information that enables the validity or status of the certificate and its amendments to be established. How will notified bodies communicate this "relevant information" to other notified bodies? Shearman Date: 18/06/03 Date of application: Signature: Safety devices, controlling devices and regulating devices (Article 1 (2)) Question: How should the application of the Directive to safety and controlling devices providing a safety function for equipment intended for use in potentially explosive atmospheres be understood? Answer: Safety and controlling devices are covered by the relevant requirements of the Directive if they contribute either directly or indirectly to the safe functioning of equipment intended for use in potentially explosive atmospheres. It should be understood that the meaning of the Directive is such that safety devices are covered under the Directive, even if (and not only if) they are intended for use outside a potentially explosive atmosphere and provide a direct (or indirect) contribution to the safe functioning of equipment intended for use in potentially explosive atmospheres. It was also evident that the controlling of ignition sources for such devices (in respect of the ATEX Directive) outside of a potentially explosive atmosphere was not required, and was meaningless if the device was inside such a potential atmosphere but did not contain an ignition source. However, this did not preclude the need to consider other relevant aspects. The reasoning is given in annexes I and II. 44 - 2 - Annex I Comment on definition of "equipment" (Article 1.1 and 1.3a) and "Safety devices, controlling devices and regulating devices" (Article 1 (2)) by Deutsche Montan Technologie, 19 November Basis Article 1 (2) defines, that "Safety devices, controlling devices and regulating devices intended for use outside potentially explosive atmospheres but required for or contributing to the safe functioning of equipment and protective systems with respect to the risks of explosion are also covered by the scope of this Directive". In Article 1 (1) and 1 (3)a "equipment" is defined: "Equipment means machines, apparatus, fixed or mobile devices, control components and instrumentation thereof and detection or prevention systems intended for use in potentially explosive atmospheres, which are capable of causing an explosion through their own potential sources of ignition" From Article 1 (3)c follows, that equipment (for differentiation to components) has an "autonomous function". In Article 3 is defined, that "Equipment, protective systems, and the devices referred to in Article 1 (2) to which this Directive applies must meet the essential health and safety requirements set out in Annex II which apply to them, account being taken of their intended use". Annex II, Preliminary observations, B) says: " For the devices referred to in Article 1 (2), the essential requirements shall apply only in so far as they are necessary for the safe and reliable functioning and operation of those devices with respect to the risks of explosion." Problem 2.1 In Annex II, clause 1.5 of the Directive " Requirements in respect of safety-related devices" are defined. Obviously this phrase has lead to the wrong opinion (together with the phrase in Article 1 (2)), that these requirements are valid for the devices referred to in Article 1 (2), only, and not for equipment. That, in contrary, according to definitions of the Directive, equipment can perform the function of safety devices, controlling devices and regulating devices is shown in the following: 1) In Article 1 (3)a "detection or prevention systems" are listed as equipment (no protective systems!). 2) Article 3 explicitly states, that equipment "must meet the essential health and safety requirements set out in Annex II which apply to them, account being taken of their intended use". There are no restrictions, that clause 1.5 of Annex II may not be applied for equipment. 3) In the preliminary remarks of Annex II in B) the requirements on devices referred to in Article 1 (2) are restricted to those, which " are necessary with respect to the risks of explosion". Here no definition is given, which these requirements are and, in particular, no restrictive statement concerning requirements on equipment is made. Obviously it is indisputable that protective systems have to contain safety function(s). 2.2 Obviously the meaning of Article 1 (2) has to be clarified. In the "Guidelines" is said that there are two main issues in Article 1 (2): i) that safety devices, controlling devices and regulating devices, if they contribute to or are required for the safe functioning of equipment or protective systems with respect to the risks of explosion are subject to the directive; 44 EXNB02-116CS Safety devices, controlling devices and regulating devices.doc

45 - 3 - ii) that devices are covered even if they are situated outside the potentially explosive atmosphere. Although the intention of the Directive is correctly interpreted with these issues, the context of the first issue can't be taken from Article 1 clause 2. Article 1 clause 2 could be understood in the way, that only those safety devices are under the scope of the Directive which are for use outside potentially explosive atmospheres. This article should better be formulated (and understood, above all) as follows: "Safety devices, controlling devices and regulating devices required for or contributing to the safe functioning of equipment and protective systems with respect to the risks of explosion also are covered by the scope of this Directive even if they are intended for use outside potentially explosive atmospheres." Moreover it is stated in the guidelines: "If the device does not have its own potential source of ignition then the device will not be regarded as equipment but of course the requirements resulting from Article 1 (2) will still apply." Here the question arises how to mark such a device. Annex II Comments by WG/98/5 on document "The application of ATEX Directive 94/9/EC to devices that contribute to the safe functioning of equipment intended for use in a potentially explosive atmosphere, including devices with a measuring function", written by Ken Thomas, 26th April November 2001 The following arguments deal with general aspects of document EOTC/01/036, only. Document EOTC/01/036 appears to conclude that Directive 94/9/EC contains requirements for safe functioning of devices only if equipment relies on the device to "control" its own ignition sources. (In document EOTC/01/036 defined as "direct" contribution to safe functioning of equipment). This opinion is incomplete because the formulation of article 1.2 is not restricted to safety devices with a function denoted in the paper as "direct" contribution. The text covers also safety devices, controlling devices and regulating devices indirectly contributing to the safe functioning of equipment. This is supported by the following two clauses of EN :1997: limitation of concentration by monitoring with gas detectors or flow detectors, which shall be coupled to alarms, other protective systems or automatic emergency functions (EN : 1997, ). use of measuring and control systems to limit the occurrence of effective ignition sources (Annex C of EN ). 45 EXNB02-116CS Safety devices, controlling devices and regulating devices.doc
