5 The Federal Law by Decree No 6 of 2009 Concerning Peaceful Uses of Nuclear Energy Legal framework for Safety, Security, Safeguards in the Nuclear Sector, which includes: Nuclear facilities; and Regulated material (radioactive material / radiation generators) Three Fundamental Principles The Federal Authority for Nuclear Regulation (FANR) established as the independent regulatory body Regulated activities prohibited except in accordance with a licence issued by FANR The licensees responsibility: Each Licensee shall be responsible for taking all steps necessary to reduce the risk of an accident to a level that is as low as reasonably achievable

6 The Regulatory Framework FANR s approach in developing national regulations under Article 38 of the Law: Conforms with IAEA Safety Standards, Security Guidance and other internationally recognized practices Taking into consideration comments by external stakeholders The intent is to produce high-level regulations, which are nonprescriptive, focusing on the essential aspects of safety, security, and safeguard Regulatory Guides have been developed to assist the licensee in complying with the regulations

7 The Regulatory Framework For Radioactive Sources, main regulations to be implemented: FANR-REG-13 for Transportation of Radioactive Materials [Reference to IAEA TSR-1] FANR-REG-23 for Security of Radioactive Sources [Based on IAEA Nuclear Security Recommendation on Radioactive Sources and Associated Facilities (NSS No. 14) and its implementing guides (NSS No. 9 and 11)] FANR-REG-24 for Basic Safety Standards for Facilities and Activities involving Ionising Radiation [Based on IAEA Basic Safety Standard] Several safety regulatory guides established based on the practices

9 The Regulation for Safety of Radioactive Source Before 2009 Federal Environmental Agency Regulate the safe use of Radioactive materials After 2009 FANR Transferred the regulation responsibilities to FANR FANR-REG-24 Regulated Activities [use, transport, import/export, storage and disposal] With Regulated Materials [radioactive material above the international exemption levels and radiation generators]

10 The Regulation for Safety of Radioactive Source FANR already licensed more than 500 entities for the safe use of radioactive material and X-ray machine. Licence conditions include: 3 years duration of issued licences Permit requested for import/export and for a prior notice for transport NON- MEDICAL 34% MEDICAL 66% From about 3 years, more than 200 inspections carried out by FANR Safety inspections instructions developed depending on the practices

12 The Regulation for Security of Radioactive Source Requirements of FANR-REG-23 regarding the implementation of: Security measures for detection, delay and response Security management measures such as access control Procedural security measures such as periodic review of plans Protection measures of information, trustworthiness and training programs Arrangements with law enforcement agency» Communication following detection of any security breach» Notification of security breach» Cooperation and assistance to locate and recover source» Annually engagement (only for Category 1) A security culture and its integration in the management system

13 The Regulation for Security of Radioactive Source FANR-REG-23 for security of radioactive sources issued in October 2011 FANR-REG-23 provides requirements to protect IAEA category 1 to 3 of radioactive sources and their aggregation in use, storage and transport The objective is to ensure in UAE territory the protection of high activity radioactive sources against theft and sabotage According FANR-REG-23 each applicant/licensee shall submit to FANR for approval a security plan and/or a transport security plan

14 The Regulation for Security of Radioactive Source Process adapted for existing licensees Identification of approximately 80 licensees with Category 1 to 3 Radioactive Sources. Introduction of Regulation 23 through site visits to each licensed facility with Category 1-3 Radioactive Sources. The Site visits provided FANR with the opportunity to:» Identify what type of security measures were already in place.» To request implementation of the Regulation 23.» Seek submission of security plans, and transport security plans (if applicable) for approval. The site visits also provided the licensee a mechanism to feedback any concerns they had regarding the implementation of the Regulation A FANR Safety and Security seminar was held for all licensees of regulated materials in UAE. The seminar provided a platform to update licensees with the latest regulatory evolutions, as well as to highlight a holistic approach to safety and security. An agreement between FANR and the UAE Ministry of Interior, was established to ensure UAE Police cooperation with the implementation of Regulation 23. In future, joint inspection of licensee

15 FANR Licensing Process FANR Integrated Management System integrates the core regulatory activities One Core Process concerns the licensing of regulated activities with the main steps: Receipt and acceptance of application Preparation and execution of assessment Preparation of formal report Licensing recommendations to FANR Board of Management for decision Licensing Procedure for radioactive material following 3S approach describes steps and topical review instructions

16 An Integrated Licence Process Application form as well as guidance for applying for regulated materials taking into account safety and security Separate review of the application by both radiation safety department and the nuclear security department (sensitivity of information) Reports collected and provided to the Board of Management for final decision Licence form modified to take into account specificity of security regulation, including specific licence conditions One licence taking into account safety and security aspects been issued

17 Conclusion FANR independent regulatory authority for safety and security of radioactive sources Regulatory framework developed for both domains (safety and security) Integrated license process for regulation of radioactive sources taking into account both aspects, including specific security conditions in the licence itself Control and inspection processes developed in both domains but to be integrated in the future
