6 Interim Partial and Global Consent Decree Status Summary Report Hamilton County/City of Cincinnati, Ohio Glossary Combined Sewer Overflow (CSO) Any discharge from any outfall identified as a combined sewer overflow or CSO in Metropolitan Sewer District of Greater Cincinnati s (GC) current permits as defined below. Consent Decree The Consent Decree on Combined Sewer Overflows, Wastewater Treatment Plants and Implementation of Capacity Assurance Program Plan, and/or the Interim Partial Consent Decree on Sanitary Sewer Overflows, including all attached Exhibits and all subsequently approved submittals. Current Permits All National Pollutant Discharge Elimination System (NPDES) permits pertaining to GC s Wastewater Treatment Plants and Sewer System that are in effect at a particular time in question. Current Permits include, but are not limited to, NPDES Permit Nos. IPX00022*BD (CSO Permit); 1PM00001*LD (Mill Creek WWTP); 1PK00006*KD (Muddy Creek WWTP); 1PK00005*KD (Sycamore WWTP); 1PL00000*OD (Little Miami WWTP); 1PK00019*GD (Polk Run WWTP); 1PK00006*HD (Indian Creek WWTP); 1PK00015*DD (Taylor Creek WWTP); and any such permits that succeed those permits and are in effect at a particular time in question. Enhanced High Rate Treatment Facility (EHRT) In general, a facility designed for sedimentation treatment that usually includes settling, disinfection, and dechlorination technologies to treat high volumes of influent quickly. Final Wet Weather Improvement Program (WWIP) The Final WWIP, ordered August 10, 2010 by Judge Arthur Spiegel, finalizes the agreement between the regulators and the Defendants and defines the scope and schedule limitations for the work to be done. The work for the Wet Weather Improvement Program is split into two phases, with Phase 1 construction projects to be complete by December 31, Infiltration The water entering a sewer system and service connections from the ground, through such means as, but not limited to, pipes, joints, connections or manhole walls. Inflow The water discharged into a sewer system including service connections, from such sources as, but not limited to: roof leaders; cellars; yard and area drains; foundation drains; cooling water discharges; drains from springs and swampy areas; manhole covers; cross connections from storm sewers; surface run-off; street wash water; or drainage. Inflow and infiltration - The total quantity of water from both infiltration and inflow, without distinguishing the source. Milestone In the context of the Consent Decrees and Final WWIP, a milestone is an enforceable deadline for the completion of work. Each project to be completed by the end of Phase 1 has potentially three milestones; the PTI submittal milestone, the Start Construction milestone, and the Construction milestone. Project progress and schedule float is tracked against these dates. National Pollutant Discharge Elimination Permit (NPDES) A permitting program authorized and established by the Clean Water Act to address water pollution discharged from point sources into waters of the United States. Plaintiff or Plaintiffs The United States, the State of Ohio and/or Ohio River Valley Water Sanitation Commission (ORSANCO), as appropriate. Pump Station - Installation that serves to lift the wastewater from a deep section of the collection system to a level closer to the ground surface. Right of Way Right of way is the land required for the completion of a project, and can include the permanent acquisition of property or easements rights. Sanitary Sewer Discharge (SSD) Any discharge to waters of the State or United States from GC s Sanitary Sewer System through a point source not specified in any National Pollutant Discharge Elimination System (NPDES) permit. Sanitary Sewer Overflow (SSO) Any discharge to water of the State or United States from GC s Sanitary Sewer System through point sources not specified in any NPDES permit, as well as any release of wastewater from s Sanitary Sewer System to public or private property that does not reach waters of the United States or the State, such as a release to a land surface or structure that does not reach waters of the United States or the State; provided, however, that wastewater backups into buildings that are caused by blockages, flow conditions, or malfunctions in a building lateral, other piping or conveyance system that is not owned or operationally controlled by GC are not SSOs for the purposes of the Consent Decrees. As such, the term SSO includes Water-in-Basements (WIBs) released from GC s Sanitary Sewer System. (The term Water-in- Basements has been changed to Sewer Backups (SBUs).) Sewage Municipal sewage, including domestic, commercial and industrial sewage. Sewer Backup - Any release of wastewater from GC s Sewer System to buildings that (i) is not the result of blockages, flow conditions, or malfunctions of a building lateral or other piping/conveyance system that is not owned or operationally controlled by GC s and (ii) is not the result of overland, surface flooding not emanating from GC s Sewer System. Sewer System The wastewater collection and transmission system owned or operated by Defendants designed to collect and convey municipal sewage (domestic, commercial and industrial) to the Defendants Wastewater Treatment Plants or overflow structures. Sewer System Hydraulic Model The hydraulic model developed in accordance with Paragraph VII.B of the SSO Decree. SSO Consent Decree The Interim Partial Consent Decree on Sanitary Sewer Overflows that was lodged in this case on February 15, Substantial Completion of Construction As defined in the Global Consent Decree, completion of construction and installation of equipment such that the system may be placed in full operation, and will both function and perform as designed. This specifically includes all control systems, instrumentation and all residual handling systems. Surcharge The condition that exists when the surface of the wastewater in manholes rises above the top of the sewer pipe, or the sewer is under pressure or head, rather than at atmospheric pressure. 8 Interim Partial and Global Consent Decree Status Summary Report Hamilton County/City of Cincinnati, Ohio U.S. EPA/Ohio EPA/ORSANCO U.S. EPA and Ohio EPA or ORSANCO unless Plaintiffs jointly elect (in their unreviewable discretion) to assign a particular task or responsibility to one or more of them. To make that election, Plaintiffs shall notify Defendants in writing of the task or responsibility that the U.S. EPA or Ohio EPA or ORSANCO is assigned. Collectively, U.S. EPA/Ohio EPA/ORSANCO are referred to as Plaintiffs, and each individually is a Plaintiff under this Decree. Wastewater Treatment Plant(s) Facility to which sewage is pumped for treatment. The following wastewater treatment plants are operated by GC: Mill Creek, Little Miami, Muddy Creek, Sycamore, Polk Run, Indian Creek, and Taylor Creek. This also includes any permitted treatment facilities owned or operated by GC. (Interim Partial (SSO) Consent Decree, p. 18) Water-in-Basement(s) Former name of the Sewer Backup Program defined above. Wet Weather Improvement Program (WWIP) The Wet Weather Improvement Program developed in response to the Interim Partial and Global Consent Decrees addressing overflows during wet weather. 11 Interim Partial and Global Consent Decree Status Summary Report Hamilton County/City of Cincinnati, Ohio Executive Summary The Wet Weather Improvement Program is on-going, with specific project and bundle work continuing through the third quarter of In addition to the planning, design, and construction work on capital WWIP projects, a significant amount of work is being performed under the allowance and asset management budgets, which will contribute to the achievement of WWIP operational goals. This report discusses activities and progress under the WWIP for the third quarter of This report documents progress made by the Metropolitan Sewer District of Greater Cincinnati (GC) toward compliance with the requirements set forth in the Interim Partial Consent Decree, Global Consent Decree, and Final Wet Weather Improvement Program during the third quarter of 2013 (Q3 2013). All requirements of these documents were met during this reporting period. Notable accomplishments during Q are listed below. More detailed project information, as well as progress on related Asset Management projects, can be viewed in the Level 3 reports at Interim Partial Consent Decree/Global Consent Decree Accomplishments Submitted the SSO 700 Final Remedial Measures Plan in December 2012 Submitted Permits to Install (PTIs) for eighteen Development Projects Received eighteen PTIs for Development Projects Submitted applications for eleven Public Improvement Project PTIs Received PTIs for twelve Public Improvement Projects Received 1,453calls from customers under the Sewer Backup Program Out of the 236confirmed Sewer Backups, customers accepted 168 cleanups, and acted upon 98 SBU claims Continued implementation of SSO Monitoring and Reporting Plan Continued implementation of Sewer Overflow Response Plan Continued implementation of Operations & Maintenance Program Continued implementation of Industrial Waste SSO/CSO Discharge Minimization & Management Program Performed regular preventative maintenance in accordance with Pump/Lift Station O&M Procedures Met 1,960 continuous monitoring permit limit conditions Continued compliance with Remedial Measures Addressing Nine Minimum Controls Satisfied all reporting milestones associated with the quarterly and annual reports. INTRODUCTION Prior to the approval of the Final Wet Weather Improvement Plan (WWIP), the Quarterly Consent Decree (QCD) Reports submitted by Metropolitan Sewer District of Greater Cincinnati (GC) were developed and submitted in two parts, one for each consent decree, and the report included both quarterly progress and historical information. After approval of the Final WWIP by the Court, GC developed this comprehensive quarterly report which addresses only activity from the quarter being reported. Historical information, including all prior quarterly and annual reports, is available on the website at for review or download. This quarterly report meets the requirements of: The Interim Partial Consent Decree on Sanitary Sewer Overflows (IPCD or SSO CD), first lodged on February 15, 2002, The Global Consent Decree on Combined Sewer Overflows, Wastewater Treatment Plants, and Implementation of the Capacity Assurance Program Plan for Sanitary Sewer Overflows (GCD or CSO CD), lodged on December 3, 2003, and amended in August The Final Wet Weather Improvement Program (Final WWIP), approved by the U.S. District Court in Q Consent Decree Quarterly Status Report Page 1

MAJOR REMEDIAL MEASURES CIP Projects (EXHIBIT 3, IPCD) The Interim Partial Consent Decree and Global Consent Decree require reporting of information on projects active (work performed, contracts in place, funds being spent) during Q For all of the projects and bundles listed below, some stage of completion will be achieved during Phase 1, although not all are scheduled for construction during that time frame. This section is provided to comply with: - IPCD (Section IX, Reporting Requirements) Part A Section 6A and Exhibit 3 - GCD (Section XV, Reporting Requirements) Part A Section 6 and Exhibit 1 - Final WWIP, Attachment 1A. 15 Interim Partial and Global Consent Decree Status Summary Report Hamilton County/City of Cincinnati, Ohio When reporting on construction projects, GC uses the following definition of Substantial Completion from the Global Consent Decree to mark the end of a project with respect to the Construction milestone: Substantial Completion of Construction shall mean completion of construction and installation of equipment such that the system may be placed in full operation, and will both function and perform as designed. This specifically includes all control systems, instrumentation, and all residual handling systems. (Page 17, Global Consent Decree) The acceptance of the Final WWIP affected the requirements for this section. As a result, studies related to Phase 1 decisions and planning activities for WWIP Phase 2 are included at the end. A. IPCD Reporting Requirements The Interim Partial Consent Decree on Sanitary Sewer Overflows included numerous capital projects in a variety of areas. All but SSO 700 were completed prior to development of the Final WWIP. GCD/Final WWIP Reporting Requirements The remaining Global Consent Decree capital projects (those unfinished at the time the Final WWIP was developed) were incorporated into the Final WWIP, and some were consolidated into bundles in the process. Those projects and bundles previously reported in the Global Consent Decree portion of previous Quarterly Consent Decree Reports are shown below, and address the combined reporting requirements of the Global Consent Decree and Final WWIP. The regulatory milestones shown below were finalized when the Final WWIP in August 2010 was accepted by the court.
