Description: This is a single family residential subdivision with 15 buildable lots and two common lots on 1.75 acres. The site is zoned R-1MD. Location: The subject property is located at the northwest corner of W. Targee Street and S. Orchard Street. Staff Comment: The applicant posted a surety bond for drainage, street lights and landscaping on May 16, The applicant has received time extensions to September 17, On August 18, 2008, the applicant requested a one year time extension. The applicant cites the new economic atmosphere for delaying the construction of the buildings where the landscaping is required for the time extension request. (see applicant s letter dated August 18, 2008) Recommendation: Staff recommends approval of a one year time extension with an expiration date of September 17, 2009 subject to the following Conditions of Approval. Conditions of Approval: 1. The applicant shall submit an amended Letter of Credit, sign a new bonding agreement with the Subdivision Division of the Boise City Planning and Development Services Department and pay the required bonding fee prior to September 23, 2008.

Two separate landscape bids shall submitted with a landscape plan referencing the unfinished landscaping work. 3. SUBDIVISIONS Re: Birmingham Place Dear Vicki, We are respectfully requesting an extension to complete the landscaping at Birmingham Place which is a 15 lot townhouse project on Orchard and Targee. In the new economic atmosphere the two remaining buildings have not been started and cannot b'e started until they sell additional units in building 1. Currently, the landscaping for the pond 1 open space lot and one building has been completed. The work yet to be completed surrounds the location where the two remaining buildings will be constructed. The landscaping can not be installed until the buildings are completed. We understand that this request will need to be approved by the City Council, and we are happy to provide any additional information necessary to assist Council with its deliberation.
