23 Resolving Adverse Effects Avoid Increase in density to achieve a successful mixed income community as required by the RFP process Provide accessible and adaptable units equaling a minimum of 20% of the units on site Minimize The scope of demolition has been minimized from the proposed demolition of all 31 contributing structures in 2006 to 10 contributing structures in the current master plan Mitigate Mitigation measures are proposed based on the current site plans to resolve adverse effects By law, mitigations must be tied to actual adverse effects

29 Programmatic Agreement Monitoring and Compliance Inadvertent Discoveries Plan Implemented if potential historic properties are discovered or unanticipated effects on historic properties are found Secure the jobsite and suspend work in the vicinity of the affected resource Notification to signatories within 24 hours Perform field evaluation within 48 hours Coordination with signatories to resolve effects

30 Programmatic Agreement Monitoring and Compliance City is responsible for monitoring compliance City may perform regular audits/inspections to ensure compliance. CHA shall provide an annual summary report to all signatories Summary report shall detail proposed scheduling changes, problems encountered, and disputes and objections received by CHA

31 Programmatic Agreement Monitoring and Compliance Dispute Resolution City is responsible for consulting with disputing party to resolve any objection If objection cannot be resolved, City will forward dispute to ACHP for review ACHP shall provide advice on resolution within 30 days Amendments Allowed by agreement in writing by all signatories
