Call to Order/Introductions: Mr. Beckman called the meeting to order at 9:32 am. Introductions were made. 3 II. Approval of October 10, 2018 Minutes: It was moved/second (Stoner/Sepulveda) to Approve the Minutes of October 10, Ms. Aguirre entered the meeting at 9:35 am. III. IV. Public Comment: None. Consent Calendar: a. Amazon Parking Lot Project, Buffer Reduction b. Lagorio Farms Project, Plan Participation c. Caton Equipment Storage Building, Plan Participation and Habitat Classification Change d. NorCal Logistics Building 8 Trailer Parking, Buffer Reduction e. Mettler Truck Services Project, Plan Participation It was moved/second (Beckman/Stoner) to Approve the Consent Calendar. V. McManis Winery Airport Way Preserve Dedication and PMP: Mr. Mayo stated the McManis Winery Airport Way Preserve Dedication consists of approximately 281 acres. The landowner will be dedicating approximately 25 acres to be held by SJCOG, Inc. The location of the property is along the north bank of the San Joaquin River southeast of the City of Manteca on Airport Way close to the county border in the Central Zone. Mr. Mayo continued to state with the dedication, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to be consistent with the existing riparian preserves in the Central Zone for economy of scale for species under the SJMSCP. There are some enhancements planned to the landscape for invasive species within the fields on to be removed. Mr. Mayo stated SJCOG, Inc. will be provided an overall easement on approximately 25 acres of riparian habitat and be provided an endowment to be set aside for the preserve as the project proceeds in the amount of roughly $108, for land management and enhancements as required under the SJMSCP permits. Mr. James Jones entered the meeting at 9:40 am. Mr. Gifford asked if he should abstain on this item because he sits on the Waldo Holt Conservancy Board who is procuring grant dollars for a portion of this property. Ms. Streeter stated to create an actual conflict there needs to be either an ownership interest or a financial interest in the property. In this situation it sounds like Mr.
4 Gifford has a perceived conflict rather than an actual conflict, however, he can abstain from voting on this item and it will be noted on record. It was moved/second (Beckman/Stoner) to 1) Approve the Conservation Easement Dedication and 2) Approve the Preserve Management Plan (PMP) for the Preserve Site. Motion passed 11/0. Mr. James Jones, EBMUD and Mr. Dan Gifford, Conservation Abstained. VI. Musco Olive Patterson Pass Preserve Dedication and PMP: Mr. Mayo stated the Musco Olive Patterson Pass Preserve Dedication consists of approximately 226 acres. The landowner will be dedicating approximately 25 acres to be held by SJCOG, Inc. The location of the property is southwest of the City of Tracy south of Patterson Pass Road adjacent to the Union Pacific rail line close to the county border in the Southwest Zone. Mr. Mayo continued to state with the dedication, SJCOG, Inc. staff has written a draft Preserve Management Plan (PMP) to be consistent with the existing grassland preserves in the Southwest Zone for management economies of scale for species under the SJMSCP. There are no enhancements planned for this preserve dedication. Mr. Mayo stated SJCOG, Inc. will be provided an overall easement on approximately 25 acres of grassland habitat and be provided an endowment to be set aside for the preserve as the project proceeds in the amount of roughly $36, for land management and enhancements as required under the SJMSCP permits. It was moved/second (Gifford/Beckman) to 1) Approve the Conservation Easement Dedication; and 2) Approve the Preserve Management Plan (PMP) for the Preserve Site. Motion passed 11/0. VII. Other Matters of Business: a. CDFW CEQA Fee Matter Update Mr. Mayo stated staff received an stating CDFW will be writing a response letter to SJCOG, Inc. and once staff and legal has had an opportunity to review the letter, a meeting will be scheduled. Staff will providing all updates to the jurisdictions and HTAC as we receive them. The meeting may consist of just SJCOG, Inc. staff and legal or staff may request that the jurisdictions also attend. b. Tahoe to the Bay Symposium: Mr. Mayo stated approximately 120 people attended consisting of mostly USFWS, CDFW, consultants, biologists and the agricultural community. Ms.
5 Sepulveda stated she appreciated SJMSCP s presentation on agricultural easements and the community. Mr. Stoner stated having a relationship with the agricultural community and preserving agricultural easements for habitat values is important. The SJMSCP received a lot of positive feedback. This item was for information/discussion only, no action was taken. VIII. Summary and Adjournment: At 9:53 am the meeting was adjourned until January 9, 2019.
6 January 2019 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: Great Pacific Nut Company Project, Plan Participation and Habitat Classification Change Motion to Approve Recommendation to SJCOG, Inc. to 1) Allow the Great Pacific Nut Company Project to Participate in the SJMSCP and; 2) Allow an Alteration to the Habitat Type Coverage from Agriculture (C34) Habitat Land to Multi-Purpose Open Space (C2) Habitat Land DISCUSSION: SUMMARY: The project applicant, Wilson Architecture, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the San Joaquin County Community Development Department because the site is in an unmapped area of the Plan. The project site is located on the north side of West Lehman Road, 985 feet west of South Ahern Road, Tracy in the Central Southwest Transition Zone (attachments 1 &2). RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to: 1) Allow the project to participate under the SJMSCP to provide biological coverage for the project impacts to the habitat types under the federal and state permits; 2) Allow an alteration to the habitat type coverage from Agricultural (C34) habitat land to Multi-Purpose Open Space (C2) habitat land FISCAL IMPACT: If the project is approved including the habitat type coverage alteration, SJCOG, Inc. will be provided mitigation for the project impacts as required under the SJMSCP for approximately acres. The impacts for this project would consist of acres of Multi-Purpose Open Space (C2) habitat impacts.
7 BACKGROUND: This project consists of a Site Approval application for a nut processing/preparation facility to be completed in three (3) phases over five (5) years. Phase 1, to be completed in 18 months, includes the construction of a 30,000 square foot storage building, a 5,000 square foot shop building, a 1,000 square foot breakroom, and a truck scale for private use only. Phase 2, to be completed in thirty (30) months, includes the construction of a 30,000 square foot shelling building. Phase 3, to be completed in five (5) years, includes a 400 square foot canopy (attachment 3). In accordance with the SJMSCP Planned Land Use Map, the project site is located in the unmapped land use area of the plan. Because it is not located on a SJMSCP Compensation Map, the project can request an alteration to the SJMSCP vegetation map habitat classification on a case by case review. The project is seeking an alteration to the habitat classification on the SJMSCP vegetation map. Per the SJMSCP s Section , a project can seek an alteration to the habitat classification by providing aerial photography imagery dated prior to SJMSCP permit issuance in Each project will be reviewed by the Habitat TAC for recommendation to the SJCOG, Inc. Board for approval on a case-by-case basis. The original SJMSCP GIS vegetation map portrays the project site as Agriculture (C34). However, the 2001 aerial (attachment 4), which shows a broader review of the habitat types in San Joaquin County, shows portions of the land within the project footprint as Multi-Purpose Open Space (C2) consisting of an existing orchard. The original SJMSCP habitat classification for this specific area would be re-classified from acres of Agriculture (C34) to acres of Multi-Purpose Open Space (C2) habitat land. 13 January 2019 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: Stockton Regional Wastewater Control Facility Modifications Project, Plan Participation Motion to Approve Recommendation to SJCOG, Inc. to Allow the City of Stockton s Regional Wastewater Control Facility Modifications Project to Participate in the SJMSCP DISCUSSION: SUMMARY: The project applicant, City of Stockton s Municipal Utilities District, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the City of Stockton s Municipal Utilities District. Although the project is in a mapped area of the plan, the project needs to be allowed to participate due to the United States Army Corps of Engineers (USACE) Clean Water Act Section 404 permit, National Marine Fisheries Service and United States Fish and Wildlife Service Section 7 Compliance, and Central Valley Regional Water Quality Control Board Section 401 Clean Water Act permitting needs. The project site is located on the north side State Route Highway 4 and west of Interstate 5 in the City of Stockton in the Central Zone (attachments 1 &2). RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to: 1) Allow the project to participate under the SJMSCP to provide biological coverage for the project impacts to the habitat types under the federal and state permits; FISCAL IMPACT: The impacts for this project would consist of acres of Urban (U) habitat impacts. There is no fee or other mitigation for Urban impacts.
14 BACKGROUND: This project consists of the demolition of certain treatment process components and buildings; rehabilitation and repurposing some existing components and buildings; and construction of new treatment process components buildings. Modifications to the facility s preliminary treatment, primary treatment, secondary treatment, tertiary treatment disinfection, and solids handling systems are proposed (attachment 3). The SJMSCP GIS habitat layer classifies the project site as Urban (U) habitat. If allowed to participate in the SJMSCP, the total disturbed area will consist of acres of Urban (U) habitat impacts. There is no fee for Urban impacts. 20 January 2019 HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: State Route Highway 4 Monopole Project, Plan Participation Motion to Approve Recommendation to SJCOG, Inc. to Allow the State Route Highway 4 Monopole Project to Participate in the SJMSCP DISCUSSION: SUMMARY: The project applicant, Epic Wireless, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) through the San Joaquin County Community Development Department because the site is in an unmapped area of the Plan. The project site is located on the north side of State Route 4 Highway, approximately 1,450 feet east of South Holt Road, Stockton in the Delta Zone (attachments 1 & 2). RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to: 1. Allow the project to participate under the SJMSCP to provide biological coverage for the project impacts to the habitat types under the federal and state permits. FISCAL IMPACT: If the project is approved including the habitat type coverage alteration, SJCOG, Inc. will be provided mitigation for the project impacts as required under the SJMSCP for approximately 1.58 acres. The impacts for this project would consist of 1.58 acres of Urban (U)habitat impacts. There are no fees for Urban impacts. BACKGROUND: This project consists of a Site Approval application for a new 125-foot-tall monopole wireless telecommunications tower and an 1,800 square foot equipment lease area (attachment 3).
