2 September 2015 Special HTAC STAFF REPORT SUBJECT: RECOMMENDED ACTION: McKinley Bridge Erosion Repair Project Motion to Approve Recommendation to SJCOG, Inc. to (1) Allow McKinley Bridge Erosion Repair Project to Participate in the SJMSCP; and (2) Revision of Incidental Take Minimization Measures for Giant Garter Snake Buffer DISCUSSION: SUMMARY: The project applicant, City of Stockton Public Works, is requesting coverage under the San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) because the site is in a mapped area of the plan and requires a 404 permit. The project is located east of El Dorado Street and north of Sperry Road, Stockton in the Central Zone (attachment 1 and 2). Despite including in the environmental document Stockton would seek coverage of the project with the SJMSCP, the McKinley Bridge Erosion Repair project moved forward with ground disturbance activities including grubbing and installing rip rap without seeking SJMSCP coverage. In addition, Stockton is likely not in compliance with the Section 1600 and 404 permits issued for the project. The project has been required to stop activities until the matter can be rectified. The permitting agencies have been alerted to the matter of work without coverage and potential violation of the plan s permits. SJCOG, Inc. staff and permitting are diligently working to follow the required SJMSCP remedies for the matter. Currently, SJCOG, Inc. staff and permitting agencies are working with the City of Stockton s Public Works Department to get the project back on track and obtain coverage for the project under the Plan to ensure future compliance with the SJMSCP and other required permits for project impacts. Some remedial action to be taken by the City are to seek coverage for the project through the HTAC/Board, compliance with SJMSCP Incidental Take Minimization Measures (ITMM); complying with all other permits issued (e.g. 404/1600) on the project; and an internal review resulting in a procedural checklist for project management. Permitting may take additional action regarding the SJMSCP permits based on City of Stockton Public Works Department s project being out of compliance with the permits that may have further reaching ramifications.

3 RECOMMENDATION: SJCOG, Inc. staff recommends the HTAC make the recommendation to the SJCOG, Inc. Board to (1) allow the project to participate under the SJMSCP to provide biological coverage for project impacts to the habitat types under the federal and state permits; and (2) a revision to the Incidental Take Minimization Measures for Giant Garter Snake (GGS) buffer. FISCAL IMPACT: SJCOG, Inc. to be provided mitigation for the project impacts as required under the SJMSCP. BACKGROUND: The existing McKinley Avenue Bridge, which crosses over the North Branch of French Camp Slough, is located on McKinley Avenue approximately 400 feet north of its intersection with Sperry Road in South Stockton. The McKinley Avenue Bridge is a two-lane bridge that has an abutment at each end of the bridge and three piers in the channel of the North Branch of French Camp Slough. The proposed project would mitigate erosion at the bridge foundations by excavating materials near the foundation and replacing them with stabilizing geofabric and rock slope protection, or riprap. Upon exposure of the pier walls, geofabric and rock slope protection would be installed around the pier walls and bridge abutment footings. The scour countermeasures would extend 15 feet upstream and 15 feet downstream of the bridge limits. In addition, the bridge deck would be resurfaced and the wing walls at the southeast and northeast corners would be repaired (attachment 3). No widening or other alterations to the existing bridge structure would occur. In order for the project to construct the McKinley Bridge Erosion Repair project, the project will impact Giant Garter Snake (GGS) habitat within the suggested 200 foot buffer. As identified in section 5.59 of the plan, HTAC, on a case by case review, can establish a setback and buffer zone to be used by a project in place of the 200 feet suggested. Because construction of portions of the bridge replacement will be placed directly into waterways and within the suggested 200 foot buffer area, the project proponent has requested a reduction in the buffer to a 0 setback. The reduction of this buffer is necessary for the construction of this project. All other ITMM measures for GGS (e.g. construction window between May and October and required survey work) will remain standard. The SJMSCP GIS habitat layer classifies the project site as Urban (U) and Natural (R). If allowed to participate in the SJMSCP, the total disturbed area of +/- 1 acre will consist of 0.21 acres of Natural (R) and 0.79 acres of Urban (U) habitat impacts. The project applicant will be responsible for mitigating for the habitat impacts that is consumed by this project by either paying the appropriate fees at time of ground disturbance or dedicating land in lieu of a fee at appropriate the SJMSCP ratio.
