Site plans may only be placed on the consent agenda if the recommendation does not include any conditions. Single-family and duplex development that are required to have a site plan review by a Planning Commission due to a plat note, PUD requirement or other regulatory mechanism may also be placed on a Commission s consent agenda. A Planning Commission member may pull such agenda item off the consent agenda to allow staff or the applicant to address issues or questions related to the site plan review criteria for decision prior to taking action.

2 TEN MILE PLANNING COMMISSION SUMMARY OF MOTIONS January 10, 2019 REGULAR MEETING Commission Members Present: Donna Skupien, Lina Lesmes, Tom Connolly, Jeannette Gongloff, Mike Beerntsen, Ross Sheely, Steve Wahl Commission Members Absent: Robert Franken Staff Present: Don Reimer, Jessica Potter Meeting Commencement: Donna Skupien, Chair, called the meeting of the Ten Mile Planning Commission to order at 5:30 p.m. Approval of Summary of Motions: The Summary of Motions from the September 13, 2018 meeting was approved as submitted. Announcements: Don Reimer, Planning Director, informed the Commission that Commissioners Connolly and Sheely terms expire on March 31 st and will need to be renewed if they wish to remain on the Commissioner. Commissioner Skupien s term expires on March 31 st and she is term limited. CONSENT AGENDA: None PUBLIC HEARINGS: None WORK SESSION: Request from Copper Mountain for an Amendment to the Copper Mountain Sub-basin Plan within the Ten Mile Master Plan to accommodate the proposed A-Lift Development. The Commission unanimously recommended that the BOCC pursue a master plan amendment based on Staff and the applicant s presentation and submitted materials. The Commission stated that master plan amendment should be kept limited in scope. During the discussion of this request this request, the Commission asked for an update on the Planning Department s progress to update all of the Master Plans. Planning Director, Don Reimer, responded that long-range planning focus shifted from master plan updates to short-term rental regulations this past year and the Planning Department will again focus on the master plans. He also discussed a possibility of consolidating the basin plans and working on neighborhood plans, where appropriate. The Commission was supportive, at least conceptually, of this idea. 4 BACKGROUND/ PROJECT SUMMARY The County Commons PUD (PUD) was created on January 23, 1995 and is proposed to be modified with Planning Case PLN18-115, which will be considered by the Board of County Commissioners at a public hearing on March 12, The purpose of the PUD is to provide a location and general plan for County offices, services, maintenance facilities, the hospital, and other public and institutional facilities. The proposed PUD amendment that will be considered by the BOCC will reflect a realignment of Peak One Drive, which results in also amending PUD Parcel boundaries. Staff will provide an update to the Planning Commission at its March 14 th hearing regarding the outcome of the BOCC hearing. This staff report has been drafted to be consistent with the anticipated approval of the PUD modification. If the BOCC does not approve the PUD amendment on March 12, the TMPC hearing may have to be continued to a later date. This proposal is for a new 8,308 square foot building that will be used to store sand and salt materials for road application. This building will be located on the eastern portion of Parcel 12 in the PUD, directly adjacent to Peak One Drive. Access to the salt and sand shed will be from County Shops Road, which provides access to all of Parcel 12 and 6. There will not be direct access from Peak One Drive. The existing salt and sand storage shed located near the western boundary of Parcel 12 will be removed once the new facility is operational. Parcel 12 of the PUD is the parcel designated for fleet maintenance, Road and Bridge facilities, the Summit Stage, Colorado Department of Transportation (CDOT) operations, and other light industrial type uses such as salt and sand storage. 5 CRITERIA FOR DECISION Section of the Summit County Land Use and Development Code ("Code") states that the Review Authority may approve a site plan only if the application meets all relevant County regulations and standards and provided the Review Authority makes the following findings: A. The application complies with County Zoning Regulations, including but not limited to use regulations, any applicable PUD requirements, design standards and other development regulations and standards. B. The application complies with County Road & Bridge standards. C. The application complies with County Subdivision Regulations. D. The application complies with any previous plans approved for the site still in effect. E. The application complies with any conditions imposed on development of the site through previous approvals. Site plan review is considered a technical review. If a site plan meets all applicable County regulations and standards, is consistent with previous plans applicable to development of the site and complies with any applicable conditions, it shall be approved. Compliance with Zoning Regulations The purpose and intent of these regulations is to insure compatibility of land uses, efficient and economical use of land and adequate light and air in development projects. They are also intended to prevent development in areas subject to environmental hazards and encourage development projects that are functional, exhibit good design and aesthetics and protect the County s natural resources and scenic beauty. The parcel is zoned County Commons PUD and is located on Parcel 12 within the PUD. Where specific standards are not required as a part of the PUD, the standards of the Land Use and Development Code shall apply. Permitted Uses and Density The subject development is located within Parcel 12 of the County Commons PUD. Permitted uses for this parcel include CDOT operations, County transportation operations center, emergency services facility, and Summit County Road and Bridge operations, including salt and sand storage. The proposed salt and sand storage facility is a permitted use listed in the PUD. The proposed building will be 8,308 square feet in size. The permitted floor area on Parcel 12 is 162,255 square feet. There is currently 132,670 square feet of built floor area on Parcel 12. The proposed new building will add 8,308 square feet. Construction of the new salt and sand storage building would bring the total floor area on Parcel 12 to 149,114 square feet, leaving 13,141 square feet available for future development or re-development on Parcel 12. Future removal of the existing salt and sand storage building will add 7,320 square feet back into the available square footage for parcel 12. PLN Salt & Sand Shed TMPC 3/14/2019 Page 3 of 7

6 Setbacks The setbacks for Parcel 12 are 40 feet from the centerline of the interior loop road, Peak One Drive. (Note, this is a modification proposed as part of the PUD amendment being considered by the BOCC March 12, instead of measuring from the right of way, as there are no dedicated right-of-ways within the County Commons). This is the only setback applicable to the proposed salt and sand storage building. The building will be set back 60 feet from the centerline of Peak One Drive on the east side of the building, thus meeting the setback requirements. The PUD indicates that parking area setbacks will be determined at the time of site plan review. This development proposes 11 parking spaces, although no spaces are required per the PUD. Parking will be located on the south side of the building with vehicular access from County Shops Road only. The parking space closest to Peak One Drive is set back well over 200 feet from the centerline of the road. Staff is comfortable with the number of parking spaces and layout as proposed. The Road and Bridge and Engineering Departments have approved of the parking area as designed. See Attachment 2 for Site Plan. Site Specific Development Standards from the PUD Color schemes consistent throughout Parcels 6, 7, 12 and compatible with the natural landscape shall be used. The applicant is proposing a combination of concrete, metal siding, and translucent polycarbonate siding for the salt and sand storage building. A colored concrete will compose the base of the structure. The remaining materials will be a dark brown metal siding with frosted translucent polycarbonate siding. These colors and materials were chosen be compatible with the surrounding buildings, including the fleet services building, bus wash, and the hospital campus. The translucent siding will provide natural lighting for the interior of the structure during day-light hours. The proposed materials and colors are compatible with the surrounding landscape. The Board of County Commissioners has reviewed the building design and materials and staff is comfortable with the building design as proposed. The proposed building and materials will blend with the surrounding developed areas. The applicant has used varying materials to break up the different facades of the building, and has proposed interesting architectural elements such as the off-set roof peak. 7 Required landscaping may be located on other Parcels within the PUD as approved by the Review Authority. Landscaping is proposed to be located on Parcel 9, located across Peak One Drive on the Parcel to the east (vacant). Landscaping will be placed adjacent to Peak One Drive in the vicinity of JP Way. Irrigation is available in the location to support landscaping installation. This project will comply with Code Section 3604, Mandatory Landscaping Design Standards, which requires xeriscape planting and places a maximum on irrigated landscaping. The applicant will be xeriscape planting with Aspen and conifer trees. The Code requires the planting of three trees and two shrubs per 1,000 square feet of development. A total of 25 trees and 17 shrubs will be required for this development. The applicant proposes the planting of 25 trees; consisting of 13 aspen trees and 12 evergreen trees (Spruce and Lodgepole Pine). A total of 17 shrubs are proposed for this site, all will be 5 gallon size. The landscaping as proposed complies with the Code requirements. Lighting The PUD requires that all exterior lighting comply with section of the Code. This section requires that all lighting be fully cutoff and downcast. The applicant has provided cut sheets of the proposed exterior lighting that meets these standards. The PUD also requires that All interior lighting shall be shielded to minimize offsite visibility to the maximum extent practicable. The interior lighting will be from downcast, frosted bulbs. The applicant has designed the interior lighting of the salt and sand shed to provide an architectural accent that would come from of the clerestory portion of salt and sand storage shed during the night time. This material has been used on the nearby Fleet Services building and will complement the overall design of the buildings on Parcel 12. The building will have timed lighting dimmers that will adjust the lighting in the salt and sand shed. Height The PUD states that the permitted building height on Parcel 12 is 45. The proposed building will be approximately 45 in height based on the height measurement standards listed within the Code. This building requires an open over-head area in order to accommodate the movements of heavy equipment on machinery. Snow Storage The PUD states that all site plans shall comply with the snow storage requirements set forth in the section of the Code. This requires 25 percent of the area of all paved or graveled areas on a site be used as snow storage. The total paved area for the new paving and parking will be 26,608 square feet in size. The plans submitted require 6,652 square feet of snow storage, and 8,860 square feet, or 33% snow storage has been provided. PLN Salt & Sand Shed TMPC 3/14/2019 Page 5 of 7

8 Waste Disposal/ Recycling This building will not require any waste or recycling removal. Drainage The County Engineering Department has reviewed this application and all of the standards for grading and drainage will be met with the issuance of a grading and excavation permit. Public Use Area Fee The Open Space & Trails Department is not requiring this fee since community facilities and institutional uses are exempt from this requirement. Compliance with County Road & Bridge Standards The County Road and Bridge Department has reviewed this proposal and they do not have any concerns. Compliance with Subdivision Standards Access Vehicular access will be from County Shops Road. The Engineering Department does not have any concerns with the proposed vehicular access. Water/Sewer This building does not require any water or sewer services. Fire Summit Fire EMS has reviewed this application and does not have any comments. Any Previous Plans Approved for the Site Still in Effect and any Conditions Imposed on Development of the Site Through Previous Approvals The most recent approval for the County Commons PUD will be a minor PUD modification under Planning Case PLN18-115, to be considered by the BOCC on March 12, This Site Plan approval will include a condition that the PUD amendment be recorded prior to the issuance of any building or grading permits. STAFF RECOMMENDATIONS Staff recommends the Ten Mile Planning Commission approve PLN19-008, Site Plan review of a new 8,308 square foot salt and sand storage building; Parcel 12, County Commons PUD/ Govt.
