3 The Seascape, February 2015 Page 3 President s Message by Andrew Tuckman, Chapter Co-President, rbarry@coastalevergreen.com Synergy is defined as the interaction or cooperation of two or more parts, substances, or other agents to produce a combined effect greater than the sum of their separate contributions. I see an inherent synergy happening in our chapter right now. Events like the January Kick-off Brunch, Supplier Night and Spring Mixer are all planned out. The board of directors is not only working well together, but also confident and strong in its endeavors. Additionally, contractors and associate members are interacting on an ongoing basis and an outreach program has taken shape. Barbara Olsen, Chris Elliot, Mike Ruscoe & Regan Barry have committed a responsibility in 2015 to help the Santa Cruz SPCA with its grounds and landscape. Look for updates in the upcoming newsletter about this great effort. For 2015, Regan and I as co-presidents will be sharing not only the illustrious title, but also the responsibility of this address. (February is my turn.) Our unique partnership is a perfect model for success and one that could be adopted by other chapters in the association maybe even in the White House! Can you imagine two presidents living in Washington, one from each party, under the same roof, making bipartisan decisions that affect the greater good of the country? Now that would be a sight! Here on the Central Coast, you should know that this chapter has two dedicated and passionate guys who actually have a great deal of fun in office. Regan & I both look forward to sitting around the conference table planning events and trying to decide the fate of the organization. We ask ourselves, What does the future hold for the CLCA association? The new normal has changed the playing field, implemented complex technology, affected weather patterns and demanded a different energy from within. Time management, sustainable landscaping practices, marketing and smart electronic devices all seem to be critical in our new day to day. But the biggest key to the chapter is setting up its dogma or set of principles for future generations to use. These include to-do lists, annual procedures, contact lists, calendars, as well as event spreadsheets that track profit and loss. In order for our chapter to really survive, a bible needs to be implemented so that incoming boards and presidents have something tangible to use. Regan and I are creating these procedures and we are confident that they will be critical in the longevity of the chapter. Now if we can only count on consistent attendance at events, the two of us would be even more optimistic about the chapter s future. But, we know that life and busy schedules can get in the way. The Sunday Kick-Off Brunch was last week, with Supplier Night in March followed by the Spring Mixer in May. All three events are carefully planned and very unique. One common theme that will be present at most of the events is live music. Our very own CLCA All-Stars will be playing their hearts out for you. Don t miss Ben Bording (Cool Earth Gardens) on lead guitar and vocals and also myself on drums with Kevin Taylor on keys. As you go about your day, remember our Central Coast Chapter. It needs all cylinders firing, all the parts working together and the community needs everyone to keep that synergy happening. With the new Monterey Bay Friendly Landscape program, the SPCA project, the impressive jobs that get entered at Beautification Awards and the Board of Directors leading the way, we will all have made our mark in history. 10 Page 10 The Seascape, February 2015 January Chapter Board Meeting Minutes by Dinah Irino, Secretary, On Thursday January 8, 2015 Regan Barry, Andrew Tuckman, Chris Elliott, Mike Ruscoe, Jerry Allison, John David, and Dinah Irino met at the Café Carbonero in Scotts Valley for the January board meeting. The meeting was called to order at 12:24 PM. The minutes from the December meeting were read and approved by Andrew and seconded by Dinah. Events The Kick-off Brunch on January 25th was discussed. Everything is in place with 2 speakers from the State CLCA lined up. Speaker topics were suggested including: general benefits of membership and state advertising and promotion of landscape contractors. Supplier night has a new date Tuesday March 24th. The Spring Mixer will be held in the Seymour Center at Long Marine Lab on May 5th. At this event we will have live music and Frank Niccoli will talk about business insurance. Member Reports Chris talked about the community service project at the Santa Cruz SPCA. Barbara Olsen is working with Chris and Mike on the project. There are 8 small landscaped sections that need a general clean up. We are looking for volunteers from our membership to help out. Each section will need a 3 man crew to work about 4 hours. We are planning on completing the project by the end of February, with a public CLCA and the individual companies who have volunteered. Contact Chris to volunteer. Mike talked about the Golf outing in September. At this point we are looking at Eagle Ridge in Gilroy and San Juan Oaks in San Juan Bautista. Dates and venue choice will be made soon. Regan asked board members for suggestions to pass along to State. They include: future leadership conference in northern California, a field trainer to visit the chapters and assist with challenges they are facing, and work on developing a consolidated list of individual board member duties so incoming board members do not feel overwhelmed by pages of text. Regan also talked about the Leadership Conference in Ontario at the beginning of February. Regan, Dinah and Mike will be attending. Andrew talked about the Monterey Bay Friendly Landscape certification program. Our agreement with Ecology Action is to certify 40 landscapes in We will be using the last Friday of each month to visit potential properties for certification. 12 Page 12 The Seascape, February 2015 CLCA Lobbying Highlights in Recent Years: Members Needed for Future Year Highlights Ever wonder why the California Landscape Contractors Association has a staff member assigned to legislative advocacy, a contract lobbyist, and a committee of member volunteers who not only provide oversight for the association s governmental affairs program, but also use their personal relationships with elected officials to advance the association s legislative goals? You already know that construction contracting is a heavily regulated occupation in California. But do you know that the state Legislature introduces hundreds of other bills relating to water, taxation, employment, and other subjects that directly impact the work of landscape contractors during a typical two- year legislative session? Are you aware that state agencies consider dozens of new regulations every year that directly affect our industry? Having a strong voice in Sacramento has yielded tangible benefits for CLCA members. We have defeated countless hostile proposals and led many successful efforts to pass beneficial laws that protect the C- 27 license and create new tools to combat unlicensed contracting. Expanding the scope and value of the C- 27 license is an area where CLCA lobbying has had particular success: Against what were thought to be very long odds, CLCA led a coalition to pass 1997 legislation that reversed a court decision allowing general contractors to execute direct contracts for single trade specialty work, including landscaping. CLCA sponsored and passed a 2003 bill allowing landscape contractors to execute prime contracts for landscaping projects that include a swimming pool, spa, or hot tub. CLCA followed up with sponsored legislation in 2007 that allows landscape contractors to sign prime contracts for the construction of outdoor kitchens and fireplaces if they are part of a landscaping project. In 2011 CLCA lobbied to include the design and installation of commercial and residential rainwater capture systems used for landscape irrigation, fountains, ponds, and decorative water features as work authorized by the C- 27 license. CLCA continuously lobbies the Legislature, the Contractors State License Board (CSLB), and other state agencies to more aggressively combat unfair competition in the landscaping industry by increasing penalties for unlicensed contracting and improving enforcement of current licensing laws. CLCA backed successful legislation in 2010 to increase the maximum criminal fines for unlicensed contracting, require a mandatory jail sentence for a third or subsequent conviction for unlicensed contracting, and clarify that enhanced criminal penalties apply to bidding or offering to perform work as well as actually performing the work that requires a license.
13 The Seascape, February 2015 Page 13 CLCA Lobbying Hightlights cont d. The association has supported budget augmentations to give the CSLB additional sworn peace officers to enforce unlicensed contracting laws as well as expand the number of stings and sweeps targeting unlicensed landscape contracting activity. CLCA helped pass 2012 legislation requiring persons who oversee bids or set up work schedules for contractors or subcontractors involving construction projects to be duly licensed. The association has worked with the CSLB and other state agencies to report specific illegal activity and to provide properties for unlicensed contractor sting operations. CLCA helps licensed contractors report unlicensed individuals and provides the former with information on how to report and forms for doing so. CLCA also has led numerous coalitions to kill harmful legislation. In recent years CLCA has opposed extending the sales tax to services, shifting the burden of the personal property tax on heavy construction equipment from owners to renters, and imposing liens on the owners of real property if employees of a landscaping, janitorial, or security service business who had done work on the property subsequently alleged that they were unpaid or underpaid. Shaping water conservation laws and regulations has also been a top CLCA priority. The association worked closely with the Department of Water Resources, the California Urban Water Conservation Council, and other entities in updating the Model Water Efficient Landscape Ordinance a few years ago. This past summer CLCA participated in the public process to develop emergency drought regulations for the entire state. The resulting State Water Resources Control Board regulations, which target runoff, are preferable to the water board s initial proposal to limit landscape irrigation to no more than two days a week. CLCA has actively supported bills to expand the use of recycled water, promote better landscape water management through water budgeting and conservation pricing, and provide that rebates received by property owners for replacing turf with more water efficient landscaping plants are not taxed as income by the state.
