3 1. Introduction and history of the site 1.1 Whitwell Quarry Complex is located approximately 475m to the south of the centre of Whitwell village in Derbyshire (Figure 1). The Whitwell Quarry Complex includes the main quarry, the northern quarry, an extraction area in the east underlying Belph Tip, a processing plant area, readymix concrete plant and Whitwell Works located to the east of the main quarry (Figure 2). The quarry and associated processing plant is operated by Lafarge Tarmac (LT) and the adjacent Works including the lime kilns are operated by Lhoist. The whole quarry complex occupies approximately 198ha. The northern part of the site is crossed by the Robin Hood Railway Line which runs between Nottingham and Worksop. The railway runs through a tunnel at the site (Figure 2). The high purity dolomitic limestone extracted at the quarry is treated in the kilns in Whitwell Works to form a product for use in refractory materials and steel manufacture. Limestone extracted from the quarry which is not suitable for use in the kilns is used principally to produce agricultural lime and a range of construction grade aggregates. 1.2 Planning permission reference CLO/1156/3 was granted on 5 March 1957 for the extraction of limestone from land south of the railway line and includes Whitwell Works. On 27 November 1984 planning permission reference BOL/1082/484 was granted to extend the quarry and permitted the extraction of mineral across and to the north of the railway (Figure 3). In accordance with the provisions of the Environment Act 1995 it was necessary for Derbyshire County Council to review the conditions of the 1957 and 1984 consents for Whitwell Quarry in order to bring them up to date. A submission for the Review of Old Minerals Permissions (ROMP) was provided to Derbyshire County Council in October 1998 and amended by submissions including an Environmental Statement in July In July 2006 revised conditions were agreed that replace the conditions in the 1957 and 1984 consents (Code No R5/0705/13). Planning permission reference CM5/598/7 for five extensions to the quarry comprising the north western, north eastern, eastern, south eastern and southern extensions to the main quarry was granted on 7 July Planning permission reference CM5/0206/178 was granted on 23 October 2006 for non-compliance with condition 10 of planning permission reference CM5/598/7 to vary the extraction sequence of the 5 extensions. A number of planning permissions have been granted for ancillary development such as site offices at the Whitwell LT/WTE/LZH/1655/01/SCOPING 1

4 Quarry Complex. The boundaries of each of the main planning permissions are shown on Figure The extraction and restoration operations at Whitwell Quarry are currently controlled by the conditions agreed through the ROMP process (Code No R5/0705/13) and planning permission reference CM5/0206/178 together with the associated Section 106 Agreements. Under Code No R5/0705/13 the mineral extraction operations and restoration operations must be completed by November Under planning permission reference CM5/0206/178 the mineral extraction operations and restoration operations are permitted until October A feature of the geology at the site is that the chemical composition of the rock varies across the site. The specification for the kiln feed mineral is tightly defined in order to generate a consistent high quality product therefore it routinely is necessary to blend rock extracted from different areas of the quarry to provide the kiln feed mineral. In order to maintain this flexibility of extraction and to ensure a consistent supply to the kilns in the medium to long term in order to satisfy the considerable demand for the products from Whitwell LT have identified four additional extraction areas at the site. 1.4 MJCA are commissioned by LT to prepare a planning application for the further extensions to Whitwell Quarry. The purpose of this document is to explain the proposed approach to the application for planning permission together with the proposed approach to and extent of the assessments of the potential environmental impacts. The document has been based on discussions with LT and Derbyshire County Council and on the experience of MJCA of working at this site for many years and in preparing applications for similar developments. 1.5 It is considered that the extensions to the quarry fall under Paragraph 19 of Schedule 1 to The Town and Country Planning (Environmental Impact Assessment) Regulations 2011 (as amended) as the area of the quarry within the proposed application boundary exceeds 25 hectares hence an Environmental Impact Assessment is mandatory.. 5 2. Site location and description 2.1 Whitwell Quarry Complex is centred at National Grid Reference (NGR) SK approximately 475m south of the centre of Whitwell village and 810m north east of the centre of Creswell in Derbyshire (Figure 1). The Whitwell Quarry Complex is approximately 1.1km south west of the centre of 450m west of the centre of Belph at the closest point. The proposed extension areas and the planning application boundary are shown on Figure 2. The area in the application boundary is referred to in this report as the site. The site which includes the main quarry, the northern quarry, the eastern area, and the four proposed extensions together with the minerals processing area including the Ready-mix Plant and site access and exit is under the control of LT and covers an area of approximately 127 hectares. For the purpose of description references to the Whitwell Quarry Complex (Figure 1) are to the entire complex including all the quarry, processing and plant areas as well as Whitwell Works located to the east of the main quarry. 2.2 The Whitwell Quarry Complex and the site is accessed by HGV traffic through a dedicated entrance from Crags Road which leads to internal haul roads. HGVs exit the site through a separate exit only road onto Southfield Lane. A one way system is operated to ensure that traffic is safely segregated. The main quarry is generally rectangular in shape orientated in a north west to south east direction. The Robin Hood railway line runs in a tunnel in a north east to south west direction across the northern part of the main quarry. 2.3 The majority of the main quarry has been excavated and is partially backfilled with quarry waste, kiln dust from the adjacent limestone kiln and colliery spoil. Aggregates stockpiles are located in the main quarry area. Colliery spoil is gradually being transferred from the eastern area to the main quarry floor in order to expose the mineral in the eastern area and to create the restoration profile for the quarry. Much of the mineral in the northern area has been extracted up to the 40 yard standoff from the edge of the railway boundary consistent with the conditions under the ROMP. As specified in the ROMP the standoff will be maintained unless agreed otherwise with Network Rail to protect the trains until the railway is diverted and the mineral around the tunnel is extracted. The northern quarry is accessed from the main quarry via a ramp over the railway tunnel. LT/WTE/LZH/1655/01/SCOPING 3

6 2.4 Extraction has been completed in the north western part of the northern quarry. The south eastern area of the main quarry and north eastern area of the main quarry are partially extracted and extraction operations have commenced in the southern part of the main quarry and the eastern area. 2.5 Whitwell Works to the east of the main quarry includes aggregate and kiln feed processing plant including crushers, screens and conveyors, kilns, product storage sheds, the site offices, a Ready-mix plant and associated infrastructure. The plant in Whitwell Works outside the proposed application boundary are operated by Lhoist. 2.6 The site is located in an area which is predominantly rural with scattered settlements and woodland. The site is bounded by agricultural fields to the west and north beyond which are the settlements of Creswell and Whitwell respectively. Beyond Whitwell Works to the east of the site are Southfield Lane in the north and Crags Lane in the south. Beyond this are Whitwell Tip to the north east and the eastern area of the Whitwell Quarry Complex. In the east of the eastern area of the site is a fully restored and landscaped area which has been completed as part of the progressive restoration of the site specified in the existing planning consents. The southern boundary of the application area is bounded by the B6042 which runs in a west to east direction from the village of Creswell. Creswell Crags is located approximately 190m to the south of the site which is a Scheduled Monument and Site of Special Scientific Interest (SSSI). Creswell Crags is on the tentative list for nomination for World Heritage Site Status. 2.7 There are numerous public footpaths and bridleways located within the vicinity of the site with a small number in close proximity to the proposed development (Figure 2). Whitwell Footpath 73 runs directly to the north of the north extension and joins Whitwell Footpath 20 which runs along the top of the railway tunnel between the main quarry and the northern area. Belph Bridleway 5 runs adjacent to the southern boundary of the site and joins Belph Bridleway 10 close to the south east corner. Elmton Footpath 1, Belph Footpath 20 and Elmton Footpath 32 run along the northern section of the western boundary to the main quarry. Belph Footpath 13 runs to the east of the eastern area. 7 2.8 There are overhead power lines which run from the site access road in a north westerly direction crossing the tunnel before turning in a westerly direction across the north of the site before turning in a south westerly direction and continuing off site. 2.9 No rights of way or services are proposed to be diverted as a result of the development the subject of this application. 8 3. Principles of the proposed development 3.1 In order to secure the ongoing supply of suitable kiln feed limestone from Whitwell Quarry it is proposed that four extensions are made to the site together with an associated extension in the operating timescales. These comprise the north extension, the north east extension, the east extension and the south east extension as shown on Figure 2. None of the extensions are located outside the existing planning consent boundaries. As explained in Section 2 the site which comprises the land within the application boundary shown on Figure 2 includes the main quarry, the northern quarry, the eastern area and the four proposed extensions together with the minerals processing area, the Ready-mix plant and the access routes which are under the control of LT. 3.2 The proposed extensions to the site will provide an ongoing supply of suitable blends of limestone to the kiln. Variation in chemical composition and hardness of the dolomite and dolomitic limestone at the Whitwell Quarry Complex and product requirements produced at the kilns in Whitwell Works means that in order to provide an appropriate blend of stone quarrying takes place at several faces concurrently across a number of areas of the site. The proposed extensions will initially provide an extended supply of the kiln feed stone at the site and once the kiln feed stone is extracted then the underlying non-chemical grade stone termed civils stone that is unsuitable for kiln feed and used for aggregate can be extracted. The kiln feed stone and civils stone will be extracted concurrently from different areas of the quarry. 3.3 Each face will be worked in three benches. The top two benches will be generally suitable for kiln feed and the bottom bench is suitable for use as aggregate. Extracted aggregate grade material will be crushed, screened and graded before it is transported from the site by road. The aggregate produced at Whitwell Quarry is of high quality and high value to the economy which generates the need for the proposed extensions. 3.4 Due to the variability of product demand and the geology in order to ensure that the necessary quality of limestone with the appropriate iron content can be provided to the kilns at Whitwell Works it is essential that several extraction areas are available for working at any one time. The rate of working the limestone is determined principally by the rate of use of the refractory grade stone. The rate of extraction of LT/WTE/LZH/1655/01/SCOPING 6

9 the underlying civils stone is determined by the rate of extraction of the refractory grade stone and the market demand for civils stone. It will be necessary to maintain flexibility with respect to the order of working of the extensions so that the extensions can be worked concurrently or separately. Extension area (Figure 3) Kiln feed reserves (tonnes) Civils stone reserves (tonnes) North extension 2,300, ,000 North East extension 640, ,000 East extension 56,000 37,000 South East extension 230, , It is anticipated that the extraction of mineral from the site will continue at the same average rate as currently hence 500,000 tonnes per annum (tpa) of kiln feed stone will be extracted and 500,000tpa of civils stone will be extracted. The proposed extensions will provide a supply of kiln grade stone for a further 8 years beyond that currently consented at the Whitwell Quarry Complex. Together with the already consented reserves it is anticipated that the life of the site will extend to 2033 for kiln grade stone and 2040 for civils stone. 3.6 The principles of the concept restoration scheme for the site will remain consistent with scheme that was approved initially under planning permission references R5/0705/13 and CM5/0206/178. The restoration of the four extension areas will tie in with the initially consented restoration scheme. The restoration scheme is based on the assumption that prior to the completion of the working of the Whitwell Quarry Complex the railway will be diverted to the south in accordance with the approved principles in the ROMP and the tunnel will have been removed. It is considered that the restoration of the quarry areas will be completed 3 years after the completion of LT/WTE/LZH/1655/01/SCOPING 7

10 extraction operations. It is anticipated that the detailed restoration scheme will be agreed at a later date consistent with the current approach at the Whitwell Quarry Complex. 3.7 As part of the development it is proposed to create two new rights of way at the site. Belph Footpath 13 can be extended in a west south west direction adjacent to the B6042 Hennymoor Lane. The footpath would run to the south of the eastern extension extraction area and to the north of the hedge adjacent to the road. This will increase connectivity with Belph Bridleway 10 and Hodthorpe and Belph Bridleway 5. Belph Bridleway 5 can be extended to formalise an existing non-official route as a footpath. The footpath currently runs in a northerly direction adjacent to the western boundary of the main quarry between Belph Bridleway 5 and Elmton Footpath 1. The proposed footpath routes are shown on Figure The quarry will continue to be worked and the mineral will continue to be processed in the same way as currently. Appropriate mitigation and controls will continue to be applied in order to minimise the environmental impacts of the proposed further extensions. LT/WTE/LZH/1655/01/SCOPING 8

11 4. Planning context 4.1 As part of the application for planning permission it is necessary to consider the planning context of the development including the planning history and current status of the site, the land use policies relevant to the proposed development, the need for the development and the alternatives to the development. 4.2 An analysis of the relevant policies in the national documents included the National Planning Policy Framework (NPPF) will be undertaken. Regard will also be given to the relevant Planning Practice Guidance Notes. The Development Plan for the site comprises the saved policies contained within the Derby and Derbyshire Minerals Local Plan (adopted 2000 and amended 2002) and the saved policies of the Bolsover District Local Plan Derbyshire County Council are currently working together with Derby City Council preparing a new Minerals Local Plan and Bolsover District Council are currently preparing a New Local Plan. Account will be taken as appropriate of the Minerals Development Plan for Nottinghamshire County Council in particular when assessing the need for the civils grade stone. If during the preparation of the application new Development Plan Documents are produced these will be reviewed as part of the preparation of the application. 4.4 The need for the proposed development will be assessed. Particular consideration will be given to the need to provide continuing suitable kiln grade material to Lhoist as well as prevention of the sterilisation of civils grade stone together with the sustainable use of resources. The suitability of the site will be explained with reference to the policies in the Development Plan. 4.5 The environmental impacts of the proposed development will be assessed as explained in Section 5 of this report. The analysis and evaluations of the environmental impacts of the proposed development will be compiled to demonstrate its contribution to sustainable development and compliance with relevant planning policies. 12 5. The assessment of potential environmental impacts 5.1 The main environmental issues that is it proposed are addressed have been determined based on discussions between LT and Derbyshire County Council, observations made of the site conditions, the planning history of the site, discussions with technical specialists in the project team and the experience of MJCA in preparing planning applications for Whitwell Quarry and similar developments. The environmental issues which it is proposed are assessed are as follows:- Landscape and visibility Blasting and vibration Traffic and transport Noise Water resources and flood risk Archaeology and cultural heritage Ecology Soil resources Amenity impact from dust 5.2 Baseline data will be collected to define the current environmental conditions at the site against which the potential environmental impacts of the proposed development will be evaluated and the design for the mineral extraction and the site restoration will be developed. The site and the surrounding area will be analysed in order to gather information which will be used to undertake the assessment of any potential environmental impacts. For the purpose of carrying out the assessments the baseline situation will include the consented development the subject of the conditions agreed as part of the ROMP process (Code No R5/0705/13) and planning permission reference CM5/0206/178. The baseline situation includes the continued operation of the consented extraction areas at the quarry including the eastern area. As the proposals for the eastern area are for an extension in time only there is considered LT/WTE/LZH/1655/01/SCOPING 10

13 no need to carry out impact assessments for the activities in the eastern area. The impact assessments will be carried out for the proposed four new extraction areas only. 5.3 From the baseline information collected the impacts of the proposed extensions will be assessed. For each of the main environmental issues the environmental impacts will be assessed for the periods of the preparation, operation and restoration of the site. The issues will be considered where relevant to humans, flora, fauna, soils, water, climate, air, landscape, material assets and cultural heritage. Where potentially significant impacts are predicted appropriate refinements to the site design and operations will be made to mitigate the impacts. The mitigatory measures will be specified in the planning application. Landscape and visibility 5.4 An initial desk study will be undertaken of the site identifying potential areas of interest and important views from publicly accessible points in the surrounding landscape. During a visit to the site the location and condition of existing site features will be confirmed such as buildings and public rights of way. The visual receptors for the proposed extension areas will be identified. The landscape character of the site will be established together with the current and adjacent land uses and the extent and nature of the views of the site from visual receptors will be evaluated. Account will be taken of relevant consented proposed developments in the vicinity. An initial site meeting has been held with Derbyshire County Council to discuss the approach to the landscape and visual impact assessment. 5.5 An assessment will be undertaken of the likely effects of the proposals on landscape features, landscape character and visibility in accordance with the Guidelines for Landscape and Visual Impact Assessment (3 rd edition). The assessment will include the impact on the landscape as a result of the operation and restoration of the site. Blasting and vibration 5.6 A blasting and vibration impact assessment will be carried out for the proposed extension areas. A baseline study will be carried out using historical data from blasting operations in close proximity to the proposed extensions and sensitive receptors will be identified. Vibration predictions will be estimated based on old LT/WTE/LZH/1655/01/SCOPING 11

14 blasting techniques and new techniques using electronic detonators for initiating blasts. The data and predictions will be analysed to establish blast design principles for the proposed extensions and identify any necessary mitigatory measures to be undertaken. Traffic and transport 5.7 A traffic and transport impact assessment will be carried out and a Transport Statement will be prepared. Existing traffic generation from the site, accident data and data on existing traffic flows for the highway in the vicinity of the site will be reviewed. Previous traffic assessments carried out for earlier planning applications will be reviewed. Discussions will be held with the highway officers at Derbyshire County Council to agree the scope of the assessment needed including the appropriate allowance for traffic growth on the local highway. Noise 5.8 An assessment will be carried out of the potential noise effects in accordance with the NPPF and the Planning Practice Guidance on minerals, which contains noise limits for mineral operations and related activities. Measurement of existing noise levels will be undertaken at up to six locations near the development site. The existing noise levels in the area of the chosen locations will be measured in terms of L Amax, L A90, L A10, and L Aeq over maximum periods of 2 hours. The noise monitoring locations will be agreed with the Environmental Health Officer at Bolsover District Council. Noise predictions will be made for each of the locations. Noise from traffic generation on the public highway will be assessed and included in the predictions. Any mitigation or noise control measures considered necessary will be identified in the noise assessment. Water resources and flood risk 5.9 Considerable work has been undertaken at the Whitwell Quarry Complex previously with respect to the potential impacts on water resources. It is considered that the small areas of additional mineral extraction will not have a significant impact on the hydrogeological and hydrological regime compared with the operations at the site for which consent is in place currently. A limited, qualitative impact assessment is therefore proposed. LT/WTE/LZH/1655/01/SCOPING 12

15 5.10 A desk based study will be undertaken of the geology, hydrogeology and hydrology of the proposed extensions areas based on published information and site investigation data including current dewatering activities. Based on geological, hydrogeological and hydrological information from the results of the desk study potentially sensitive receptors will be identified. An assessment will be made of the vulnerability of water resources in the vicinity of the extension areas together with the current quarry. The likely impact on vulnerable receptors of the operation and the restoration of the site will be assessed based on the working method together with the operational and restoration design. The potential impact on the RIGS within the quarry will also be assessed The site is located within Flood Zone 1 which is defined in the Planning Practice Guidance to the NPPF as having a less than a 1 in 1000 year annual probability of flooding from rivers or the sea. It is considered that the proposed development is unlikely to have a significant impact on flood risk at the site compared with the operations already permitted and carried out hence a simple qualitative Flood Risk Assessment will be prepared and included in the application. Archaeology and cultural heritage 5.12 As the proposed development is taking place within or immediately adjacent to the already disturbed footprint of the quarry it is considered that any potential effects on cultural heritage will be limited to those off site in relation to their setting. On this basis a brief archaeological and cultural heritage review will be undertaken. The review will include confirmation of the statutory buildings and monuments in the area together with consultation with Derbyshire County Council and Historic England. Consideration will be given to the potential impacts of the proposed development on the setting of any sensitive properties or monuments. Particular attention will be given to the assessment of potential effects on the Creswell Crags monument and visitor centre which is a SSSI and currently on the tentative list for nomination for World Heritage Site status. Ecology 5.13 Significant ecological survey work has been carried out at the site over many years. A number of surveys were undertaken at the site during 2014 including a Phase 1 LT/WTE/LZH/1655/01/SCOPING 13

16 habitat survey on the proposed extension areas, a badger survey of all suitable habitats, a hedgerow assessment, reptile surveys of suitable habitat, a Great Crested Newt (GCN) environmental DNA (edna) survey of waterbodies at the site, bat activity surveys using both transects and static detectors and a breeding bird survey including peregrines. A site visit will be undertaken in 2015 to review the Phase 1 habitat survey and record any changes. Badger activity records will be updated. A check will be undertaken on the Peregrine nesting locations. Based on the results of the ecological surveys and the evaluation of the conservation importance of flora and fauna at the site an assessment of the potential ecological impacts of the development will be undertaken. If necessary suitable mitigatory measures will be included in the development proposals. Soil resources 5.14 Most of the soils have been stripped from the working areas of the Whitwell Quarry Complex. The existing soils and agricultural information will be reviewed including soil handling, storage and restoration schemes and relevant planning conditions. An Agricultural Land Classification (ALC) survey was undertaken of the north east extension in July If necessary further ALC surveys will be carried out on the proposed extension areas and the resources in the existing stockpiles will be accessed. A soil stockpile is located currently on part of the proposed north extension. It is proposed that most of the stored soil is moved to a different storage location to allow access and extraction. A bund of soil will be left in place to provide a continuing visual screen to the users of Whitwell Footpath 73. An assessment will be made of the impact of the proposals on soil resources at the site. Dust 5.15 A qualitative assessment of the potential impacts of dust which may be generated by the proposed development will be undertaken based on the relevant minerals guidance. The assessment will identify the site activities most likely to generate dust emissions, consider site parameters which may increase potential impacts from dust including meteorological data and the location of receptors in the vicinity of the site taking into consideration the effectiveness of the current and proposed control measures. The assessment will take into account the mitigation measures specified LT/WTE/LZH/1655/01/SCOPING 14

17 in the dust management procedures currently carried out on site and will identify further mitigation measures and modifications where considered necessary. Cumulative impacts 5.16 The cumulative impacts of the proposed development will be assessed together with those from permitted or committed developments in the vicinity of the site. It is considered likely that it will be necessary to review cumulative impacts with respect to noise, traffic and landscape and visibility. LT/WTE/LZH/1655/01/SCOPING 15

The structure of the planning application and the Environmental Statement 6.1 The Environmental Statement will be prepared in accordance with The Town and Country Planning (Environmental Impact Assessment) Regulations 2011 (as amended). The planning application and the Environmental Statement will comprise several volumes. 6.2 Volume 1 will comprise the planning application. This will include the planning application forms and certificates, a Planning Statement which will consist of the description of the proposed development, a review and analysis of the relevant planning policies and an assessment of the need for the proposed development and a Statement of Local Engagement which sets out how the community have been consulted on the application. 6.3 Volume 2 will comprise the Environmental Statement which will be sub-divided into three parts. A Non Technical Summary will be included and will also be made available as a separate document. Part 1 of the Environmental Statement will include a description of the site and its setting and the approach to the EIA and scoping. Part 2 will comprise a description of the current and proposed operations at the site along with the development proposals and the alternatives considered including the options of do nothing and using alternative sites. Sufficient detail will be provided for development control purposes and to facilitate the assessment of the impacts. Part 3 will comprise a description of the baseline conditions at the site and the assessment of the potential environmental impacts associated with the proposed development.
