1 June 6, 2013 BOARD MATTER F ACTION: Consider a funding request from the Wyoming Department of Environmental Quality (DEQ) for a Clean Water State Revolving Fund (CWSRF) Core Program Loan for corrective action at leaking storage tank sites in Wyoming AUTHORITY: W.S through and State Loan and Investment Board Rules, Chapter 11 ALTERNATIVES: Approve or Deny Loan Request ANALYSIS: The DEQ has applied for a non-interest bearing loan of $14,000,000 from the Clean Water State Revolving Fund program for a term of up to twenty (20) years to finance corrective action at eligible leaking aboveground and underground storage tank contaminated sites. Please see attached a copy of a letter dated April 16, 2013, from DEQ requesting Loan #20. Clean Water State Revolving Fund Loans awarded to DEQ bear no interest per W.S (b). Once DEQ has repaid the loan from the Corrective Action Account, the funds are available to award loans for eligible publicly owned clean water projects. CWSRF Funding Balance $86,123,087 Available 1,000,000 Cheyenne Pending 14,000,000 DEQ Pending $71,123,087 Balance if Pending applications approved DIRECTOR S RECOMMENDATION: The Director recommends that the Board approve a Clean Water State Revolving Fund Loan to the Wyoming Department of Environmental Quality for $14,000,000 at the interest rate of 0.0% per year for a term of twenty (20) years for the remediation of eligible leaking aboveground and underground storage tank contaminated sites. It is further requested that this loan be considered at the next board meeting. The project sites that potentially would be addressed are those outlined in the 2014 Intended Use Plan and the 2014 Priority List of Water Pollution Control Revolving Fund Program, commonly known as the Clean Water State Revolving Fund (list attached) and anticipated projects to begin in fiscal year This loan request is made in accordance with W.S (b). As required by W.S , the loan payment will be made directly from the WDEQ Corrective Action Account to the State Water Pollution Control Revolving Loan Account.
