SIZE OF PARCEL: 64 acres REQUEST: The request is to conditional use permit to operate recreational use (campground) during the County Jam music festival. CURRENT ZONING: The property is zoned RH Rural Homes District and C-2 General Business District. The purpose of the RH Rural Homes District is established to provide for suburban large-lot development with individual on-site water and sewage disposal facilities, and the purpose of the C-2 General Business District is established to provide an area for retail businesses of a community-wide range. ADJACENT ZONING & LAND USES: ZONING LAND USE North RH Residential West RH Residential South RH Residential East C2 Fanny Hill LAND USE PLANS: The County Land Use Plan, adopted in April of this year, includes this property in a Rural Residential Planning area. The Farmland Preservation Plan, adopted in 1983, includes the site in the Agriculture Area where agricultural or open space use was expected to continue. The Town Comprehensive Plan adopted in 2010 also includes this property in the Rural Transitional Planning area. Rural Residential (RR) Intent and Description: The primary intent of this classification is to identify areas suitable for future non-farm residential development. Rural Residential areas include lands that are delineated as existing residential properties or vacant platted areas. In addition, some undeveloped land has been designated for RR development where subdivision expansion is likely to occur. These additional areas tend to be adjacent to existing rural subdivisions or where local roads and utilities exist to efficiently and economically serve the area. BACKGROUND FOR REQUEST: The applicant is requesting a conditional use permit to establish a recreational use on the property. Specifically the recreational use proposed is a 93 site campground that will be operated during the weeks of the County Jam music festival and the Eau Claire Events festival. These events occur in July of each year. The Westgate Sportsman Club had utilized its property as a campground during the week of County Jam up until five-years ago when it was discontinued by the ownership. The campground, as proposed, would be available to campers the Wednesday before the Country Jam music festival through the Monday following the event, and the Thursday before the Eau Claire Events festival through Monday following the event. The Westgate Sportsman Club will be closed to its members (public) during both events. The site will be provided with a shuttle service to and from the Country Jam festival grounds. The Westgate Sportsman Club staff will manage the property and will also provide the security. No camping will be allowed to take place in the right-of-way of Sportsman Drive. The application also stated that directional signs will be used to direct traffic to the site and there be a temporary sign at the entrance of the property. The application materials also included the camping polices, the site plan showing the camping pads, along with portable restroom facilities, garbage receptacles, shuttle pick up, water and lights. Garbage disposal will be provided by Waste Management, and Dressel s Cesspool Service will provide the portable restroom facilities for the campground. 2

3 APPLICABLE ZONING REGULATIONS: Section Purpose. This section describes the purpose of the zoning code. Generally, the purpose of the zoning ordinance is as follows: to separate incompatible land uses from one another; to maintain public health and safety; to protect and conserve natural resources; to prevent overcrowding; to preserve property values; and to maintain the general welfare of the citizens. Section E. Public recreational uses Section E. Recreational facilities Chapter Conditional Uses. Standards for approval of conditional uses: 1) the use must be in conformance with the purpose of the zoning district it is located in; 2) the use will not be injurious to the use and enjoyment of other property in the immediate vicinity; 3) adequate utilities, access, drainage and other necessary facilities have been or are provided; 4) adequate off-street parking is provided; 5) adequate measures have been taken to prevent or control offensive odors, fumes, dust, noise and vibration so these will not constitute a nuisance, and lighting is controlled so that it does not result in disturbance to neighboring properties; 6) soil conditions can support the use; 7) access does not pose traffic congestion or hazards. ANALYSIS: It appears that the proposed can be found to be consistent with all of the standards for conditional use permits. The recreational use should not be in conflict with the purpose of the zoning district, provided it is limited as indicated in the application to two weeks in July of each year. It appears that there is sufficient space on the property to meet the camping and parking needs as long as Sportsman Drive is clear of parking. Soil conditions are satisfactory for the use. Establishing quiet hours will assist with negative impacts relating to noise from the campground. It also appears that the use of the facility can be found to be consistent with the purpose of the zoning ordinance. TOWN BOARD ACTION: Katie Garrett, Town Clerk for the Town of Union stated in an dated June 17, 2014 that the Town Board voted to approve the conditional use permit for Westgate Sportsman s Club. The town board did request additional information from the applicant on the following items: The applicant provides clarification to the Town Board how ambulance service would be provided to the area. Direct contact information from the applicant is to be provided to the town during the events. Ash collection barrels shall be provided. The applicant shall attend the August Town Board meeting for a debriefing of the event. Nothing shall be allowed within the right-of-way of Sportsman s Drive. No walking on roads. No glass bottles shall be allowed. Campfires shall only be allowed in campfire rings only as long as there is no burning ban in effect. Bus route information shall be provided. RECOMMENDATION: Staff has concluded that the conditional use request to create a recreational use (campground) at the Westgate Sportsman Club will be consistent with the standards for conditional use permits, and they will be consistent with the purpose of the zoning code. Staff recommends approval of the conditional use permit with the following conditions: 1. The site plan submitted with the application shall be attached to and made a part of the permit, and all development of the site shall be done in accord with the site plan. 2. All campers shall be required to take the shuttle to and from the music festival grounds. 3. The applicant shall conduct daily meetings with management staff and the Sheriff s Department to address any issues that may have developed during the previous evening. 4. Searchlights, spotlights, laser beams, or any concentrated beams of light shall be prohibited. 5. Quiet hours shall be from 2:00 AM to 8:00 AM. 6. All necessary Eau Claire County Health Department approvals shall be secured prior to the opening of the campground. 7. The applicant shall maintain ash collection barrels onsite for its campers. 8. The right-of-way of Sportsman s Drive shall be clear of parking and camping. 3

4 9. All campers shall be provided a copy of the campground rules by the campground management. 10. Campfires shall only be allowed in campfire rings, provided there is no burning ban in-effect. 11. Westgate Sportsman Club officials shall provide the department, town board and all adjacent neighbors with the appropriate contact numbers that can be called in case of concern or complaint. Any complaints shall be reported to the department and the town. 12. All garbage will be picked up and removed from the property after each event. 13. Recycling facilities shall be provided to the campers during both events. 14. Westgate Sportsman Club officials must attend town board meeting after the event of the current year to discuss the successes and failures of the event. 15. The applicant shall obtain the necessary state, county, and town permits for the project. 16. All lighting shall be shielded and pointed downward as not to cause light pollution at the property line. 17. The egresses and ingresses shall be clearly signed for the use they are intended to serve. 18. The Land Use Supervisor can approve minor alterations from the terms of the permit. A major change does require the approval of the committee at a public hearing. 19. The owner shall allow staff from the Eau Claire County Department of Planning and Development to enter the property at reasonable times to inspect the premises for compliance with the conditions of the permit. 20. The permit is subject to Sections to of the Zoning Code. These provisions establish when a conditional use permit lapses, the conditions under which it can be revoked, and when a CUP expires due to the abandonment of a use. 4

The following conditional uses may be allowed in the R-l-L district, provided that the requirements of Chapter are met: C. Governmental and religious uses; Chapter Conditional Uses. Standards for approval of conditional uses: 1) the use must be in conformance with the purpose of the zoning district it is located in; 2) the use will not be injurious to the use and enjoyment of other property in the immediate vicinity; 3) adequate utilities, access, drainage and other necessary facilities have been or are provided; 4) adequate off-street parking is provided; 5) adequate measures have been taken to prevent or control offensive odors, fumes, dust, noise and vibration so these will 18

DETAILS OF THE REQUEST: The request is for a conditional use permit for governmental use. The Lake Eau Claire Association Inc. is seeking approval to construct a 300 square foot (12 by 25 ) building to house aeration equipment that will be used to aerate Lake Eau Claire. The building will also store equipment used in water quality sampling of lake water. The main aeration equipment consists of an air diffusion system and a fan. The site plan reveals that the access to the building is off of County Highway ND and a parking area next to the building. The Lake Eau Claire Lake Association will own the property and the Lake Eau Claire Lake District will provide oversight assistance operating the aeration unit and testing the water. The Lake Association and Lake District plan to construct a kiosk sign that will be placed on the property where announcements will be placed about lake improvement projects. ANALYSIS: The following is staff analysis based on code requirements for conditional use permits: 1. The use must be in conformance with the purpose of the zoning district it is located in. Governmental uses are allowed in the R-1-L District with a conditional use permit. The aeration building is proposed for the sole purpose of housing aeration equipment to be used to aerate the lake. 2. The use will not be injurious to the use and enjoyment of other property in the immediate vicinity. It does not appear that neither the building nor the aeration equipment will be injurious to the use and enjoyment of the adjacent properties. This use serves a public purpose to improve the water quality of the lake. 3. Adequate utilities, access, drainage and other necessary facilities have been or are provided. Access is off of County Highway ND. 4. Adequate off-street parking is provided. It appears that the adequate off street parking is provided onsite. 5. Adequate measures have been taken to prevent or control offensive odors, fumes, dust, noise and vibration so these will not constitute a nuisance. The only anticipated potential nuisance factor would be noise from the air diffusion system, but that is mitigated by vibration absorbing footpads and solid building walls with building heat ventilation projected into the forested area. 6. Soil conditions are adequate to support the use. Soil conditions are adequate 7. Access does not pose traffic congestion or hazards. The access to the lot requires a permit from the County Highway Department. TOWN BOARD ACTION: The Town Board of Town of Ludington met on June 12, 2014, and per Randy Horlacher, Town Chair, the town supports the Lake Eau Claire Association conditional use permit request. STAFF CONCLUSIONS AND RECOMMENDATION: Staff concludes that the conditional use permit request from the Lake Eau Claire Association to construct 300 square foot aeration building meets the standards of chapter and conforms with the purpose of the zoning code. Staff recommends approval of the conditional use permit with the following conditions. 1. The site plan submitted with the application shall be attached to and made a part of the permit. 2. Applicable local, county and state permits/approvals shall be applied for and obtained prior to the commencement of any construction activities for the aeration building. This includes but not limited to: a driveway access permit, an erosion control permit, a property address, a land use permit and commercial building permit. 3. All lighting shall be shielded as to not to cause light pollution at the property lines. 4. Two parking spaces shall be maintained onsite. 19

20 5. The proposed kiosk/sign is allowed without a permit as a community service sign, but must be out of the road right-of-way and out of the visual triangle area for the driveway. 6. 41 REPORT: Eau Claire County DEPARTMENT OF PLANNING AND DEVELOPMENT Eau Claire County Courthouse, Rm Oxford Avenue Eau Claire, Wisconsin (715) Housing & Community Development Emergency Services Management Real Property Description Land Use Controls Building Inspection Land Conservation Planning County Surveyor TO: COMMITTEE ON PLANNING AND DEVELOPMENT FROM: Rod Eslinger, Supervisor, Land Use Controls Division DATE: June 18, 2014 RE: Pat and Kelly Toutant Request for Variance Lot 53, First Assessor s Plat Town of Washington, Section 32, T27N-R9W, Town of Washington The Toutant s are requesting a variance to divide Lot 53, First Assessor s Plat Town of Washington into two lots. A variance is required because lot 2, as presented, is shown to be less then the County s 1.5-acre minimum lot size for the creation of new lots within the City of Eau Claire 3 Mile Extraterritorial Platting Jurisdiction. There is a house located on lot 53. The property is 2.75 acres and is zoned R-1-L, Residential Large lot. The minimum lot size for the R-1-L district is 20,000 square feet. This lot is not served by municipal sewer or water. The City of Eau Claire will need to approve the map as presented because the CSM does not conform to the City s 10- acre density standard. In an dated June 12, 2014, Janelle Henning, Town of Washington Administrator, stated the town does not have any concerns with the map as presented. Section B. Size. Lot area shall conform to the provisions of Title 18 except that within the extraterritorial jurisdiction of the City of Eau Claire where municipal sewer services are not readily available and within unzoned towns, outside of the shoreland overlay district, the minimum lot area shall be 1.5 acres. Under of the subdivision control code, the committee can grant variances to Chapters 18.82, 18.83, and of the code. The committee must find that there is exceptional or undue hardship in the request; it is not detrimental to the public good, and without impairment to the intent and purpose of the code. The committee must consider all the facts and testimony when deliberating this matter. STAFF RECOMMENDATION: Staff recommends that the committee grant the variance to allow Lot 53 First Assessor s Plat Town of Washington to be divided to create two lots. Staff recommends that the committee state findings to support their decision to grant or deny the request. The following reasons may be used to support approving the request: 1. That the Town of Washington supports the variance as the division is consistent with neighboring properties and road frontage on Patton and State Streets. 2. The parcels conform to the R-1-L District minimum lot size. 3. The variance will not be detrimental to the public good, the spirit and purpose of the code will be upheld. 4. The purpose of the Subdivision Control Code will be upheld. 41

46 Summary On May 20 th, 2014 the Eau Claire County Board of Supervisors completed a strategic planning work session to review the County strategic plan. The County Board members reviewed the County Mission Statement, County Values and Beliefs, and the Strategic Issues. County Board members further prioritized the Strategic Issues as indicated below. Call to order Chair Gary Gibson called the meeting to order at 7:06 PM. 2. Public Hearing: a. Request for a conditional use permit to place a seasonal cabin in the A-1 Exclusive Agricultural District. CUP Ronald & Vicki Anderson / Discussion Action Mr. Rod Eslinger gave an overview of the application and staff report and the conditions required for seasonal structures in A1 zoning. It was noted that the Pleasant Valley Town Board s policy is not to make recommendations on conditional use permit applications. Mr. Eslinger provided a video of the area in which he detailed the current usage and planned use. Staff is recommending the conditional use permit be granted with the seven (7) conditions outlined in the staff report. Ronald Anderson spoke on the request and answered a few questions from the committee. No one else spoke in favor or against. ACTION: Motion by Jim Dunning to approve the conditional use permit request with the conditions outlined in the staff report. Motion carried, 3-0. b. Request for a conditional use permit for the cumulative area of all accessory structures to exceed 1,200 square feet (2,160 square feet requested) in the R-1-L Single Family District, Large Lot. CUP John & Joan Wood / Discussion Action Mr. Rod Eslinger explained the request for an accessory structure to exceed 1,200 sq. ft. in the Single Family Residential Large Lot District. The applicant is proposing to construct a 960 square foot garage in addition to the existing 1,200 square foot detached garage on the property, which will increase the cumulative area of all accessory structures onsite to 2,160 square feet. Mr. Eslinger described the area of the request and the standards of the county code. It is noted that the Town Board of Seymour made a motion not to oppose the conditional use permit. Mr. Eslinger presented the staff report and its recommendation to grant the conditional use permit with the nine (9) conditions outlined in the staff report. John Wood spoke on the intended plan and structural detail of the building. He answered a few questions of the committee. No one else spoke in favor or against the application. 55

Proposed Ordinance: File No /035 Amending the 1982 Official Zoning District Boundary for the Town of Washington Ferguson Rezoning request / Discussion Action Mr. Rod Eslinger described the purpose of the request; its location, surrounding land use and zoning. He reviewed land use for the area and gave details of the request. He analyzed the request using four standards for rezoning land from the A-1 District and four standards for rezoning into the AR District. It was noted the Town of Washington recommended approval of the request. Staff concluded the request would meet the standards for rezoning out of the A-1 District and into the AR District. Staff recommended the Committee recommend approval of the rezoning to the County Board. A video of the site was shown. Mr. Andy Ferguson presented the reasons and need for the request to build a house from the production facilities of the orchard operations. No one else spoke in favor or against the application. ACTION: Motion by Jim Dunning to approve file 14-15/035. Motion carried, Variance to Create a Lot that Exceeds the 4:1 Depth to Width Ratio, Section 17, T26N-R09W, Town of Washington (Ferguson) / Discussion Action Mr. Rod Eslinger reviewed the staff report describing the proposed lot configuration; the intent is to save desirable agricultural land for the orchard. Additional development will not occur on the remainder of the quarter-quarter section as it will be required to be deed restricted due to the AR zoning requirements. Staff concludes it is reasonable to allow the lot to be created as proposed and does not object to the variance request. No one else spoke in favor or opposition. ACTION: Motion by Steve Chilson to approve the variance request based on the lot configuration will minimize the loss of agricultural land.
