3 Don Mouth Naturalization and Port Lands Flood Protection Environmental Assessment Terms of Reference Stage Individual Public and Stakeholder Meetings and Correspondence Meetings November 16, 2005 Meeting between TRCA staff (Adele Freeman, Deborah Martin- Downs) and members of the Task Force to Bring Back the Don (TFBBD). A presentation on the Don Mouth Naturalization and Port Lands Flood Protection (DMNP) was given by Deborah Martin-Downs. Meeting participant feedback The east option could go through the land bridge to the outer harbour rather than through the Environmentally Significant Area (ESA) at the base of Tommy Thompson Park to the lake The turning basin is a required part of the shipping use of the channel and the Port is a significant salt distribution centre Rather than closing off options, encourage discussion of them The environmental community may still by dissatisfied by the plans for the Portlands but TFBBD should not dwell on history TFBBD s vision and 2001 figure do show the river heading into the harbour through the existing outlet point and crossing 480 Lakeshore The criteria being used for the evaluation of alternatives may not represent the majority of public opinion When can alternatives no longer be considered? - Response: During the Environmental Assessment (EA) stage, if options become available that were not carried forward in the Terms of Reference (ToR), TRCA would be amenable to including them, but once the evaluation of alternatives is complete and the preferred alternatives selected, additional options would not be possible Support for alternative #2 was voiced by a participant TFBBD passed a motion that The Task Force to Bring Back the Don, having reconsidered its vision for the Mouth of the Don River, as expressed in the Task Force s 1997 poem and its 2000 drawing, recommits itself to this vision and endorses the Toronto and Region Conservation Authority s and the Toronto Waterfront Revitalization Corporation s effort to continue to refine the options for the project, in consultation with the public (and) to move the Environmental Assessment forward expeditiously November 28, 2005 Meeting between TRCA staff (Adele Freeman, Michelle Vanderwel) and three members of the public: Sharon Howarth, Michael Rosenberg and Karen Buck. Adele Freeman showed slides from the TFBBD presentation (above) and updated the participants of this meeting on the current state of a number of initiatives in the Port Lands and nearby regions
4 Meeting participant feedback Screening should not occur at the ToR stage of the EA. All potential alternatives to should go forward, so that they may be evaluated individually at the EA stage of consultation. The study area should be increased in size OR moved east, so that possibilities such as those shown on the map will be within the study area (see attached submission of meeting participant Michael Rosenberg). The flood protection component of the project appears to be overshadowing that of the river mouth naturalization. The terminology Don Mouth Naturalization" was questioned. It was questioned whether TRCA s objectives include removing land from floodplains. - Response: Developing the area is not in fact dependent on the flood protection provided by this project. This project must be put into context with other initiatives in the area. Also, TRCA s objectives are stated as: healthy rivers, sustainable communities, green space and biodiversity. The river mouth cannot be naturalized without considering water quality. Clean-up should be considered as one of the objectives. While soil and groundwater decontamination have been added to the objectives of this project, work on the river upstream of the mouth would need to be conducted before the mouth could be considered naturalized. December 6, 2005 Presentation of petition by Sharon Howarth to TRCA staff (Michelle Vanderwel). Petition was signed by 292 signatories. The petition statement was as follows: The Don River Environment Assessment must include the south option right through the Port Lands as well as the possibility of going east or west of this option. December 21, 2005 Meeting between TRCA staff (Adele Freeman, Ken Dion) and one member of the public (Bryan Bertie). Meeting participant feedback Two key issues should be considered as part of the Don Mouth Naturalization and Port Lands Flood Protection Project EA: 1) Consider opportunities for Wilson Yard and encouragement of future expansion of weekday train storage in the Keating Yard, instead of Wilson Yard, in design of naturalized mouth of the Don. - Response: The Harbour Lead to the Keating Yard probably represents a greater impediment to attaining our hydraulic, sediment management and naturalization goals than the Wilson Yard. TRCA has on numerous occasions raised the question; all responses thus far indicate that rail traffic is for now required to the Port Lands and that alternative rail connections to the Keating Yard are unlikely. If either the Wilson Yard or Harbour Lead piece is not deemed necessary in the future, TRCA will be opportunistic in having those areas included to improve the naturalization design. It was then suggested that an alternative be prepared that does not depict Wilson Yard, and/or Harbour Lead as part of the naturalization. - Response: TRCA will consider this suggestion through the EA process
5 2) Consider opportunities for widening the Don Narrows westward from Queen Street to north of Gerrard. Does the potential to relocate the two existing rail lines (Belleville and Bala) along the west side of the Don River exist? - Response: If the railways will consider this option, TRCA would be interested in examining this alternative further. February 7, 2006 Meeting between TRCA staff (Adele Freeman, Ken Dion) and representatives of Trillium Ridge regarding the Toronto Port Lands Canal Proposal. Meeting participant feedback Trillium Ridge will be seeking TWRC approval of the Toronto Port Lands Canal Proposal. - Response: Until such approval is received, TRCA cannot incorporate this proposal into the planning for the DMNP. However, the alternatives to in the ToR are sufficiently flexible such that if TWRC approves the canal proposal, alternative methods developed in the EA phase of the DMNP can then incorporate this proposal into their planning. The proponents were advised to provide input into TWRC s marine strategy. February 8, 2006 Phone call between TRCA staff (Adele Freeman) and a member of the public (Terry Fahey) regarding the DMNP. Suggested TRCA should work on natural patterns, e.g. a system of islands with lower lands around them that would flood. There is a need to get away from the grid system of the Don Greenway. - Response: TRCA appreciates the need for a more aesthetic design for the Portlands. At this point, we need to answer some of the technical questions and then integrate this work into the design approach. There is a need for quiet lagoons along the north shore of Lake Ontario. - Response: On this issue, TRCA suggests attending the upcoming Marine Use Strategy public meeting; TWRC will have meeting information available. February 9, 2006 Eastern Waterfront Transit Projects Kickoff Meeting Paul Murray (Gartner Lee Ltd.) attended this meeting to provide a status report on the DMNP and to better understand these projects to identify interfaces and timelines between them. TTC and TWRC staff also presented. The Eastern Waterfront Transit projects represent three individual EA projects supporting transit for the East Bayfront, West Don and Portlands precincts. TTC and MOE have agreed that the ToR for all three projects will be done jointly. Once the ToRs are approved, the West Don and East Bayfront projects will proceed. The Portlands EA will be delayed pending key decisions like the location of the mouth of the Don. The schedule for the ToRs is to develop and consult with stakeholders/public in the spring and submit the ToRs in the summer of The EAs should then commence in the fall. TTC expects that the first two EAs will be completed by Fall
6 Dave Hardy has been retained by TWRC to facilitate the consultation for the transit EAs and coordinate consultation with other project activity in the Portlands. The approach he outlines is consistent with TWRC s guideline and similar to the framework for the DMNP. Other projects that will have to be coordinated with these transit EAs include DMNP, the Knuckle area and the World Expo Bid. The World Expo Bid will be submitted in May 2006 and may identify legacy projects that support the transit EAs. A Request for Proposals for the knuckle area will be out February 9 th. This project will look at the road linkages in the area and land uses. This project is expected to be completed by the spring March 2, 2006 Port Lands Action Committee Meeting TRCA staff (Adele Freeman and Ken Dion) attended this meeting to answer questions regarding the project and provide background to the PLAC members. March 16, 2006 Don Watershed Regeneration Council Meeting Paul Murray (Project Manager, Gartner Lee Ltd.) attended this meeting to provide background on the alternatives considered for the project and the rationale behind their inclusion in or exclusion from the Terms of Reference. The Don Council meetings are attended by Council members and guests. The Don Council had already approved and submitted a letter commenting on the Terms of Reference; this meeting provided a deeper understanding of the issue for members that had been unable to attend the public meetings. May through July 2005 Meetings and Discussions with Home Depot Representatives TRCA staff and/or Gartner Lee staff (Paul Murray, Project Manager) met or teleconferenced with Home Depot representatives on two occasions during this period to discuss the DMNP and Home Depot s development proposal. Discussions continue with Home Depot representatives. See letter from Home Depot s legal counsel, attached. December 2005 through March 2006 Meetings and Discussions with Toronto Film Studios Representatives TRCA staff and/or Gartner Lee staff (Paul Murray, Project Manager) met or teleconferenced with Toronto Film Studios representatives on two occasions during this period to discuss the DMNP and Toronto Film Studio s Filmport development. Discussions continue with Toronto Film Studio representatives. See letter from Toronto Film Studios, attached. 19 Don Mouth Naturalization and Port Lands Flood Protection Project COMMUNITY WORKING SESSION #1 AND SITE WALK AT THE MOUTH OF THE DON RIVER Toronto and Region Conservation (TRCA) has commenced the Don Mouth Naturalization and Port Lands Flood Protection Project. Ultimately this project will develop a preferred alternative that will transform the existing mouth of the Don River including the Keating Channel into a healthier, more natural river outlet to the lake, while at the same time, removing the risk of flooding to 230 hectares of urban land to the east and south of the river. This project is a key component of the Toronto Waterfront Revitalization Corporation s mandate to renew and revitalize Toronto s waterfront. This project is subject to the requirements of the Ontario Environmental Assessment Act as an Individual Environmental Assessment (EA). We are currently developing a Terms of Reference which is the first step of an Individual EA. This project is also subject to the requirements of the Canadian Environmental Assessment Act.
