The subject site is currently platted as W.D. Lacy Addition and commonly known as Block 29. There have been no previous zoning cases in the general vicinity in the past five years. Transportation: The proposed development has three points of access. There are two points of access from South Collins Street and one point of access along East I-20 Frontage Road. Thoroughfare Existing Proposed South Collins Street 120-foot, 6-lane major arterial 120-foot, 6-lane major arterial Traffic Impact: Water & Sewer: Drainage: Fire: The proposed zoning change will generate similar traffic patterns and will not significantly impact the adjacent roadway systems. Water and sewer services are available to the subject site. The site is located in the South Fish Creek drainage basin. No portion of the site is located within a FEMA designated floodplain and no significant drainage impacts are expected to result from development of this site, as long as the developer complies with all relevant city ordinances. Fire Station Number 12, located at 5050 South Collins Street, provides protection to this site. The estimated fire response time is less than five minutes, which is in keeping with recommended standards. School District: The proposed specific use permit request is located in the Arlington Independent School District and has no impact on the schools serving this site. 2 Northern Arlington Ambience Southeast Arlington Community Alliance Southwest Action Team of Arlington WeCan (West Citizen Action Network) Fitzgerald Concerned Citizens Maybrook Estates HOA Southeast Arlington Community Alliance Villages of Fairfield Neighborhood Association Property Owners: 7 Letters of Support: 0 Letter of Opposition: 0 PLANNING AND ZONING COMMISSION SUMMARY: Public Hearing: August 20, 2003 Specific Use Permit SUP03-05 At 9:03 p.m., Chair Haddad called the public hearing on Specific Use Permit for gasoline sales and related convenience store less than 5,000 square feet on approximately 1.7 acres of land currently zoned BP-CS (Business Park Overlay- Community Service) with AP1 (Airport Overlay), generally located south of East Interstate 20 Highway and east of South Collins Street with the approximate address being 4201 South Collins Street. Proponent s Portion: Present to speak in support of this case was Karen Mitchell, Mitchell Planning Group, 7823 Nine Mile Bridge Road, Fort Worth. She began with some history about Quik Trip stating they have been in business since 1958, have over 400 stores nationwide, and that the first store they opened in Texas was here in Arlington. She further stated that with what they propose to put at this location they are in compliance with the CS zoning, the Southeast Sector of the Comprehensive Plan, the Airport 1 district, and they believe they have demonstrated that they correspond to and are not detrimental to the uses desired for the 2000 Interstate 20 Business Area Plan. She further stated that the Business Park Overlay requires them to have a Specific Use Permit and that Quik Trip would be a vital element to the supporting infrastructure for the area and an asset based on their commitment to Arlington. Chair Haddad asked about the screening material on the roof and stated that the Ordinance requires that the rooftop equipment be completely screened from view. Ms. Mitchell stated they are looking into an opaque material that would meet the requirements of the Ordinance. Chair Haddad stated he understands from meetings with Quik Trip that this construction will be an upgrade from the stores existing in Arlington. Ms. Mitchell stated that they have added some architectural features such as the cast stone and are doing 100% masonry. She further stated that this store will have masonry on the support columns of the gas canopy instead of the metal that is on the others. Chair Haddad asked about the brick that appears to go further up toward the roof than some of the other stores. Ms. Mitchell stated they usually put a metal façade around, but are taking brick all the way up on this store. Chair Haddad asked if this unit has been built anywhere else in the Metroplex. Walt McMennamy, Quik Trip, Trinity Boulevard, Fort Worth stated they have built this store in Plano and have a similar design in Keller. Commissioner Daley stated the 2000 Interstate 20 Business Area Plan does not call for a gasoline station here. Ms. Mitchell answered that included in the packets was a letter from Quik Trip and some supporting documentation that show the location of existing facilities in the area. She further stated there are no land uses like this in the section they are in according to the Business Area Plan. She said that looking at the comprehensive plan and the underlying district there is a need for a support type business like Quik Trip and they Specific Use Permit SUP03-5R1 i-2

3 feel they are not going to be detrimental to the other business that will be located in the area. Commissioner Smith asked regarding the design of this store and what makes it unique to Arlington. Mr. McMennamy answered by showing a drawing of the design and pointing out the changes and items that are different than their regular stores. Commissioner Shepard stated that there is a large gasoline facility on the west side of Collins to the north of Interstate 20 and another on the east side of Collins on the north side of Interstate 20; then crossing over Interstate 20 there are two additional gasoline sales places, most of them in connection with a convenience store. He stated that in the letter from Quik Trip it says there is no like establishment in the area. Mr. McMennamy answered that they are a convenience store, but their pricing and the items they provide are like a smaller grocery store. Commissioner Shepard asked if there would be any outside vending machines. Mr. McMennamy answered they have their ice machine inside the store and there would be no outside vending machines. Commissioner Shepard also asked about outside displays. Mr. McMennamy stated they would like to have outside displays, but they would work with a restriction of height, etc. Commissioner Shepard mentioned that the amount of signage would be limited to what is depicted on the plans submitted. Mr. McMennamy stated that is correct. Commissioner Weydeck stated she had mentioned she would like to have a pitch to the roof of the main structure. Mr. McMennamy stated they feel the design they are proposing is unique and there are a number of reasons they would like to stay away from the pitched roof. He stated that the cost would be one of the reasons, but the main reason is that it s been a maintenance issue. Also present to go on record in favor of this case was Stephen Cavender, 2111 North Collins Street, Suite 323; and Stephen Walker, 1717 Newton Drive, Flower Mound. Opposition Portion: There was no one present to speak in opposition to this case. Being no one else to speak for or against this case, Chair Haddad closed the public hearing. Commissioner Shepard stated there is a significant gap with the spacing of the trees, that on the west side facing Collins, there is a 50 foot difference between the first two then it goes to 20. He stated that in the corners, it s to provide some visibility of the sign when the trees grow. He further stated they are trying to have the trees directly in front of the canopy which is the most impact. Commissioner Shepard further stated there is not a lot of plant material, but not many trees. Mr. McMennamy stated they have 80 feet of landscaping from curb to curb on Interstate 20 and they are only required to have 20 feet. He mentioned there is 40 feet of right-of-way and 20 feet of required landscaping and they added 20 feet on top of that. Chair Haddad mentioned that there should be something more to help hide all the concrete like berming. Ms. Mitchell stated they have done tree groupings instead of spacing them out and have used crepe myrtles for color. Mr. McMennamy said they would not be opposed to additional screening for the parking on the south side of the site. Commissioner Roach stated she would not be supporting this case because she has concerns about another gas station and feels it is inappropriate for this corner. Chair Haddad stated he does realize there are two other gas stations on Collins and feels they are more a destination type and feels this location would serve the purpose of the other gas stations on Interstate 20. Motion: Commissioner Smith moved to forward Specific Use Permit SUP03-05 to the City Council with a recommendation of approval subject to DRC Comments and the following stipulations: 1) incorporating the revised color site plan with the additional trees to be Specific Use Permit SUP03-5R1 i-3

4 added to the cluster, 2) buffer be provided to screen the parking on the southwest side, 3) rooftop screening be opaque, 4) no outdoor vending machines, and 5) limit signage to the signs depicted on the plan. He stated that he would like to request a continuance because he thinks there is a good opportunity for them to work with Staff to bring back a substitute landscape plan to mitigate the issue. Chair McGlaun stated that this case will be continued until Staff determines it is ready to come back before the Commission.
