The Technical Committee on Industrial and Medical Gases is presenting two Reports for adoption, as follows: Report I: The Committee proposes for adoption, amendments to NFPA 51, Standard for thedesign and Installation of Oxygen-Fuel Gas Systems for Welding, Cutting, and Allied Processes, 2002 edition. NFPA is published in Volume 3 of the 2004/2005 National Fire Codes and in separate pamphlet form. NFPA 51 has been submitted to letter ballot of the Technical Committee on Industrial and Medical Gases, which consists of 19 voting members. The results of the balloting, after circulation of any negative votes, can be found in the report. Report II: The Technical Committee proposes for adoption, amendments to NFPA 560 Standard for the Storage, Handling, and Use of Ethylene Oxide for Sterilization and Fumigation, 2002 edition. NFPA is published in Volume 9 of the 2004/2005 National Fire Codes and in separate pamphlet form. NFPA 560 has been submitted to letter ballot of the Technical Committee on Industrial and Medical Gases, which consists of 19 voting members. The provisions of this standard reflect a consensus of what is necessary to provide an acceptable degree of protection from the hazards addressed in this standard at the time the standard was issued Unless otherwise specified, the provisions of this standard shall not apply to facilities, equipment, structures, or installations that existed or were approved for construction or installation prior to the effective date of the standard. Where specified, the provisions of this standard shall be retroactive In those cases where the authority having jurisdiction determines that the existing situation presents an unacceptable degree of risk, the authority having jurisdiction shall be permitted to apply retroactively any portions of this standard deemed appropriate The retroactive requirements of this standard shall be permitted to be modified if their application clearly would be impractical in the judgment of the authority having jurisdiction, and only where it is clearly evident that a reasonable degree of safety is provided. 1.5 Equivalency. Nothing in this standard is intended to prevent the use of systems, methods, or devices of equivalent or superior quality, strength, fire resistance, effectiveness, durability, and safety over those prescribed by this standard Technical documentation shall be submitted to the authority having jurisdiction to demonstrate equivalency The system, method, or device shall be approved for the intended purpose by the authority having jurisdiction. Substantiation: This would ensure consistency for these requirements. VISCOMI, R.: The proposed changes are not consistent with the requirements currently recognized and applied as part of the existing NFPA 560 standard. The change suggested potentially imposes significant modifications to existing EO facilities. The existing NFPA 560 standard has proven to be a safe standard in which to construct, store, handle and use ethylene oxide. Authorities having jurisdiction have relied comfortably on the requirements imposed by this standard. Therefore, the change is deemed unnecessary and punitive. Furthermore, NFPA 560 has always been understood, recognized and accepted as being exempted from NFPA 55, given the uniqueness of the operation Log #CP1 Final Action: Accept (Chapter 3 Definitions (GOT)) Recommendation: Adopt the preferred definitions from the NFPA Glossary of Terms for the following terms: Limited-Combustible Material. Use NFPA 55 definition as follows: Limited Combustible. A building construction material not complying with the definition of noncombustible material that, in the form in which it is used, has a potential heat value not exceeding 3500 Btu/lb (8141 kj/kg), where tested in accordance with NFPA 259, Standard Test Method for Potential Heat of Building Materials, and complies with (a) or (b): (a) materials having a structural base of noncombustible material, with a surfacing not exceeding a thickness of in. (3.2 mm) that has a flame spread index not greater than 50; and (b) materials, in the form and thickness used, other than as described in (a), having neither a flame spread index greater than 25 nor evidence of continued progressive combustion and of such composition that surfaces that would be exposed by cutting through the material on any plane would have neither a flame spread index greater than 25 nor evidence of continued progressive combustion. (Materials subject to increase in combustibility or flame spread index beyond the limits herein established through the effects of age, moisture, or other atmospheric condition shall be considered combustible. [220, 1999] Outgassing. (secondary) NFPA 560, 2002 ed. Release of adsorbed or absorbed ethylene oxide after sterilization. Pressure Relief Device. (preferred) NFPA 58, 2004 ed. A device designed to open to prevent a rise of internal pressure in excess of a specified value due to emergency or abnormal conditions. Storage. (preferred) NFPA 55, 2005 ed. An inventory of compressed gases or cryogenic fluids in containers that are not in the process of being examined, serviced, refilled, loaded, or unloaded. Substantiation: Adoption of preferred definitions will assist the user by providing consistent meaning of defined terms throughout the National Fire Codes. Adopt the preferred definitions from the NFPA Glossary of Terms for the following terms: Limited-Combustible Material. Use NFPA 55 definition. Outgassing. (secondary) NFPA 560, 2002 ed. Committee Statement: The changes were made to increase consistency Log #CP4 Final Action: Accept (3.3 Ethylene Oxide) Recommendation: Add a definition for Ethylene Oxide Container as follows: Ethylene oxide container. A compressed gas container used for ethylene oxide or flammable mixtures of ethylene oxide with other chemicals. Substantiation: The term is used in the document Log #CP9 Final Action: Accept ( Sterilization Building) Recommendation: Add a definition for Sterilization Building as follows: Sterilization Building. A detached building, which is comprised of all ancillary systems and rooms supporting the sterilization process, including the mechanical rooms, electrical room, preconditioning room or preconditioning cells, conveyance rooms, preheat room, sterilizer room, aeration room or cells, emissions control area, EO drum storage room, gas transfer room, unprocessed and processed product storage areas, control room, process maintenance areas, and offices directly related to the sterilization process. A This building can include the mechanical room, electrical room, nitrogen tank and vaporizers area, chiller area, preconditioning room or preconditioning cells, conveyance rooms, preheat room, sterilizer room, aeration room or cells, emissions control area, EO drum storage room, gas transfer room, shipping and receiving office(s), unprocessed and processed product storage areas, control room, maintenance areas, offices for the process support personnel, and any other rooms or systems as applicable in supporting the sterilization process. Substantiation: To define a detached sterilization building because there are requirements that use this concept Log #CP6 Final Action: Accept ( Special Rooms) Recommendation: Delete and the term special rooms throughout the document. Substantiation: This action is being taken achieve consistency with NFPA This terminology does not exist in NFPA Log #3 Final Action: Reject (3.3.41; 11.6; 14.1) Submitter: Denyse DuBrucq, AirWars Defense Recommendation: Add new text to read as follows: Cryogenic capture of reagent spill or diffusion into atmosphere. Liquid Nitrogen can freeze liquid material spilled allowing it to be picked up, shoveled, and put in a container for disposal. Liquid Nitrogen can cool the air such that gaseous or mist dispersion is capture and dropped as snow or
3 Report on Proposals F2006 Copyright, NFPA NFPA 560 collected on water mist and dropped as snow and again collected as a solid, shoveled and put in a container and sealed for disposal Cyrogenic capture can freeze spilled liquid for collection as solid, shoveling it into a container for disposal. Dispersed gas into the air can form clouds in the cold or could be collected on water mist which forms snow and is again collected in solid form, shoveled and contained and disposed of. Liquid Nitrogen collection is quick and safe but note the precaution below. Nitrogen drowning must be recognized and its remedy defined in all personnel safety training opportunities. If there is no odor, no cause for the individual to be passed out in a working environment, the person discovering the situation should yell to notify others and immediately get breathing equipment for him/herself and for the victim. Put the breathing apparatus on. Then approach the victim, install the breathing apparatus and begin artificial respiration. If no breathing apparatus is available use large plastic bags to contain fresh air for oneself and for the victim. Tie the filled bag over one s face and have material to do the same to hold the filled bag of gas over the victim s face tying loosely at the neck so as not to strangle the victim. Then apply artificial respiration. Once victim is breathing, help him/ her up and take him from the location or carry victim out and get professional EMT help to evaluate the victim s condition. THIS SHOULD BE POSTED ANYWHERE NITROGEN GAS CAN BE RELEASED IN ITS PURE FORM. (the above statement may be placed in t he Annex A section, Explanatory Material, but it would be more noticed and useful in the text of the Code) Sprinklers. Comment: Using Fixed Liquid Nitrogen equipment, were an event of escape of ethylene oxide to occur, the material can be solidified and picked up as a solid preventing further contamination of water or air. Substantiation: Liquid nitrogen can recapture escaped ethylene oxide so exposure (text illegible) can be lessened and crises averted if fixed fire apparatus for LN is installed and LN supply available. Note: Supporting material is available for review at NFPA Headquarters. Recommendation: Revise text to read: Smoking or open flames shall not be permitted within m (20 50 ft) of any area where ethylene oxide containers are handled. Substantiation: Smokers should not be allowed within 50 feet of any area with flammable containers. Smokers have been witnessed discarding cigarettes by tossing them 10 to 15 feet from where they are standing. That disregard for safety could place a discarded cigarette within 5 feet of a container with flammable gas. in Principle Revise to read: Smoking or open flames shall not be permitted within 7.62 m (20 25 ft) of any area where ethylene oxide containers are handled. Committee Statement: Consistent with NFPA 55, Storage, Use, and Handling of Compressed Gases and Cryogenic Fluids in Portable and Stationary Containers, Cylinders, and Tanks Log #CP7 Final Action: Accept (5.2.1) Recommendation: Add a new as follows: Storage within buildings shall be in accordance with NFPA 55. Recommendation: Add a new section to read: 7.1.2* Exhaust ventilation shall be installed in all indoor dispensing areas used for ethylene oxide. Exhaust ventilation shall comply with the following: (1) Mechanical ventilation shall be operated continuously at a rate of not less than 0.3 m 3 /minm 2 (1 ft 3 /minft 2 ) of floor area of dispensing area. (2) Exhaust ventilation shall not be recirculated within a room or building. Exception: Where the air is treated to reduce the ethylene oxide concentration to below that which represents a hazard, recirculation shall be permitted. Controls shall be provided to ensure the performance of the treatment and recirculation system. (3) The ventilation system shall be designed to prevent accumulation of ethylene oxide anywhere in the dispensing area. (4) Loss of ventilation shall activate a visual and audible alarm and shall stop the flow of ethylene oxide at the remotely operated shutoff valve closest to the (5) Exhaust ventilation shall be installed in accordance with section Substantiation: The reference to section is to insure that electrical components meet the requirements of Class I, Division 2, Group B areas in accordance with NFPA 70, National Electrical Code. Committee Meeting Action: Reject Committee Statement: The proposal is redundant. Requirement is covered in Chapter Log #CP10 Final Action: Accept (7.5) Recommendation: Add a new 7.5 as follows: 7.5 Ethylene Oxide shall not be piped outside the confines of the process area. 5 Notice of Intent to Make a Motion (NITMAM) Sequence of Events Leading to Issuance of an NFPA Committee Document Step 1 Call for Proposals Proposed new Document or new edition of an existing Document is entered into one of two yearly revision cycles, and a Call for Proposals is published. Step 2 Report on Proposals (ROP) Committee meets to act on Proposals, to develop its own Proposals, and to prepare its Report. Committee votes by written ballot on Proposals. If two-thirds approve, Report goes forward. Lacking two-thirds approval, Report returns to Committee. Step 3 Report on Proposals (ROP) is published for public review and comment. Report on Comments (ROC) Committee meets to act on Public Comments to develop its own Comments, and to prepare its report. Committee votes by written ballot on Comments. If two-thirds approve, Reports goes forward. Lacking two-thirds approval, Report returns to Committee. Step 4 Report on Comments (ROC) is published for public review. Technical Report Session Notices of intent to make a motion are filed, are reviewed, and valid motions are certified for presentation at the Technical Report Session. ( Consent Documents that have no certified motions bypass the Technical Report Session and proceed to the Standards Council for issuance.) NFPA membership meets each June at the Annual Meeting Technical Report Session and acts on Technical Committee Reports (ROP and ROC) for Documents with certified amending motions. Step 5 Committee(s) vote on any amendments to Report approved at NFPA Annual Membership Meeting. Standards Council Issuance Notification of intent to file an appeal to the Standards Council on Association action must be filed within 20 days of the NFPA Annual Membership Meeting. Standards Council decides, based on all evidence, whether or not to issue Document or to take other action, including hearing any appeals.
6 The Technical Report Session of the NFPA Annual Meeting The process of public input and review does not end with the publication of the ROP and ROC. Following the completion of the Proposal and Comment periods, there is yet a further opportunity for debate and discussion through the Technical Report Sessions that take place at the NFPA Annual Meeting. The Technical Report Session provides an opportunity for the final Technical Committee Report (i.e., the ROP and ROC) on each proposed new or revised code or standard to be presented to the NFPA membership for the debate and consideration of motions to amend the Report. The specific rules for the types of motions that can be made and who can make them are set forth in NFPA s rules which should always be consulted by those wishing to bring an issue before the membership at a Technical Report Session. The following presents some of the main features of how a Report is handled. What Amending Motions are Allowed. The Technical Committee Reports contain many Proposals and Comments that the Technical Committee has rejected or revised in whole or in part. Actions of the Technical Committee published in the ROP may also eventually be rejected or revised by the Technical Committee during the development of its ROC. The motions allowed by NFPA rules provide the opportunity to propose amendments to the text of a proposed code or standard based on these published Proposals, Comments and Committee actions. Thus, the list of allowable motions include motions to accept Proposals and Comments in whole or in part as submitted or as modified by a Technical Committee action. Motions are also available to reject an accepted Comment in whole or part. In addition, Motions can be made to return an entire Technical Committee Report or a portion of the Report to the Technical Committee for further study. The NFPA Annual Meeting, also known as the World SafetyConference and Exposition, takes place in June of each year. A second Fall membership meeting was discontinued in 2004, so the NFPA Technical Report Session now runs once each yearat the Annual Meeting in June. Who Can Make Amending Motions. Those authorized to make these motions is also regulated by NFPA rules. In many cases, the maker of the motion is limited by NFPA rules to the original submitter of the Proposal or Comment or his or her duly authorized representative. In other cases, such as a Motion to Reject an accepted Comment, or to Return a Technical Committee Report or a portion of a Technical Committee Report for Further Study, anyone can make these motions. For a complete explanation, NFPA rules should be consulted. The filing of a Notice of Intent to Make a Motion. Before making an allowable motion at a Technical Report Session, the intended maker of the motion must file, in advance of the session, and within the published deadline, a Notice of Intent to Make a Motion. A Motions Committee appointed by the Standards Council then reviews all notices and certifies all amending motions that are proper. The Motions Committee can also, in consultation with the makers of the motions, clarify the intent of the motions and, in certain circumstances, combine motions that are dependent on each other together so that they can be made in one single motion. A Motions Committee report is then made available in advance of the meeting listing all certified motions. Only these Certified Amending Motions, together with certain allowable Follow-Up Motions (that is, motions that have become necessary as a result of previous successful amending motions) will be allowed at the Technical Report Session. Consent Documents. Often there are codes and standards up for consideration by the membership that will be non-controversial and no proper Notices of Intent to Make a Motion will be filed. These Consent Documents will bypass the Technical Report Session and head straight to the Standards Council for issuance. The remaining Documents are then forwarded to the Technical Report Session for consideration of the NFPA membership. Important Note: The filing of a Notice of Intent to Make a Motion is a new requirement that takes effect beginning with those Documents scheduled for the Fall 2005 revision cycle that reports to the June 2006 Annual Meeting Technical Report Session. The filing of a Notice of Intent to Make a Motion will not, therefore, be required in order to make a motion at the June 2005 Annual Meeting Technical Report Session. For updates on the transition to the new Notice requirement and related new rules effective for the Fall 2005 revision cycle and the June 2006 Annual Meeting, check the NFPA website.
7 Action on Motions at the Technical Report Session. In order to actually make a Certified Amending Motion at the Technical Report Session, the maker of the motion must sign in at least an hour before the session begins. In this way a final list of motions can be set in advance of the session. At the session, each proposed Document up for consideration is presented by a motion to adopt the Technical Committee Report on the Document. Following each such motion, the presiding officer in charge of the session opens the floor to motions on the Document from the final list of Certified Amending Motions followed by any permissible Follow-Up Motions. Debate and voting on each motion proceeds in accordance with NFPA rules. NFPA membership is not required in order to make or speak to a motion, but voting is limited to NFPA members who have joined at least 180 days prior to the session and have registered for the meeting. At the close of debate on each motion, voting takes place, and the motion requires a majority vote to carry. In order to amend a Technical Committee Report, successful amending motions must be confirmed by the responsible Technical Committee, which conducts a written ballot on all successful amending motions following the meeting and prior to the Document being forwarded to the Standards Council for issuance. Standards Council Issuance One of the primary responsibilities of the NFPA Standards Council, as the overseer of the NFPA codes and standards development process, is to act as the official issuer of all NFPA codes and standards. When it convenes to issue NFPA documents it also hears any appeals related to the Document. Appeals are an important part of assuring that all NFPA rules have been followed and that due process and fairness have been upheld throughout the codes and standards development process. The Council considers appeals both in writing and through the conduct of hearings at which all interested parties can participate. It decides appeals based on the entire record of the process as well as all submissions on the appeal. After deciding all appeals related to a Document before it, the Council, if appropriate, proceeds to issue the Document as an official NFPA code or standard. Subject only to limited review by the NFPA Board of Directors, the Decision of the Standards Council is final, and the new NFPA code or standard becomes effective twenty days after Standards Council issuance. The illustration on page 9 provides an overview of the entire process, which takes approximately two full years to complete.
