1 ORDINANCE NO. 974 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, PIERCE COUNTY, WASHINGTON, AMENDING THE CITY OF BONNEY LAKE COMPREHENSIVE PLAN LAND USE DESIGNATIONS MAP BY APPROVING AN URBAN GROWTH BOUNDARY AMENDMENT, COMMONLY REFERRED TO AS UGAS-FENNEL CORRIDOR, RESULTING FROM THE 2002 ANNUAL UPDATE PROCESS. WHEREAS, on May 30, 1995, The City of Bonney Lake adopted Ordinance 697 which created the current Bonney Lake Comprehensive Plan; and WHEREAS, subsequent annual amendments were made to the Bonney Lake Comprehensive Plan on the following dates: May 28, 1996 (Ord. 721), November 10, 1998 (Ord. 791), October 27, 1998 (Ord. 794), August 8, 2000 (Ord. 840), and October 23,2001 (Ord. 897); and WHEREAS, the City Council of the City of Bonney Lake has established a process for considering updates to its Comprehensive Plan on an annual basis (BLMC 18.54); and WHEREAS, on March 11, 2002, the City of Bonney Lake held a duly advertised open houselinformational meeting for the purpose of presenting information about the 2002 annual comprehensive plan amendment process and proposed schedule to interested parties; and WHEREAS, the City of Bonney Lake Planning and Community Development department accepted applications for comprehensive plan amendments through April 5, 2002; and WHEREAS, the City of Bonney Lake Planning and Community Development department formally reviewed the following eight (8) proposed comprehensive plan amendments: Capital Facilities Element (text amendment, applicant - City of Bonney Lake Public Works); UGAI-214t h (mapluga boundary amendment, applicant - City of Bonney Lake); UGA2(A)-41 ONW (map/uga boundary amendment, applicant - City of Bonney Lake); UGA2(B)-410NE (map/uga boundary amendment, applicant - City of Bonney Lake); UGA3- Falling Water (map/uga boundary amendment, applicant - Lodestar LLC); UGA5-Fennel Corridor (map/uga boundary amendment, applicant - City of Bonney Lake); UGA8-Sumner School District (map/uga boundary amendment, applicant - Sumner School District); and Inlet Island/Maple Pt. (map/request for redesignation amendment, applicant - James & Lucy Ellis and contributing residents of Inlet Island); and WHEREAS, on August 21, 2002, the City of Bonney Lake Planning and Community Development department invited all property owners residing within a proposed comprehensive plan amendment area to an open house/informational meeting to learn more about the comprehensive plan amendment process and related public involvement process; and WHEREAS, on September 10, 2002, notice of the proposed comprehensive plan amendments was sent to the Washington State Office of Community Development (OCD) pursuant to RCW 36.70A.I06, with same notice sent to relevant state agencies; and Page 1

2 WHEREAS, on October 2,2002 the Bonney Lake Planning Agency held a duly advertised public hearing to receive testimony on the proposed comprehensive plan amendments; and WHEREAS, on October 2, 2002 the City of Bonney Lake received comments from OCD, attached in Exhibit A, and read said comments into the record during the public hearing held 10/2/02; and WHEREAS, on October 7, 2002, the applicant for the Inlet Island/Maple Pt. comprehensive plan amendment formally withdrew their application and requested no further action, resulting in a total of seven (7) proposed comprehensive plan amendments considered for final action; and WHEREAS, in addition to the Planning Agency hearing held October 2, 2002, the proposed comprehensive plan amendments were discussed at the following Planning Agency meetings: September 4, September 18, and October 16; 2002; and WHEREAS, on October 16, 2002, the Bonney Lake Planning Agency made a motion to recommend, and on October 22, 2002 made a formal recommendation at a City Council meeting, that City Council adopt the proposed comprehensive plan amendments as indicated in Planning Agency Resolution No (Exhibit B); and WHEREAS, Bonney Lake, SEP A Lead Agency, determined that none of the proposed eight amendments create a probable significant adverse impact on the environment and that an Environmental Impact Statement is not required under RCW 43.21C.030; and WHEREAS, on October 24, 2002, a notice stating the City's intent to issue a Determination of Non-Significance (DNS) was published in appropriate newspapers, posted according to code, and mailed to SEP A lead agencies for their review; and WHEREAS, on November 10, 2002, OCD's 60-day review required pursuant to RCW 36.70A.I06 was complete; and WHEREAS, on November 12, 2002, the Bonney Lake City Council held a duly advertised public hearing to receive testimony on the proposed 2002 comprehensive plan amendments; and WHEREAS, in addition to the November 12, 2002 City Council public hearing, the proposed comprehensive plan amendments were discussed at the following City Council meetings: October 22, November 5, November 19, November 26, 2002; and WHEREAS, on November 25, 2002, the IS-day SEPA comment period and IS-day SEP A appeal period ended with no comments received and no appeals filed; and Page 2

3 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City of Bonney Lake hereby amends its Comprehensive Plan Land Use Designation map to incorporate the proposed urban growth boundary map amendment, described in Exhibit C and identified in Exhibit D, and staff is directed to submit a comprehensive plan/urban growth boundary amendment application to Pierce County Planning and Land Services in 2002 for their subsequent consideration. Section 2. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as required by law PASSED by the City Council and approved by the Robet1 L. We recognize the substantial investment of time, energy, and resources that these amendments represent. This letter represents our official comments. We would like to let you know our primary concern that we recoxrimend the city address before you adopt these amendments: OCD supports the staff recommendation to deny the request to redesignate Inlet Island and Maple Point from R-2 (Medium Density Residential) to R-l(Low Density Residential). This proposed land use, designation change eliminates the possibility to develop modular and manufactured homes ' accessory dwelling units, and duplexes. The staff report dated September , st tes that the current density for'. Inlet Island is 3.08 dwelling units per acre. Further, the staff report concluded based on the Buildable Lands Capacity Analysis report by Pierce County that the overall ensity of onney.i:/ e is.. ' below four dwelling units per acre. OCD suggests you analyze the need for this additional land based on: (1) the Buildable Lands Capacity Analysis report by Pierce County and the data on Bonney Lake's densities that will be available in 2903 (that report indicates that current residential'densities within the UGA are below what is considered urban by the CPSGMHB) and (2) the cityts ability to provide for sewer, water, transportation, and other city public facilities and services to these areas. OCD recognizes that the current amendments are, intended as a first step to adding the areas to the UGA. As you go through that process we recommend you consider WAC Urban Growth Areas, specifically subsections 3(d), (e) and (f). 6 WAC Urban growth areas. (1) Requirements. (a) Each county planning under the ' Act shall designate an urban growth area or areas within which urban growth shall be encouraged and outside of which growth can occur only if it is not urban in nature, (b) Each city that is located in such a county shall be included within an urban growth area, An urban growth area may include more than a single city, (c) An urban growth area may include territory that is located outside a city if such territory already is characterized by urban growth or is adjacent to territory already characterized by urban growth, (d) Based upon the population growth management planning population projection made for the county by the office of financial management, the urban growth areas in the county shall include areas and densities sufficient to permit the urban growth that is projected to occur in the.county for the succeeding twenty-year period. Each urban growth area shall permit urban densities and shall include greenbelt and open space areas. (e) Urban growth should be located first in areas already characterized by urban growth that have existing public facility and service capacities to serve such development. (f) Urban growth should be located second in areas already characterized by urban growth that will be served by a combination of both existing public facilities and services and any additional needed public facilities and services that are provided by either public or private sources. (g) It is appropriate that urban government services be provided by cities and urban government services should not be,provided in rural areas. (2) General procedure. (a) The designation process shall include consultation by the county with each city located within its boundaries. (b) Each city shall propose the location of an urban growth area. (c) The county shall attempt to reach agreement with each city on the location of an urban growth area within which the city is located, (d) If an agreement is not reached with each city located within the urban growth area, the county shall justify in writing why it so designated an urban growth area. (3) Recommendations for meeting requirements. The following steps are recommended in developing urban growth areas: (a) County-wide planning policies. In adopting urban growth are s, each county should be guided by the applicable countywide (and in some cases multicounty) planning policies. To the maximum extent possible, the creation of urban growth areas should result from a cooperative effort among the jurisdictions involved. (b) General considerations. For all jurisdictions planning under the act, the urban growth area should represent the physical area within which that jurisdiction's vision of urban development can be realized over the next twenty years. The urban growth area should be based on densities selected to promote goals of the act -densities which accommodate urban'growth served by adequate public facilities and discourage sprawl. (c) Development of city proposals. In developing the proposal for its urban growth area, each city should engage in a process of which involves the set forth in and of this subsection. 1

WHEREAS, on May 28, 1996, the City of Bonney Lake adopted Ordinance 721 which adopted the current City of Bonney Lake Comprehensive Plan; and WHEREAS, the Growth Management Act, RCW 36.70A.130, allows cities to consider proposed amendments to the comprehensive plan which are consistent with and further refine the adopted comprehensive plan, no more frequently than once every year; and WHEREAS, the Planning and Community Development Department held a duly advertised public open house on March 11, 2002 to present and explain the annual comprehensive plan amendment process and schedule; and WHEREAS, on August 21, 2002, the Planning and Community Developme t Department invited all property owners located within areas impacted by proposed 2002 comprehensive plan amendments to an informational meeting/open house to explain the specifics of proposed amendments, potential impacts, proposed land use designations and schedule for the amendment review; and WHEREAS, as required by RCW 36.70A.I06(3), the City transmitted the draft proposed amendments to the Sate of Washington Office of Community Development (OCD) Department on September 10, 2002; and WHEREAS, the City of Bonney Lake Planning and Community Development Department received written comments (Exhibit lid") on the proposed 2002 comprehensive plan. amendments from OCD on October 2, 2002; and WHEREAS, the City of Bonney Lake Planning Agency held duly advertised public meetings on September 2, September 18, and October 16, 2002, during which the proposed c()mprehensive plan amendments were discussed; and WHEREAS, the City of Bonney Lake Planning Agency held a duly posted/advertised public hearing on October 2, 2002 for the purpose of receiving testimony on eight proposed comprehensive plan amendments for 2002; an.d -WHEREAS, the City of Bonney Lake Planning Agency moved to make recommendations on the proposed comprehensive plan amendments for the City Council's ' consideration on October 16, 2002, as shown on Exhibit "A"; and - - Page 1 of 1

11 Project UGA3 - Falling Water - Recommend passage of the proposed map amendment that would add approximately 861 acres (209 parcels -484 acres 2.f which are under - applicant's ownership) to the City's UGA and planning 'area:--the applicant requested a Duplex, Mobile Home and Single-Family Residential land use designation for the entire 861 acres. The recommended land use designations are as follows: ' Duplex, Mobile Home and Single-Family Residential for all of parcel nos and and for the NE corner (approximately of total parcel) of parcel no ; Conservation/Open Space for parcel no (Creekridge Glenn Phase 1 Open Space Tract) and either side of Fennel Creek, encompassing at a minimum the creek and steep slope areas; The city previously established land use designations (adopted in 1996) for a total of 10 tax parcels on the north side of Rhodes Lake Rd. and east of Angeline Rd. Those designations are a combination of Low Density Residential, Conservation/Open Space, and Public ParkslFennel Creek Corridor. No changes, are recommended for the established designations in this area; and Low Density Residential for the remainder of the area. The proposal adequately mitigates impacts identified under Chapter BLMC, State Environmental Policy Act, and Chapter BLMC, Sensitive Areas. Further, the proposal bears a substantial relation to public health, safety and welfare and is in the best interests of the residents of Bonney Lake. Provisions for open space, drainage ways, streets and other public ways, utility services and facilities, parks and recreation facilities and school facilities will be addressed in relation to speci:fj.c. development proposals. PLANNING AGENCY FINDINGS OF FACT CITY OF BONNEY LAKE, W ASIDNGTON 2002 COMPREHENSIVE PLAN AMENDMENTS Project UGA5-Fennel Corridor - The proposal is consistent with the Bonney Lake Comprehensive Plan goals, objectives and policies, specifically, policies within the Land Use, Housing and Natural Environment Elements. Proposed amendment is consistent with the Countywide Planning Policies. The proposal adequately mitigates impacts identified under Chapter BLMC, State Environmental Policy Act, and Chapter BLMC, Sensitive Areas. Further, the proposal bears a substantial relation to public health, safety and welfare and is in the best interests of the residents of Bonney Lake. Provisions for open space, drainage ways, streets and other public ways, utility services and facilities, parks and recreation facilities and school facilities will be addressed in relation to specific development proposals. Project UGA8-Sumner School District - The proposal is consistent with the Comprehensive Plan goals, objectives and policies, specifically the following:' (1) Land Use Element Policy 2-2a. Discourage urban sprawl within the Bonney Lake undeveloped areas; and (2) Land Use Element Policy 2-3b. Encourage development in areas where adequate public facilities and services exist or can be provided in an efficient manner. Th proposed Medium Density Residential designation is consistent with CPP Policy 6.1, which requires an average net density of four units per acre. The proposal adequately mitigates impacts identified under Chapter BLMC, State Environmental Policy Act, and Chapter BLMC, Sensitive Areas. Further, the proposal bears a substantial relation to public health, safety and welfare and is in the best interests of the residents of Bonney Lake.
