2 COUNTYWIDE PLANNING COMMISSION SUMMARY OF MOTIONS December 5, 2016 COMMISSION MEMBERS PRESENT: Molly Lee, Leigh Girvin, Erik Vermulen, Emily Tracy, Marc Hogan, Drew Goldsmith, Kelly Owens, Ed Kaupas STAFF PRESENT: Lindsay Hirsh Leigh Girvin, temporary Chair, called the meeting of the Countywide Planning Commission to order at 5:33 pm Approval of Summary of Motions: The Summary of Motions of September 19, 2016 was approved unanimously as presented I. REGULAR AGENDA: PLN Amend Figures 3-2 and 3-3 of the County's Land Use and Development Code to reinstate museums in the A-1 (Agricultural) Zoning designation as a Conditional Use. Commissioner Kaupas made a motion to recommend approval to the BOCC with the following findings: 1. The proposed revisions meet the purpose and intent of the Summit County Land Use and Development Code, which is to protect, promote and enhance the public health and safety; to provide for planned and orderly development in Summit County in a manner consistent with constitutional rights of property owners; and to balance the needs of a changing population with legitimate environmental concerns. 2. The proposed amendment gives consideration to the goals and policies in the Summit County Countywide Comprehensive Plan( CCP ). Specifically the proposed amendment speaks to Goal A/Policy 4 of the Historic and Cultural Resources Element of the CCP. 3. Pursuant to the County land use statutes at C.R.S et seq. and the Local Government Land Use Control Enabling Act at C.R.S et seq., the County has broad authority to regulate the use of land and to protect areas of historical importance. The proposed amendment is in conformance with applicable State Statutes. Commissioner Tracy seconded the motion and it was approved on a unanimous (8-0) vote. II. WORK SESSION None III. DISCUSSION ITEMS: Suggested Revisions for Consideration in Next Master Plan Update The commission discussed additional methods to advertise the public meetings once the CWMP update begins in order to garner more public input. Countywide Planning Commission issues Once the CWMP update gets underway the County should research methods to further incentivize affordable housing and look into ways of taxing short term rentals. The Commission further discussed the need for a code amendment to allow guest houses (with TDR s) and make accessory apartments and caretaker units more flexible and methods to incentivize the use. 1

4 PLANNING DEPARTMENT Peak One Dr. PO Box Frisco, CO STAFF REPORT TO: FROM: FOR: SUBJECT: Countywide Planning Commission ( Commission ) Kate Berg and Dan Osborn, Senior Planners Don Reimer, Planning Director May 1, 2017 Work Session Countywide Comprehensive Plan Update Discuss project plan and preparation for May 10 th community open house PURPOSE: Per direction received from the Board of County Commissioners (BOCC), the County is initiating a public planning process to update the Countywide Comprehensive Plan in 2017, and we will then initiate subsequent public processes to update each of the four basin master plans over the next 2-3 years. To kick off the process to update the Countywide Comprehensive Plan, the purpose of the May 1 work session is to discuss the overall project plan and timeline with the Commission and to prepare for the upcoming community open house on May 10. The May 10 open house will be the first opportunity for the Commission and county staff to discuss the Comprehensive Plan update with the community and seek initial community input on the key issues and priorities to be addressed in the Plan update. PROJECT OVERVIEW: The Countywide Comprehensive Plan provides policy guidance for decisions related to land use, growth and development within the unincorporated areas of Summit County, and also addresses other key community issues that require County collaboration with the Towns and other agencies (e.g., CDOT, U.S. Forest Service). The current edition of the Plan was adopted in 2009 and has helped to guide County land use decisions and policies over the past 8 years. Master plans are updated on a periodic basis to incorporate revisions needed to address changing conditions, new socio-economic circumstances (e.g. short-term rentals, climate change, workforce housing needs), or other modifications in policy direction recommended by the community. The goal of the current Plan update is to revise the Countywide Comprehensive Plan to effectively guide development in the County over the next years. There will be many opportunities for the community to provide input to help inform this Plan update, and the County will be seeking input from the community on the key issues and priorities to be addressed in the Plan update. Purpose of the Countywide Comprehensive Plan: When reviewing the Countywide Comprehensive Plan to identify appropriate revisions and updates, it is important to keep in mind the twofold purpose of the County s master plans. 1. A Guide for Development Review - Master plans serve as advisory guides to help shape future development in a manner that is consistent with the community s stated goals and policies for appropriate future land use. In this context, they must effectively inform 1

5 developers and decision-makers (e.g., Planning Commissioners, Board of County Commissioners) on important policies to be applied in conjunction with development approvals, in order to achieve the stated community vision. 2. An Action Plan for Implementation Master plans also outline actions or implementation strategies that should be initiated by the County or other entities, in order to achieve the goals outlined in the plan. Key Policies in the Existing Countywide Comprehensive Plan: The Countywide Comprehensive Plan contains ten elements, each addressing a separate subject area, but collectively addressing our community s overall needs and desires. These elements include Land Use, Environment, Transportation, Housing, Community and Public Facilities, Design and Visual Resources, Historic and Cultural Resources, Open Space, Recreation and Trails, and Economic Sustainability. Land Use: The heart of the Plan is the Land Use Element. The Land Use Element recommends the general location of where new growth should occur in the County and provides policy guidance on how that growth should occur. Environment: The Environment Element emphasizes protection of environmentally sensitive lands and preservation of our air and water resources. Transportation: The Transportation Element provides policy direction on developing a comprehensive, safe and efficient transportation system. This element emphasizes the need to coordinate the different components of the transportation system (i.e., roads, public transit routes, bicycle and pedestrian paths and trails), and promote viable alternatives to automobile use. Housing: The Housing Element focuses primarily on providing a framework to increase the supply of housing for local residents on a countywide basis. Community & Public Facilities: This element emphasizes the need to ensure that adequate infrastructure and public services are provided as growth occurs. Design & Visual Resources: The Design & Visual Resources Element focuses on strategies to preserve the visual appearance of our existing landscapes. Historic & Cultural Resources: This element emphasizes the need to identify and protect important historic resources in the County, such as old mining buildings, community buildings, and other historic structures. Open Space: The Open Space Element recommends strategies to preserve important open space areas throughout the County. Recreation & Trails: This element focuses on the need to preserve and enhance recreational opportunities in the County. Economic Sustainability: The Economic Sustainability Element promotes opportunities to help diversify the County s economy. A summary of the key policies contained in each Element of the Countywide Comprehensive Plan is attached for the Commission s reference. 2

6 Key Project Goals: The primary goal of the Countywide Comprehensive Plan Update is to engage the community in a public process to evaluate the existing Plan and determine: What policies are still relevant and should be retained in the updated Plan? What conditions have changed in the County over the past 8 years, and what new goals and policies are needed in the updated Plan to address these changing conditions? In addition, another key goal of the Plan update is to streamline the Plan in order to make it a more concise and user-friendly document. Project Timeline: County Staff will work with the Countywide Planning Commission and other community stakeholders to update the Countywide Comprehensive Plan over an anticipated 8-month timeframe. The planning process is kicking off with the May 1 Commission work session and will extend through December TASK 1: INFORMATION AND COMMUNITY INPUT GATHERING, MAY JUNE Countywide Planning Commission Work Session May 1, 5:30pm, Buffalo Mountain Room, County Commons, 37 Peak One Drive, Frisco Public Event #1 Community Open House - Wednesday, May 10, 4:30 6:30 pm, Community & Senior Center, 83 Nancy s Place, Frisco o Introduce the community to the project, including: Purpose of the Countywide Comprehensive Plan, how the plan is used and its importance, key policies in the existing Plan Project Overview Purpose of the update, project goals, project timeline, future public input opportunities Key themes / current issues identified by the Countywide and Basin planning commissions to be discussed with the community and addressed in the Plan update Best practices comprehensive plan examples from other communities o Gather initial input on the key issues and priorities to be addressed in the Plan update. o Public outreach and advertising prior to the May 10 open house will include: s to community stakeholders and interested parties, press release, segment on SCTV County Connection May episode, event fliers, Summit Daily display ads and Explore Summit calendar item, radio ads on Krystal 93, Dish with the Commish on KSMT (Fri., May 5, 7:30am), Facebook and Twitter posts. Employers and Business Community - Summit School District, CDOT, Copper Mountain, Vail Resorts, A-Basin, Centura Health, Summit County Chamber of Commerce, small business / Main Street business representatives Town and County Staff Planning, Engineering, Open Space & Trails, Summit Stage, Public Works, Public Health, Town and County Managers Open Space & Natural Resource Management County and Town Open Space & Trails, USFS, CPW, Summit Water Quality Committee, Blue River Watershed Group, others? Planning Commission Focus Group The June Countywide Planning Commission is being planned as a Planning Commission focus group, with invitations extended to the Basin Planning Commissions, and the Town Planning Commissions. The goal will be to ensure a mix of planning commissioners with longevity and valuable historical knowledge, as well as those who bring a new, fresh perspective. Public Outreach / Community Input Table at Community Events Ongoing during May and June o County staff will be on-hand at community events throughout May and June to talk with residents about the Plan update and gather community input. County staff will be working with the Towns to identify the most appropriate events to attend for the best opportunity to talk with local residents about the project and gather public input. We are targeting a minimum of four community events, one in each of the four basins. More details will be discussed with the Commission at the May 1 work session. TASK 2: DRAFT PLAN, JULY SEPTEMBER Countywide Planning Commission July Meeting (Date TBD) project update and synopsis of community input received during Task 1 County staff will draft Plan Regular Countywide Planning Commission meetings to discuss plan update in August and September (first Monday of each month) BOCC Work Session Update prior to second community open house event (Date TBD) Send draft plan to stakeholders, interested parties, focus group participants, referral agencies for review and comment Public Event #2 Second Community Open House September (Date TBD) O Present draft master plan for community input TASK 3: FINAL PLAN, OCTOBER DECEMBER Draft Final Plan incorporating input received during Task 2 Present draft of Final Plan to BOCC and Countywide Planning Commission in November for final review 4

8 Adoption by Countywide Planning Commission at Public Hearing Target December 4 COUNTYWIDE PLANNING COMMISSION ROLE: The Countywide Planning Commission is the review authority tasked with adopting updates to the Countywide Comprehensive Plan. Over the next 8 months, the role of the Commission will include participation in the following: Monthly Commission meetings throughout the master plan update process to discuss the project at each stage, and to adopt the updated Plan once finalized. Planning Commissioners will be included on the project interested parties list and will be invited and encouraged to participate in all public meetings and events (e.g., community open houses). COMMUNITY INPUT GATHERING: As noted above, the County will be seeking input from the community to identify the key issues and priorities to be addressed in the Plan update, including input to help determine: What policies are still relevant and should be retained in the updated Plan? What conditions have changed in the County over the past 8 years, and what new goals and policies are needed in the updated Plan to address these changing conditions? Key Themes for Community Input: The Countywide and Basin Planning Commissions have preliminarily identified the following current issues to be further discussed with the community and addressed in the Plan update: Community Carrying Capacity managing traffic and congestion during peak visitation periods. Workforce Housing and Short-term Rental Impacts develop policies to provide attainable locals housing and mitigate impacts from short-term rentals and second homes. Climate Change identify strategies for reducing emissions and address impacts on wildfire, water supply, and seasonal changes to recreation. Transportation improve walkability and bikeability, public transit and parking, and wayfinding signage. Prioritize Goals, Actions/Policies create a realistic implementation plan that prioritizes the most important actions to be implemented by the County and other partner entities. Throughout Task 1, the County will gather input from the community on these and other ideas, to be incorporated into the updated Plan. PROJECT WEBPAGE: A project webpage has been created and can be viewed at The project webpage contains information on the overall project purpose and timeline, the schedule of upcoming community events, and other opportunities to provide public input. There will be an online survey linked to this webpage prior to the May 10 open house, so community members will be able to provide input if they are unable to attend any of the scheduled community events. RECOMMENDATION: Staff requests that the Commission review the information contained in this staff report and the attached documents, and come to the May 1 work session prepared to discuss the project plan and the game plan for the May 10 kick-off open house. 10 Existing 2009 Countywide Comprehensive Plan Key Policies Land Use: The heart of the Plan is the Land Use Element. The Land Use Element recommends the general location of where new growth should occur in the County and provides policy guidance on how that growth should occur. Key policies include: Focus new development within existing urban areas and maintain the character of rural areas. Maintain the current level of density in the County. Use Transferable Development Rights (TDRs) to locate density in appropriate areas. New development proposals should be sensitively designed to avoid important environmental and visual resources. Coordinate with the towns and other agencies on land use issues such as urban growth boundaries, and to ensure a generally consistent land use pattern between uses within towns, national forest and County jurisdictions. Environment: The Environment Element emphasizes protection of environmentally sensitive lands and preservation of our air and water resources. Key policies include: New development should avoid environmentally sensitive areas, such as wetlands, wildlife habitat areas, and floodplains. In cases where avoidance is not entirely possible, any impacts shall be limited and appropriately mitigated. Promote strategies to protect and enhance air and water quality. Promote energy and resource conservation. Transportation: The Transportation Element provides policy direction on developing a comprehensive, safe and efficient transportation system. This element emphasizes the need to coordinate the different components of the transportation system (i.e., roads, public transit routes, bicycle and pedestrian paths and trails), and promote viable alternatives to automobile use. Key policies include: Develop a comprehensive transportation plan to address transportation needs on a countywide basis. Promote mass transit programs and facilitate development that accommodates pedestrian and bicycle use. Housing: The Housing Element focuses primarily on providing a framework to increase the supply of housing for local residents on a countywide basis. Key policies include: Facilitate development of affordable workforce housing through incentives such as: land donation or discounted land sales; supplying or subsidizing utility taps or fees and other 1 P age

11 infrastructure requirements; expedited development review, review fee waiver or funding assistance. Collaboration & Partnerships - Work with the Summit Combined Housing Authority, towns, school district, non-profit organizations, business and other appropriate entities in a coordinated and creative manner to facilitate and provide for local resident housing. Land Banking Pursue the land banking of properties that have been identified as potential sites for affordable workforce housing in respective basin master plans. Financing The County shall continue to explore mechanisms to generate ongoing funding to support or initiate affordable workforce housing projects. The County shall continue to leverage financial resources through public/private partnerships for affordable workforce housing projects. Pursue strategies to preserve units that are now occupied by local residents as local resident housing into the future (e.g., acquisition of market-rate housing and resale/rental as deedrestricted housing, buying the right to impose deed restrictions). Work with the Summit Combined Housing Authority to maintain and expand their existing financial assistance programs which provide low interest loans for down payment assistance and for structural repair and maintenance of existing affordable workforce housing units. Create incentives to facilitate the construction of additional accessory apartments in the County, and develop strategies and incentives to help property owners legalize existing illegal/non-permitted accessory apartments. Continue to allow deed-restricted affordable housing units, created in conjunction with an upzoning, to be exempted from the need to transfer in development rights. Community & Public Facilities: This element emphasizes the need to ensure that adequate infrastructure and public services are provided as growth occurs. Key policies include: Ensure infrastructure is planned, funded and built to support new development. o The County and towns should work with infrastructure and service providers to develop capital improvement plans and equitable funding mechanisms to satisfy plan needs. o Explore the feasibility of implementing impact fees to fund additional infrastructure and offset impacts of development (e.g., roads). o Require fiscal impact studies to evaluate the off-site impacts of new development. o New growth should be responsible for funding capital improvements it requires and impacts to infrastructure (with the exception of deed-restricted affordable workforce housing). Development of community facilities and the extension of services should be carefully planned and coordinated with the towns, special districts, and appropriate agencies. o Promote cooperation between governmental entities, including sharing of services (e.g., plowing roads). o The County should work with the School District to coordinate planning for schools, parks and joint use facilities. 2 P age

12 o o o Encourage and provide for expanding health care facilities to serve area residents. Locate community facilities used by the general public so they are accessible by public transit. Encourage new and expanding development to provide for childcare needs and encourage employers to provide for the childcare needs of employees. Promote clustering of development where appropriate to provide for more efficient distribution of public facilities and services. Develop stricter water conservation measures to be applied to new and existing development (e.g., xeriscaping, low-flow toilets). Promote the practice of the Three Rs: Reduce, Reuse and Recycling, among County residents to lessen waste going to the landfill and for other environmental benefits. Design & Visual Resources: The Design & Visual Resources Element focuses on strategies to preserve the visual appearance of our existing landscapes. Key policies include: Identification and prioritization of visually important lands in the County and the use of techniques to protect those areas from development. Ensure new development is designed in a visually sensitive manner by regulating building materials and colors, building design (e.g., building mass, size and height), location of structures and landscaping, so that structures blend into the natural landscape. \ Avoid or minimize development impacts on steep hillsides and ridgelines. Promote sustainable building practices in residential and commercial development. Historic & Cultural Resources: This element emphasizes the need to identify and protect important historic resources in the County, such as old mining buildings, community buildings, and other historic structures. Key policies include: Working in conjunction with the Summit Historical Society and Colorado Historical Society, develop a comprehensive inventory of the County s historical and cultural resources (structures and sites of local, state and national historical significance). Work cooperatively with property owners to avoid development impacts to historic and cultural resources, and develop incentives to encourage the preservation of historic and cultural resources. Promote educational and interpretive efforts to provide information about the County s rich local heritage. Open Space: The Open Space Element recommends strategies to preserve important open space areas throughout the County. Key policies include: 3 P age

13 Focus o protecting open space, particularly around existing urban areas to maintain each community s individual identity. Focus on techniques to acquire and protect open space lands in a cost-effective manner. Recreation & Trails: This element focuses on the need to preserve and enhance recreational opportunities in the County. Key policies include: A need for the County to better define its role in providing developed recreational facilities. Guidelines for trails that address trail design, trail character, securing of public access, and an emphasis on providing an interconnected network of trails. Guidelines for the Recpath network and winter trail use. Economic Sustainability: The Economic Sustainability Element promotes opportunities to help diversify the County s economy. Key policies include: Continued promotion of the tourism and recreation industry. The need to develop an overall countywide Economic Strategy that identifies the types of economic opportunities the County should target and pursue in the future. 4 P age

15 Successful communities don t just happen; they must be continually shaped and guided. A community must actively manage its growth and respond to changing circumstances if it is to meet the needs of its residents and retain the quality of life that initially attracted those residents to the community.

16 Planning Commissions prepare comprehensive plans to develop a community s vision to guide development, and preserve the public health, safety, and welfare. It is a communities vision and critical road map to guide decisions about future development. Comprehensive planning ensures orderly development of land and provides consistency and surety in land use decisions.

17 The Comprehensive Plan is used by the Countywide Planning Commission, the four basin planning commissions, and the Board of County Commissioners as the official land use policy document and a guide for decisions that affect the physical development of the County. Provides policy guidance for land use, growth and development decisions within the unincorporated areas of Summit County, and also addresses other key community issues that require County collaboration with the Towns. Provides a consistent statement of the County s plans and policies for future development and Land Use Codes. It preserves and enhances the County s unique mountain character and protects its natural and recreational resources.

20 Vision: Guide future land use decisions to ensure that growth occurs in appropriate locations and that our rural mountain character is maintained. Key Goals/Policies: Focus new development within urban areas and maintain the character of rural areas. New developments should be sensitively designed to preserve important environmental and visual resources. Use Transferable Development Rights (TDR s) to locate density in appropriate areas. Defer specific land use issues and designations to basin master plans.

Amendments to the Development Code should protect wetland areas. Promote strategies to protect and enhance air and water quality. Promote energy and resource conservation.

22 Vision: Maintain and develop a comprehensive, safe, and efficient transportation system, with an emphasis on promoting viable alternatives to the automobile. Key Goals/Policies: Develop a comprehensive transportation plan to address transportation needs on a countywide basis. Encourage mass transit programs and facilitate development that accommodates pedestrian and bike use.

23 Vision: Provide for the diverse housing needs of all residents, workers, and guests in the County. Key Goals/Policies: Update the Countywide Housing Needs Assessment on a periodic basis (every 2 3 years). Conduct an evaluation of rental housing to ensure development of a wide range of housing for mixed income levels and household types. Develop incentive programs to promote affordable housing. Revise development standards, procedures or fee structures, encourage the development of local resident housing.

24 Vision: Provide consistent, reliable, and appropriate facilities for the long-term development of the County that are compatible with the mountain environment. Key Goals/Policies: Focus on coordinated planning for provision of governmental services and infrastructure in a cost efficient manner. Promotion of recycling programs to extend the life of the County landfill and to emphasize environmentally friendly solutions to waste management.

Key Goals/Policies: Identification and prioritization of visually important lands in the County and the use of techniques to protect those areas.
