9 CORRESPONDENCE (C) May 3, 2012 CFN Executive Committee Toronto and Region Conservation Authority Subject: REQUEST FOR DISPOSAL OF TORONTO AND REGION CONSERVATION AUTHORITY-OWNED LAND South of Eglinton Avenue, west of Scarlett Road (adjacent to 223 Edenbridge Drive, City of Toronto, Etobicocke York Community Council Area) Humber River Watershed I am writing this letter to the members of the Executive Committee to express my concern and opposition over the proposed disposal of approximately 2,800 ft 2 of parkland that lay in the Humber River valley and the Humber River watershed. As noted by the TRCA itself, the City of Toronto is facing ever growing challenges in maintaining possession of the limited amount of natural vegetation cover dispersed throughout the municipality. Continued urban growth in will result in the loss of 460 hectares (1,137 acres) of natural vegetation; A portion of this loss will occur in the Lower Humber River subwatershed, where the property in question is located. Given the significant development in this watershed, in addition to safeguarding this natural habitat and the crucial role it plays in the environmental, there is a growing need to identify and protect the cultural resources of these areas. In June 2008, TRCA published the Humber River Watershed Plan Implementation Guide, which listed the following recommendations as part of it watershed management strategy: 1. Protect and expand terrestrial natural cover. Land use policy, regeneration and land securement projects are the primary implementation mechanisms to achieve this set of recommendations 2. Build more sustainable new communities and retrofit older ones to improve their sustainability by improving water management and promoting more sustainable practices overall. Improving water management included managing pre-development water balance by protecting natural heritage systems, and by naturalizing urban landscaping. By relinquishing TRCA property that contains mature trees, stabilizing root systems, and pervious landscaping that infiltrates and treats the water quality of stormwater runoff that will outlet to the Humber River, the TRCA is in effect dismantling part of the natural cover that maintains the watershed. 3. Recognize the Humber s distinctive heritage through an enhanced region open space system. Securing additional lands for green space is intrinsic to supporting healthy communities in celebrating and enjoying part of Toronto s natural and cultural heritage. 148

10 Due to the significant development in the Humber River watershed, there is an urgent need to identify and protect the cultural resources of this area. According to the TRCA, of 1,401 historical sites and buildings in the Humber River Watershed, only six per cent are currently protected, under the Ontario Heritage Act (TRCA, 2012). Instead of depleting existing park land, we should be seeking to acquire additional lands throughout the city, and ensuring that parkland currently in possession of the City remains so. By selling this portion of land to a private owner, the TRCA is acting contrary to its own environmental management strategies and best management practice recommendations. In the TRCA s 2008 report, Humber River State of the Watershed Report Surface Water Quantity, it was identified that the Lower Humber is experiencing increased runoff from urban surfaces associated with upstream development. Additionally, stream flow tends to increase rapidly during storm events due to high rates of runoff, causing the potential for flooding hazards downstream. With continued natural land cover loss, mitigation actions will become more expensive and less effective; This land is not surplus; this land is an essential part of the city and one of its most valuable resources. It is existing habitat for a variety of species that are already under stress in an increasingly urban environment. Toronto is losing more green space every month, green space that keeps water and air clean, helps with climate regulation, benefits the aquatic system, promotes a natural water cycle, provides habitat for plant and animal life and supports healthy communities and provides areas for recreation and enjoyment. As an individual who specializes in water resources engineering and has studied and worked in this engineering field for over eight years, I understand the importance of maintaining Toronto s green space and protecting it from the impacts of development. It is why I urge you today, as an executive member of the board, to decline the sale of this parcel of land, and to keep it public for Toronto s residents and future residents to enjoy. I feel strongly that this should be opposed as it is in my view a. inappropriate for any private citizen to purchase our precious parkland no matter how small and b. his lack of understanding regarding conflict of interest has made it clear that Mr. Ford has no qualms about using his position for his own ends as he does not see any problem with it. I think that this is an abuse of his position and is disrespectful of his office and sets a poor precedent for the future. 14 CORRESPONDENCE (G) Gary & Bill To 03/05/ :34 PM cc Subject Re: Parkland Purchase for Mayor Ford's Security May 3,2012 Dear Sir/Madam, I have been watching on TV and reading in the papers about Mayor Rob Ford s attempt to purchase park land for security reasons so that he could build a fence. Several years ago, we contacted TRCA (when it was MTRCA) about a similar land purchase beside our home on the edge of the Don Valley in the old Borough of East York near the Leaside Bridge. We wanted to purchase the land to secure our home which had been broken into twice.the Toronto Police were contacted both times. We were told that the Conservation Authority does not sell land to individual home owners. I trust that this rule will be applied in this case and that there are not two rules: one for ordinary citizens and one for the Mayor. Dillane, Director, Finance and Business Services <jdillane@trca.on.ca> From: Chris Smith 239 Wolverleigh Blvd Toronto, ON M4C 1S Mr Dillane; I am writing to you regarding item EX8.2, which is to be addressed at the Executive Committee meeting on the morning of Friday, May 4th, My concern is that the supporting materials for this item are incorrect. In the Executive Committee Agenda, it states that the matter is regarding "the subject parcel of TRCA land situated south of Eglinton Avenue, west of Scarlett Road (adjacent to 223 Edenbridge Drive)". Further more, it states that "A plan illustrating the location of the subject lands is attached." This plan appears on page 34 of the agenda. The plan has a clearly marked area, described as "SUBJECT PROPERTY", but there is no way to determine the size or shape of the parcel of land that is to be the subject of this decision. Fortunately, there is a City of Toronto online site with accurate property boundaries, the TOMAPS application (see references). If we zoom in to the area in question in EX8.2, options that allow turning on property boundaries and property numbers will appear. If we compare this map with the TRCA map, it can be easily seen that the TRCA map "subject property" is in fact, 223 Edenbridge Drive. The parcel of land "adjacent to 223 Edenbridge Drive" is not marked on this map in any way. I have enclosed both a screenshot of the TOMAPS area in question, and an image with the TRCA plan overlaid on the TOMAPS image. From a comparison of these two, one can see that this is not a matter of mapping accuracy. The TRCA map is quite accurate in showing 223 Edenbridge. It seems a reasonable expectation that the plan should also show the subject parcel of land, since that is the entire reason for this item coming before the Executive Committee. As the plan is currently drawn, there is no way to determine - even approximately - the area or shape of the parcel of land under consideration. 154

16 Decisions of the Executive Committee need to be beyond reproach, and the starting point for that is accurate materials presented to the Committee and available to the people of the Toronto region. I realize that people may attend the meeting tomorrow expecting this item to be discussed, and that is unfortunate. It is more important that proper documentation be used for notable decisions than for the Committee to act in the interests of short-term convenience. I would suggest that item EX8.2 be held over until the Executive Committee meeting 4/12 on June 1st, 2012, so as to provide staff with the opportunity to create and distribute a more appropriate plan in support of this decision. Finally, I would appreciate an acknowledgement of the receipt of this , so that I can be certain this issue is being addressed with due care. 19 SECTION I - ITEMS FOR AUTHORITY ACTION RES.#B45/12 - Moved by: Seconded by: CORPORATE LOGO Updating the Toronto and Region Conservation Authority corporate logo and wordmark. Michael Di Biase Colleen Jordan THE EXECUTIVE COMMITTEE RECOMMENDS THAT the new Toronto and Region Conservation Authority (TRCA) corporate logo and wordmark be approved. CARRIED BACKGROUND The main TRCA visual signature is the corporate logo and accompanying wordmark. The current logo, commonly called the chevron, was officially adopted in It was designed, as described in the rationale accompanying its introduction, to present a meaningful image of the Authority and spell out what conservation is all about. The principal colours of blue and green represent grass, trees and water the three most common components associated with conservation. The wordmark that accompanies the logo has evolved over the decades, driven principally by the name change from Metropolitan Toronto and Region Conservation Authority to Toronto and Region Conservation Authority and most recently with the inclusion of for The Living City. The most recent version has been in use since In 2011 The Living City Foundation adopted a new logo and wordmark as part of a re-launch of the Foundation. In order to strengthen the presence of the term The Living City, TRCA staff applied the same visual treatment of the words The Living City in the Foundation s logo, to all TRCA initiatives associated with the term, including The Living City Campus at Kortright. This process led to a re-examination of the TRCA logo and wordmark design. In assessing its effectiveness, the staff identified opportunities to redesign the current logo and workmarks to better represent TRCA today. To capitalize on this opportunity, staff developed a new version of the logo and wordmark. This version was shared with staff from across the organization and from external communications and design experts, including the principals at Stephen Thomas Ltd., designers of The Living City Foundation logo. The great majority of responders, including from the experts, endorsed the design. RATIONALE In developing an updated visual identifier staff considered three principal design criteria: fit with the organization s vision and mandate; ability to be easily recognized; integrates with other logos and designs TRCA currently has. The updated TRCA visual signature honours the organization s heritage while acknowledging its deepening role in the community. 158

20 Each element in the logo is a part of TRCA: the circle is a common symbol of communities; the green leaf as a symbol of TRCA's objective to support biodiversity; the blue wave as a symbol of TRCA's objective to support healthy rivers and shorelines; the yellow hand as symbol of TRCA's objective to support sustainable communities; the black stylized T that pulls and integrates the three objectives together in a holistic and complete way. The T can also be a symbol for a trail system, a river and a partnership, all those things that TRCA needs to be successful. TRCA s visual signature is strengthened by the use of high impact, contemporary fonts for ease of recognition and distinctiveness. The font used for The Living City is consistent with that used in all other initiatives that use The Living City label, thereby connecting all initiatives that support The Living City and strengthening their combined presence and impact. The word Conservation is bold, active and memorable as a statement of the cause. The colour version of the proposed logo and wordmark is included with the agenda package. DETAILS OF WORK TO BE DONE The first step to adopting the updated visual signature is to prepare guidelines for its use that address design factors such as spacing requirements around the logo and coloured backgrounds. Phase one of the roll-out will be completed in 2012 and will consist of replacing the current logo on all TRCA web pages, all new printed materials and signs, and inclusion of the new logo on a new road-facing sign at TRCA Head Office. In 2013, the logo will be replaced on major road-facing signs at TRCA conservation areas and on staff uniforms. Logo replacement on letterhead, business forms and business cards will occur as existing stocks run out and they are re-printed. FINANCIAL DETAILS All design work associated with this initiative has been and will continue to be completed by staff designers at no additional cost to TRCA. Replacement of the logo on TRCA web pages will also be completed by TRCA staff. The cost for new and replaced road-facing signs is estimated at $10,000 in 2012 and $25,000 in funding for this initiative is identified in the Operating Budget and 2013 expenses will be budgeted for in the 2013 Operating Budget. CARRIED BACKGROUND The two policies have been developed as part of a review of all TRCA HR policies and the comparison of TRCA policies with others including NGO's, municipalities and conservation authorities to ensure that TRCA is consist with standards in the public sector. RATIONALE The protection of whistle blowers is included in the TRCA Code of Conduct. The policy outlined in Attachment 1 is recommended to further support and understand the nature of that protection. The Employee Participation in Municipal, Provincial and Federal Elections Policy as outlined in Attachment 2 has been developed to formally approve as policy the informal guidelines for employees that is currently the practice at TRCA. There are no issues that have arisen to require the approval of these policies. This is simply part of TRCA's continuing commitment to integrity and transparency in our day-to-day operations. 22 Attachment 1 Whistle Blower Protection Policy Policy Employees who, in good faith, report wrongdoing or perceived wrongdoing, shall at all times be protected. Definitions "Employees" means include all TRCA employees; full time, part time and contract and paid or unpaid interns and registered volunteers. "Wrongdoing" means instances of fraud and waste and refers collectively to any perceived illegal or inappropriate conduct including but not limited to: violation(s) of TRCA policy and Authority direction; breaches in conflict of interest and the Employee Code of Conduct; misuse of TRCA funds or assets including intellectual property; gross mismanagement based on willful, intentional acts or negligence. "Whistle Blower" means a TRCA employee who in good faith reports wrongdoing to the appropriate authority, in an attempt to end or rectify the wrongdoing. "Reprisal" means any harassment, intimidation, dismissal, suspension, demotion, discipline or threat of dismissal, suspension, demotion or discipline of an employee as a direct result of the employee, in good faith disclosing a wrongdoing or perceived wrongdoing. When an employee believes that he or she has witnessed a significant wrongdoing, he or she must disclose his or her concerns and observations to his or her supervisor, manager or director and Human Resources. HR will conduct an investigation in compliance with the Employee Code of Conduct. If the supervisor, manager or director or HR are parties in the investigation then the employee must disclose his or her concerns to the Chief Administration Officer and if the CAO is a party in the investigation, the employee must disclose his or her concerns to the Executive Committee through the Chair. If an employee knowingly makes a false complaint in bad faith or who knowingly makes a false or misleading statement that is intended to mislead the investigation of a complaint, that employee will be subject to a disciplinary process up to and including dismissal as per the Employee Code of Conduct. For further information on the investigation process, please refer to the Employee Code of Conduct. April 5,

23 Attachment 2 Policy Employee Participation in Municipal, Provincial or Federal Elections Policy All TRCA Employees must ensure that any involvement in a municipal, provincial or federal election campaigns does not adversely affect their ability to perform their duties as employees of TRCA. Restrictions address the need for employees to be, and to appear to be, impartial. Definitions "Employees" means all TRCA employees: full time, part time and contract employees, as well as paid or unpaid interns and registered volunteers. "Municipalities" means local and regional municipalities within TRCA jurisdiction, including City of Toronto, the Region of York (the City of Vaughan, Town of Richmond Hill, Town of Markham, Townships of King, Town of Aurora and the Town of Whitchurch-Stouffville), the Region of Peel (City of Brampton, City of Mississauga, Town of Caledon), the Region of Durham (Town of Ajax, City of Pickering and Township of Uxbridge), the Township of Adjala-Tosorontio and the Town of Mono. The "provincial" election activities only include those in Ontario and the "federal" election activities only include those in Canada. 1. All TRCA employees are encouraged to vote during elections. 2. No TRCA employee may canvass or work in support of a municipal, provincial or federal candidate during working hours. Working hours do not include vacation time or personal time on leaves of absence. 3. TRCA Employees (other than those identified in Item 4 below) may engage in political campaign activities, outside of working hours and on vacation or personal leaves of absence. These activities include being a registered member of a political party, canvassing, attending an all candidates meeting and making donations to campaigns or party funds. 4. The following TRCA employees are restricted in their participation in municipal, provincial or federal elections to voting, attending all candidates meetings and donating to campaign funds: The Chief Administrative Officer/Secretary-Treasurer; any member of Directors Committee; senior staff who are in direct contact with elected officials of municipal or regional councils, the Provincial Legislature or Federal Parliament and/or their standing committees where TRCA related issues may be addressed or decisions affecting TRCA, may be made. 162

24 5. TRCA staff working on behalf of a municipal, provincial or federal candidate shall not use any TRCA resources e.g. office equipment. 6. No TRCA employee shall wear any identifiable TRCA uniforms or other identification while campaigning for a municipal, provincial or federal candidate or use their title or position with TRCA in a way that would lead a member of the public to infer that TRCA is endorsing the candidate or party. 7. No TRCA employee shall wear or affix to TRCA clothing buttons or other promotional media that support any political candidate or party. 8. No TRCA employee shall coerce another employee nor shall a supervisor compel staff to engage in political activities. Such actions on the part of employee or supervisor shall be subject to disciplinary action, up to and including dismissal. 9. 26 Since 2001, Toronto and Region Conservation Authority (TRCA) has been leasing to the Town of Whitchurch-Stouffville a parcel of land in the Bruce's Mill Conservation Area for four mini-soccer fields. The master plan for Bruce's Mill Conservation Area was completed and endorsed by TRCA in November The soccer fields are located in an area that has been designated as Public Use in the master plan. The Public Use management zone allows for recreational and educational uses, facilities or services and may accommodate low, moderate or high intensity public use. The Master Plan s recommendation for these fields is that they remain available as multi-purpose recreational activity fields. The multi-purpose recreational activity field uses continue to be refined. No specific opportunity or use has been determined or specified other than the soccer use. Given this situation and to continue to allow for flexibility, staff is recommending that the lease with Whitchurch-Stouffville be extended for one year with two one year renewal options. A map showing the lands subject to this proposal is attached. FINANCIAL DETAILS The lease rate for 2011 was $6,900. Staff is proposing a lease rate of $7,100 for this year. CARRIED BACKGROUND TRCA, with the support of our member municipalities, has developed and implemented a Regional Watershed Monitoring Network within TRCA's area of jurisdiction. The network has been designed to be a comprehensive, integrated and coordinated system which fulfills the needs of the Remedial Action Plan (RAP), TRCA, and the individual watershed and waterfront councils and alliances, while furthering the interests of municipal, provincial and federal partners. The Regional Watershed Monitoring Program includes aquatic habitat and species, fluvial geomorphology, terrestrial natural heritage (flora and fauna), surface water quality, surface water quantity (flow and precipitation) and groundwater. The surface water quantity component, which includes precipitation and stream flow data, is critical to TRCA's flood forecasting and warning program and is also used by municipalities and consultants for stormwater management planning, municipal infrastructure design and watershed modelling. The focus of this assignment is to retain a consultant for one year to maintain, monitor and archive stream flow data for 23 gauges within TRCA's entire stream gauge network. The consultant will also continue to develop stage/discharge relationships for each gauge and train TRCA staff to complete these tasks independently is the last year TRCA will be using outside contractors for the monitoring and maintenance of the stream gauge network. TRCA will be maintaining all components of the stream gauge network internally starting in

32 RATIONALE Historically, the majority of gauging has been carried out by Environment Canada, through their Water Survey Canada (WSC) division for stream gauge monitoring. Outside of Environment Canada's objectives, TRCA identified the need to increase the knowledge base of TRCA's watersheds by increasing the number of gauges and expanding the network, especially on smaller watercourses that could be affected by development. The availability of private contractors who undertake open channel water quantity work remains limited in this field. The methodology for collecting stream flow data is complex. While some consulting firms offer a service of flow measurement in storm and sanitary sewers, very few are able to monitor open channel flows to Environment Canada standards. In 2007, OHS participated in a competitive bid process to provide these services to TRCA and has historically been awarded the contract for the following reasons: OHS has successfully monitored and maintained over a hundred stream gauges throughout Ontario including TRCA's stream gauge network for the past twelve years; existing stage/discharge curves could be compromised if other contractors took over the network; OHS conducts all field work and data processing for TRCA and has gained experience in TRCA monitoring needs and objectives, location of the existing stations, and has provided technical expertise regarding various types of monitoring equipment; OHS is familiar with the set-up, downloading and Serial Data Interface (SDI) sensor programming of the Sutron 9210 datalogger used by TRCA at some of the stream gauge stations; TRCA is planning to take over monitoring the stream gauge network in 2013 and OHS has agreed to train staff in the methods of natural open channel flow measurement and to author a comprehensive operations manual to allow staff to continue providing accurate flow data to TRCA's internal and external clients. TRCA has provided a detailed task list to OHS for which they have provided a quote of $ plus HST. Staff is of the opinion that this represents good value for the extent of work requested. OHS has proven their experience in the field of open channel flow monitoring and has successfully and effectively provided TRCA with these services for the past twelve years. Therefore, staff recommends that the project be a sole source contract with OHS as per Sections and of TRCA's Purchasing Policy as follows: The goods and services are only available from one source or one supplier by reason of: Need for compatibility with goods and services previously acquired and there are no reasonable alternatives, substitutes or accommodations The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier. 34 BACKGROUND This request is being brought to the attention of the Executive Committee in accordance with Resolution #26, adopted by TRCA at Authority Meeting #1/91, held on February 22, TRCA staff has been approached by Ross Vaughan representing Robert and Renata Ford owners of a residential property at 223 Edenbridge Drive. Robert and Renata Ford are requesting that the subject parcel of TRCA land situated south of Eglinton Avenue, west of Scarlett Road (adjacent to 223 Edenbridge Drive) be sold for the purpose of adding the parcel to their residential lot. CARRIED BACKGROUND In November 2011, Toronto and Region Conservation Authority s general contractor DDR Landscaping Contractors Ltd., now known as Tannenbaum Landscape and Design Inc., commenced the construction of an Engineered Mechanically Stabilized Earth (MSE) wall, as part of the remedial works associated with the Troutbrooke Slope Stabilization Project. During construction several unforeseen issues arose affecting construction of the MSE wall, which have impacted the overall scope of work and construction schedule. These issues included but were not limited to: Preparation of the base of the MSE wall determined that native competent soils were deeper in several locations than predicted based on the results of the preconstruction borehole investigations, requiring additional excavation and testing. Five existing structures adjacent to the MSE wall were determined or suspected to be failing and required additional design, field investigations and replacement, expanding the scope of work. Unseasonable winter weather conditions including heavy rains caused construction delays and localized slope failures that had to be addressed, which have extended the overall length of the expected construction period. RATIONALE In September 2011, at Authority Meeting #8/11, Resolution #A164/11 was approved which provided authorization to TRCA staff to retain Terraprobe through a sole source agreement based on their familiarity with the slope conditions and understanding of the problem from the assessments they completed in 1991, 2009 and 2010; their involvement throughout the Class Environmental Assessment process; their design of the remedial works; and the need to complete inspections and monitoring during construction to ensure the Engineered MSE wall is installed as designed. TRCA staff reviewed Terraprobe s proposed fees, it was concluded that the fees were appropriate, and reflected the efforts the firm would be providing during the construction phase of this project. 175

37 Based on the change in the scope of work and extended length of construction, additional design, testing and inspection costs are anticipated during the remaining construction period. To ensure that the remaining construction of the MSE wall proceeds with verification of the construction by the designing engineer and that additional engineering issues can be promptly addressed should they arise, staff recommend that the amount of the Construction Inspection and Testing contract be increased by $35,000, plus HST, for a total cost not to exceed $84,900, plus HST.
