Jack Heath Suzan Hall THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS The Earth Rangers Foundation (Earth Rangers) entered into a lease of certain lands within the Kortright Centre for Conservation, City of Vaughan, with Toronto and Region Conservation Authority (TRCA) for the construction and operation of a wildlife veterinary and rehabilitation centre; WHEREAS TRCA is in receipt of a request from Earth Rangers to amend the leased area. THEREFORE LET IT BE RESOLVED THAT the leased area be amended as follows: (1) add 2,949 square metres to the leased area as shown on the survey sketch prepared by MMM Group dated December, 2008; (2) delete 3,907 square metres from the leased area as shown on the survey sketch prepared by MMM Group dated December, 2008; THAT Earth Rangers be responsible for all costs related to amending the lease; THAT an archaeological review is to be completed at the expense of Earth Rangers with any mitigative measures being carried out to the satisfaction of TRCA; THAT the granting of the lease be subject to any Planning Act approvals that may be required; THAT the granting of the lease be subject to the approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act. R.S.O. 1990, chapter C.27 as amended; 1069

5 AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to implement the lease amendment, including the obtaining of necessary approvals and the signing and execution of any documents. CARRIED BACKGROUND At Authority Meeting #6/01, held on July 27, 2001, under Resolution #A139/01, the Authority directed staff to enter into a lease of certain lands within the Kortright Centre for Conservation, City of Vaughan, with The Earth Rangers Foundation for the construction and operation of a wildlife veterinary and rehabilitation centre. The lease was signed on August 1, At Authority Meeting #6/02, held on June 21, 2002, under Resolution #A153/02, the Authority approved the building, site plan and trail plan associated with the Earth Ranger Centre (ERC). The Earth Rangers Foundation completed the construction of the ERC and veterinarian residence in 2004 and began operations. The ERC building is a landmark in Canada for energy efficiency and has been recognized for outstanding leadership and design related to sustainable energy practices. In May of 2006, the Earth Rangers Centre received a Leadership in Energy and Environmental Design (LEED) Gold designation from the Canada Green Building Council. The Earth Rangers mission is to inspire children with a lasting passion to build a better future. In order to achieve this they are focusing on three areas: school programs featuring Animal Ambassadors (features non-releasable animals), outdoor leadership camps and environmental technologies at the ERC. In the Fall of 2006, The Earth Rangers Foundation decided to transfer their wildlife hospital to the Toronto Wildlife Centre and focus the ERC programs on living responsibly and transforming the ERC into a showcase for sustainable technologies and practices. The ERC will continue to house their Animal Ambassadors and provide educational opportunities. At Authority Meeting #1/07, held on February 23, 2007, under Resolution #A17/07, staff was directed to submit a bid to the World Green Building Council to develop and support a Secretariat to be located in The Living City Campus at Kortright. TRCA's bid was successful. As part of the efforts to transform the ERC, The Earth Rangers Foundation agreed to lease approximately 4,200 square feet of the ERC to the World Green Building Council, to support a Secretariat. Earth Rangers programming has grown to the point where their parking is no longer adequate and TRCA is in receipt of a request to increase the size of their parking lot. As a result, it is proposed that 2,949 square metres be added to their current leased area. In exchange, Earth Rangers is prepared to remove 3,907 square metres from the leased area as shown on the attached sketch. The parking lot will be enhanced with a ground source heat pump loop, four 10kw solar photovoltaic trackers and the surface will be permeable pavers. The design will minimize tree and earth removal. A tree relocation and replacement plan will be prepared to the satisfaction of TRCA. The Humber Watershed Alliance, at its meeting held on October 21, 2008, adopted resolution #G45/08 as follows supporting the proposed parking lot expansion: 1070

6 THAT the Humber Watershed Alliance members support the proposal by Mr. Schad to expand the parking facility at Earth Rangers, in a northerly direction, by 1,500 square metres in exchange for 4,500 square metres of TRCA land which will be removed from the existing lease agreement; THAT solar panels be installed in the parking lot to generate education opportunities and energy which will be used in the Earth Rangers facility; THAT permeable pavement be used in the parking lot as a preferred sustainable building practice; THAT replanting and landscaping be undertaken in all disturbed areas to the satisfaction of TRCA; AND FURTHER THAT the expansion of geothermal heating at the facility be endorsed to further reduce heating and cooling costs. FINANCIAL DETAILS Earth Rangers is responsible for all costs related to amending the leased area and for all the construction, planting compensation and maintenance costs related to the expanded parking lot. All terms and conditions of the 2001 lease, including rent, remain unchanged. Jack Heath Reenga Mathivanan THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS the Town of Whitchurch-Stouffville has requested an additional extension to the lease for soccer fields within the Bruce s Mill Conservation Area, south of Stouffville Sideroad and east of Warden Avenue; THEREFORE LET IT BE RESOLVED THAT the lease with the Town of Whitchurch-Stouffville for soccer fields at Bruce's Mill Conservation Area be extended until December 31, 2010; AND FURTHER THAT authorized officials be directed to take whatever action is necessary to finalize the lease extension, including the obtaining of any approvals and signing and execution of documents. CARRIED BACKGROUND At Authority Meeting #2/07, held on March 30, 2007, Resolution #A46/07 was approved as follows: THAT WHEREAS the Town of Whitchurch-Stouffville has requested an additional extension to the lease for soccer fields within the Bruce s Mill Conservation Area, south of Stouffville Sideroad and east of Warden Avenue; THEREFORE LET IT BE RESOLVED THAT the existing lease be extended for an additional 2 year period; AND FURTHER THAT the appropriate Toronto and Region Conservation Authority (TRCA) officials be authorized and directed to take whatever action is necessary to finalize the transaction, including the obtaining of any approvals and signing and execution of documents. In 2001, TRCA entered into a lease for a three year period with the Town of Whitchurch-Stouffville for the use of a parcel of land in the Bruce's Mill Conservation Area for four mini-soccer fields. In 2003 the lease was extended for an additional 3 year period and in 2007 the lease was extended for an additional 2 years. 1073

9 The master plan for Bruce's Mill Conservation Area was initiated in 2004 and it is anticipated that it will be completed early this year. The soccer fields are located in an area that has been designated as a public use zone in the draft master plan. The public use management zone allows for recreational and educational uses, facilities or services and may accommodate low, moderate or high intensity public use. Through the Public Use and Recreation Plan component of the draft master plan, the site is further designated to be used as an active, nature-based recreation area. The intent is to use these open fields on the west side of the property for an active recreational use, such as a campground, equestrian facility, bike facility, etc.. No specific opportunity or use has yet been specified. Given that the eventual plan for this area is conversion to a larger, active use area, staff is recommending that the period of the extension be kept to a minimum. Town of Whitchurch-Stouffville staff has requested an extension until December 31, A map showing the lands subject to this proposal is attached. FINANCIAL DETAILS The lease rate for 2008 was $6,300. Staff is proposing a lease rate of $6,500 for the first year of the extension and $6,700 for the second year. 11 RES.#B174/08 - Moved by: Seconded by: CITY OF BRAMPTON Request for a permanent easement for a stormwater management facility located south of Queen Street East and west of The Gore Road, in the Claireville Conservation Area, City of Brampton, Region of Peel, CFN Receipt of a request from the City of Brampton and Orchard Ridge (Brampton) G.P. Inc. to provide a permanent easement for a stormwater management facility located south of Queen Street East and west of The Gore Road, in the Claireville Conservation Area, City of Brampton, Humber River watershed. Jack Heath Maja Prentice THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Brampton for a stormwater management facility which will assist Orchard Ridge (Brampton) G.P. Inc. with their development in this vicinity; WHEREAS it is in the opinion of TRCA that it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the City of Brampton and Orchard Ridge (Brampton) G.P. Inc. in this instance; THEREFORE LET IT BE RESOLVED THAT a permanent easement containing 6.03 acres (2.44 hectares), more or less, be granted to the City of Brampton for a stormwater management facility to facilitate the development of adjacent lands owned by Orchard Ridge (Brampton) G.P. Inc., said land being part of Lot 4, Concession 9, City of Brampton, Regional Municipality of Peel, subject to the following terms and conditions: (a) The easement price is $1,203, which is to be paid by Orchard Ridge (Brampton) G.P. Inc. to TRCA, plus all legal and survey costs incurred to complete the transaction; (b) In addition, Orchard Ridge (Brampton) G.P. Inc. will provide the following restoration enhancements; (i) buffer planting along the west limit of the subdivision; (ii) tertiary wetland enhancement; and (iii) development and construction of an off-site wetland and restoration project; (c) All disturbed areas are to be restored to the satisfaction of TRCA as soon as possible after completion of construction; (d) Sediment control measures in a manner satisfactory to TRCA are to be practiced during construction; (e) Orchard Ridge (Brampton) G.P. Inc. shall monitor the effectiveness of the facility for a two year period following construction; 1076

12 (f) The City of Brampton is to be responsible for all repairs and/or maintenance of the stormwater management facility which may be required in perpetuity and for indemnifying TRCA from any and all claims arising from the construction and payment of all taxes; (g) An archaeological investigation is to be conducted before any site disturbance with any mitigative measures required being carried out all at the expense of Orchard Ridge (Brampton) G.P. Inc. to the satisfaction of TRCA; (h) Any additional considerations as deemed appropriate by TRCA staff or its solicitor. THAT said easement be subject to an Order in Council being issued in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended; AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to implement the easement agreement, including the obtaining of necessary approvals and the signing and execution of any documents. CARRIED BACKGROUND The proposed stormwater management facility will service lands owned by Orchard Ridge (Brampton) G.P. Inc. located south of Queen Street East and west of The Gore Road, in the Claireville Conservation Area of the City of Brampton, Humber River watershed. In addition, an adjacent industrial subdivision which was developed prior to implementation of stormwater management best practices, will be connected and treated by the facility. In accordance with TRCA guidelines ''Use of Authority Owned Lands For Storm Water Management" approved at Authority Meeting #11/92, held on January 22, 1993, the proponent has demonstrated that the proposed location on TRCA-owned land is reasonable and all technical requirements of TRCA staff has been satisfied. A detailed design will be carried out prior to construction of the pond, and a permit will be required under Ontario Regulation 166/06. The Orchard Ridge (Brampton) G.P. Inc. hosted a Community Information Session to explain the proposed application on June 7, 2005 and the City of Brampton held a public meeting on December 11, Also, the proposal was reviewed by at the Claireville Subcommittee on September 3, The Minutes of the subcommittee meeting were received by the Humber Watershed Alliance at Meeting #4/02, held on October 22, The subject land is part of a larger parcel acquired from the Favorite Construction Company Ltd. under the Claireville Dam & Reservoir Project on November 1st, Staff has carried out negotiations with representatives of the developer and respectfully submit that the compensation package relating to the 6.05 acres (2.44 hectares) easement, is fair and reasonable. 1077

13 The total compensation package includes $1,203, for purchase of the permanent easement and restoration enhancements estimated to cost $118,000. The enhancements will include: (i) buffer planting along the west limit of the subdivision; (ii) tertiary wetland enhancement; and (iii) development and construction of an off-site wetland and restoration project. It is proposed that Orchard Ridge (Brampton) G.P. Inc. carry out terms (i) and (ii) based on plans approved by TRCA and that item (iii) will be a cash payment to TRCA at the time the permit under O. Reg. 166/06 is issued. FINANCIAL DETAILS It is proposed that the compensation obtained from this easement be utilized for the purchase of priority properties under the 'Greenlands Acquisition Project for '. Ron Moeser Reenga Mathivanan THE EXECUTIVE COMMITTEE RECOMMENDS THAT the roster of preferred advertising vendors for Toronto and Region Conservation Authority's (TRCA) advertising requirements from January 1, 2009 to December 31, 2009 be established; THAT the total cost of services contracted to the preferred advertising vendors not exceed $300,000, plus applicable taxes; AND FURTHER THAT staff conduct a review of the performance of the individual vendors to determine any changes to the roster and budget allocation in CARRIED BACKGROUND TRCA uses many advertising vendors for the promotion of activities and communication with key audiences. TRCA's criteria for selecting vendors includes the ability to reach target audiences effectively, price, reliability, quality of service and opportunities for value added promotion. 16 These vendors provide advertising services to promote facilities, events, initiatives, public meetings and awareness of environmental issues. If it is determined that these vendors do not supply the best combination of reach, quality, service and price for a particular product, staff may use the purchasing policy to source vendors. Pursuant to Ontario Regulation 166/06, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. 17 CITY OF BRAMPTON BELL CANADA To construct, reconstruct, erect or place a building or structure on Queen Street East, West of Centre Street, in the City of Brampton, Etobicoke Creek Watershed as located on the property owned by Bell Canada. The purpose is to undertake works within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to facilitate the installation of an underground utility corridor associated with a municipal Road Occupancy and Access Permit. The permit will be issued for the period of January 16, 2009 to January 15, 2011 in accordance with the following documents and plans which form part of this permit: Plan 401, prepared by Plantec Consulting Engineers, dated March 10, 2008, Revision No. 3, revised on December 12, 2008, stamped received by TRCA Planning & Development staff on December 19, 2008; Plan 402, prepared by Plantec Consulting Engineers, dated March 10, 2008, Revision No. 3, revised on December 12, 2008, stamped received by TRCA Planning & Development staff on December 19, RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to facilitate the installation of an underground utility corridor on Queen Street East, west of Centre Street, in the City of Brampton. The utility corridor will consist of the installation of conduit portions on both the east and west side of the Etobicoke Creek under an existing sidewalk and will utilize an existing utility corridor located on the Queen Street bridge in order to cross Etobicoke Creek. The installation of the utility corridor will be installed via directional drilling within an existing telecommunications manhole. As such, there are no ecology, geotechnical, hydrogeological, or flooding concerns with this application. Control of Flooding: The proposed works will utilize an existing telecommunication manhole for installation. As such, there will be no impacts to the storage and/or conveyance of flood waters. Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns anticipated with this project. 1082

18 Conservation of Land: No significant vegetation will be removed as a result of construction. All disturbed areas will be restored with a native, non-invasive seed mix in accordance with TRCA's guidelines. Plantings As no vegetation is to be removed by the proposed works, plantings are not required. Policy Guidelines: This proposal is in conformity with Section Infrastructure and Servicing - of the Authority's Valley and Stream Corridor Management Plan (VSCMP). To construct, reconstruct, erect or place a building or structure on Lot 118, Plan 43M-1778, (26 Scotchmere Crescent), in the City of Brampton, Humber River Watershed as located on the property owned by Wood-Haven Homes Incorporated. The purpose is to undertake works in a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a square metre (2,950 sq. ft.) single family dwelling associated with a minor variance application and building permit. The permit will be issued for the period of January 16, 2009 to January 15, 2011 in accordance with the following documents and plans which form part of this permit: Sheet No. 118, Siting and Grading Plan, prepared by Hunt Design Associates Inc., dated September 5, 2008, stamped received by TRCA Planning& Development staff on December 12, RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose is to undertake works in a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a square metre (2,950 sq. ft.) single family dwelling located at 26 Scotchmere Crescent, in the City of Brampton. The subject property is located within an approved residential subdivision (Plan 43M Riverstone Phase II) for which a TRCA permit was previously issued (Permit #C06-625). This previous permit was for the subdivision grading and infrastructure works only and not for the construction of the dwelling associated with this application. The implementing Zoning By-law for the subject property requires a 7.5 metre (24.61 ft.) structural setback for all buildings and structures adjacent to the buffer block and valleylands to the rear of the subject property. As requested 1083

19 through an associated Minor Variance Application (City File #A08-207), a 7.0 metre (22.96 ft.) setback is proposed to the adjacent buffer block at the rear of the subject property.
