The purpose is to undertake the major rehabilitation of Edenbridge Drive from Bearwood Drive to Scarlett Road. Works include the replacement of the existing sanitary sewer, watermain and the construction of a new storm sewer. No in-water works are associated with this proposal. 124 IMPERIAL OIL LIMITED To temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse west of Weston Road south of Lanyard Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed as located on the property owned by Hydro One. The purpose is to undertake maintenance works to restore the minimum depth of cover over an Imperial Oil Pipeline. Works will include the excavation of the existing pipeline within Emery Creek and the placement of rip-rap to protect the subsurface structure. A Fisheries and Oceans Canada (DFO) Letter of Advice will be issued by TRCA for this project. 126

2 CITY OF TORONTO [TORONTO AND EAST YORK COMMUNITY COUNCIL AREA] EX10.60 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump, or remove any material originating on the site or elsewhere between Rosedale Valley Road and the east side of the Don Valley Parkway, in the City of Toronto (Toronto and East York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto and TRCA. The purpose is to undertake maintenance to an existing 400mm watermain crossing the Lower Don River. Works will involve relining the watermain in four locations. A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO) for this project. 128 CITY OF VAUGHAN EX10.61 TRIBECCA DEVELOPMENT CORPORATION To change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units and alter a watercourse on Lot 43, 19, Plan 4061, 3319, (Pondview Road), in the City of Vaughan, Don River Watershed as located on the property owned by City of Vaughan. The purpose is to construct a new headwall and outfall associated with stormwater management infrastructure improvements within a Regulated Area of the Don River watershed between Thornridge Drive and Pondview Road in the City of Vaughan. 130 TOWN OF RICHMOND HILL EX ONTARIO LIMITED To construct, reconstruct, erect or place a building or structure, change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 56, Concession 1 EYS, (360 19th Avenue), in the Town of Richmond Hill, Rouge River Watershed as located on the property owned by Ontario Limited. The purpose is to undertake site preparation and grading, temporarily or permanently place materials originating from the site or elsewhere, and to construct the appropriate sediment and erosion controls, in support of draft approved plan of subdivision 19T(R)

(WILD WATER KINGDOM) Deferral of 2012 Rent KEY ISSUE Recommends acceptance of proposal from WWK Recreation Inc. for deferral of 2012 rent. RECOMMENDATION THAT staff be directed to take the action necessary to implement a proposal for deferral of the 2012 rent for WWK Recreation Inc.; AND FURTHER THAT the deferral of rent be subject to any terms and conditions required by Toronto and Region Conservation Authority (TRCA) staff and solicitors, including any required third party approvals and agreements. RATIONALE TRCA is in receipt of a written request from WWK Recreation Inc. for the deferral of the balance of 2012 rent. The tenant is requesting the deferral of payment for the following reasons: (1) WWK Recreation Inc. is still being impacted by the recovering economy (2) the sports dome bookings for the fall of 2011 and the winter/spring of 2012 were significantly reduced because of the loss of the Sports Dome general manager, and (3) the opening of a zip-line and driving range, as new attractions, for 2012 were delayed until August resulting in a significant reduction in projected revenue. WWK Recreation Inc. advises significant efforts are being made to add to WWK's revenue capacity beyond the summer months when the water park operates. Staff has determined the final amount due and owing to TRCA as of September 3, 2012 is $275, plus interest and applicable taxes. Under the terms of the existing lease, interest is payable on deferred rent in the amount of prime plus 1%. Although the tenant has a long history of not meeting payment due dates, rent for the leased lands has always been paid and staff continues to have a good working relationship with the owner/manager. The following is payment schedule proposed by WWK Recreation Inc.: monthly payments of $75,000 commencing December 15, 2012, and ending February 15, 2013, for a total of $225,000; payment of the remaining $50, plus interest, applicable taxes and TRCA's reasonable costs on March 15, 2013; 118

4 Under the terms of the lease, if there is a default, TRCA may decide to terminate the lease, in which case, the tenant's lender has the option of paying the arrears and putting the lease in good standing. Failing action by the lender, TRCA would be entitled to take the lands, improvements and fixtures and either lease the water park with the equipment etc. to another operator, close the water park or operate the water park. Staff recommends that the proposal be accepted subject to third party approvals and agreements as required and the necessary legal arrangements being put in place. The third party approvals and agreements relate to the leasehold mortgage held by the Business Development Bank of Canada and ESC Chongsim Corporation, the parent company of WWK Recreation Inc. TRCA has agreed to such proposals in the past and payment has always been made. The interest rate charged under the lease is favourable to TRCA. Further, TRCA is in a secure position in terms of any default by the tenant. 10 CITY OF TORONTO [ETOBICOKE YORK COMMUNITY COUNCIL AREA] EX10.58 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Edenbridge Drive from Bearwood Drive to Scarlett Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed as located on property owned by the City of Toronto and TRCA. The purpose is to undertake the major rehabilitation of Edenbridge Drive from Bearwood Drive to Scarlett Road. Works include the replacement of the existing sanitary sewer, watermain and the construction of a new storm sewer. No in-water works are associated with this proposal. The permit will be issued for the period of December 7, 2012 to December 6, 2014 in accordance with the following documents and plans which form part of this permit: Letter of Undertaking from the City of Toronto committing to provide revisions to engineering and landscape drawings to the satisfaction of TRCA; dated December 3, 2012; received by TRCA on December 3, RATIONALE The application was reviewed by staff on the basis of the following information: 125

11 Proposal: The City of Toronto is proposing to undertake the road reconstruction of Edenbridge Drive between Royal York Road and Scarlett Road. Works will include the reconstruction of the existing road and subsurface utilities. New sidewalk will also be constructed to provide a continuous pedestrian route. A small segment of road approximately 120m long will be converted from a rural to an urban cross section. A new 300mm diameter storm sewer will be constructed to provide drainage for the urban cross section. This will connect to the existing storm sewer in the area. The existing 300mm sanitary sewer and 200mm watermain will be removed and replaced within the existing roadway. Dewatering is anticipated to facilitate the construction of the subsurface utilities. Discharge will be treated prior to being released to the environment. Construction staging and storage is to be located within the existing municipal right-of-way. Tree protection fencing and erosion and sediment control measures are to be installed prior to the commencement of work. Vegetation removals will also be required to complete these works. Construction is projected to occur during Control of Flooding: The proposed is not anticipated to impact flooding, flood storage or the conveyance of flood waters. Pollution: Standard erosion and sediment control measures (silt fence, catchbasin filters, rock check dams) will be installed prior to construction and will be maintained for the duration of work until the site has been stabilized. All dewatering discharge is to be treated prior to being released into the environment. These measures are being implemented to prevent the release of construction generated sediment from entering into the adjacent watercourses and valley system. Erosion and sediment control measures are being implemented in accordance with the Erosion and Sediment Control Guideline for Urban Construction (2006). Dynamic Beaches: Not applicable Erosion: Impacts to slope stability and erosion are not identified as a result of the proposed. Conservation of Land: No in-water works are associated with the proposed. Plantings Numerous trees are to be trimmed and four trees are slated for removal to facilitate the proposed works. Compensation for vegetation removals/ injury will be completed through the planting of 34 trees. Disturbed areas are to be restored to pre-construction conditions or better. 12 EX10.59 IMPERIAL OIL LIMITED To temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse west of Weston Road south of Lanyard Road, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed as located on the property owned by Hydro One. The purpose is to undertake maintenance works to restore the minimum depth of cover over an Imperial Oil Pipeline. The permit will be issued for the period of December 7, 2012 to December 6, 2014 in accordance with the following documents and plans which form part of this permit: Letter of undertaking from Imperial Oil to TRCA committing to provide landowner authorization; dated November 26, 2012; received by TRCA on November 30, RATIONALE The application was reviewed by staff on the basis of the following information: 127

13 Proposal: Imperial Oil is proposing to undertake remediation works to restore the minimum depth of cover over an existing oil pipeline under Emery Creek within a Regulated Area of the Humber River Watershed, south of Lanyard Road, west of Weston Road. The proposed site for the remediation works is adjacent to an existing storm water outfall that outlets into Emery Creek. To facilitate the proposed works the area immediately adjacent to the outfalls will need to be dewatered with flows from the outfalls being pumped around the work site. Works within the work zone will include the excavation of the oil pipeline, installation of a protective membrane around the pipe and backfilling of the area with 300mm rip rap to prevent scour above the structure. Access to the area will be facilitated through the construction of two temporary access routes. Additionally, a construction staging/storage area will be located adjacent to the outfalls. The work zone, access routes and storage areas will be isolated with sediment control fencing. One tree and several shrubs will be removed to accommodate access to the site. Works are anticipated to be completed during the fall of Control of Flooding: Impacts to flooding, flood storage or the conveyance of flood waters are not anticipated as a result of the proposed. Given the location of works a flood contingency plan will be prepared to stabilize the site and remove equipment/materials in the event that a significant storm event is anticipated. Pollution: Erosion and sediment control (silt fence) will be installed prior to construction and maintained for the duration of works, until the site can be stabilized and restored. These measures are being implemented to prevent the release of construction generated sediment from entering into the adjacent watercourse. Erosion and sediment control measures have been provided in accordance with the Erosion and Sediment Control Guideline for Urban Construction. Dynamic Beaches: Not applicable Erosion: Impacts to slope stability and erosion are not anticipated as a result of the proposed. Conservation of Land: With erosion and sediment control measures in place, the potential for Harmful, Alteration, Disruption or Destruction (HADD) of fish habitat will be mitigated. A DFO Letter of Advice will be prepared by TRCA staff for this project. Plantings Vegetation removals will include the removal of one tree. Compensation will be completed through the planting of 56 shrubs along the bank of the watercourse. Additionally, two types of seed mix will be used to stabilize and restore ground cover disturbed as a result of the proposed. The purpose is to undertake maintenance to an existing 400mm watermain crossing the Lower Don River. Works will involve relining the watermain in four locations. The permit will be issued for the period of December 7, 2012 to December 6, 2014 in accordance with the following documents and plans which form part of this permit: Letter of undertaking from the City of Toronto to TRCA to provide revisions to the engineering and landscape drawings to the satisfaction of TRCA; dated November 26, 2012; received by TRCA on November 26, RATIONALE The application was reviewed by staff on the basis of the following information: 129

15 Proposal: The City of Toronto is proposing to rehabilitate an existing 400mm watermain that crosses the Lower Don River at Rosedale Valley Road. Works will involve lining the pipe interior at three work locations. Infrastructure is to be accessed by excavating three 3x4m trenches, each to a depth of 1.8m, and by removing an existing maintenance chamber cover. Area 1, on the west side of Bayview Avenue, will contain two trenches and shall be accessed from existing roads. Area 2, on the east bank of the Lower Don River, contains a maintenance chamber cover and will not necessitate any soil disturbance. This w ork area is to be accessed from the paved pathways that run adjacent. As work area 2 is located on TRCA property, archaeological staff has been consulted. Work area 3, on the east side of the Don Valley Parkway, shall contain an open trench the same size as area 1, and is to be accessed from the paved pathways to the east. Staging areas will also be established at each work area. Construction is anticipated to occur in fall Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. All grades will be maintained or matched. Pollution: Erosion and sediment control measures (silt fence, mud mats) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into the Lower Don River. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006). Dynamic Beaches: Not applicable Erosion: There are no impacts identified to slope stability or erosion as a result of these works. Conservation of Land: A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO) for this project Plantings Two trees will require removal to facilitate access at work area 3. To compensate for this loss, six trees are to be planted at the completion of works. All excavated areas shall be restored using topsoil and sod, thus restoring all work areas to pre-construction conditions or better. The permit will be issued for the period of December 7, 2012 to December 6, 2014 in accordance with the following documents and plans which form part of this permit: Grading Plan, Drawing No. GR-1, prepared by Valdor Engineering Inc., revise dated October 15, 2012; Storm Sewer Outfall Plan & Profile, Drawing No. PP-2, prepared by Valdor Engineering Inc., revise dated October 15, RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose is to construct a new headwall and outfall associated with stormwater management infrastructure improvements within a Regulated Area of the Don River watershed. As part of the redevelopment of the property adjacent to the subject lands, the City of Vaughan required that an existing stormwater sewer be upgraded to accommodate the proposed redevelopment. These upgrades include the replacement of an existing stormsewer pipe with a larger sized pipe and construction of a new headwall for the outlet of this pipe. A portion of these proposed works including the headwall are located within the corridor of a drainage feature which is subject to flooding. 131

17 TRCA Ecology staff have reviewed the proposed works and are satisfied that the area of disturbance has been adequately isolated from the drainage feature to prevent the transport of sediment into the feature during construction. In addition, as the works are located at the head of a highly urbanized drainage feature, a fisheries timing window does not apply. TRCA Water Resources Engineering staff are also satisfied that the design of the outfall will not result in any downstream erosion issues. The proposed works will not alter any of the existing grades and as such will have no impacts on the storage or conveyance of flood waters. Control of Flooding: There will be no impacts on the storage or conveyance of flood waters as a result of this project. Pollution: A coffer dam and sediment control fencing will isolate the area of disturbance and prevent the transport of sediment into the drainage feature. Dynamic Beaches: Not applicable Erosion: There are no geotechnical issues associated with this application. Conservation of Land: As a watercourse will not be impacted by the proposal, no fisheries concerns will result. There are no other significant natural features on or adjacent to the site that may be negatively impacted by the project. 19 Proposal: The applicant seeks permission to undertake site preparation and grading, temporarily or permanently place materials originating from the site or elsewhere, and to construct the appropriate sediment and erosion controls, in support of draft approved plan of subdivision 19T(R) The site is located on the north side of 19th Avenue, between Bayview and Yonge Street, south of Shadow Falls Drive, and within the Rouge River Watershed, in the Town of Richmond Hill. North and south of the site are existing subdivisions, and to the east is an approved plan of subdivision under construction. Currently, the property contains a single detached house, a large detached garage structure (to be demolished), manicured grass, numerous mature trees (planted by the landowner), and a portion of the Rouge River Valley crosses the southern portion of the site. The Rouge River Valley and associated woodlands further bound the property to the west. The plan of subdivision was originally draft approved with TRCA conditions by the Town of Richmond Hill on August 21, 1998, and was recently extended by the Town. In working with the applicant and the municipality, the TRCA provided updated comments and revised conditions with respect to the extension of draft plan approval and minor revisions to the plan. The proposed subdivision retains the existing house on property on a separate lot, and maintains access from 19th Avenue. The development creates 9 additional residential lots on a cul-de-sac with access from Shadow Falls Drive, and a reservation for a future road within Block 11 to access lands to the west. Servicing from the north to 19th Avenue exists in an easement through the property, which was constructed to service the subdivision to the north. This proposal also includes the retention of several mature trees as an ecological restoration area on the northern boundary of the site, south of the existing residential lots fronting Shadow Falls Drive. While a number of trees have been identified for preservation along the east and west property lines, a few mature trees will also be removed in support of the development. There is a physical grade separation from the established grades of the plan of subdivision exists from the valley corridor. This grade transition will be achieved through minor grading (in the area of the proposed demolished garage and driveway) to meet the existing grades of the valley corridor. This slope will be planted with a number of native plant materials to create a vegetative buffer to enhance and restore the valley edge from the proposed development. The proposal also provides rain gardens on each lot to aid in groundwater infiltration on the site. Control of Flooding: Portions of the demolition and removal works are contained within the Regional Storm Floodplain, however these areas will be restored to a naturalized state. As such, no impacts to the storage and/or conveyance of flood waters are anticipated. Pollution: Appropriate erosion and sediment controls will be installed and maintained on the subject property throughout all phases of construction, and will remain in place until the lands have been stabilized. Dynamic Beaches: Not applicable Erosion: The proposed grade transition will be planted with a number of native plant materials to stabilize the slope. As such, there are no geotechnical and/or slope stability concerns associated with this project. 134

20 Conservation of Land: The applicant has agreed to provide an extensive planting plan to establish a defined environmental buffer from the valley corridor, as well as additional plantings along the western property line abutting the woodlot. The proposed plant materials are comprised of woody, native, non-invasive species. Both the plant materials and quantities were reviewed to TRCA's satisfaction. Staff anticipate the works will restore the forest and valley edge and enhance the edge of the adjacent features. There are no fisheries related concerns associated with this project. Plantings The planting plan consists of native, non-invasive plant species in accordance with TRCA's guidelines.
