5 Item 9.1 Section III Items for the Information of the Board TO: FROM: Chair and Members of the Executive Committee Meeting #13/14, Friday, January 13, 2017 Carolyn Woodland, Senior Director, Planning, Greenspace and Communications RE: VOLUNTARY PROJECT REVIEW OF WORKS UNDERTAKEN BY ORGANIZATIONS EXEMPT FROM ONTARIO REGULATION 166/06, AS AMENDED KEY ISSUE To report on progress of the TRCA Voluntary Project Review protocol established in 2014, regarding works undertaken by organizations exempt from Ontario Regulation 166/06, as amended Toronto and Region Conservation Authority Regulation of Development, Interference with Wetlands and Alteration to Shorelines and Watercourses. RECOMMENDATION IT IS RECOMMEDED THAT the staff report on projects reviewed through the Toronto and Region Conservation Authority (TRCA) Voluntary Project Review (VPR) process from 2014 through 2016 be received. BACKGROUND In 2014, the TRCA fee schedule provided an option for organizations exempt from TRCA s regulation, including but not limited to Crown corporations, railway companies and the telecommunication industry, to apply for TRCA review under the Voluntary Project Review process. These organizations are exempt from the Conservation Authorities Act Section 28 regulatory approval process and permits are not required. However, TRCA is concerned that infrastructure projects exempt from TRCA s regulation are not meeting the tests of our permitting process, and as such, provincial and conservation authority interests including, but not limited to, flooding management, erosion hazard, impacts to watercourses and natural heritage systems may not be adequately addressed. To address this concern, in the interest of both public safety and best management practices, TRCA developed a process whereby the exempt party may voluntarily request TRCA to review and comment on detailed design activities associated to confirm that TRCA policies and procedures are being addressed. Once TRCA concerns are satisfied, a Voluntary Project Review Letter is provided by staff advising that TRCA objectives and requirements as set out in The Living City Policies and Ontario Regulation 166/06, as amended, have been satisfied. While TRCA works with multiple user groups in the environmental assessment and detailed design review stages of various projects, to date, only Metrolinx has committed to the VPR process. Metrolinx has formally committed to providing TRCA with detailed design and technical reports, and to working with staff in a streamlined and expeditious manner for all projects in order to ensure their projects meet the five tests of TRCA s regulation including, flooding, erosion, conservation of land, pollution and dynamic beaches. Using the leadership of Metrolinx as an example, TRCA continues to seek a similar level of engagement with all other organizations exempt from TRCA s regulation on a continual basis. 5

6 Item 9.1 Since the inception of the VPR process in 2014, TRCA has reviewed multiple projects related to both Metrolinx GO and Light Rail Transit (LRT), and issued 12 VPR letters. 16 CITY OF VAUGHAN RIVERSIDE BOULEVARD To construct, reconstruct, erect or place a building or structure and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 32, Concession 1 Part Lot 100, Plan NO. 3765, (18 Riverside Boulevard), in the City of Vaughan, Don River Watershed. The purpose is to recognize the construction of a sq. m. ( sq. ft.) pergola structure at the rear of an existing single detached dwelling within a Regulated Area of the Don River Watershed. The described works were carried out without TRCA permits or municipal permits. As such, the applicant has paid double the permit application fee amount for this permit "after-the-fact'. The property is located on lands known municipally as 18 Riverside Boulevard, in the City of Vaughan. The permit will be issued for the period of January 13, 2017 to July 12, 2017 in accordance with the following documents and plans which form part of this permit: Site Plan, prepared by applicant, received by TRCA on December 8, 2016; Sheet L129, Details, prepared by MHLA Inc., dated May 2014, received by TRCA on December 8, RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to recognize the construction of a sq. m. ( sq. ft.) pergola structure at the rear of an existing single detached dwelling within a Regulated Area of the Don River Watershed. The described works were carried out without TRCA permits or municipal permits. As such, the applicant has paid double the application fee for this permit "after-the-fact'. The property is located on lands known municipally as 18 Riverside Boulevard, in the City of Vaughan. 16

17 TRCA staff previously issued a permit (TRCA Project Reference # 0450/12/VAUG, C , issued on August 10, 2012, expired August 9, 2014) to facilitate the construction of a new dwelling, in-ground swimming pool and patio area and to conduct minor grading works on the property. TRCA became aware of the pergola structure through review of a Minor Variance application (A198/16) which was submitted to permit a reduced setback from the interior side lot line for the pergola. Through review of the Minor Variance application, the applicant was informed that the subject pergola was not a part of the approved plans previously permitted by TRCA. The southern portion of the subject property is traversed by a valley corridor associated with the East Don River. Based on TRCA staff review, the location of the pergola is generally flat and consists of manicured lawn. Furthermore, the structure is appropriately setback from the valley slope, such that it can be maintained without impacting the natural feature/landform or being affected by geotechnical impacts. Additionally, the property is entirely outside of the Regional Storm Flood Plain associated with the East Don River. As such, there are no geotechnical, ecological or flood related impacts anticipated with the subject works. Fee and Permit Timing: As the works were completed prior to the issuance of a permit under Ontario Regulation 166/06, the permit is to be issued "after-the-fact". The applicant has paid double the application fee as required for a permit issued "after-the-fact" in association with the violation of Ontario Regulation 166/06. In addition, the time frame for this permit has been adjusted to reflect that the works have been completed (i.e. 6 months). Control of Flooding: The subject works are located outside of the Regional Storm Flood Plain. As such, no impacts to flood storage and conveyance will occur as a result of the works. Pollution: Erosion and sediment controls are not required for this application, as works have already been completed. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns with this project. Conservation of Land: The location of the constructed works is void of any significant vegetation. Plantings Given that no significant vegetation was removed during construction of this project, no plantings are required. 17

18 Policy Guidelines: This proposal complies with Section General Regulation Policies - and Section Property Improvements and Non-habitable Accessory Structures - of The Living City Policies for Planning and Development in the Watersheds of the Toronto and Region Conservation Authority. CFN: Application #: 1274/16/VAUG Report Prepared by: Stephen Bohan 5743 sbohan@trca.on.ca For information contact: Coreena Smith 5269 csmith@trca.on.ca Date: December 20,
