5 Claims Policy In order to assure proper handling of your claim, please follow instructions listed below: 1. All claims must be filed within 24 hours of receipt of goods, and must be accompanied by photographic evidence 2. Claims filed late will not be accepted 3. Claims filed after transplant will not be accepted Remedies, credits, or replacements shall be issued based on the following criterion: Problem Boxes arrived crushed Plants were not ordered or order was cancelled Plants were wrong variety Plants were too big / too small Plants were infected with pest, weed, or disease Plants had dried out in transit (within shipment window) Remedy DO NOT accept boxes. Decline shipment! We will arrange to pick up the plants We will arrange to pick up the plants We will offer proportional discount or we will arrange to pick up the plants We will offer discount to offset treatment costs or we will arrange to pick up the plants At our discretion, we will credit or replace proportion of damaged plants All UPS and FedEx deliveries are packed to the highest industry standards. We do NOT warrant plants after they have left our docks. While we may offer (at our discretion) assistance in filing a claim with your carrier of choice, we WILL NOT credit plants for transport damage or late delivery. We warranty to the extent of purchase only, that all nursery stock is sold true and as described within recognized trade tolerances. 2. It is the customer s responsibility to examine the plants immediately upon delivery, and file any claims due to transportation damage with the carrier. 3. Any other claims must filed with ARC Ferns within 24 hours of delivery so that an inspection may be conducted. 4. BY ACCEPTING THE PLANTS, THE CUSTOMER UNDERSTANDS AND AGREES THAT IN THE EVENT OF ANY CLAIMS OR LITIGATION, HIS SOLE AND EXCLUSIVE REMEDY SHALL BE LIMITED TO A REFUND OF THE PURCHASE PRICE OF THE PLANTS ALLEGED TO BE DEFECTIVE. 5. IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT ARC Ferns, LLC WILL NOT BE LIABLE FOR DAMAGES OR INJURIES TO ANY PERSON OR PROPERTY, AND UNDER NO CIRCUMSTANCES SHALL ARC Ferns BE LIABLE FOR INCIDENTAL OR CONSEQUENCIAL DAMAGES. 6. Any claim or litigation shall be governed, construed and enforced according to the laws of the State of Florida. Payment Terms and Discounts For our customer with established credit our terms are NET 30. Major Credit card payments are welcome. If credit has not been established, CASH IN ADVANCE, C.O.D., OR MAJOR CREDIT CARD. Finance charge of 1.5% per month will be assessed to delinquent accounts. Florida jurisdiction, legal fees and court expenses will be included in all claims of unpaid invoices. Sales Tax certificate is required from all customers. Cancellation 4 weeks prior to shipment will not be charged. 10% will be billed after that date. Restocking charge: 5% of sales value charged on any order already staged and/or packed and not picked up on specific date. 8.
