1 July 11, 2016 Mayor Pro Tem Wishart opened the regular meeting of the Gaylord City Council with prayer by Council Member Sharrard at 7:00pm on Monday, July 11, 2016, in the City Council Chambers, located in the Gaylord City Hall, 305 East Main Street, Gaylord, Michigan. The Pledge of Allegiance, led by Chief McVannel, followed the invocation. Members Present: Mankowski, Wishart, Duczkowski, Johnson, Hartz, and Sharrard. Members Absent: Jenkins. Motion by Sharrard, supported by Hartz to add the following item to the agenda: # 7 M.O.P.H Ladies Auxiliary Solicitation Permit Ayes: Unanimous. Motion carried Motion by Duczkowski, supported by Sharrard, to dispense with the reading of the minutes from the previous meeting and accept them as presented. Ayes: Unanimous. Motion carried Public Comment: Mrs. Judy Duhoski, 214 East Sheldon, requested that Diana s Delights comply with their Café Permit and leave enough room for foot traffic on the sidewalk in front of the restaurant. She also asked about temporary repairs that need to be done with sidewalks/curbs so they are wheelchair accessible. Mrs. Janet Flint, 217 East Sheldon, commented that only twice in the last two weeks has Diana s been in compliance with the permit. Mrs. Dona Wishart, 524 West Fourth Street, asked the council to take into consideration walkability issues for those with limited eyesight when making the temporary fixes, as well as the completion of the Downtown Project. Motion by Johnson, supported by Hartz to grant the sign variance requested by Shoppes on Main, LLC on behalf of Lessee, Lamar Advertising. The sign will be relocated on the existing property; utilizing LED lighting on one side of the sign. The sign message will be equipped to re-pixilate every 8 seconds. The variance we granted because of the following issues: 1. Explain why the hardship is due to unique circumstances and not the general conditions of the neighborhood. Will be required to relocate this sign to allow for the construction of the N/S access road in connection with the overall road improvement plans for the Shoppes on Main retail development. 2. Explain why granting the variance will not alter the essential character of the given locality or neighborhood. The sign already exists at this location and has nine years remaining on the existing lease. 3. Explain why the hardship is not the result of the applicant s own actions. MDOT requires the alignment of the N/S access road directly across from the Home Depot drive on the south side of M-32 and the sign prevents this possibility.

2 4. Explain why granting the requested variance will not have an adverse impact on surrounding properties or businesses. The sign already exists, it is just being moved. Motion by Duczkowski, supported by Mankowski to accept the first reading of an amendment to the City of Gaylord Water Service Ordinance Section Motion by Sharrard, supported by Johnson to accept the first reading of amendments to the City of Gaylord Sign Ordinance Sections , , a, b, and c. Ayes: Hartz, Mankowski, Sharrard, Wishart and Johnson, Nays: Duczkowski. Motion carried. Motion by Mankowski, supported by Sharrard to approve the resolution terminating the ICMA-RC 401(k) Plan. Motion by Sharrard, supported by Hartz to sign the Warranty Inspection Service Contract with Dixon Engineering in the amount of $ for inspection services on the Herr Gessler Water Tower.
