4 PANAGARH-PALSIT-DANKUNI SECTION FROM KM TO (NEW CH.) OF NH-2 IN WEST BANGAL 1 PROJECT DESCRIPTION 1.1 Project Background Ministry of Shipping, Road Transport and Highways through National Highways Authority of India (NHAI) has upgraded the stretch Panagarh Palsit -Dankuni from Km to Km (New Chaiange/Km to ) of National Highway No.2 in West Bengal to 4 lanes divided carriageway facility through Concessionaires on BOT (Annuity) basis. The Project is a part of Golden Quadrilateral (G.Q.) connecting high-density metro corridors of Delhi, Mumbai, Chennai and Kolkata. NH-2 is the link between Delhi and Kolkata, amongst other linkages, it traverses through five states namely Delhi, Haryana, Uttar Pradesh, Bihar, Jharkhand and West Bengal. The NH-2 connects number of major urban conglomerates on its way like Delhi, Agra, Kanpur, Allahabad, Varanasi, Dhanbad, Durgapur and Howrah. The Concessionaires have completed the construction work and the project facility is open to traffic. The Concessionaire has the responsibility to maintain the project highway during the concession period to comply with standards and specifications spelled out in the concession agreement. 1.2 Concessionaire The project stretch under the Annuity Approach on BOT basis has been splitted in two sections. The details of stretch and Concessionaires are as given in Table 1.1 below. The Concessionaire site office address for Operation and Maintenance is: M/s Mapex Infrastructure Pvt. Ltd, Mosagram, Ajhapur (Highway), Burdwan, West Bengal, PIN Project Features Topography The Project Road is passing through the area of Ganges Plateau through plain terrain. The road is crisscrossed by a number of cross drainage works. The temperature in the project area varies from 10 o C to 45 o C. The average annual rainfall in Burdwan District is 1470mm and in Hooghly District 1621 mm. The range of relative humidity varies from a minimum of 8 % to a maximum of 23 %. 10 1.4 Appointment of Independent Engineer (IE) As per terms of the Concession Agreement, an Independent Engineer has to be appointed for supervision during operation and maintenance period. Unihorn India Pvt. Ltd. has been appointed as an Independent Engineer on the basis of National Competitive Bidding. The letter of award was issued by NHAI on vide their letter No. NHAI/15019/1/2004/CGM (Tech)/VOL-II/173/43204, dated The agreement was signed on The contract is initially for 2 Years with the Date of Commencement as Extension of Time (EOT) has been proposed vide IE s letter no. UNI/HO/C- 17/08-15/398, dated to NHAI for 6 months ending on EOT is under process in NHAI, of which approval is expected soon. The Consultant has commenced the services. Road, Post-Jotram, Burdwan , West Bengal Tel.: , Fax: tlpalsit@unihornindia.com 2 TERMS OF REFERENCE OF INDEPENDENT ENGINEER 2.1 Objective The main objective of the assignment is comprehensive supervision of the operation and maintenance activities carried out by the Concessionaire to ensure complete compliance with respect to technical specifications and various stipulations contained in the Concession Agreement with high standard of quality assurance in supervision of O & M works. The Independent Engineer is expected to play a positive and independent role in discharging its functions, there by facilitating the smooth operation and maintenance of the project. Broadly the role of IE is to: Page -7

11 The objective of this consultancy is: Independently review, monitor and where required by the agreement, to approve activities associated with operation and maintenance of the Project Facilities to ensure compliance by the Concessionaire with the O&M requirements set out in schedule I of Concessionaire Agreement. Report to the parties on the various Physical, Technical and Financial aspects of the project based on inspections, site visits and tests. Assist the parties in arriving at an amicable settlement of disputes should the need arise, and Review matter related to safety and traffic management measures adopted by the Concessionaire for the project. 2.2 Scope of Services The services of Consultant w.r.t. Project Highway shall include but not be limited to the operation and maintenance of the following: Road work. Fee Collection system including buildings and related structures. Hardware and software Communication systems. Administration and Maintenance Depots. Rest Area and Fuel and Service facilities Lighting system Interchanges Bridges Service Roads Lay byes, Bus bays Traffic safety, Landscaping, arboriculture and other Project Facilities The Concession Agreement envisages appointment of [Independent Consultant] IC by the NHAI. The IC shall, in principle, be responsible for review of operation and maintenance activities, Affirmation of all certifications done by the Concessionaire, etc. The IC shall not be involved in day-to-day implementation or operations of the project. The responsibilities of the IE shall also include the following: To monitor, in accordance with Good Industry Practice, the operations and maintenance activities undertaken by the Concessionaire so as to ensure compliance with the O&M requirements. To review the O&M Plans and Schedules submitted by the Concessionaire from time to time and assist the Concessionaire in finalizing the same. Monitor Operation & Maintenance activities (including maintenance of equipment, standards of service, traffic management, safety and Page -8

12 environmental issues) and the overall quality of O&M activities so as to ensure compliance by the Concessionaire with the O&M Requirements, O&M Plan and O&M Manual. Periodically review the O&M Manual for adequacy. Inspect the Project Facilities at least once a month and as and when exigencies require ascertaining conformity with Project requirements. Review and ascertain the cost variation arising as a result of Change in Law and / or Change in Scope and determine the Additional Cost. Undertake a quarterly review of the various records and registers to be maintained by the Concessionaire (including the records relating to complaints and accidents) and suggest suitable remedial measures/ procedures, where necessary. Review the accident record on the project highway and suggest remedial measures. To mediate and assist in resolving disputes, if any, between NHAI and Concessionaire during O&M stage. Initiate necessary action to undertake maintenance obligation of risk and cost of the Concessionaires in the case of their failure to carryout O&M. In the event of Emergency, the Independent Engineer shall assist the Concessionaire in dealing with the same and if necessary require or permit, as the case may be, the Concessionaire to take such appropriate steps or measures including where necessary decommissioning of any project Facilities. 3 OPERATION AND MAINTENANCE REQUIREMENTS 3.1 General The O&M requirements are set out in Schedule-I of Concession Agreement. Concessionaire shall ensure that during concession period the project facilities are maintained to be the standards and specifications set out therein. The concessionaire shall further ensure that: The project facilities are kept free from undue detonation and undue wear Applicable and adequate safety measures are taken Minimum delay is caused to users of the project facilities Adverse effects on the environment and to the owners and occupiers of the property and /or land in the vicinity of the project facilities, due to any of its actions is minimized Any situation which has been arisen or likely to arise on account of any accident or other emergency is responded to as quickly as possible and its adverse effects controlled/minimized Disturbance or damage or destruction to property of third party by operations of the project facility is controlled/minimized Page -9

13 Members of the public times are treated with due courtesy and consideration by its employees/agents Users are provided with adequate information and forewarned of any event or any other matter affecting the project facilities to enable them to control/minimize any adverse consequences by such event or matter A complaint register to record grievances of any member of the public in relation to the operations and maintenance of the project facilities is dully maintained Traffic data and data relating to the O&M of the project facilities are collected All materials used in the maintenance, repair and replacement of any kind of the project facilities shall meet the design requirements/ standards prescribed in the DPR The personnel assigned by the Concessionaire have the requisite qualifications and experience and are given the training necessary to enable the Concessionaire meet the O&M requirements 3.2 Operation & Maintenance Manual and O&M Plans The Concessionaire shall finalize the O&M Manual and O&M Plans. The O&M plan is required to be submitted six weeks prior to the anniversary of COD each year. 3.3 Maintenance Requirements All the road work and pavement contained in the project Facilities (including those in the ancillary facilities) during operation period shall be maintained in traffic worthy condition as per intervention levels 1 and 2 provided in the Table 1-2 of Concession Agreement for various maintenance activities set out. Maintenance Activities shall comprise of: Routine Maintenance Periodic Maintenance Emergency Maintenance Other Maintenance Works Routine Maintenance (a) In order to ensure smooth and uninterrupted flow of traffic during normal operating conditions for all 24 hours of a day, routine maintenance of the Project Facilities shall include but not be limited to: Prompt repairs of potholes, electrical items, concrete joints, drains lane marking, lighting and signage; patching, re-grading of granular shoulders to designed standard, making good the deficiency of material on the shoulder, drain cleaning, repairing of signs, road marking, carrying out repairs to pavement crack by sealing; Page -10

14 Replacement of equipment/consumables, horticultural maintenance and repairs to equipment, pavements, bridges, structures and other civil work which are part of the Project/Project Facilities. Maintenance of the approach road to and underpass, overpasses and drainages within the Project Site in accordance with Good Industry Practice. Keeping the Project Site/Project Facilities in a clean, tidy and orderly condition free of litter and debris and taking all practical measures to pavement damage to the Project Facilities or any other property on or near the Project Site. Removing and disposing of in accordance with all Applicable Laws and Applicable Permits. All rubbish, debris, est. including any and all equipment, supplies, materials and wastes brought or produced by the Concessionaire/Contractor on the Project Site. Undertaking maintenance works in accordance with the O & M Plan and O & M Manual. Preventing, with the assistance of the concerned law enforcement agencies where necessary, any unauthorized entry to and exit from and any encroachments including any encroachments on the ROW/Project site. Taking all reasonable measures for the safety of all the workmen, material, supplies and equipment brought to the project site. (b) For routine maintenance work, the Concessionaire shall generally follow the operational and performance criteria specified in the respective IRC/MOR & H standards and specifications for each of the performance indicator covered under pavement condition survey, roughness and BBD deflections. Where such criteria are not specified in the standards, the Concessionaires, for the purpose of routine maintenance shall set forth such criteria as to conform to Good International Standards and Good Industry Practice for sound pavement maintenance practices in consultation with the Independent Engineer. (c) The Concessionaire shall regularly carry out the necessary preventive maintenance activities for the Project Facilities to ensure adherence to the Design Requirements/ specification set out in the DPR throughout the Concession Period. (d) The Concessionaires shall strictly follow and adhere Asset Management Project Deliverables and Tolerance Criteria as given in Appendix 1.1 of Concession Agreement. (e) Road Engineers have been assigned to identify and out necessary repair / replacement work Periodic Maintenance To be carried out during the end of 5th,10th and 15th years from COD in respect of Panagarh-Palsit section and 5th, 10 th and 15th, year from the COD in respect of Palsit-Dankuni Section as per Concession Agreement. 15 3.3.3 Emergency Response Protocol (ERP) Emergency Response Protocol (ERP) shall be developed by Concessionaires in consultation with the local police, hospital/ ambulance services, fire department and other authority/support personnel and the Independent Engineer. ERP shall set out steps to be taken and measures to be adopted by the Concessionaire in responding to dealing with emergency including those situations related to vehicle accidents involving personal injuries, property damage and force majeure etc. as detailed in the Concession Agreement Other Maintenance Works It involves maintaining the following facilities as per Concession Agreement: (a) Illumination (b) Highway Sign & Road Markings (c) Landscaping (d) Safety Barriers and Pedestrians Guard Rail (e) PIU Complex, Maintenance Yard and wayside amenities-service Area (f) Truck Lay byes and Bus Bays (g) Road Furniture 3.4 Safety & Traffic Management Operations Safety Week has been celebrated from 10th January to 16th January 2016 with Concessionaires, Independent Engineer and District Administration Burdwan. 27th National Safety Week was inaugurated on 10th January Slogans of Road Safety Time for Action have been displaced at PIU and other Places from Panagarh to Dankuni. Messages of Safety were addressed to road users, and divers, shop keepers, villagers, pedestrians through public addressing system at different vulnerable places during safety week. Pamphlets were also distributed to improve awareness among people. A meeting was held on in the chamber of District Magistrate, Hooghly in presence of Project Director, PIU Durgapur, IE & the Concessionaire regarding the fixing sign boards of the highway chainage from 603 KM to 649 KM. Till date, concessionaire has not complied the observation, needed to be complied at earliest. ADG traffic visited both the sections with Concessionaires, Independent Engineer, and NHAI on His observation is yet to be complied Traffic Management Traffic management shall be under taken during Maintenance Activities in consultation with IE as per the site conditions. Traffic Management Plan for planned scheduled O & M activities shall be prepared in consultation with IE with all the requirements spelled in CA. Page -12

16 The Corridor Control Plan shall envisage regular 24 hours patrol/surveillance of the ROW in the Project/Project Facilities shall be required to monitor, report and take actions against activities, such as, encroachments, unauthorized construction on road or entrance connections, structures, interference with drainage system etc, within 150 m of the highway corridor. Surveillance also includes traffic operation and management of the accidents and other incidents. This plan shall be developed in consultation with local administration and IE and shall form part of O & M Manual. For safety among others a Traffic Safety Officer is to be nominated by the Concessionaire Inspection Inspections of various items of Project Highway and other facilities have been classified as below and related relative frequencies have been spelt out in Concession Agreement. a) Visual inspections b) Close inspection c) Through inspection The frequency of inspection can be suitably revised in consultation with IE if the situation so warrants. 3.6 Reporting requirements The concessionaire shall make available to the IE/NHAI, a monthly report containing the following minimum information within 5 days of the end of each calendar month: Inspections undertaken by the Concessionaire during the month and action taken/proposed thereafter (i) Details of all reports submitted to IE during the month (ii) O & M inspection compliance report (iii) Maintenance activities undertaken during the month ended (iv) Details of any emergency and action taken. 3.7 Operational and Maintenance Manual The O & M Manual prepared by the Concessionaires in consultation with IE shall set out the operations and maintenance standards and details of O & M activities to be undertaken during Concession Period, so that the Project Facilities shall at all times conform to the Design Requirements/specifications set out in the DPR. The Manual shall include without limitation the following aspects: Organization structure with responsibilities of key personnel Traffic management plan including the corridor control plan Page -13

17 Safety management programme including the emergency response protocol Inspection procedures Maintenance invention levels Asset management project deliverables and tolerance criteria Environment management plan Maintenance programme Management information system Report formats. 3.8 Miscellaneous The Concessionaire shall: Maintain an inventory of all items comprised in the project facilities (The Inventory), in a format to be developed in consultation with IE. This shall be updated throughout the concession period Take all reasonable steps to facilitate the transit of Abnormal Indivisible Loads along the Project Facilities Responsible for the installation, operation, maintenance and removal of any equipment belonging to third parties. 4 INDEPENDENT ENGINEER S ORGANIZATION 4.1 Line of Communication between Entities. 22 5.2 Maintenance Activities Routine and Other Maintenance The Concessionaire has been found lacking in maintaining certain routine maintenance items like rectification of ruts, cracks, potholes, damaged shoulder, drainage road cleanness, inadequate plantation in median and ROW, deficient road marking, missing hectometer stones, encroachments, unauthorized parking, unauthorized access, unauthorized dumping, inadequate informatory and caution signs, poor illumination, broken cattle mesh guard, damaged crash barrier etc. All these shortcomings have been pointed to the Concessionaire in the startup meeting held on Deficiencies held are pointed out time to time to the Concessionaires through letters for rectification. Before passing the annuity, non-compliance list / rectification notice with attached list are being issued for rectification Periodic Maintenance 10 th Year periodic renewal was completed of both the sections Panagarh-Palsit & Palsit-Dankuni in the month of MAY Safety & Traffic Management Operations The Concessionaire has submitted a Safety Management Programme on which is being followed. Unauthorized access and encroachments is quite a regular feature and Concessionaire has shown interest in getting them vacated. For safety among others, a Traffic Safety Officer has not been nominated by the Concessionaire. CGM NHAI called on a meeting on 9th July with IE & concessionaire at Kolkata. TL submitted a proposal to reduce the rate of accident. 5.4 Inspection Visual, close and through inspections are to be undertaken by the Concessionaires as per the approved programme. In the monthly report submitted by the Concessionaires for the Month of February 2016 and all Maintenance Activities undertaken and details of any emergency and action taken. The Concessionaire has been carried out traffic count and axle load test for Panagarh-Palsit and Palsit-Dankuni Section. Report has been submitted. New Chainage National Highway NH Km to Km Right of Way The ROW generally varies from 45 m to 60 m in respect of Panagarh-Palsit Section and about 90 m in respect of Palsit-Dankuni Section. Exact details are awaited from the Concessionaire Other Features The details of other features like pavement width, median width, pavement surface type, shoulder type and width, junctions, intersections, service roads, way side amenities, bridges, culverts, ROB/RUB, underpasses, road side drain etc are the same as given in Para Plantation The road side plantation as well as median plantation is considered adequate. The Concessionaire has been carrying out with plantation at damage/missing spots for both the sections. Avenue Plants numbered are within ROW in both sections. IE has prepared the plantation report of both the section and submitted to Project Director Office with a copy to the Concessionaire vide letter no. Unihorn/NHAI/ Page -23

27 NH-2/O&M/IC-1/2014/115, dated The Concessionaires have done plantation in ROW during monsoon season. 6.2 Details of Proposal sent to NHAI As directed by ADG Traffic, Speed Limit Sign Boards for both the Sections sent to NHAI (PIU) DGP for necessary approval. 6.3 Details of NCRs Issued No NCR has been issued so far. 6.4 Review of Accidents and Remedial Measures The Concessionaire has included a list of monthly accidents in his Monthly Reports of January, February & March No suggestion for any kind of remedial measures has so far been projected. The majority of the accidents are due to over speeding of vehicles. 6.5 Review of Encroachment Details The Concessionaires have included a list of monthly encroachments in their Monthly Reports of January, February & March Review of Unauthorized Access The Concessionaires have included a list of unauthorized access cases in their Monthly Reports of January, February & March Breach of Obligations No such instance of breach of obligation has so far come to our notice. 7. SUMMARY FINDINGS 7.1 Standard of Services The standard of services of operation and maintenance is generally satisfactory. 7.2 Details of Slippages and Remedial Measures There are certain persistent slippages and potholes for which the Concessionaire has been asked to attend from time to time. It had been observed that some signage is missing or damaged in the project corridor. The detailed list of signage are prepared and forwarded to Page -24

28 Concessionaires with instruction to comply the list, different location of both the section pavement is damaged after overlaid, necessary repairs are required. The BC overlaid is damaged on different locations in both the sections for which the Concessionaires have been instructed and they are doing the repair. At different locations of the stretch metal beam crash barrier is damaged and needs to be repaired/replaced immediately to avoid accidents. RHS of Singur ROB expansion joint not functioning properly. Repainting of structure with suitable paint is required. Reverse camber in shoulder in different location of DE section are observed which requires attention to rectify before monsoon to avoid the damage of pavement. Road Safety Expert Prof. M. N. Shreehari visited the site and has pointed out deficiencies related to safety and has suggested for improvement of safety in the project. Road Safety report has been submitted to the NHAI vide out letter no. Unihorn/NHAI/NH-2/O&M/IC-1/2014/367, dated His observations are yet to be complied. Page -25
