VILLAGE BOARD MEETING STAFF REPORT REPORT TO: REPORT FROM: AGENDA ITEM: Burt R. McIntyre, President Village Board of Trustees Michael J Kaster, PE, Director of Engineering Review and take action on Resolution , a Relocation Order for the improvement and extension of Evergreen Avenue and Greenfield Avenue. POLICY ISSUE Should the Village Board approve the relocation order to acquire right of way, and easements for the relocation, improvement, and extension of Evergreen Avenue, and Greenfield Avenue? BACKGROUND INFORMATION Transportation Project Plats (TPPs) are typically the first steps in establishing roadway locations in advance of construction projects. TPPs also identify needed property for the proposed improvements. The project area is Greenfield Avenue, Shawano Avenue, and Evergreen Avenue, locally referred to as 5 Corners or 5 Points." This area, as shown on the attached TPP, is needed for two main reasons. One reason is that Brown County is seeking funding for a reconstruction project on Shawano Avenue from the CTH FF roundabout northwest to Glendale Avenue. The other reason is the utility service requested for development of the apartment complex approved by the Plan Commission and Village Board in the summer of As staff began looking at utility extension plans, the need for coordination meetings with Brown County became necessary to ensure that utilities for the apartment complex were being installed in a permanent location that could efficiently serve the adjacent properties. It was clear in discussions that the existing intersection of Greenfield and Shawano could not remain with the proposed reconstruction due to poor angles and close vicinity of the Evergreen Avenue intersection. Based on discussions with Brown County, staff coordinated the layout and design of a roundabout intersection for the area. The layout for the 5 points area that is on the attached maps is the only identified design and road pattern providing all of the following: 1. Intersection geometry meeting design standards. 2. Good major/collector roadway patterns promoting efficient traffic flow through the Village. 2 3. No impacts to existing buildings due to right of way acquisition. Upon receiving agreement with Brown County Highway staff on the intersection design at 5-points, Village staff coordinated the proposed roundabout intersection design with two overall major road patterns. The maps are attached to this report. The road patterns were developed maintaining the spirit of the Comprehensive Plan while coordinating the patterns with the future VV Interchange being constructed by WisDOT. The investigation was necessary to ensure that the right of way being acquired with this Relocation Order and TPP would serve the Village well going into the future fully developed condition. Staff hosted a public informational meeting with residents of the area on April 5. The residents at the meeting all supported alternative 2. The road pattern investigation and informational meeting gave staff direction and confidence in the proposed roundabout intersection location. The resolution is a relocation order which provides adequate right of way and easements to improve, extend, and maintain pavements, utilities and surface water drainage. With approval of the resolution Staff will begin the property acquisition process for the proposed utility extension project. The project could begin as early as July pending property and construction permit acquisition. PRIOR ACTION/REVIEW N/A FISCAL IMPACT: 1. Is There A Fiscal Impact? Yes 2. Is it Currently Budgeted? Yes 3. If Budgeted, Which Line? Enterprise Fund 4. Amount? $100,000 RECOMMENDED ACTION Village staff recommends that the Village Board approve the attached resolution. 5 Resolution RELOCATION ORDER FOR THE LAYING OUT, IMPROVEMENT, EXTENSION AND RELOCATION, OF PUBLIC STREETS EVERGREEN AVENUE AND GREENFIELD AVENUE WHEREAS, the Village of Howard has determined it necessary to layout, relocate, extend, and improve Evergreen Avenue and Greenfield Avenue beginning approximately 500 feet north of Shawano Avenue continuing approximately 2,000 feet south and east, in the Village of Howard; and WHEREAS, the Village Board of Trustees finds it necessary to acquire certain interests and rights in the lands as shown on Transportation Project Plat No and , attached to this Relocation Order and made part of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Village Board of Howard: 1. The Relocation Order hereto attached including Transportation Project Plat s No and as prepared by Mau & Associates pursuant to Section , Wis. Stats., is hereby approved and the Village Engineer is authorized to sign the Plat on behalf of the Village of Howard. 2. Public necessity requires the acquisition of certain rights and interests from parcels of property identified on the Relocation Order and located within and adjacent to the aforementioned project in the Village of Howard, Brown County, Wisconsin hereby laid out and established to the lines and widths as shown on Transportation Project Plat No and This Resolution together with the attached order is collectively a Relocation Order in accordance with Wis. Stats (1) for the purpose of the relocation and improvement of Evergreen Avenue and Greenfield Avenue beginning approximately 500 feet north of Shawano Avenue continuing approximately 2,000 feet south and east, and it is also a determination of necessity for the project in accordance with Wis. Stats (2). 4. The Village Staff and Attorney of the Village of Howard, Wisconsin are hereby authorized and directed to institute, as necessary, condemnation proceedings to acquire the necessary rights and interest in the parcels of property identified on the Relocation Order. 5. The Relocation Order is made pursuant to the provisions of Chapter 32 and Section 61.34(3) and Section of the Wisconsin Statutes. The Transportation Project Plat No and is made pursuant to the provisions of Section , Wisconsin Statutes. 6. The required rights and interest in the lands as shown on Transportation Project Plat No and shall be acquired in the name of the Village of Howard. 6 Relocation Order WHEREAS, pursuant to the authority under Section s and 61.34, Wis. Stats., the Village Howard therefore orders and resolves as follows: 1. That said relocation and improvement of Evergreen Avenue and Greenfield Avenue beginning approximately 500 feet north of Shawano Avenue continuing approximately 2,000 feet south and east is hereby laid out and established to the lines shown on Transportation Project Plat No and That interests will be required by the Village of Howard, Wisconsin in order to establish, lay out, widen, enlarge, extend, construct, reconstruct, improve or maintain the relocation and improvement of Evergreen Avenue and Greenfield Avenue beginning approximately 500 feet north of Shawano Avenue continuing approximately 2,000 feet south and east as designated on the schedule of interests required and to the lines and widths as shown on Transportation Project Plat No and Schedule of properties and interest to be acquired in the name of the Village of Howard is as follows: See schedule of lands and interests required as set forth on Transportation Project Plat No and , Village of Howard, Wisconsin, the same of which is attached hereto and incorporated by reference as though fully set forth herein. 4. That this Relocation Order and the attached Transportation Project Plat No and shall be recorded in the Office of the Register of Deeds for Brown County within twenty (20) days after the Plat is signed.
