Banerjee Road, Kolkata Minutes of the meeting of the High Power Committee in connection to Fire related matters held on 27/11/2015 at 3:30p.m. at Conference Room No. 1 of C.M.O. Buildings. The meeting was presided by Sri Debabrata Mazumdar, Hon ble MMIC (SWM). The meeting was attended by: (1) From KMC:- Mr. Shahazad Shibli, Jt. Mpl. Commissioner (Rev.), Sri Anindyo Karforma (D.G. (5)C.E.S.C.Ltd.:- Sri Prabir Kumar Mitra (Chief Legal Advisor), Sri Debasish Bandyopadhyay (Sr. Manager-PLAC &EM). Sl. Issue Point Remark of Licence Deptt., KMC Decisions of the Meeting No. 1. To release the CEs for so far as 42 endangered and fire prone buildings are concerned. On , the High Power Committee resolved to release the CEs for 42 endangered and fire prone buildings on the basis of either production of fire NOC of the building or on submission of undertaking by respective Traders Association of the building or the owner of the building regarding compliance to Fire & CESC norms. 31 buildings submitted the same and got their CEs released for In this financial year ( ), 04 buildings have already been released on the basis of Fire NOC plus 40, Strand Road, that was outside the list. For rest of the 38 buildings, decision is required as to whether following the norms like financial year , the CEs for those buildings be released. Our suggestion:- The endangered and fire prone buildings that will be able to submit fire NOC/clearance from WBF & ES will be permanently struck off from the list and CEs of such buildings will not remain withheld henceforth. Out of the total 42 nos. of endangered and fire prone buildings, those buildings that have already obtained Fire Clearance/NOC will be permanently struck off from the list and C.Es of such buildings will not remain withheld henceforth. Rest of such buildings, that would be able to produce Fire Clearance /NOC in future will also be permanently struck off from the list and C.Es of such buildings will not remain withheld henceforth. It has been seen that 11 nos. of endangered and fire prone buildings [as per list marked A ] out of the total 42 endangered and fire prone buildings have never submitted Fire Clearance /NOC and also never produced undertaking cum declaration regarding fire compliance. -So, those buildings will not be released till they are submitting Fire Clearance /NOC. Since, already 04 nos. of such buildings [as per list marked B ] have produced Fire Clearance /NOC, the remaining [ ]=27nos. of buildings (as per list marked C ) will be released on

2 production of either Fire Clearance /NOC or undertaking cum declaration regarding fire compliance. However, prior to submission of such undertaking cum declaration at KMC, they need to be stamped & receipted from WBF&ES Deptt. It has further been decided for better management of the entire issue periodic inspection by the representatives of KMC, CESC, DOE, WBF & ES & Kolkata Police be made under the co-ordination of Authorities of Kolkata Police. 2. To release the CEs for so far as KMC markets are concerned. 3. How to deal with renewal of individual CEs of Stephen Court and Surya Sen Market. 4. How to deal with renewal of CEs of Nandaram Market and Tripal Patty. CEs of non-hazardous businesses in KMC markets are already released. However, the CEs for hazardous businesses like restaurants, eating houses etc. are to be released decision required as to whether like previous years, this year also, such businesses may be released on application for renewal of CEs. It has been seen that some individual traders/businessmen especially of Stephen Court, Surya Sen Market are approaching KMC for renewal of their CEs with individual fire NOC/clearance. But, we are unable to act because fire NOC/clearance for the entire building has not been submitted as per decision of the last High Power Committee meeting. Our suggestion:- Those traders/businessmen of these buildings, who would produce fire NOC/clearance for their individual business place, would be released with their CEs. Discussion and specific decision is required. For rest period of the current financial year all the C.Es of KMC Market will be released. However, a copy of these minutes of the meeting may be forwarded to Chief Manager (Market) with a request for taking up of necessary Fire Safety Measures in consultation with WBF&ES, DOE, Govt. of W.B. & CESC. Those traders/businessmen of Stephen Court and Surya Sen Market, who would produce fire NOC/clearance for their individual business place, would be released with their CEs, provided nothing contrary is being heard and/or reported from WBF&ES. Will not be released. 5. Whether individual trades/businesses carried on at different shopping malls, cinema halls and multiplexes will be released, because the entire building has got fire NOC/clearance. At the time of discussion in the last meeting of the High Power Committee, it was decided that even if shopping malls, cinema halls and multiplexes have got fire NOC/clearance for the entire building, but some particular hazardous trades have to produce separate fire clearance/noc. But on previous years, we used to release CEs of those particular hazardous trades doing business at shopping malls, cinema halls and multiplexes on the basis of fire NOC for the entire building. If there is Fire Clearance /NOC of WBF&ES for the entire building/premises, the particular and individual eating houses, restaurants, bars etc. doing business at shopping malls, cinema halls and multiplexes will not be liable to produce individual Fire Clearance/NOC of WBF&ES. If there is existence of Gas Bank in any of such buildings/ premises, then separate Fire Clearance /NOC of WBF&ES for such Gas Bank needs to be produced.

3 Our suggestion: We will follow the same procedure with a rider that such particular hazardous trades/businesses will have to produce copy of the application submitted to WBF & ES. However, it is imperative that individual traders doing business at shopping malls, cinema halls and multiplexes etc. who would produce Fire Clearance /NOC of WBF&ES will be released with their Certificates of Enlistment on usual course Whether CEs for Guest Houses, Boarding Houses and Lodging Houses without kitchen be released. Whether CEs for Paying Guest Houses (where there will be maximum 05 beds) without kitchen be released. Prior to that, we never insisted for fire clearance/noc for such Paying Guest Houses (where there will be maximum 05 beds) without kitchen. Our suggestion: We will follow the same procedure with a rider that such particular Paying Guest Houses will have to produce copy of the application submitted to WBF & ES accompanied with Affidavit-cum- Declaration that there are no kitchen facilities for getting their CEs released. It has been decided that, on the basis of submission of current application before WBF & ES accompanied with Affidavit-cum- Declaration that there are no kitchen facilities, the CEs for Guest Houses, Boarding Houses and Lodging Houses may be released, provided nothing contrary is being heard and/or reported from WBF&ES. Whether CEs for internationally branded restaurants-cum-eating houses using only Micro Oven/Electric Oven/Induction Cooker etc. run by electric power only be released. Decision is required to be taken in this regard. Manufacturing Units in Industrial Estates what will be the fate of renewal of CEs. Decision is required to be taken in this regard. To promote the business at MS&ME Sectors and for the benefit of ease of doing business, Certificates of Enlistment of Manufacturing units in different Industrial Estates will be released on payment of arrear fees/charges, upon submission of necessary undertaking- cum- declaration regarding fire compliance by the
