The Nurseries who have obtained the Nursery license no. on Registration under the Nursery Act i.e., Andhra Pradesh Registration of Horticulture Nurseries (Regulation) Act 2010 (ACT No.13 OF 2010) from the Horticulture Department only should submit the Tender documents. 2. The tenderes have to be produced all the required certificates and licenses as per the rules and regulations of the Government. 3. The mentioned quantity is only approximation and right to increase or decrease the quantity is vested with the Project Director, DWMA, Eluru. 4. No: 10 Schedule -B General Terms and Conditions: 1) Sealed Offers are invited for supply of quality plant material of different varieties of fruit species during the year under MGNREGS Horticulture, IPT and Homestead plantation Programme to the different villages of West Godavari District district in the prescribed form purchased from the department duly signed and shall only be considered. 2) The offers should reach on (or) before the last date and time prescribed. 3) Tender Schedule is not transferable. 4) This tender document contains (5) schedules (A,B,C,D &E) 5) Nurseries having registered and obtained license from Horticulture Dept under Nursery Act 2010 i.e., Andhra Pradesh Registration of Horticulture Nurseries (Regulation) Act 2010 (ACT No.13 OF 2010) and having a minimum experience of (3) years in production and supply of different kinds of fruit plant material to the State /Central Govt. Institutions / Departments/ Corporations / Universities in the last (3) years. (Proof to be furnished) only are eligible. 6) The Nursery should have infrastructure facilities together with required technical / skilled manpower for production of plant material. 7) The Nurseries should have a minimum turnover of Rs. 25 lakhs during the last (3) years i.e. from , & (The relevant documents should be furnished). 8) Applications without required information or enclosures are liable to be rejected. 9) Invitation of Tenders shall not confer any right to the Tenderers to insist for work orders. The Tenders shall be approved as per the rules in vogue. 10) Failure of successful Tenderer to comply with the requirements shall constitute sufficient grounds for annulment of the order and forfeiture of E.M.D. In such an event, the Project Director, DWMA, Eluru reserves the right to invite the next highest Tenderer for negotiations and entrust the allotment. 11) Incomplete Tender and conditional offers submitted shall be summarily rejected.

No: 11 Schedule B 12) EMD of Rs.1,00,000/- ( Rupees One Lakh only) shall be paid in the shape of Demand Draft only drawn from any schedule bank in favour of The Project Director, DWMA, Eluru payable at Hyderabad and shall be enclosed to the schedule-a. Tenders without E.M.D shall be summarily rejected. 13) After opening of the financial bid, if it is found that the highest rate quoted is not satisfactory and not acceptable, the Department shall have the right to call for negotiations and fix up the rates of quality plant material within the terms and conditions of the tender. 14) The successful bidder shall execute an agreement on a non-judicial stamp paper of Rs.100/- (Rupees One Hundred Only). 15) The EMD / Security Deposit of the successful Tenderers shall be retained and refunded only after satisfactory completion of period of Agreement. 16) E.M.D will be forfeited if the successful bidder refuses to enter contract after award is made to the Tenderer and E.M.D. of unsuccessful Tenderers shall be refunded after finalization of the tender and execution of agreement by the successful Tenderer. 17) Information regarding litigation, expulsions and blacklisting of the Tenderer, if any, shall be submitted with details and declaration should be submitted on a Rs.10/- non-judicial stamp paper. 18) No subletting of the Tender is permitted. 19) Any violation of the above terms and conditions will be seriously dealt with. 20) The Department is not responsible for the loss /theft damages due to any calamities. 21) a) The Joint Collector, Eluru shall have the right to terminate the Tender by giving (30) days notice if the bidder / Tenderer violates any of the prescribed conditions and non-performance i.e., if not able to supply quality plant material in time. This fact may be considered in the subsequent tenders. b) In case it is found that the material supplied is spurious or defective or substandard quality the Project Director, DWMA, Eluru is entitled to purchase the material from other short listed nurseries and the difference of cost and loss sustained by reason of such supplies will be recovered from him in addition to the penalty.

12 Issuing Sl. No: 12 22) Penalty: A. In case of supply of spurious material, the cost of plant material shall not be paid and EMD shall be forfeited besides blacklisting the Nursery. B. In case delay in supply of plant material, after issue of the work order, a cut of 10% of the cost of plant material, for the first 10 days delay and additional 10% cost for every subsequent 10 days delays, shall be imposed. 23) The successful bidder shall obtain the necessary permission if any from the statutory authorities etc., and shall pay the taxes payable to all the statutory authorities/bodies/public authorities under different enactments, etc, as applicable. 24) The Arbitrator for fulfilling the duties set forth in the arbitration clause shall be the Project Director, DWMA, Eluru and his / her decision shall be final and binding. The provisions of Indian Arbitration Act 1940 (or) any statutory amendment, modifications (or) re-enhancement thereof and the rules made there under and for the time being in force shall apply to the arbitration proceedings. 25) All disputes and differences arises are subject to the Jurisdiction of the Courts at Eluru only. 26) The Joint Collector/ Chairman, DPC, Eluru (or) his / her nominee reserves the right to accept, reject (or) cancel the tenders at any time without assigning any reasons thereof. 27) The decision of the Joint Collector/ Chairman, DPC, Eluru will be final and binding and no further correspondence will be entertained. 28) The Tenderer should sign on each paper and affix the seal with date

No: 15 Schedule -C Specific Conditions: 32) This Tender document contains (5) schedules. 33) The Tenderers are requested to submit the Tenders as detailed: Schedules A, B, C & D shall be submitted in one sealed cover duly subscribing general information, general terms and conditions, specific terms and conditions and Technical Bid. together with EMD. Furnish Schedule-E, Financial / Price Bid in separate cover duly filled and signed shall be submitted in separate sealed cover duly subscribing Financial / Price Bid. All the above (2) covers shall be kept in a separate cover duly subscribing Tender for supply of fruit plants under MGNREGS Horticulture Programme on the top of the cover with the name and address of the applicant and to be dropped in the box kept at in the office of Project Director, DWMA, Eluru on (or) before the prescribed time and date. 34) First the technical bid will be opened on the day of opening of Tender date along with the EMD cover. These terms and conditions also shall farm part of contract. 35) The successful Tenderer has to supply the plant material to the destination or location indicated in the supply order by the competent authority throughout the district under MGNREGS & IWMP- Horticulture Programme. 36) The purchase orders shall be placed by the competent authorities of Project Director, DWMA, Eluru / PO, NREGS(MPDO) / PO, IWMP, duly indicating the quantity, species, size of the bag, place of supply and officer to whom to be supplied. 37) The supplier should submit the bills to the concerned authority together with delivery challan for arranging payment. 38) All the successful Tenderers should supply the quality plant material within (7) days from the date of purchase orders as per the technical specifications approved for the purpose. 39) The rates quoted and finalized once should be firm and shall be valid up to or till the completion of the supplies under Plantation programme. The Project Director, DWMA, Eluru will not entertain any upward price revisions during the validity period of tender.

No: 16 Schedule C 40) On placement and acceptance of purchase order, if the supplier does not perform his obligation as per the order, such supplier will be black listed and The Project Director, DWMA, Eluru reserves all rights to make alternative arrangements to procure them from any short listed source and the difference of cost paid, if any, will be recovered from the defaulting supplier through appropriate action. 41) In the event of any plant material failing to confirm to the specifications of quality parameters, the Project Director, DWMA, Eluru has the right to reject them out right and the payment in the stocks liquidated shall be withheld. 42) The Project Director, DWMA, Eluru (or) his / her nominee (s) shall have the right to inspect the nurseries and the quantity and quality of the plant material to ascertain their conformity to the standards of the contract, at any time. 43) The Tenderer has to supply 5% of plant material extra to compensate the mortality. 44) All the plant material being supplied should be staked and transported, at their own cost. 45) If any Nursery supplies the plant material not as per the specifications/parameters, the cost of such material shall not be paid, EMD will be forfeited and blacklisted in addition to initiation of legal action. 46) If any Tenderer failed to supply the quantity indicated in the Tender schedule E or supplied less, such less supplied quantity will be purchased from the open market. If the cost is higher than the approved cost, the difference will be recovered from the Tenderer besides forfeiting the EMD. 47) The quantity notified is only tentative and may increase or decrease as per the requirement. The decision of Project Director, DWMA, Eluru will be final. The Tenderer should not have any right to insist to procure the plant material which was allotted tentatively. 48) The rate quoted for the plant material in the Tender schedule should be inclusive of all charges and taxes (i.e., as per the purchase order), loading, transit loses and 5% extra plant material exclusive transportation charges. The transportation charges will be paid separately.

The transportation charges will be borne by the department. 50) The payment will be made after obtaining of necessary certifications from the concerned officers as per the rules in vogue. 51) 75% of the plant material cost will be paid to the supplier after delivery of the plant material and the remaining 25% cost will be paid after obtaining field verification remarks from the verification team sent by the Project Director, DWMA, Eluru. 52) I have read and understood all the terms and conditions laid down in the Tender document and abide to them. 53) Canvassing in any manner will leads to disqualification and EMD will be forfeited.
