Photographs of the Site east of Columbia Memorial The Commission should consider the following criteria in its deliberation, which shalll be utilized to substantiate its findings too determine the extent to which the proposed use would be compatible with surrounding properties; the surrounding land uses and thee performance impacts of the additional antennaee should be considered. Special Use Permits may allow certain uses of land, buildingss or structures wheree adequate measures can be taken to assure compatibility with surrounding uses, public need and the City as a whole. Background On April 22, 2014, City Council remanded this request back to the Planning and Zoning Commission forr reconsideration. The Council felt that there was new information to bee provided to the Commission as a result off the applicant s indication to camouflage the tower and to allow the applicant to coordinate with the Commissionn and staff. The applicant proposes to camouflage the monopole as a flagpole with an American flag. The pole will bee illuminated and operated by AT&T in accordance withh proper flag etiquette. In addition, the fencing along thee northern and eastern sides of the proposed enclosure has been moved to provide space to install the continuouss hedge that staff recommends as a condition. Site and Surrounding Area The proposed location of the cell tower will be located behind an office/warehouse structure, occupied byy McLaughlin Erectors Inc. No additional access is needed. Section of the Communication Towers and Structures ordinance establishes design standardd requirementss for communication towers. Below is an analysis of thee proposed tower with regards to the design standards ass required by the ordinance: Sec (a) (4): Use of City Property. It is recommended for the service provider to make ass much use as possible of existing city property, such ass water towers, city buildings, lighting facilities, etc., provided all other requirements of this chapter can be met. The City of League City has an elevated water tower located on South Shore Boulevard approximately 3,3000 linear feet west of the proposed tower location. The applicant and stafff have determined that the water tower mayy be a suitable alternative location for single cell antennae, but due to the limited ground space, future colocationn would be extremely limited. The applicant has requested the proposed site for future growth of additionall carriers. The alternate site would also require an exemption to thee residential setback with residences being approximatelyy 60 feet away from the elevated water tower. Sec (b) (1): Residential Setbacks. Towers must be set back a minimum distance of 400 feet or a distance equal to 150% of the height of the tower,, whichever is greater, from any off-site residential lot line. The required setback for a 120-foot communication tower is 400 feet from the eastern property line. The base off the proposed tower is located approximately 110 feet from the eastern property line. The applicant is requestingg an exemption to the setback requirement. Sec (b) (2): Nonresidential Setbacks. Towers must be set back a minimum distance of 100 feet or a distance equal to 150% of the height of the tower,, whichever is greater from any lot line. The required setback for a 120-foot communication tower is 180 feet from the northern property line. The basee of the proposed tower is located approximately 50 feett from the northern property line and approximately 2000 feet from the southern property line. The applicant is requesting an exemption to the setback requirement. Sec (b) (4): Facilities on existing structures/ buildings. Any accessory building shall comply with the standard city codes requirements for setbacks. The applicant is proposing to locate an equipment shelter approximately 180 square foot in size within thee enclosure, as well as a generator. The proposed equipment shelter meets the minimum setbacks. Sec (c) (1): Height Criteria. The maximum tower height, including antennae and special use permit has been granted by City Council. accessories, shall not exceed 200 feet, unless a majorr The proposed height of the tower is 120 feet and conforms to the maximum height limits. 3 Sec (d) ): Parking Design. Parking shall be so designed as to provide a cast-in place asphalt or concrete riding surface. Crushedd limestone or other all-weather surfaces can be used in areas that are not visible from a public right-of-way. Thee proposed materials grading, and drainage for off-street parking facilities shall be sealed by registeredd professional engineer and shall be subject to approval by the city engineer. The applicant has not proposed adding any additional parking to the site. Parking will be provided through thee existing business on the site. Sec (e) : Lighting. Lighting shall meet but not exceed the Federal Aviation Administration (FAA) minimum, if lighting is requiredd by the FAA. Strobe lights shall not be used for night-time lighting, unless required by the FAA. The lights shalll be oriented so as not to project directly onto surroundingg residential property, consistent with FAAA requirements.. Prior to issuance of a special use permit, the applicant shall be required to submit documentationn from the FAAA that the lighting is the minimum lighting required by the FAA. No lights are proposed on the tower, as none are requiredd by the Federal Aviation Administration (FAA). Sec (f) : Security Fencing & Landscaping. The facilities shall be protected by fencing along their entire perimeter to prevent unauthorized access. Thee base of the tower, any guy wires, and any associatedd structures, walls or fences shall be surrounded by a landscape buffer hiding the ground elements of the facility from view. The site developer has the option off providing the landscape buffer around the tower base and associated items individually, or providing a bufferr around the perimeter of the entire site. The enclosure will be screened with an 8-foot chain link fence. The applicant is proposing to extend shrubss around the entire enclosure except where entry will be made. The City Arborist recommends that Southern Waxx Myrtles be planted (30-inches on center) for their ability to develop into full screening six (6) feet tall withinn twenty-four (24) months. During the previous consideration, there were concerns for the location of the site in relation to a swale andd detention pond. The applicant has shifted the enclosure slightly southwards, as well as decreasing the depth of thee enclosure to allow plants to be installed directly adjacent to these features. It is not foreseen that the plantingss would interrupt the designedd function of the swale or detention pond. Sec (h) ): Camouflage. The service provider shall make every attempt to conceal the transmitting facilities to the maximum extentt possible. The paint scheme shall contribute to the camouflage of the facility. The applicant proposes to camouflage the cell tower as a flagpole with an American flag. The flagpole would bee illuminated with the flag and maintenance provided d by AT&T. The proposed camouflage will meet thee requirement. Potential SUP Conditions 1. The communication tower shall be a monopole camouflaged as a flagpole. The flag shall be an Americann flag which is appropriately proportioned to the height of the tower. The flag will be provided, maintained andd operated by the owner of the tower. 2. A fence, consisting of black coated PVC, and a continuous hedge of Southern Wax Myrtle shrubs (30-inchess on center) shall be provided on all sides of the enclosure s perimeter, except for the access gate area.
