1 ITEM NO. : 10.4 Town Council Meeting Date: April 19, 2017 TOWN OF WINDSOR AGENDA REPORT To: From: Subject: Mayor and Town Council Jim O Brien, Project Manager Keiser Park Restroom Facilities Project Recommendation to Council: Approve the plans and specifications and award the construction contract to Siri Grading and Paving Inc., in the amount of $148,450 for the construction of the Keiser Park Restroom Facilities Project and authorize the Town Manager to execute the construction contract and any required construction change orders up to the authorized project budget on behalf of the Town. Background: Council approved the Capital Improvement Program (CIP) for Fiscal Year (FY) which included the Keiser Park Restroom Facilities Project. Additionally, the installation of a single use restroom servicing the playground area of Keiser Park has also been identified as a high priority in the Parks and Recreation Master Plan and in various community outreach meetings. The restroom is a single use pre-fabricated structure consistent in construction, appearance, and operational features with other park restrooms located at Keiser Park and Hiram Lewis Park. The site location for the restroom was identified in the Keiser Park Phase 1 Improvement Project completed in The improvements included the installation of a sewer lateral line to the future restroom location. In preparation for the delivery and placement of the pre-fabricated structure, site construction will include grading, compaction and leveling of the building pad, rough installation and connection of all other utilities, and repaving of the surrounding pathways. The addition of this restroom will enhance public convenience by offering a restroom closer in proximity to the playground and picnic areas located at the front of the park. It will also reduce the repeated pedestrian crossing of sensitive park riparian areas. The pre-fabricated structure meets all the necessary accessibility, and energy efficient requirements as well as providing many vandal resistant features. Construction of the restroom structure is performed by the manufacturer (Public Restroom Company) off site and then shipped when completed. Installation of the pre-fabricated restroom structure takes approximately one day to complete and is performed by the manufacturers installation crew in coordination with Siri. Once the structure is set in place, Siri will make the final utility connections and perform any final site construction tasks. A Notice to Contractors (NTC) soliciting construction bids was issued by Public Works on February 21, The NTC was advertised in the local newspaper and added to the Town website. 1 of 2

2 Discussion: On March 28, 2017 four bids were received for construction of this project (see attached bid summary). Bid amounts ranges from $148, to $188, Siri Grading and Paving, Inc., submitted the lowest responsive bid of $148, and is therefore, the apparent lowest responsible bidder. Staff has reviewed the bids and the information submitted by the bidders and found them to be in order. Construction is tentatively scheduled to begin in late spring 2017 and should be completed within 30 working days. Delivery of the pre-fabricated structure is tentatively a six to eight week turn-around time. Fiscal Impact: Sufficient appropriations are included in the FY General Fund Budget. Environmental Review: Pursuant to CEQA Guidelines Section 15162, the proposed project would not result in any new impacts and no new mitigation measures are required (see Attachment 2, memorandum from LSA Associates). This memorandum focuses primarily on the analysis contained in the Keiser Park Master Plan Environmental Impact Report, certified by the Town in 2008 (EIR) 1 that analyzed impacts associated with development of Keiser Park and provided mitigation measures to reduce potential impacts to lessthan-significant levels. While the restroom evaluated in this memorandum is not explicitly identified in the EIR, development of restroom facilities are within the scope of the project covered by the EIR, and it provides the framework and appropriate mitigation measures for determining that the proposed project is exempt from further CEQA review. The purpose of this memorandum is to inform the Town of Windsor that installation of the restroom at Keiser Park will not result in any environmental impacts and no further environmental review is required. PROJECT BACKGROUND The proposed project involves installation of a new restroom facility at Keiser Park in the Town of Windsor, Sonoma County. The proposed project site is located at the northern portion of Keiser Park, immediately south of the playground area and Windsor River Road. Figure 1 shows the site s regional and local context. Figure 2 depicts an aerial photograph of the project site and surrounding land uses. Figure 3 illustrates the site plan for the project and location of the proposed restroom within Keiser Park. The restroom facility would include one unisex single-occupancy restroom. The facility footprint dimensions would be approximately 11 feet by 10 feet wide and approximately 11 feet and 7.5 inches in height. Development of restroom facilities was previously analyzed as part of the Keiser Park Master Plan EIR. The EIR was prepared and certified in 2008 and analyzed potential impacts associated with buildout of Keiser Park which included a recreation center, aquatic center with two swimming pools, two small ball fields with soccer field overlays, one lighted ball field, restroom facilities, and two children s play areas. 1 Windsor, Town of Draft Keiser Park Master Plan Environmental Impact Report. 8 The EIR concluded that development of restroom facilities could result in potential impacts associated with water demand. Specifically, as noted on page 4.L-6 of the EIR, primary water demand associated with development of the Master Plan was primarily associated with existing water usage. As such, development of Keiser Park, including the proposed restroom evaluated in this memorandum, could result in an incremental increase in water usage. The EIR included Mitigation Measure L-1 described below, that would ensure that potential impacts to water demand would remain less than significant. Mitigation Measure L-1: As feasible and applicable, the Town shall implement the following water-efficient equipment and devices into the design of new park facilities and project plans: low-, ultra-low, and dual flush flow toilets and showerheads; water efficient irrigation systems that include drip irrigation and efficient sprinkler heads; evapotranspiration (ET) irrigation controllers; and drought-resistant and native plants for landscaping. In addition, irrigation sprinklers shall be checked for broken heads or clogged nozzles and repaired immediately and watering of landscaped areas shall be avoided or limited on windy days or during the hottest part of the day. Implementation of Mitigation Measure L-1 would be required for the proposed project and would ensure that potential water demand impacts associated with the proposed restroom would be less than significant, and no additional mitigation measures would be required. The EIR also identified that development of Keiser Park Master Plan would not exceed the City s available water supplies with implementation of Mitigation Measure L-1. CEQA FRAMEWORK The proposed project was within the scope of the project previously analyzed as part of the Keiser Park Master Plan EIR. Pursuant to CEQA Guidelines Section (use of a previous EIR to cover later activities) the following conditions apply to the proposed project: c. Use with Later Activities. Subsequent activities in the program must be examined in the light of the program EIR to determine whether an additional environmental document must be prepared. 1) If a later activity would have effects that were not examined in the program EIR, a new Initial Study would need to be prepared leading to either an EIR or a Negative Declaration. 2) If the agency finds that pursuant to Section 15162, no new effects could occur or no new mitigation measures would be required, the agency can approve the activity as being within the scope of the project covered by the program EIR, and no new environmental document would be required. 3) An agency shall incorporate feasible mitigation measures and alternatives developed in the program EIR into subsequent actions in the program. 12/20/16 (P:\TOW1601 Keiser Park Restroom CEQA\PRODUCTS\Exemption Memo FINAL\FINAL Keiser Park Restroom CE Memo docx) 5

9 4) Where the subsequent activities involve site specific operations, the agency should use a written checklist or similar device to document the evaluation of the site and the activity to determine whether the environmental effects of the operation were covered in the program EIR. 5) A program EIR will be most helpful in dealing with subsequent activities if it deals with the effects of the program as specifically and comprehensively as possible. With a good and detailed analysis of the program, many subsequent activities could be found to be within the scope of the project described in the program EIR, and no further environmental documents would be required. As discussed above, this analysis has determined that no new or substantially more severe impacts would occur and no new mitigation measures would be required for the proposed project. Specifically, potential impacts associated with installation of restroom facilities were previously analyzed as part of the Keiser Park Master Plan EIR. The Town as the CEQA Lead Agency can approve the activity as being within the scope of the project covered by the program EIR and no new environmental document would be required. Additionally per CEQA Section 15162, no additional environmental review is required for the project because: 1. No substantial changes are proposed in the project (development of a restroom) which would require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; 2. No substantial changes have occurred with respect to the circumstances under which the project would be undertaken, and no major revisions to the previous EIR are required; 3. No new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete shows any of the following: a. The project will have one or more significant effects not discussed in the previous EIR or negative declaration; b. Significant effects previously examined will be substantially more severe than shown in the previous EIR; c. Mitigation measures or alternatives previously found not to be feasible would in fact be feasible, and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or d. 10 The proposed project does not include substantial changes to the project analyzed as part of the Keiser Park Master Plan EIR. The Town would continue to implement the mitigation measures required by the EIR during construction and operation of the proposed restroom, and the proposed project would not result in new more severe impacts than those identified and mitigated in the EIR. In addition, development of the proposed restroom does not represent a substantial change to the project evaluated in the Keiser Park Master Plan EIR. The project would not increase the severity of any other impacts nor would the project require any additional mitigation that was previously found not to be feasible. As such, the proposed project would comply with CEQA Guidelines Sections and CONCLUSION Impacts associated with construction of restroom facilities were previously evaluated and mitigated in the Keiser Park Master Plan EIR. The proposed project would be required to implement Mitigation Measure L-1 to ensure potential impacts associated with development of the proposed restroom are reduced to less-than-significant levels. Pursuant to CEQA Guidelines Section 15162, the proposed project would not result in any new impacts and no new mitigation measures are required. Therefore, further evaluation and documentation under CEQA is not required pursuant to CEQA Guidelines Section None of the conditions or circumstances that would require preparation of subsequent or supplemental environmental review pursuant to CEQA Guidelines Section exists would occur.
