FOREST LAWN MEMORY GARDENS - WAIVER REQUEST 5740 S PINE AVENUE OCALA Project # #17098 Parcel # Permit # Forest Lawn Memory Gardens APPLICANT requests waiver for a 20'x30' steel storage building because there is no pad, no current flooding conditions exist, and it is needed strictly for storage of tractors. Motion by Tracy Straub to approve the consent agenda, seconded by Doug Andrews 4. SCHEDULED ITEMS: A. HOSPICE OF MARION COUNTY ACCENT MEDICAL WAREHOUSE ADDITION - WAIVER REQUEST FLORIDA ORANGE GROVE LOTS SE 62ND STREET OCALA Project # #17093 Parcel # Hal Barrineau - HW Barrineau & Associates APPLICANT requests waiver for the following additions to the Hospice site: 3,384 sf building #4, 11,161 sf drive aisles & parking, and 736 sf sidewalks & driveway apron. The proposed new impervious is 15,281 sf (3.30%) bringing the total impervious area to 87,022 sf (18.8%). The existing stormwater management facilities already permitted and constructed include proposed impervious improvements. Calculations are provided on sheet C002 of the submitted plans. Motion by Tracy Straub to approve a waiver to the major site plan and for building permit submittal only with as builts and a final inspection, seconded by David Galassi Motion amended by Tracy Straub to include working with Stormwater to ensure stormwater improvements are appropriate, seconded by David Galassi B. EQUELS PROPERTY, THOMAS - WAIVER REQUEST S HWY 475 OCALA Project # #17096 Parcel # Shep Dozier LDC C(1) - Driveway Spacing CODE states the minimum allowed distance between a driveway and the nearest intersecting roadway or driveway shall be as shown in Table and

3 EQUELS PROPERTY CONTINUED APPLICANT requests waiver as owner's parcel contains 109 acres, more or less, with 1,264 feet of frontage on S Hwy 475. The existing driveway on S Hwy 475 is located within the north 70 feet of the subject parcel. Owner's mother wants to purchase a 10 acre parcel on the south end of the subject parcel and construct her residence on it. Even with 1,264 feet of frontage on S Hwy 475, owner cannot meet the driveway spacing requirement to effect this division under LDC (B)(1). Owner wants to sell the 10 acre parcel to his mother and preserve his ability to effect an agricultural lot split under LDC (B)(8). This waiver will allow the driveway for the 10 acre parcel to be placed within the north 50 feet of the 10 acre parcel or other location that is acceptable. This section of S Hwy 475 is flat and straight and provides clear line of sight for the proposed driveway. Motion by Tracy Straub that (1) this parcel is eligible to have a driveway; (2) driveway placement is to be determined at such time of construction; and (3) in the future, further splits of the parent parcel or the split parcel shall use the existing driveway with the parent parcel or the proposed driveway with the split parcel, seconded by David Galassi C. MARION OAKS SPORTSFIELD PARKING LOT EXPANSION - WAIVER REQUEST MARION OAKS UNIT 3 TRACT B 325 MARION OAKS LANE OCALA Project # #17104 Parcel # David Pierce - Marion County MSTU Department APPLICANT requests waiver to expand the existing parking lot approximately 11,000 square feet. The existing wood posts are to be relocated/removed and replaced to accommodate proper alignment and spacing for the expansion. The number of spaces is to be determined in design. The parking lot is to be constructed with an 8 inch stabilized subgrade, 6 inch compacted limerock, and 1.25 inch asphalt Type SP 9.5. Motion by Tracy Straub to waive the major site plan subject to (1) working with the Landscape Architect for the landscaping, (2) talking to the water management district about any stormwater needs, and (3) the parking lot being designed per Code with proper width of drive aisle and parking spaces, seconded by Todd Clifford D. DEER PATH NORTH EXPANSION - PRELIMINARY PLAT Project # #15738 Parcel # Tim Brooker - Tillman & Associates Engineering Applicant requests to reactivate plan and will resubmit within 30 days. Initial comments review by DRC was on April 6, 2015 with two weeks to resubmit. 3

4 E. DEER PATH NORTH EXPANSION - IMPROVEMENT PLAN Project # #15700 Parcel # Tim Brooker - Tillman & Associates Engineering Applicant requests to reactivate plan and will resubmit within 30 days. Initial comments review by DRC was on April 6, 2015 with two weeks to resubmit. Motion by David Galassi to approve a 30 day extension to resubmit for Items 4D and 4E, seconded by Doug Andrews F. POPEYES HWY MAJOR SITE PLAN Project # #16401 Parcel # Rick Krietemeyer - Z Development Services; Jan Lemon Initial comments review. Applicant met with staff on September 24, LDC B & D - Cross Access (Parallel Access) CODE states cross access shall be shown on the plans, be established through a public easement, and provide access to adjacent commercial development. APPLICANT requests waiver to defer construction of the western +/- five feet of the planned parallel access connection to a future time due to unknown off-site grade variations and conditions. Motion by Tracy Straub to approve subject to execution and recording of a cross access easement and cross access covenant being obtained prior to building permit issuance, seconded by Todd Clifford LDC C(1) - Driveway Spacing CODE states the minimum allowed distance between a commercial driveway and the nearest intersecting roadway or driveway shall be as shown in Table and APPLICANT requests waiver on the secondary Highway 484 driveway in order to facilitate deliveries to the project site. The large turning radius required for delivery truck movement through the project site cannot be accommodated with only one driveway. Motion by Tracy Straub to approve the driveway separation requirement providing for a right-in/right-out driveway on 484, seconded by Doug Andrews Jan Lemon stated that she is present only because she is concerned about the traffic pattern. Since there has been a traffic light at SW 20th Avenue Road, it has been fabulous for the trucks getting out of the plaza and for anything off of SW 20th Avenue Road. Her only concern with a curb cut on 484, even though it is a right-in/right-out, will be stopping traffic to get in or trying to exit traffic onto 484. It is the 484 traffic cut that she is concerned with because of the light which is only a block down from there. It has worked very, very well since it went in. Her only concern is that when people go to make the right-in/right-out will it cause an issue right before that traffic light. Her concern on this is not Popeye s. Her 4

5 POPEYES HWY 484 CONTINUED total concern on this is the traffic pattern. Tracy Straub stated that if they had done a full driveway, she is absolutely correct and those would be the types of concerns. The rightin/right-out is viewed as a continuous movement. It does not create an issue at that signal. Masood Mirza discussed the traffic pattern entering the Popeye s site from 484 and, in this case, felt that they are allowing a proper access here. Ms. Lemon stated that there is already an approved PUD on both sides of 484 and she asked how many curb cuts are going to be allowed. That traffic light has been fabulous for the area in terms of moving traffic and protecting folks. Every time a curb cut is made that traffic pattern is disturbed and the computer on that traffic light is disturbed. So, if DRC is going to approve this one, they seriously have to consider anything that may come in the future on an enormous acreage PUD and give some serious consideration to what kind of curb cuts are going to be done. Tracy stated that as growth continues, she believes the area is in good shape for parcels to come. It is the older parcels that are out there already. They have a design that DRC would not approve today but they are out there. Motion by Tracy Straub to acknowledge all comments and resubmit within 10 working days, Doug Andrews 5.
