We have made a preliminary determination that the aquatic resources that would be impacted by the proposed project are subject to Corps of Engineers jurisdiction under Section(s) 9 & 10 of the Rivers and Harbors Act of 1899 and/or Section 404 of the Clean Water Act. If an approved jurisdictional determination is completed as part of the review process for this application, a copy will be posted on the St. Paul District web page at the following link: Project PROJECT DESCRIPTION AND PURPOSE: The applicant is applying for a Department of the Army permit to discharge fill material in waters of the U.S. for the construction of 137,000 square foot multi-family residential building, parking lot, and access road for the purpose of residential development. The development would include a 99-unit building with a community center and ArtSpace, underground (104 stalls) and above ground parking (102 stalls), and underground stormwater detention within the City of Brookfield s Tax Incremental Financing District 3. NAME, AREA AND TYPES OF WATERS (INCLUDING WETLANDS) SUBJECT TO LOSS: The proposed project would result in the discharge of fill material and permanent loss of 0.43 acre of fresh wet meadow wetland adjacent to an unnamed tributary to Dousman ditch. This wetland is dominated by reed canary grass, stinging nettle, stinging goldenrod, and European buckthorn. 1
2 FEDERAL THREATENED & ENDANGERED SPECIES: According to the U.S. Fish and Wildlife Service (USFWS) Midwest Region website, the Northern longeared bat (threatened), Poweshiek skipperling (endangered), Eastern prairie fringed orchid (threatened), and Rusty patched bumble bee (proposed as endangered) are found in Waukesha County. The Corps will coordinate any potential effects to the species listed above and their critical habitat with the USFWS. FLOODPLAIN: The project would result in the net fill of approximately 879 cubic yards within the FEMA 1% Annual Chance Flood Hazard (100-year floodplain). The City of Brookfield requires compensatory floodplain storage. Approximately 1,054 cubic yards of flood water storage is proposed outside of delineated wetland areas. ALTERNATIVES CONSIDERED: The no-build alternative would avoid impacts to aquatic resources but was not considered by the applicant because it failed to address the purpose of the project. The applicant has stated that other project sites were considered in the Village of Elm Grove and City of Brookfield along the Bluemound Road corridor; however, these sites were dismissed by the applicant due to smaller than needed site size and zoning. A total of three on-site configurations were evaluated. Two alternatives were dismissed due to larger amount of wetland impacts. The preferred alternative avoids the tributary and wetland area along the eastern parcel boundary. The applicant states that wetland impacts were minimized by: reducing the size of the building to the smallest building prototype economically feasible, incorporating underground parking and subsurface stormwater management, incorporating a retaining wall, and minimizing the width of the south ingress/egress access road. Erosion control and storm water management would be conducted with Best Management Practices and wetland areas would be protected by silt fence. COMPENSATORY MITIGATION: The applicant proposes to fulfill federal compensatory mitigation requirements by purchasing advanced credits from the Wisconsin Wetland Conservation Trust (In-Lieu Fee) program contingent upon Corps approval.
