Since there may be local variations and unique circumstances in the territories covered by each AHJ it is worth clarifying. For instance, a municipality may cover its own geographic boundaries and provide services to areas outside of its boundaries in the absence of another agency or AHJ, so the municipality should ensure all areas where it exercises primary responsibility are covered. As written it appears to be encouraging agencies to consider using "field personnel" (normal firefighters/emts/etc) in the execution of these activities. It could be made a bit more clear, especially since the standard is only stating that the FPO shall EXAMINE opportunities. It is also worth articulating that the FPO should give consideration to engaging outside partners and stakeholders when practicable. 8 5 of 15 8/16/2016 8:18 AM Public Input No. 11-NFPA [ New Section after ] 5.4 The FPO shall identify large facilities, distinctive areas, and/or specific hazards that may require a separate CRA or more detailed analysis based upon the geographic isolation, unique circumstances or cultural/economic/political significance of the area. Since many communities may have particularly significant or challenging locations that are unique and/or present specific sets of challenges, it is important to encourage agencies to identify those and decide whether they can be adequately handled in the FPOs CRA. For instance, if a community covered the municipal boundaries AND a major international airport that is outside the city limits and is a separate political entity, it would be useful to have a separate CRA that handled the unique FPO challenges related to the airport, in this example. The line as written was unnecessarily vague and ambiguous. These two points are intended to provide more guidance, especially as it relates to the next point, the social dimension of community risk. 10 7 of 15 8/16/2016 8:18 AM Public Input No. 13-NFPA [ New Section after ] The FPO shall examine the social dimension of community risk to identify the most vulnerable persons, communities, and areas most affected by fire incidents and other non-fire risks, inclusive of but not limited to, age, economic deprivation, ethnic/language isolation, lifestyle, mobility, risky behaviors, social dependency, and other measures of vulnerability. While perhaps a bit more prescriptive than this standard is intending to be, it should be clearly articulated that any analysis of community risk should not only include a quantitative risk model of the risk of commercial structures or necessarily even just structures themselves... it should make it clear that the CRA should address the question of people quite explicitly. Personnel responsible for fire prevention and code enforcement activities shall meet, at a minimum, meet the job performance requirements in NFPA 1031 for the inspection duties they perform. This section shall not be construed as preventing local jurisdictions from requiring additional training and/or competencies. The wording as it stands can be interpreted to be a terminal competency, making for potential labor/management conflicts if additional requirements are desired by the jurisdiction. The proposed language makes it easier for departments/agencies to require additional education or training in order to meet unique community or agency needs. Existing The Authority Having Jurisdiction shall perform a Community Risk Assessment in order to establish minimum inspection frequencies. In the absence of a Community Risk Assessment, existing occupancy fire prevention inspection and code enforcement inspection frequencies shall be not less than those specified in Table 6.7. Table 6.7 Minimum Inspection Frequency High Moderate Low Critical infrastructure Occupancy Risk Classification Frequency Annually Biennially Triennially Per AHJ The minimum inspection frequencies provided by Table 6.7 are intended to be used in those instances when a Community Risk Assessment has not been performed. As currently written, the language establishes minimum frequencies that may be contrary to what is actually found to be necessary after performing a CRA. The additional language clarifies the intent of this section to provide a minimum in the absence of a CRA. Examples of high-risk occupancies are apartment buildings, are hospitals, high-rise buildings, hotels, dormitories, lodging and rooming, assembly, child care, detention, educational, and ambulatory health care. See input #15 for the Ambulatory health care addition. Remove apartments because the definition is too broad. The NFPA defines and apartment as three units. Only 23 percent of apartments are over 20 units according to American Fact Finder. Only 16 percent of residential fire deaths occur in apartments vs. 84 percent in one-and-two family dwellings. Apartment fire causes are 77 percent smoking, cooking, candles and 60 percent of fire deaths are from those same causes according to the NFPA. Larger apartment buildings would be covered by the high risk definition if they are in high rises or have built-in fire protection systems. Examples of moderate-risk occupancies are ambulatory health care, and industrial industrial properties that do not maintain, store, use, or handle flammable and combustible materials that would require a fire code permit. Definition is inconsistent with NFPA 1 which consider ambulatory health care high-risk by Definition. NFPA * Moderate-Risk Occupancy. An occupancy that has a history of moderate frequency of fires or a moderate potential for loss of life or economic loss. A Moderate-Risk Occupancy. Examples of moderate-risk occupancies are ambulatory health care, and industrial. Ambulatory care occupancies as defined in NFPA 1, section , are occupancies where occupants under anesthesia and treatments rendering them incapable of self-preservation thus requiring staff assistance in an evacuation. Ambulatory health care facilities would be a high-risk occupancy based on the definition provided in NFPA 1730 section NFPA * High-Risk Occupancy. An occupancy that has a history of high frequency of fires, high potential for loss of life or economic loss, or that has a low or moderate history of fires or loss of life but the occupants have a high dependency on the built-in fire protection features or staff to assist in evacuation during a fire or other emergency. Exclude industries that maintain, store, use or handle regulated materials that have a potential for higher frequency and severity of fires. 20 14 of 15 8/16/2016 8:18 AM Public Input No. 6-NFPA [ Section No. A ] A To be effective, fire and explosion investigation and analysis must be conducted in a systematic manner. The systematic approach recommended for fire investigation, as contained in NFPA 921, is that set forth in the scientific method, as follows: (1) Recognize the Need. First, it should be determined that a problem exists. In this case, a fire or explosion has occurred and the cause should be determined and listed so that future, similar incidents can be prevented. (2) Define the Problem. Having determined that a problem exists, the investigator or analyst should define the manner in which the problem can be solved. In this case, a proper origin and cause investigation should be conducted. This is done by an examination of the scene and by a combination of other data collection methods, such as the review of previously conducted investigations of the incident, the interviewing of witnesses or other knowledgeable persons, and the results of scientific testing. (3) Collect Data. Facts about the fire incident are collected by observation, experiment, or other direct data-gathering means. The data collected are called empirical data because they are based on observation or experience and are capable of being verified or are known to be true. (4) Analyze the Data (Inductive Reasoning). The scientific method requires that all data collected be analyzed. This is an essential step that must take place before the formation of the final hypothesis. The identification, gathering, and cataloging of data do not equate to data analysis. Analysis of the data is based on the knowledge, training, experience, and expertise of the individual doing the analysis. If the investigator lacks expertise to properly attribute meaning to a piece of data, then assistance should be sought. Understanding the meaning of the data will enable the investigator to form hypotheses based on the evidence rather than on speculation. (5) Develop a Hypothesis. Based upon the data analysis, the investigator produces a hypothesis or group of hypotheses. The hypothesis must be based solely on the empirical data that the investigator has collected. (6) Test the Hypothesis (Deductive Reasoning). To be valid, a hypothesis must be able to stand the test of careful and serious challenge. Testing of the hypothesis is done by the principle of deductive reasoning, in which the investigator compares his or her hypothesis to all the known facts as well as the body of scientific knowledge associated with the phenomena relevant to the specific incident. A hypothesis can be tested either physically, by conducting experiments, or analytically, by applying scientific principles in thought experiments. When relying on experiments or research of others, the investigator must ensure that the conditions and circumstances are sufficiently similar. When the investigator relies on previously conducted research, references to the research relied upon should be noted. If the hypothesis cannot be supported, it should be discarded and alternative hypotheses should be developed and tested. This can include the collection of new data or the re-analysis of existing data. The testing process needs to be continued until all feasible hypotheses have been tested and one is determined to be uniquely consistent with the facts and with the principles of science. If no hypothesis can withstand an examination by deductive reasoning, the issue should be considered undetermined.
