8 THE AMENDMENT WAS THE MAIN MOTION WAS NOT CARRIED CARRIED BACKGROUND TRCA staff has been studying possibilities for a new or expanded head office for a number of years now. To support and advise staff as the project moves forward, a small Long Term Office Accommodation Working Group (LTOAWG) was created at Authority Meeting #4/08, held on May 23, 2008, by Resolution #A126/08, in part, as follows: THAT a Long Term Office Accommodation Working Group consisting of Toronto and Region Conservation Authority (TRCA) Members representative of the participating municipalities including the Chair, be created to support and guide staff in development and implementation of the Long Term Office Accommodation project;......that the Working Group include Chair Gerri Lynn O'Connor, Councillor Ron Moeser, Councillor Maria Augimeri, Deputy Mayor Jack Heath and Councillor John Sprovieri;... The Working Group is comprised of one representative from each of the City of Toronto, the regions of Durham, Peel and York, including the Chair of the Authority, and any other interested TRCA Members. Deputy Mayor Heath and Councillors Moeser and Tovey have expressed an interest in continuing on the LTOAWG, and the Chair of the Authority is to automatically be appointed. In addition, an appointee is needed to represent the Region of Durham, unless the Chair of the Authority, to be elected at Annual Authority Meeting #1/15, held on January 30, 2015, is a Durham representative. In 2012 the LTOAWG was reconstituted by the Authority. Since that time, staff has explored options for the construction of a new permanent head office facility on the parking lot lands that TRCA owns at BCPV and its present Head Office location at 5 Shoreham Drive. The firms of DTAH and N. Barry Lyon Consulting were hired as the design and finance team to examine international precedents, develop options for both sites, and investigate alternative methods of financing the proposals. The alternatives, which confirmed the general development carrying capacity and potential buildout of the lands, was presented to the LTOAWG on October 25, 2013, with financing options being discussed with staff in the following months. As space accommodation pressures increased during this time, TRCA has leased a temporary Interim Head Office facility at 101 Exchange Avenue for a six year term, as approved at Authority Meeting #2/14, held on March 28, Staff from the Downsview Office have been relocated to the Interim Head Office and staff from the 5 Shoreham Drive office will be relocated in March. The relocation of staff to 101 Exchange Avenue has eliminated the additional staff relocation costs previously associated with the redevelopment of the 5 Shoreham Drive site. 6

9 Staff has examined the existing planning and zoning permissions on both the 5 Shoreham Drive and BCPV parking lot sites. The BCPV parking lot site is designated as Parks and Open Space Areas Other Open Space Areas in the City of Toronto Official Plan. These areas are to be used primarily for open spaces associated with specialized uses and facilities (eg. a TRCA facility). The 5 Shoreham Drive site is designated as Parks and Open Space Areas Natural Areas which are to be used primarily for conservation and passive recreation uses. However, despite the Official Plan designations, the existing Zoning By-law on the 5 Shoreham Drive site allows for a wide variety of "uses of the Conservation Authority", and the property is pre-zoned for office use subject to the provisions of the by-law. This would allow for the redevelopment of the 5 Shoreham Drive site without the need for a Zoning By-law Amendment. The BCPV parking lot site, however, is subject to the City's new Zoning By-law which zones the site Open Space Recreation (OR) which does not include the site specific provision for "uses of the Conservation Authority" and does not allow for office based uses. Uses that are allowed include most public sector uses such as fire station, community centre, day care, entertainment, museum, etc. RATIONALE Staff has discussed this with City of Toronto Planning staff and a Zoning By-law Amendment is required to accommodate an office on the BCPV parking lot site. This is a long process, involving comprehensive public engagement and a well thought out plan incorporating public uses such as park land or other community uses. Extensive consultations with potential users and TRCA's partners, and the development of a comprehensive financing strategy are required over a two or three year period before any detailed design work could proceed. As such, it is unlikely that a new headquarters building could be constructed on the BCPV parking lot site and staff relocated within the six year timeframe of the lease at 101 Exchange Avenue. The existing Head Office site at 5 Shoreham Drive has been the location of TRCA's Head Office since the 1970's. It is located in close proximity to the steep slopes of the Black Creek Valley Corridor and associated significant natural features and includes Honour Roll trees. TRCA's history is rooted here and the ravine setting will require careful planning to ensure that The Living City Policies are met and exceeded as any redevelopment of the site evolves. Given this history, the input provided by the work completed by DTAH, an examination of the planning permissions on both sites, and the opportunity granted by the temporary relocation to 101 Exchange Avenue, staff is of the opinion that the 5 Shoreham Drive site should be chosen as the location for TRCA's new, long term, headquarters building. The use of the site for some other form of redevelopment would be problematic given the challenges and risk posed by re-designating the site from Open Space to some other development-based designation, as well as the fact that TRCA as an environmental agency is the most suitable party to redevelop a site in close proximity to such sensitive natural features. 7

10 Staff recommend that a two-phased approach be taken to the planning of both sites. Phase 1 is to establish a Master Plan for both sites north and south of Shoreham Drive. This will build on the existing conceptual development framework completed by DTAH in 2014 and will examine options to accommodate a future development partner that could include an office user, residential development or other institutional and community uses while considering the ongoing operational needs of Black Creek Pioneer Village. Phase 2 is to develop a schematic design and construction cost estimate for a new +/- 80,000 square foot headquarters on the 5 Shoreham Drive site. The latter would put TRCA in a position to apply for Site Plan approval and building permits, and construct a new headquarters prior to the expiry of the lease at 101 Exchange Avenue. Staff has developed an excellent working relationship with the DTAH team lead by Joe Lobko through the process to date. DTAH is an award-winning landscape architecture/architecture/urban design firm that focuses on sustainable development, mostly for public and non-profit sector clients including the City of Toronto, Toronto Waterfront Revitalization Corporation, Evergreen and TRCA. Examples of their successful projects include the Evergreen Brick Works, the Black Creek Urban Farm on Jane Street and Wychwood Barns, the first two of which are owned by TRCA. Given this, staff asked DTAH to identify a suitable team and to provide a proposal to implement the planning and design process. DTAH has built an interdisciplinary team that includes leaders in the green design industry, with experience on projects where innovative thinking around sustainable design was a defining characteristic, and recently submitted a proposal for the work. Many of the proposed team members are actively involved in the Canada Green Building Council and other innovative green building organizations. This proposal has been reviewed and is supported, with some refinements, by staff who will make a recommendation to the Authority on February 27th on award of the contract. CONCLUSION Staff recommend that members of the Working Group be selected, that the 5 Shoreham Drive site be chosen as the preferred location for a new headquarters building, and that staff be directed to prepare a report on award of a preferred source contract based on the DTAH proposal, to be considered for approval at the February 27, 2015 Authority meeting. 11 SECTION II - ITEMS FOR EXECUTIVE ACTION RES.#B4/15 - Moved by: Seconded by: LOWER DON 1D-2D FLOOD MODEL Request for Proposal # Award of Contract # for professional engineering services in support of the creation of a 1D-2D hydraulic model and regulatory engineered floodline mapping for the Lower Don River from Pottery Road to the Lake Ontario Outer Harbour, City of Toronto. Giorgio Mammoliti Jennifer O'Connell THAT Contract # for the engineering services required for the development of the 1D-2D hydraulic model and engineered floodline mapping for the Lower Don River from Pottery Road in the City of Toronto downstream to the Lake Ontario Outer Harbour be awarded to Stantec Consulting Ltd. at a total cost not to exceed $131,638.00, plus HST, it being the highest ranked proponent resulting from evaluation criteria set out in the Request for Proposal (RFP); THAT Toronto and Region Conservation Authority (TRCA) staff be authorized to approve additional expenditures to a maximum of 15% of the contract cost as a contingency allowance if deemed necessary; THAT should staff be unable to negotiate a mutually acceptable agreement with the above-mentioned proponent, staff be authorized to enter into contract negotiations with the next highest ranked proponent; AND FURTHER THAT authorized TRCA officials be directed to take such action as necessary to implement the contract, including the signing and execution of documents. CARRIED BACKGROUND The purpose of this study is to prepare an integrated update to TRCA's regulatory floodline modeling and mapping for the Don River, south of Pottery Road to the Lake Ontario Outer Harbour. The study will involve the development of a coupled one and two dimensional hydraulic model, preparation of engineered floodline mapping, and the characterization of the floodplain in the area with discussion on the flood vulnerability of infrastructure located within the Don Valley Transportation Corridor. Several one or two dimensional models have been previously developed within the study area: The floodline for the Don River between Pottery Road to Queen Street East is based off a one-dimensional HEC-RAS model originally developed by EarthTech in Parts of this model were last updated in 2011 by R.J. Burnside & Associates. A Delft 3D two-dimensional model was developed for the Don Mouth Naturalization Project Environmental Assessment (DMNP EA). This model was not calibrated on flood event data but was validated as part of a peer review for the environmental assessment (EA). The area between Queen Street and the former CN rail embankment has an engineered floodline based off a refined (2013) version of the Delft 3D model. 9

12 The Delft 3D model was selected for the Don Mouth Naturalization and Port Lands Flood Protection Project EA (DMNP EA) through an evaluation of non-periphery hydraulic modeling systems with 2D and 3D capabilities. The Delft 3D system scored particularly high in its ability to model sediment transport and bed scour and therefore was selected for use in the DMNP EA. The Delft 3D model, however, is less effective in representing structures such as culverts and bridges whose soffits are within the floodplain. As the study area for the current model update involves urban areas exhibiting both one and two dimensional flow, a coupled 1D-2D model is the preferred tool for the regulatory floodplain mapping update. The regulatory floodplain at the mouth of the Don River was previously defined based on a model developed in 1991 and the model is no longer descriptive of the floodplain following the construction of the West Don Lands Flood Protection Landform. Currently, the 2013 refined Delft 3D model is being used as an information source for areas south of the rail embankment to the mouth of the Don River. The project will provide a comprehensive model that meets TRCA's standards for regulatory mapping and is descriptive of the existing floodplain. Other benefits of updating the flood model include that it will: provide better understanding of the flood mechanisms associated with flooding of the Don Valley Transportation Corridor and will form the basis of flood remediation studies for the vulnerable infrastructure in the area; leverage newly collected high resolution gauge data at Todmorden Mills and Dundas Street to calibrate and validate the model; create a model that is supported by calibration, providing a more grounded basis for the results, which are used in the assessment of development and infrastructure applications; incorporate information and modeling collected over the course of the DMNP EA, as well as generate an updated topographic and base-map dataset that can be used in detailed design of the DMNP; and provide descriptive figures and animations, suitable for use in communicating with TRCA staff, public agency partners and the general public. As the number of 2D modeling exercises is increasing throughout the Toronto region, TRCA engineering staff has established 2D modeling protocols to standardize the modeling approach, including the use of DHI's Mike Flood as the 2D model standard for regulatory floodplain delineation. In addition, using LiDAR information to define the topographic base for 2D models is now the standard approach for areas where 2D modelling exercises are being completed. In 2013, TRCA acquired high resolution digital elevation models using LiDAR for the study area. Given the limitations with existing models and advances in the new technology used to obtain accurate topographic information and flood modeling results, TRCA staff has identified the need to develop a fully coupled 1D-2D flood model for the Lower Don River. The results of the 1D-2D model and floodplain characterization will be completed by late fall 2015 and used to accurately define flooding conditions, regulation extents, and flood remediation opportunities and requirements throughout the study area. 10

13 RATIONALE Request for Proposals for highly specialized engineering services in coupled 1D-2D flood modeling was advertised on-line with biddingo.com on December 9, The submissions were evaluated on a weighted scoring system consisting of 85% technical criteria and the remaining 15% on the fee proposal. These criteria included the following: applicable experience of the responding lead firm and their consulting team, particularly in 1D-2D coupled hydraulic modeling with Mike Flood and experience in the study area; experience, qualifications and availability of individual team members proposed for this project; consultant understanding of the scope of work; proposed approach and methodology for this assignment including an assessment of any anticipated difficulties and the proposed approach to overcome them; proposed schedule and work plan, and ability to comply with the proposed schedule; and detailed cost breakdown. Per TRCA's Procurement Policy and procedures, the proposals were opened by the Procurement Opening Committee on January 7, 2015 with the following results: BIDDERS TOTAL (Plus HST) ADHYTECH Geomorphic $81, Valdor Engineering Inc. $85, Conestoga Rovers and Associates Ltd. $ Baird & Associates $129, Stantec Consulting Ltd. (in partnership with Limnotech) $197, Members of the Selection Committee, consisting of TRCA staff (Sameer Dhalla, Rehana Rajabali and Ken Dion), reviewed the proposals based on the aforementioned evaluation criteria. 14 Based on the evaluation of the bids, it was concluded that the combined technical and fee proposal valued at $131, submitted by Stantec Consulting Ltd. offered the best service for value among the engineering firms whose technical capacity matched the project needs. Although Adhytech Geomorphic and Valdor Engineering provided low bid prices, their lack of experience in the project area and in 1D-2D coupled Mike Flood modeling, resulted in lower technical scores. Furthermore, their technical proposals did not demonstrate a strong understanding of the scope of work. Stantec Consulting Ltd. had the most complete proposal that met the requirements of the RFP. The project team offered the most experience with projects of similar scale and scope, including regulatory floodplain mapping experience and an understanding of the uses of the final product. By partnering with DHI and RBWater (Rob Bishop), Stantec was able to leverage extensive 1D-2D Mike Flood modeling experience and knowledge of the study area, including its history and significance. Staff report on the status of 2015 municipal levy requests to TRCA's participating municipalities. Jennifer Innis Jennifer O'Connell IT IS RECOMMENDED THAT the staff report on the status of municipal budgets dated January 26, 2015 be received. CARRIED BACKGROUND Toronto and Region Conservation Authority (TRCA) staff initiated the 2015 and multi-year municipal budget estimates process in the spring 2014, and to date has included a number of staff level meetings and presentations. In the coming months, TRCA staff will appear before and make further presentations to councils and various committees of councils in order to secure final approval of 2015 levy funding. 12

15 Each jurisdiction has a distinctive budgeting process which leads to the respective elected councils approving a TRCA funding allocation. As a result of the 2014 municipal elections, 2015 funding approvals have been progressing on a delayed schedule. TRCA staff still anticipates, however, that the respective municipal council approvals will be completed in sufficient time for the Authority to adopt TRCA s 2015 budget (and associated municipal levy) at its April 2015 meeting. This report provides an update on the status of the budget process and negotiations for 2015 municipal funding. Detailed project descriptions which have been submitted to each of the municipalities are available to members upon request. RATIONALE General Levy The TRCA operating budget is supported by a general levy on participating municipalities. The general levy comprises the net cost of services which is apportioned to the participating municipalities on the basis of current value assessment (CVA) in each municipality, as adjusted by TRCA policy. The net cost refers to gross expenditures, approximately $40 million, less revenues from all other sources. Except for Durham Region, the table below summarizes the general levy amounts that are being recommended by municipal staff. Staff level meetings have not concluded with Finance staff in Durham Region. The amount shown below represents TRCA's initial budget request for Durham Region. 16 Special and Capital Projects Levy The capital and special levy budget represent the net cost of capital projects that are, for the most part, deemed by the Authority to singularly benefit the municipality in which the project occurs. The capital levy is accordingly assigned to, and raised from, the respective benefitting municipality. The exception to this policy is for corporate or administrative projects which are apportioned on the basis of CVA. The table below summarizes the 2015 level of levy support from the major participating municipalities in the TRCA jurisdiction. Amounts that will be required from the Township of Adjala-Tosorontio and the Town Mono are not significant. Regional Municipality of Durham The 2015 capital submission request to Durham Region in the amount of $1.135 million includes an increase of 5% on the core budget plus two special requests. A special request of $18,000 ($30,000 total) in new funding will allow for a more complete assessment of erosion sites within the Region. The 2015 submission also includes new funding to initiate a Conservation Land Care budget in Durham, similar to the ones in York and Peel Regions. This funding will enable TRCA to effectively look after its land holdings and trail network for Durham Region residents. The recently released 2015 budget guidelines allow a 1.5% increase over 2014 in this category of funding. A further staff level meeting is scheduled for February 4, 2015 with Durham Region Finance staff. Regional Municipality of Peel The 2015 capital submission to Peel Region includes core funding of $ million, an increase of 2.5% over TRCA has also included a special request for $1.25 million in each of 2015 and 2016, respectively, to fund municipal servicing of the Bolton Camp site. Peel Region has proposed that the additional funding for Bolton Camp municipal servicing be allocated from the Peel Utility Reserve. City of Toronto The 2015 capital submission to the City of Toronto totals $ million, of which $ million is financed from City of Toronto Water revenue and reserve contributions and the balance, $3 million, is debt financed. The key elements of the of the City of Toronto budget are summarized below: 14

17 Debt funded projects $3 million - unchanged from Base budget - water revenues -$4.069 million, an increase of 2.5% over Erosion Control (initial enhancement) - $2 million, unchanged over Erosion Control (additional funding) - $5 million - unchanged from 2014, ending in In meetings between TRCA and City of Toronto senior staff, TRCA has been advised that the City is pursuing a cost-sharing agreement with the federal and provincial governments that will assist the City in addressing outstanding capital needs including those identified by TRCA. Within the current 10 year cycle Toronto Water has included $56 million (and $9 million beyond the cycle) starting in 2016 for critical erosion and flood projects across the City to be undertaken by TRCA, based on a 2/3 contribution from senior levels of government. Toronto Water has made available $3 million for the Scarborough Waterfront Access Plan environmental assessment which will be substantially completed in This funding exists outside of the formal levy process and is not included in the above totals. The actual implementation of the plan, which is estimated to cost $54 million within the current cycle, has been identified as a future pressure, but not funded. Regional Municipality of York Prior to the 2015 budget cycle, TRCA staff met with York Region Finance staff to advise them of TRCA s intention to substantially increase its funding requests beginning with the 2015 cycle. While the requests for additional funding were positively received, the Region s current financial situation has not allowed it to confirm additional funding beyond a modest inflationary increase of $94,000 or 1.9%, as noted above. The TRCA multi-year submission to the Region included a list of potential projects which have been termed "unaccommodated pressures" by the Region. The 2015 capital request to York Region (including unaccommodated pressures) totalled $9.631 million. Following negotiations between TRCA and York Region staff, the revised TRCA 2015 capital and special levy funding will be recommended at $4.960 million, an increase of 1.9% over SUMMARY A high level summary of the important issues has been provided for the information of the members to assist them as the TRCA budget comes before various municipal committees and councils.
