3 EXECUTIVE SUMMARY On Tuesday, June 17, 2014, an Open-House Public Involvement (PI) Meeting was conducted by Ohio Department of Transportation (ODOT) District 4 to present and discuss the project, as currently proposed, with local residents, business owners, the general public, and public officials. Public comments regarding the proposed SUM project and any potential social, economic, and/or environmental impacts associated with the proposed project were welcomed and solicited by ODOT personnel. In total, 32 people, including residents, business owners and local officials attended the Open-House PI Meeting. Members of the public were encouraged to view project information exhibits in the open-house area. The exhibits focused on the following areas: Proposed Improvements Right-of-Way Acquisition Process Maintenance of Traffic (MOT) Air Quality/Noise/Environmental Documentation Throughout the Open-House PI Meeting, personnel from ODOT, Carpenter Marty Transportation and McCormick Taylor (Project Team) were available to address any questions and/or concerns regarding the proposed highway improvements project. Written and oral comments were solicited during the meeting, and written comments could be provided by mail prior to the end of the formal comment period on July 7, Comment Summary Comment forms were provided to solicit feedback from attendees of the meeting. Seven (7) comment forms were completed and returned to ODOT District 4. In general, the written and oral comments indicated the following concerns/suggestions: Construct noise walls prior to the widening of Interstate Route (IR) 76; Maintain highway condition to reduce noise levels; Correct drainage issues with the culverts located at STA and STA , and the Barber Road interchange; IR-76 entrance/exit ramps at Barber Road should remain open during construction; Maintain traffic along IR-76 24/7; Do not change current traffic patterns at the Barber Road interchange; Construction should be completed in a timely manner so impacts on local businesses are reduced; Highway signs along IR-76 should be large and highly visible; Require truck traffic to stay in right lane on the gradual hill inclines; Construct noise walls to reduce noise; and Deficient entrance ramp from Barber Road to eastbound IR-76. 4 MEETING DETAILS Date/Time: Tuesday, June 17, :00 p.m. to 7:00 p.m. Location: Barberton Middle School Cafeteria th Street NW Barberton, OH Purpose of Meeting: The purpose of the public meeting was to present and discuss the currently proposed SUM widening/reconstruction highway improvements project along IR-76 with local residents, business owners, the general public, and public officials; to solicit public comments regarding the proposed project, and any potential social, economic, and/or environmental impacts associated with the proposed project; present and discuss the proposed noise walls and their selected colors and textures; and solicit public comments regarding the air quality qualitative Mobile Source Air Toxics (MSAT) study and the quantitative Particulate Matter 2.5 (PM 2.5 ) Hot- Spot Analysis. Representatives from ODOT District 4 and project consultants were available to discuss the proposed improvements, right-of-way acquisition process, and environmental impacts, and address any questions and/or concerns the public may have regarding the proposed project to improve highway capacity and reduce congestion to better serve the needs of the traveling public. The following highway improvements were presented and discussed at the meeting: Addition of one (1) eastbound/westbound lane from west of State Route (SR) 21 to east of W. State Street within the existing highway median; Addition of five (5) noise barriers; Extension of entrance and exit ramps at interchanges; Reconstruction and replacement of bridges/culverts; Highway drainage improvements; and Full depth pavement replacement along the mainline and ramps. The proposed project is scheduled for construction in Fall The estimated construction cost is approximately $104 million. Meeting Notifications: A news release was issued to local media on May 30, 2014 to announce the meeting date, time, location, and purpose. As a result of the news release, the Akron Beacon Journal Online posted an article on June 4, 2014, entitled ODOT wants to add lane to I-76 through Norton, Barberton. Additionally, an electronic advertisement was posted on the ODOT District 4 website. Public meeting notification letters, dated June 3, 2014, were mailed to 268 property owners, businesses and public officials. See Appendix A of this report for copies of the news release, publication, notification letter and distribution list. Page 2

5 Attendance: Thirty-two (32) attendees registered for the meeting. See Appendix A of this report for a copy of the public meeting sign-in sheet. Representatives from ODOT District 4 and project consultants were available to discuss the proposed improvements, right-of-way acquisition process, and environmental impacts, and to address any questions and/or concerns the public may offer. Justin Pitts MEETING FORMAT Held in the Barberton Middle School cafeteria, the meeting was structured as an Open-House PI Meeting. The meeting format provided the public with an opportunity to speak one-on-one with Project Team members, to ask questions, and to express their interests, comments and concerns regarding the project. Members of the Project Team were available throughout the Open-House to address any questions, identify public issues, and collect public input. Informational Stations: Listed below is a description of each informational station from the Open-House Public Involvement Meeting: Station 1: Registration and Introduction. Upon arrival, attendees were asked to sign-in at the registration table where a PI Informational Handout on the proposed project and public meeting was available for their use. The PI Information Handout included a Public Meeting Comment Form that gave the public an opportunity to provide written comments or suggestions at their discretion. See PI Informational Handout and completed Comment Forms in Appendix A of this report. This PI Handout was also available on ODOT s website. Station 2: About the Project. This station included multiple mapping sets and project documentation throughout the exhibit area, and was established to convey a level of understanding with the public regarding the proposed project. Plot aerial mapping with proposed widening superimposed, preliminary right-of-way plans including the property map and right-of-way detail sheet for the proposed right-ofway takes at the Wolf Creek/abandoned railroad area, proposed maintenance of traffic (MOT) mapping, and the anticipated project schedule were displayed for Page 3

In addition, two (2) bound hard copies of the Barber Road, Cleveland-Massillon Road, SR 21 and IR-76 Feasibility Studies were provided for viewing, and project team members were available to interact one-on-one with participants and solicit public comments/suggestions. Station 3: Air Quality. Air quality is an important consideration for all proposed highway projects which add capacity; therefore, project team members were available at Station 3 to discuss results of the Mobile Source Air Toxics (MSAT) and Particulate Matter 2.5 (PM 2.5) Hot-spot Analysis with the public, and give the public an opportunity to comment on these air quality analyses, and the other social, economic and environmental impacts for the project. The Qualitative MSAT Analysis Report and PM 2.5 Hot Spot Analysis Report were available for review during the meeting. A handout regarding the air quality study and where to send comments regarding the study was available at this station and additional comment forms were also available here. Station 4: Noise Analysis and Community Context Sensitivity. As part of the environmental process, a traffic noise analysis was conducted to assess sound levels and identify Noise Sensitive Areas. Public participants were given the opportunity to view the traffic noise analysis report, selected noise wall locations on aerial mapping, and the texture/material and color chosen for the residential and highway sides of the noise barrier, and interact one-on-one with individual team members at this station. Station 5: Environmental Overview. This station was established to convey a level of understanding with the public regarding the environmental impacts of the project, and give the public an opportunity to provide information regarding the presence of any known cultural resources and/or environmental sensitive areas relative to this project. Participants were able to review environmental documentation prepared for the project study area, particularly the Level 2 Ecological Survey Report, Environmental Site Assessment (ESA) Screening, Phase I ESA, Section 106 Request for Review, and Purpose and Need document. Station 6: Comment Area. Attendees used this area to complete their comment forms and place them in the Public Comments box for Project Team review. This comment form allowed attendees to , mail or fax their comments up to two weeks following the public involvement meeting, as well. INFORMATION GATHERED Public Involvement Meeting Comments: Interested attendees were encouraged and offered the opportunity to submit a written comment on the provided Public Meeting Comment Form during the meeting, or by mail or to ODOT District 4. An area was available for attendees to write their comment(s) and leave their comment sheet in a designated Public Comments Box. A total of 7 public comments were received by ODOT District 4. Roadway drainage ditches will be enhanced within ODOT right-of-way to accommodate storm water flow. Two lanes in each direction along IR-76 shall be maintained at all times during project construction. The current traffic pattern at the Barber Road interchange will not be modified by the project. The westbound IR-76 exit ramp to Barber Road will be closed a maximum of 30-days. The eastbound IR-76 entrance ramp from Barber Road will be closed a maximum of 120-days. The westbound IR-76 entrance ramp from Barber Road and the eastbound IR-76 exit ramp to Barber Road will be maintained. ODOT will maintain the integrity of the highway. The entrance ramp from Barber Road to eastbound IR-76 will be lengthened to allow for proper acceleration as part of the project. The construction of recommended noise walls is included as part of the project. Page 6

9 Noise Public Involvement Comments: On March 7, 2014, property owner/occupant Noise Public Involvement (PI) letters and noise wall surveys were distributed to benefitted property owners/occupants (receivers) located behind the recommended noise walls along the five (5) noise sensitive areas (NSAs) adjacent to IR-76 in the cities of Norton and Barberton to determine if the benefitted receivers want the recommended noise walls as part of ODOT s noise abatement design process. The PI Noise mailing and subsequent door-to-door canvassing also provided benefitted receivers with possible textures/materials and colors to select for the residential sides of the recommended noise walls. Results of the Noise Wall Survey were totaled following the end of the 60-day comment period. The total number of possible votes for benefitted property owners and/or occupants and survey results, including the preferred material/color, is provided in Table 2. Table 2. Therefore, all of the recommended noise walls are currently proposed for detailed design and construction as part of the IR-76 widening/reconstruction project. The state agency is proposing to add a third lane to the highway between state Route 21 and West State Street. It s a fairly high-traveled area, ODOT spokesman Justin Chesnic said about the reason why. About 70,000 vehicles use that 5.6-mile stretch each day. Norton Police Chief Thad Hete said the two-lane highway can get congested during rush hour and called it a highaccident area in the city. If [adding lanes] would cut down on the congestion and cut down on the number of accidents, I m all for it, he said. The $105 million project also involves adding noise walls in some areas; extending ramps at interchanges; rebuilding and replacing bridges and culverts; improving drainage; and replacing the pavement. There s no date set for the construction to begin. Instead, the agency is preparing the project now for when funding becomes available, Chesnic said. ODOT will hold a public hearing to gather feedback from 5 to 7 p.m. June 17 at the Barberton Middle School cafeteria, 477 Fourth St. NW. Urankar, District Deputy Director June 3, 2014 Subject: Open House Public Involvement Meeting Proposed Interstate Route 76 Widening/Interchange Improvements Project ODOT Project: SUM ; PID Cities of Norton and Barberton, Summit County, Ohio Dear Resident/Property-Business Owner/Interested Citizen: The Ohio Department of Transportation (ODOT) will conduct an Open House Public Involvement Meeting for proposed roadway improvements along Interstate Route 76 (IR-76), in the cities of Norton and Barberton, Summit County, Ohio. This project will improve highway capacity and reduce traffic congestion to better serve the needs of the traveling public. The project limits extend from Medina Line Road, in Norton, to West State Street, in Barberton, a distance of approximately 5.6 miles. The project proposes to construct one (1) additional eastbound and westbound travel lane from west of State Route (SR) 21 to east of West State Street within the existing highway median. The project includes extension of entrance/exit ramps at interchanges, bridge and culvert reconstruction and replacement, drainage improvements and pavement replacement along mainline IR-76 and ramps. The public involvement meeting is scheduled on Tuesday, June 17, 2014 from 5:00 PM to 7:00 PM at the Barberton Middle School cafeteria located at th Street NW, Barberton, Ohio. The public involvement meeting will be conducted in an open house format with no formal presentation. Attendees may arrive anytime between 5:00 PM and 7:00 PM. The purpose of this public involvement meeting is to present and discuss the proposed project and to solicit public comments regarding its social, economic and environmental impacts. In compliance with Section 106 of the National Historic Preservation Act of 1966, as amended (codified as 36 CFR 800), ODOT also requests information regarding the presence of any known cultural resources in the vicinity of the project. Cultural resources include prehistoric and historic archaeological sites, historic bridges and buildings, sites and districts. An analysis of potential highway traffic noise impacts concluded noise abatement is warranted, feasible and reasonable along five (5) Noise Sensitive Areas (NSA). A total of approximately 12,500 linear feet and 170,000 square feet of noise walls were identified and determined to satisfy the ODOT noise abatement and cost reasonableness criteria for identifying noise abatement locations. Based on the results of a noise survey recently conducted within the five (5) NSAs, all five (5) recommended noise wall locations received greater than 50% support in favor of construction by the adjacent residents/property owners and, therefore, are proposed for construction as part of the IR-76 widening/reconstruction project. In addition to highway traffic noise, air quality is an important consideration for any proposed highway project to add capacity. A quantitative Particulate Matter (PM) 2.5 Hot-spot Analysis was performed for the project as -over- ODOT is an Equal Opportunity Employer and Provider of Services

S. Environmental Protection Agency (EPA) and Ohio EPA. Results of this analysis indicate the PM 2.5 design values for Opening Year 2019 and Design Year 2036 Build conditions for the 24-hour and annual standards are less than the National Ambient Air Quality Standards (NAAQS) of 35µg/m 3 (micrograms per cubic meter of air) and 15 µg/m 3, respectively. The quantitative PM 2.5 Hot-spot Analysis report prepared for the project is available for review at the ODOT District 4 Office, 2088 South Arlington Road, Akron, or the ODOT District 4 website at (select the Public Meetings/Public Involvement heading on the left side menu). ODOT requests comments on the quantitative PM 2.5 Hot-spot Analysis and the other social, economic and environmental impacts for the project. Mapping, environmental reports, including the highway traffic noise analysis and the quantitative PM 2.5 Hot-spot Analysis, and project plan sheets illustrating the project will be displayed. Throughout the open house, representatives of ODOT and its project team will be available to discuss the proposed improvements and environmental impacts and to address any questions and concerns. PROJECT DESCRIPTION The proposed project limits extend from Medina Line Road, in Norton, to West State Street, in Barberton, a distance of approximately 5.6 miles and involve the construction of one (1) additional eastbound and westbound travel lane from approximately 4,350 feet west of State Route (SR) 21 to approximately 420 feet east of West State Street within the existing highway median. The project also includes: extension of entrance/exit ramps at interchanges; bridge and culvert reconstruction and replacement; drainage improvements; full-depth pavement replacement along the mainline and ramps and noise wall installation. DESIGN-BUILD The proposed widening of IR-76 with improvements to existing interchanges is being constructed as a Design-Build project. Design-Build combines the design and construction phases of a project into one contract. This process is typically faster than the Design-Bid-Build process that is traditionally used by ODOT. In the Design-Build scenario, the design firm and construction contractor collaborate as a team, working concurrently on the final design and construction phases of the project, to expedite delivery. 18 PURPOSE AND NEED The purpose and needs of the transportation improvement are to reduce congestion, preserve the highway facility and establish current design standards in the transportation improvement study area. Traffic Congestion: To measure operational conditions along a highway facility, ODOT uses a qualitative analysis called Level of Service (LOS) as defined by the Highway Capacity Manual. LOS is a letter code ranging from A for excellent conditions to F for failing conditions. The conditions defining the LOS for highways are summarized from the HCM as follows: Using the certified traffic counts, a series of traffic analyses were completed to evaluate the existing and projected LOS for the section of IR-76 from the Medina County Line to State Street. Table 1 below summarizes the LOS for the highway sections from the traffic analysis during peak travel hours for 2016 and the Design Year 2036 with no transportation improvements. 19 In summary, one section from Barber Road to State Street is LOS D in the current year (2016 EB/WB) and one section from Cleveland-Massillon Road to Barber Road is LOS E in the current year (2016 EB) in the no-build condition. However, all four (4) sections in design year (2036 EB/WB) have LOS D or E in the no-build condition. Structural Consideration: A Bridge Condition Rating survey was completed in Twelve (12) structures exist within the proposed project limits. However, two (2) of the structures (SUM /Clark Mill Road over IR-76 and SUM /Summit Road over IR-76) are being replaced as a separate, independent project. The in-depth inspection process consists of assigning all of the individual items of the bridge a code from 1-4. A code of 1 indicates good condition, 2 indicate fair condition, 3 indicate poor condition and 4 indicate critical condition. These individual item codes are then used to assign the major components of the bridge (deck, superstructure, substructure, and approaches) summary of rating from 0-9, with 0 indicating a failed condition and 9 indicating excellent condition. This rating reflects the overall condition of the structure. Table 2 below summarizes the existing conditions of the 12 structures within the project study area. A FO bridge is one that has inadequate lane widths, shoulder widths, vertical Page 3

20 clearances or does not meet current geometric standards. A SD bridge signifies that a bridge has a deficiency in the deck, superstructure or substructure. The proposed project will replace three (3) structures, rehabilitate two (2) structures, and provide minor maintenance to five (5) structures and channel cleanout at one (1) structure. Pavement Condition: In addition to the congestion-related analyses, ODOT s analysis of existing pavement condition along IR-76 determined the existing pavement has exceeded its useful service life. IR-76 is a priority system facility within the limits of the transportation improvement. The 2012 Pavement Condition Rating (PCR) for Summit IR-76 from the Medina County Line Road to Central Avenue ranges from 72 to 82 (good). However, PCR numbers are maintained at a good level with periodic spot paving repairs. A PCR of 65 or less is considered to be deficient for a priority system facility. The original pavement for this section of IR-76 was constructed in 1960 and The Average Daily Traffic (ADT) in 2016, along the section of IR-76 within the project limits, is calculated to be 344,920 vehicles per day and the Design Year 2036 ADT is calculated to be 428,170 vehicles per day. The existing pavement in this section of IR-76 exhibits high severity joint and slab cracking distresses due to the high truck volumes and poor subsurface drainage. The existing pavement in this section of IR-76 has been maintained with regular asphalt overlays in 1986, 1996, and 2006 and with a large quantity of deteriorated pavement joints spot paved in 1992 and 2011 with asphalt concrete patches. The high truck traffic volumes have aggravated the existing slab cracking distresses such that the PCR degradation rates are increasing at an accelerated pace above the normal pavement degradation rates. Ultimately, continued pavement rehabilitation necessary to maintain acceptable pavement conditions with these types of distresses becomes cost prohibitive. Further, the ODOT Pavement Design and Rehabilitation Manual addresses pavement life cycle based on a 35-year duration. While this manual recognizes rehabilitation treatment on pavement prior to reaching 35 years in age and beyond, it does not provide a definitive service life for pavement. The existing pavement has surpassed its useful service life based on the following: (a) the age of the pavement 53 years old in 2013, (b) the actual/future traffic volume on the pavement substantively exceeds the projected traffic volume used to design the original pavement, and (c) the deterioration/distresses of the existing composite pavement. These factors impair the ability of this portion of IR-76 to function properly, both currently and in the future, with minimal maintenance costs. Ramp Consideration: Three (3) merge ramps (NB SR 21 to EB IR-76; SB SR 21 to WB IR-76; and Barber Road to EB IR-76) are substandard in length and fail to support adequate acceleration for merging onto IR-76. Two (2) exiting ramps (EB IR-76 to Barber Road; and WB IR-76 to Barber Road) are also substandard in length and fail to support adequate deceleration for vehicles exiting IR-76. Highway to highway ramps should have a combination of radius, grade and super-elevation (curve banking) allowing drivers of all vehicles to maintain speeds within 15 mph (less) of the posted mainline speeds. Ramps from local roads where the vehicle enters from a stopped condition should have a combination of radius, grade, super elevation and length allowing drivers to obtain highway speeds by the time a merge is attempted. Exit ramps that end at a stop-controlled local street should be long enough, given expected traffic backup, and with adequate radii grades and super elevation to allow drivers to accomplish virtually all their deceleration on the ramp. Table 3 below summarized the existing ramp conditions and the proposed ramp lengths. Page 4

RIGHT-OF-WAY ACQUISITION During preliminary engineering, preliminary right-of-way plans were developed to determine the additional right-of-way acquisition necessary to construct the project. Right-of-way acquisitions will be performed by ODOT in accordance with the Uniform Relocation Assistance and Acquisition Policies Act of 1970 and amendments of 1987 (Public Law and Public Law ). The main objective of this Act is to ensure that every effort is made to acquire the needed right-of-way in a fair and equitable manner. Basic policies have been established in this effort by the Federal Highway Administration (FHWA) and ODOT. All property must be appraised before acquisition is started. This is done by ODOT or ODOT s pre-qualified appraisers who are familiar with real estate values in the area. Upon determination of the fair market value, an ODOT negotiator will contact the property owner for an appointment. At this time, the negotiator will explain the project to the owner and the effect of the project on the property. The negotiator will then present an offer based on the appraisal, both orally and in writing. It is hoped that the needed right-of-way can be acquired through successful negotiations. However, if an agreement cannot be reached, property owners have recourse through the local Page 5

22 judicial system where just compensation will be determined by a jury, if necessary. This is a basic overview of the right-of-way procedures. It is the intent of ODOT that every effort will be made to obtain a mutually-beneficial agreement with all property owners so that they are justly compensated for their property. MAINTENANCE OF TRAFFIC DURING CONSTRUCTION ODOT requires two lanes in each direction on IR-76 to be maintained except for allowable restrictions per the Permitted Lane Closure Policy. Existing ramps are to remain open to the maximum extent possible during the mainline IR-76 and ramp reconstruction. Short term closures will likely be required to reconstruct the ramp pavement; however, ramps at adjacent interchanges are not to be closed concurrently. Brief descriptions of ramps closures with durations and detour routes are provided below. Below is a summary of these studies. Traffic Noise: In accordance with federal and state regulations traffic noise monitoring was performed at 23 locations, while noise modeling was conducted for 84 additional sites to determine the potential impacts from the proposed widening of IR-76 in Summit County. Noise sensitive land uses within 500 feet of the proposed Page 6

23 widening were modeled. The evaluation concluded that noise abatement in the form of noise wall construction is warranted, feasible and reasonable for five (5) of the 12 Noise Sensitive Areas (NSAs). Noise Sensitive Areas NSA E NSA F Location The IR-76 eastbound Easton Road/Cleveland Massillon Road noise barrier is located south of IR-76 and extends along the right-of-way line from the Easton Road overpass east to approximately 300 feet west of Cleveland Massillon Road. The IR-76 westbound Easton Road/Cleveland Massillon Road noise barrier is located north of IR-76 and extends along the right-of-way line from the Easton Road overpass east to Cleveland-Massillon Road. NSA I The two noise barrier system along Summit Road is located south of IR-76 and extends west along IR-76 from Summit Road. The IR-76 eastbound Summit Road/West State Street noise barrier is located south NSA K of IR-76 and extends along the proposed right-of-way from Summit Road east to West State Street. NSA L The IR-76 westbound Summit Road/West State Street noise barrier is located north of IR-76 and extends along the right-of-way line from approximately 450 feet east of Summit Road east to West State Street. Length (feet) 2,495 2,691 1,962 2,671 2,680 In March 2014, a noise survey was sent to the owners and residents along these locations to determine if the recommended noise walls should or should not be constructed as part of the project. Greater than 50% of the benefitted receptors in all five (5) NSAs voted in favor of the recommended noise walls. Therefore, all five (5) of these noise walls are proposed for construction with the project. ODOT asked for input from the residents of potentially affected properties to vote for the desire to have the noise walls constructed and on the color and texture of the proposed noise walls. Below Table 4 summarizes the results of the residents responses. A qualitative Mobile Source Air Toxics (MSAT) was performed for this project and coordinated with the Ohio Environmental Protection Agency (EPA). The study concluded that for the design year build scenario on the highway Page 7

24 network in the project area, regional MSAT emissions are expected to be substantively lower than those emitted today even when taking into account the small projected increase in vehicle miles traveled. In addition, a quantitative PM 2.5 Hot-spot Analysis was performed for the project and coordinated with the U.S. Environmental Protection Agency, the Ohio Environmental Protection Agency and the Federal Highway Administration (FHWA). The hot-spot analysis concluded that the proposed project is not of air quality concern. Hazardous Materials: Based on review of the Phase I Environmental Site Assessment (ESA), completed March 2014, no further environmental site assessment or special material management is warranted for the project. Ecological Resources: According to the March 2014 Level II Ecological Survey Report (ESR), the project will result in impacts to 17 streams totaling 8,428 linear feet of stream impacts, 23 wetlands totaling 1.1 acre of a Category I, II, III wetland impacts, and three (3) jurisdictional ditches totaling 0.03 acre of ditch impacts. Summit County is within the known range of the Federally-listed Endangered Indiana bat (Myotis sodalis), the proposed Federally-listed Endangered northern long-eared bat (Myotis septentrionalis), the Federally-listed Endangered northern monkshood (Aconitum noveborancense), and Federally-listed Species of Concern bald eagle (Haliaeetus leucocephalus). Additionally, record for the State Species of Concern Virginia rail (Rallus limicola), State Endangered shore-growing peat moss (Sphagnum riparium) and bog willow (Salix pedicellaris), State Potentially Threatened pale straw sedge (Carex albolutescens), leather-leaf (Chamaedaphne calyculata), tamarack (Larix laricina), and marsh five-finger (Potentilla palustris), and State Threatened tawny cotton-grass (Eriophorum virginicum), Howe s sedge (Carex atlantica ssp.capillacea), swamp birch (Betula pumila), buckbean (Menyanthes trifoliate), pitcher-plant (sarracenia purpurea), spotted turtle (Clemmys guttata), and swamp birch (Betula pumila) was identified in proximity to the project study area. Construction activities associated with the project could result in impacts to approximately 69 suitable Indiana bat roost trees (living or standing dead trees or snags with exfoliating, peeling or loose bark, split trunks and/or branches, or cavities), and removal of approximately 19.6 ac. of young second growth forest. The removal of the 69 potentially suitable roost trees and 19.6 ac. of young second growth forest the proposed project is likely to adversely affect the continued existence of the Indiana bat. In addition, removal of the 19.6 ac. of young second growth forest may affect but is not likely to adversely affect the northern long-eared bat. The northern monkshood prefers shaded to partially shaded cliffs, algific talus slopes, or cool streamside sites. These areas have cool soil conditions, cold air drainage, or cold groundwater flow. This type of habitat was not identified within the project study area; therefore, it is anticipated that this project will have no effect to the northern monkshood. The nearest known bald eagle nest is approximately 7.5 miles to the south of the eastern edge of the project. No suitable habitat for the bald eagle exists within the project study area. As the nearest known nest is located approximately 7.5 miles south from the eastern edge of the project study area and based on the habitat within the project study are, this project will have no effect on this species. No individuals for the shore-growing peat moss, pale straw sedge, bog willow, tawny cotton-grass, Howe s sedge, swamp birch, buckbean, leather-leaf, tamarack, pitcher-plant, marsh five-finger, swamp birch and Virginia rail were found within the project s area of disturbance. However, suitable habitat for the spotted turtle was identified within the project s area of disturbance. A spotted turtle survey was conducted in October 2013, but no individuals were observed during the site reconnaissance. Page 8

25 Cultural Resources: A literature search was completed for the proposed project to determine if previously recorded cultural resources are located within the project study area. According to the October 2013 Section 106 Request for Review (RFR) and based on review of the ODOT-OES IOC, dated March 18, 2014, no further cultural resource investigations are warranted. In accordance with 36 CFR 800.5(b), FHWA, with ODOT as their agent, determined a finding of no adverse effect is applicable to the subject undertaking. PROJECT SCHEDULE & COSTS Construction for the proposed project is expected to begin Calendar Year 2018 pending the final funding plan. The estimated project construction cost is $104 million using Federal and state funds. 29 Noise Public Involvement Summary SUM ; PID INTRODUCTION McCormick Taylor, under contract with the Ohio Department of Transportation (ODOT), conducted a study on potential noise abatement measures in the cities of Norton and Barberton, Summit County, Ohio for the SUM (PID: 93501) roadway widening and intersection improvements project. The project proposes roadway improvements and bridge/culvert maintenance activities to approximately 29,000 feet (ft.) or 5.5 miles (mi.) of Interstate Route 76 (IR-76) to improve highway capacity and reduce congestion to better serve the needs of the traveling public. The project extends from the South Medina Line Road to West State Street and involves the addition of one (1) eastbound/westbound lane from west of State Route (SR) 21 to east of State Street within the existing highway median, extension of entrance/exit ramps at interchanges, bridge/culvert reconstruction and replacement, drainage improvements, and full depth pavement replace along the mainline and ramps. See Project Mapping in Appendix A. As part of the environmental process, a traffic noise analysis was conducted to identify noise sensitive land uses and assess sound levels for Design Year (2036). Noise sensitive land uses were divided into grouping of common Noise Sensitive Areas, referred to as NSAs, to assist in determining the feasibility and reasonableness of noise walls during the mitigation analysis. Following the approval of the preliminary noise analysis (referred to as Noise Analysis Technical Report) by the Federal Highway Administration (FHWA) and ODOT, a noise survey was conducted to determine if 50% or greater of the benefitted receptors desire the recommended noise barrier. NOISE BARRIER LOCATION DESCRIPTIONS Noise monitoring was performed at 23 locations while noise modeling was conducted for 84 additional sites. This effort was necessary to gain a thorough understanding of the existing noise environment. Results of the IR-76 Noise Analysis indicated that Design Year (2036) Build noise levels exceed the Noise Abatement Criteria (NAC) within 11 of the 12 evaluated NSAs. Design Year (2036) Build noise levels were projected to approach or exceed the FHWA/ODOT NAC at approximately 93 sensitive land use areas, thus warranting noise abatement consideration. Noise abatement evaluations concluded that noise abatement was warranted, feasible and reasonable for five (5) NSAs within the project study area. The decision to construct a recommended noise wall depends on the benefitted property owners/occupants responses to this Noise Wall Survey. As determined by ODOT Central Office noise personnel, property owner/occupant Noise Public Involvement (PI) letters and noise wall surveys were distributed to benefitted property owners/occupants on March 7, 2014 to help satisfy the reasonableness criteria as part of ODOT s noise abatement design process. See Benefitted Receptor Addresses in Appendix B, and Noise Public Involvement Letter and Survey Form in Appendix C. Public participation pertaining to the Noise Wall Survey was minimal; therefore, ODOT District 4 personnel conducted door-to-door canvassing which involved multiple field visits, s and phone calls starting March 8, 2014 and ending May 21, As part of the PI Noise mailing and door-to-door canvassing operation, benefitted receptors were provided with noise wall specifics such as textures/materials and color to assist with their vote in the design of the barrier. A Noise/Air Quality/Public Involvement Meeting will be held on June 17 th, 2014 at the Barberton Middle School cafeteria to discuss the proposed project with local residents, business owners, the general public, and public officials. Locations of the proposed noise walls and selected colors and textures of the barriers will be displayed and copies of the Noise Analysis Technical Report will be available for public Page 2

CONCLUSSIONS/RECOMMENDATIONS A traffic noise analysis was conducted to identify noise sensitive land uses and assess sound levels for Design Year (2036). Noise sensitive land uses were divided into grouping of common Noise Sensitive Areas, referred to as NSAs, to assist in determining the feasibility and reasonableness of noise walls during the mitigation analysis. Noise monitoring was performed at 23 locations while noise modeling was conducted for 84 additional sites in order to gain a thorough understanding of the existing noise environment. The results of the noise analysis for the IR-76 project indicated that Design Year (2036) Build noise levels exceed the NAC within 11 of the 12 evaluated NSAs. Design Year (2036) Build noise levels were projected to approach or exceed the FHWA/ODOT NAC at approximately 93 sensitive land use areas, thus warranting noise abatement consideration. The noise abatement evaluations concluded that noise abatement was warranted, feasible and reasonable for five (5) NSAs within the project study area. ODOT District 4 personnel distributed property owner/occupant Noise Public Involvement (PI) letters and noise wall surveys to benefitted property owners/occupants on March 7, In addition to the PI Letter, ODOT District 4 personnel conducted door-to-door canvassing which involved multiple field visits, s and phone calls starting March 8, 2014 and ending May 21, As a result of the Noise Wall Survey and door-to-door canvassing, greater than 50% of the benefitted receptors in all five (5) NSAs voted in favor of the respective proposed noise walls.
