If an approved jurisdictional determination is completed as part of the review process for this application, a copy will be posted on the St. Paul District web page at the following link: Project Description and Purpose (per applicant) HyVee is proposing to construct a convenience store that provides food, beverage, and gas amenities to the local neighborhood and college students. The project proposal consists of 8,780 square feet (0.2 acre) of retail space, a 36seat coffee shop, a 32seat dining area, 14 fueling stations, and a total of 67 parking lot stalls. The project proposes to permanently impact 0.84 acre of wetland and temporarily impact 0.02 acre of wetland for the construction of the convenience store. The applicant reduced the number of parking stalls to 67, the minimum quantity of parking stalls allowed by city code in order to reduce the wetland impact. The facility would support the Minnesota State University (MSU) Mankato campus area and to meet the need for the surrounding residential development and college students to have an accessible and serviceable location for food and beverage purchases. The 3acre site is located on the corner of Stadium Road and Heron Drive in the city of Mankato, Minnesota. Name, Area, and Types of Waters Subject to Loss: The proposed project includes the discharge of fill material permanently within 0.84 acre of wetland and temporarily within 0.02 acre of wetland. Of the proposed wetland impacts, 0.83 acre are to Wetland A, a floodplain forest wetland, and 0.01 acre are to Wetland C, a seasonally flooded basin. The 0.02 acre of proposed temporary impacts are to Wetland A. 1

2 Alternatives Considered (per applicant): 1. The applicant considered the no build alternative. The applicant stated this alternative would not meet the need of the surrounding neighborhood and would not foster economic development. 2. Constructing the facilities slightly west of the current location could avoid all wetland impacts. Per the applicant this alternative was not within the budget constraints of the project and would increase the project cost by four times the current amount. Access from Heron Drive would be eliminated and would hinder the store s visibility and traffic logistics. 3. The applicant considered a layout that would involve 0.9 acre of wetland impact but the alternative would require acquisition of the property to the west, increasing the cost and exceeding the budget constraints for the project. This project would also result in greater impacts than the applicant s preferred alternative. 4. A reconfiguration of the parking spaces that are directly west of Wetland A to instead be located south of the proposed building was considered to reduce wetland impacts. The applicant considered the reconfiguration to be unsafe for vehicular and pedestrian traffic. 5. The applicant considered double stacking gas pumps in an effort to reduce wetland impacts. Upon further consideration, this was considered not feasible by the applicant as a result of the reduced amount of space surrounding the pumps and the resulting safety concerns from vehicular and pedestrian traffic. Compensatory Mitigation: The applicant has proposed to purchase 1.66 wetland credits from the wetland bank #1650 located in Major Watershed 25 and Bank Service Area 9 within Lyon County, Minnesota. Federally Listed Threatened and Endangered Species An Official Species List was generated for the project area from the U.S. Fish and Wildlife Service IPaC website on March 22, The northern longeared bat (threatened) was the sole species provided on the list to have the potential to be found in the project area. Historic Properties Coordination with our Cultural Resources Management team began on March 22, 2018 to comply with the National Historic Preservation Act.
