1 MEMORANDUM TO: FROM: NFPA Technical Correlating Committee on Building Code Robert Solomon DATE: April 1, 2010 SUBJ: NFPA 5000 TCC Report on Proposals Letter Ballot (A2011) In accordance with the NFPA Regulations Governing Committee Projects, attached is the Letter Ballot on the Report on Proposals (ROP) for the 2012 Edition of NFPA Also attached is a copy of the Proposals that have TCC Notes. Please note the ballot has two parts: Part 1 is a Letter Ballot on the Technical Correlating Committee Amendments to the ROP (TCC Notes), and not on the Proposals themselves. Reasons must accompany Negative and Abstaining votes. Part 2 is an Informational Letter Ballot Authorizing the Release of the ROP. Negative votes are limited to subjects within the purview of the TCC. Opposition on a strictly technical basis is not sufficient grounds for substantiating a negative vote. If you have correlation issues please identify and describe your concerns in the area of the ballot form for identification of correlation issues. 6 Log #71 BLD-IND The Technical Correlating Committee (TCC) directs that a public comment be submitted in the TCC s name to BLD-IND. Make the Recommendation for the comment to read: Review the definitions from NFPA 88A, 2011 edition (proposed) and make any additional changes that may be necessary. In addition, the committee is asked to revise the content of 3.XX.1,. The reference to Section 5.5 of NFPA 88A should be revised as follows: Extract text of NFPA 88A, Section 5.5 to Chapter 30 of NFPA 5000 (such as 30.8.XX) and then revise the definition to refer to this paragraph. Make the Substantiation for the comment to read: The public proposal refers to the 2010 edition, the committee statement refers to the 2012 edition but the current schedule shows there will be a 2011 edition of NFPA 88A. The definition should be revised to refer to the necessary text in NFPA 5000 as opposed to referring back to NFPA 88A. This can be accomplished by extracting the additional text as suggested. A parking structure that meets the requirements of 4.7 of NFPA 88A. Any parking structure that is not an open parking structure. A parking structure that utilizes sloped floors for vertical vehicle circulation. A parking structure that uses lifts or other mechanical devices to transport vehicles to the floors of a parking structure, where the vehicles are then parked by a person. A parking structure that uses computer controlled machines to store and retrieve vehicles, without drivers, in multi-level storage racks with no floors. To coordinate with the changes that have been approved in NFPA 88A at the ROP stage for the 2010 edition. Annex material is being developed and will be completed by the TC on or before November 6, Accept proposed definitions but extract references from NFPA 88A,, 2012 edition. Add new definitions as follows: A building, structure, or portion thereof used for the parking, storage, or both, of motor vehicles.[88a, 3.3.x] A parking structure that meets the requirements of 5.5 of NFPA 88A.[88A, 3.3.x] Any parking structure that is not an open parking structure.[88a, 3.3.x] A parking structure that utilizes sloped floors for vertical vehicle circulation. See committee action on proposal f (Log #CP550). It is noted that the correct reference in the definition of open parking structure should be section 5.5 of 88A,. The committee will review these definitions again at the ROC stage in the event any changes have been made to NFPA 88A during their ROC work. Affirmative: 23 1 Rosales, R. ALLISON, T.: This is a special definitions section. "3.x.x.1, Parking Structure, Open" says that this is a structure meeting the requirements of NFPA 88A. We should be saying it is as defined in NFPA 88A (or NFPA 1 or 101) and not include requirements in the definition. We say in our committee statement that we are extracting the definitions from 5

7 88A, so this must be a mistake. 6

8 a Log #CP305 BLD-RES The Technical Correlating Committee (TCC) notes that this proposal is out of sequence. A series of related proposals ( a, , , , , , a) are concerned with the topic of providing a fire rated separation between garage areas and living spaces in one and two-family dwellings, lodging or rooming houses, hotels and motels, apartments and residential board and care occupancies. The Technical Correlating Committee (TCC) directs that a public comment be submitted in the TCC s name to BLD-BCF, -BLC, -FIR, and -RES. Make the Recommendation for the comment to read: Review the actions taken on Proposals a, , , , , and to ensure there is a consistent treatment of this subject. Make the Substantiation for the comment to read: This proposal relates to the need to provide a separation between garages and living spaces in residential occupancies. Each committee is being asked to review the base criteria proposed for chapter 8 and determine if further correlation within the occupancy chapters is necessary. Technical Committee on Building Construction, Add to Section (4) Private garages attached to a dwelling unit(s) protected in accordance with Add Section A private garage attached to a dwelling unit(s) shall be separated from the dwelling unit in accordance with this section A private garage adjacent to a dwelling unit shall be separated from the dwelling unit and its attic by a wall that: 1. has not less than ½ in. (mm) gypsum board or its equivalent applied to the garage side and 2. is continuous from the garage floor to the underside of the roof deck A private garage beneath a dwelling unit or a portion of a dwelling unit shall be separated by 5/8 in. Type-X gypsum board or its equivalent applied to the garage side of the floor or ceiling framing members Openings Openings between the garage and a room designated for sleeping purposes shall not be permitted Openings between the garage and the dwelling unit shall be equipped with solid wood doors or solid or honeycomb steel doors not less than 1 3 / 8 in. This proposal provides the construction criteria in Chapter 8 and requests that the applicable occupancy TC's (BLD-BCF and BLD-RES) insert the scoping text in their Chapters. Accept the proposed new , (renumbered as ), (renumbered as ), and (renumbered as ). The committee action accepts the proposed revisions to the chapters within the scope of BLD-RES. 9 NFPA and International Code Council codes and standards and is not supported by the National Association of Home Builders (NAHB). NAHB therefore abstains on this NFPA 5000 action Log #CP1a BLD-BLC The Technical Correlating Committee (TCC) directs that the Final Action on this proposal be changed to. See Proposals , , and which provide a basis for retaining the definition as currently shown. Technical Committee on Fundamentals, Revise text to read as follows:. An area of a building separated from the remainder of the building by construction having a fire resistance of at least 1 hour and having all communicating openings properly protected by an assembly having a fire resistance rating of at least 1 hour. [ 2008] This definition is the preferred definition from the NFPA Glossary of Terms. Changing the secondary definition to the preferred definition complies with the Glossary of Terms Project. Delete the definition of Fire Area and replace with the following:. The aggregate gross floor area separated from the remainder of a building by fire walls, fire barriers, or a combination thereof. The committee removed the requirement which is not appropriate for a definition. Affirmative: 22 2 Backstrom, R., Skalko, S Log #CP1b BLD-MEA The Technical Correlating Committee (TCC) notes that the committee statement for Reject be forwarded to the Glossary of Terms (GOT) Technical Advisory Committee for review. Technical Committee on Fundamentals, Revise text to read as follows:. An area of a building separated from the remainder of the building by construction having a fire resistance of at least 1 hour and having all communicating openings properly protected by an assembly having a fire resistance rating of at least 1 hour. [ 2008] This definition is the preferred definition from the NFPA Glossary of Terms. Changing the secondary definition to the preferred definition complies with the Glossary of Terms Project. The proposed definition is incorrect in that the whole building could be a fire area. The proposed definition would cause a hazardous area room protected by fire-rated barriers to be considered a fire area. Affirmative: 26 Abstain: 1 1 McMahon, C. 10 c Log #CP704 BLD-MER The Technical Correlating Committee (TCC) directs that a public comment be submitted in the TCC s name to SAF-MER. Make the Recommendation for the comment read: Revise the definition to read as follows: Fifty percent of all major tenant areas and one hundred percent of all other floor areas designated for tenant occupancy and exclusive use including storage areas. The area of tenant occupancy is measured from the centerline of joint partitions to the outside of the tenant walls. All tenant areas including areas used for storage, are part of the gross leasable area. Make the Substantiation for the comment read: The last sentence of the definition currently starts with the words all tenant areas which include major tenants and then the newly added text adds in 50 percent of the major tenant areas so as to create a conflict in language. The suggested revision above clarifies these points. Technical Committee on Mercantile and Business Occupancies, Revise definition as follows: Gross Leasable Area. The total floor area designated for tenant occupancy and exclusive use. The area of tenant occupancy is measured from the centerlines of joint partitions to the outside of the tenant walls. All tenant areas, including areas used for storage, and 50 percent of the area of major tenants, are part of the gross leasable area. Revised definition provides clarification when determining the gross leasable area for the purpose of calculating the occupant load of the mall. Gross leasable area does include 50 percent of the major tenant areas which should be indicated in the definition. Affirmative: 18 1 Bedell, M. 9

11 Log #26a BLD-FIR The Technical Correlating Committee (TCC) directs that a public comment be submitted in the TCC s name to BLD-FIR. Make the Recommendation for the comment to read: Review the actions taken on Proposal by BLD-SCM to ensure there is a consistent treatment of this subject. The current text is for foam plastic and the new term is for foam plastic insulation. The committee should consider retaining the current term and its definition in addition to adding the new term. Make the Substantiation for the comment to read: Several TC members voted negatively or abstained on this item indicating they had not had the chance to review the actions taken by BLD-SCM. In addition, there are other uses for foam plastic materials beyond just serving as an insulating material. Marcelo M. Hirschler, GBH International / Rep. American Fire Safety Council Revise text to read as follows: * Thermal Barrier. A material that limits the average temperature rise of an unexposed surface to not more than 250 F (139 C) for a specified fire exposure complying with the standard time temperature curve of NFPA 251, Standard Methods of Tests of Fire Resistance of Building Construction and Materials * Thermal Barrier for Foam Plastic Insulation (Thermal Barrier). A material, product, or assembly that prevents or delays ignition of foam plastic insulation by limiting the temperature rise on the surface of the foam plastic insulation and by acting as a flame exposure barrier to the foam plastic insulation for a 15-minute time period (NFPA 275). A Thermal Barrier. Finish ratings, as published in the UL Fire Resistance Directory, are one way of determining thermal barrier. NFPA 275 is a test method designed specifically to assess whether a material, product or assembly constitutes a thermal barrier. FM 4880, UL 1040 and UL 1715 are also test methods recognized by the code for approving materials, products or assemblies as thermal barriers. The present definition should be replaced by extracting the one contained in NFPA 275, since NFPA 275 was specifically developed to clarify the test for thermal barrier materials to be used over foam plastic insulation. This definition is more generic and ties in with the two conditions needed for a thermal barrier: temperature transmission and assembly integrity. The existing definition addresses the aspect of temperature transmission only. NFPA 275 contains two tests. 1. The temperature transmission fire test in NFPA 275 uses the ASTM E 119 (or NFPA 251 or UL 263) time-temperature fire curve to expose the thermal barrier specimen and it requires the following: During the 15-minute test period, the average measured temperature rise above the average temperature at the start of the fire test for the thermocouples described in Section 4.3 shall not exceed 250 F (139 C), and the measured temperature rise of any such single thermocouple shall not exceed 325 F (181 C). Therefore, the temperature transmission fire test in NFPA 275 corresponds to what the code requires now. 2. The integrity fire test in NFPA 275 requires that the thermal barrier material, together with the foam plastic insulation, be tested to NFPA 286 (which is a 15 minute test) and that the pass/fail criteria are identical to those used for NFPA 286 elsewhere in the code (for example Chapter 10). The code should continue to recognize that thermal barrier materials tested, in conjunction with foam plastic insulation, to FM 4880, UL 1040 and UL 1715 and complying with the conditions of acceptance of these tests are equally acceptable. NFPA 275 also states that the integrity fire test can be conducted in accordance with these alternate test methods, when their pass/fail criteria are used. The annex note is being changed because there are now specific methods for assessing whether a material, product or assembly constitutes a thermal barrier, rather than using a UL directory. Materials. See committee action taken on proposal by the TC on Structures, Construction, and Affirmative: 15 Negative: 3 Abstain: 2 FRANCIS, S.: The proposed definition limits the application of a thermal barrier to ONLY foam plastics. It has been referenced in other uses in the code. No technical value is added by changing the definition to include prescriptive 10

12 requirements (i.e. limiting its application to foam plastics). This would have a negative impact on construction requirements for wildland codes and for other sections of the building code. We have conducted a telephone survey of various members of the Self-Storage Association located throughout the United States. For the vast majority of cases the largest individual storage unit their members rent out is 10 ft by 30 ft. Since the largest overall unit appears to be the 20 ft by 30 ft size for a total area of 600 sq ft, we have proposed a limitation in the definition of 750 sq ft to provide for a factor of safety. Certainly anyone leasing a large warehouse building to multiple tenants would not be leasing such a small space. On the other hand, if the space is too small in the definition, then it is possible for a mini-storage building to be constructed with larger individual tenant spaces to avoid being captured by the definition. Therefore, a reasonable factor of safety of 25 percent of the maximum area currently being leased seems reasonable. The phrase from view is taken from the similar definition in of NFPA 1 to make them consistent. NOTE: We will be submitting a similar proposal to NFPA 1. Revise definition as follows: * Mini-Storage Building. In practice, the only thing that matters is whether the material complies with ASTM E 136 and that is what is being used in NFPA 211, in NFPA 101 and in NFPA 5000 (as well as in other codes) for classifying a material as noncombustible. The NFPA 220 definition does not address this and the NFPA 5000 and 101 definitions are contained in two sentences. It is therefore recommended, in order to improve consistency within NFPA documents that the definition from NFPA 5000 be revised to contain a single sentence and used as shown. Proposals are being made to other committees to adopt the same definition so as to obtain consistency in terminology. This proposal is similar to other proposals submitted so as to lead to more consistency within NFPA definitions.
