The approximate UTM coordinates are: Zone 14 N , E , Latitude , Longitude BANK SERVICE AREA: The proposed bank service area is Lower Red River of the North BSA 3. DESCRIPTION OF PROJECT: The sponsor is proposing to develop the Prosser Wetland Bank. The proposed bank site is approximately 75.8 acres in size, including upland buffer areas. NEED AND OBJECTIVE OF PROJECT: As stated in the prospectus for this wetland bank: No wetland banks are currently active in Kittson County, MN. No wetland banks are currently active in the Tamarack/Joe Rivers Watershed. There are no active wetland banks within the same county or watershed as the proposed wetland bank. Creating a wetland bank at the proposed location would be beneficial, as any projects proposing wetland impacts in Tamarack/Joe Rivers Watershed would be mitigated for in the same watershed. Wetland areas on neighboring properties have been disturbed by agricultural activities and some wetlands have been drained from ditch construction. The proposed project would allow for the storage of additional hydrology onsite which would be beneficial to the watershed and neighboring properties during high water conditions. ESTABLISHMENT, OPERATION AND MANAGEMENT: The project objectives will be achieved by blocking drainage features, leveling a portion of project area, seeding a portion of the project area and monitoring the project area to ensure the project is establishing as proposed. According to information supplied by the applicant, areas labeled Map ID I and Map ID III contain existing wetland and are dominated by hydrophytes. Additional areas would be restored and/or enhanced with native wetland plant species to meet vegetation standards for wetland establishment. The area to be restored or enhanced originally consisted mainly of Shrub-Carr or Hardwood Swamp wetland, with some Fresh Wet Meadow Wetland. The applicant proposes to establish a high quality Shrub-Carr wetland throughout a majority of the bank site. Currently, willows appear to be establishing throughout the project area. The applicant believes that the shrubs will eventually become dominant

2 Regulatory Branch (File No. MVP LSP) throughout the entire project area, excluding the proposed Shallow Marsh. Quaking aspen found in the adjacent wooded area on the subject property will likely spread throughout much the project area and will return the project area to near natural conditions over time. The sponsor proposes to create a high quality Shallow Marsh in an existing gravel pit in the northeast corner of the property. The gravel pit is currently a Shallow Marsh wetland with a cattail monoculture, but the sponsor proposes to partially fill the basin and increase the vegetation diversity with additional seeding. The proposed plant communities and seeding zones for this wetland bank are shown on pages 6 and 7 of the attached drawings. OWNERSHIP AND LONG-TERM MANAGEMENT: Mark Prosser is the project sponsor and land owner that is ultimately responsible for completing the project. Mark Prosser is the fee title owner of the subject property (entire 151 acre property) and will be in charge of the long-term management of the site once all credits have been sold. See Figure 1 (Page 1 of 8) showing the location of the subject property. Long-term management will ensure that the conservation easement signs are not removed or vandalized. The bank site would be periodically visited to ensure that no disturbances had occurred. If any site disturbances occurred or if portion of the bank site is degraded, the appropriate agencies would be contacted to determine the appropriate actions and the area would be restored. ECOLOGICAL SUITABILITY: Please see the map on Page 6 of 8 in the attached drawings. This drawing depicts the proposed planting areas discussed in this paragraph. Much of the subject property appears to be wetland. Hydrophytic vegetation currently exists and is dominant throughout much of the area labeled as Map ID I and Map ID III on Figure 9. According to the NRCS Web Soil Survey Map ID I, II and III are comprised of Rosewood fine sandy loam, and Rosewood and Cormant soils. Both soils are poorly drained with a depth to water table of 18 inches. A restrictive soil layer was found in some of the soil pits. This restrictive layer may perch groundwater for long enough duration to create hydric soils and contribute hydrology near the ground surface. Blocking surface drainage features may enhance existing hydrology to what may be considered to be pre-disturbance conditions. An exhausted gravel pit is located in the northeast corner of the property. The gravel pit area has filled with water and is currently a Shallow Marsh wetland (Map ID IV). The areas north and south of the gravel pit (Map ID V) are mainly upland. A Shrub-Carr wetland has developed on the north side of the gravel pit. This wetland area currently retains adequate hydrology to support wetland functions. The sponsor proposes to create a continuous swale area connecting Map ID IV and V. Map ID V is proposed to be scraped with the excavated soil to be used to partially fill Map ID IV and create a variety of water depths. Map ID IV will continue to collect runoff from the surrounding land and will be planted with an emergent wetland seed mix to increase vegetation diversity. Map ID V will be at a slightly higher elevation, but will also collect runoff from the surrounding land which may contribute to wetland establishment. Map ID V will be planted with a wetland seed mix and willows will be transplanted to encourage hydrophytic vegetation to become established. HYDROLOGY: The site was visited by WSN personnel on November 2, 217. WSN personnel looked for evidence of hydrology and recorded their findings on data sheets. Hydric soils were found throughout the project area. The gravel pit area had approximately 1-foot of standing water in November of 217. The observed water table in sample pits was approximately 1.5 to 3.5 feet below the surface in most of the project area. Surface saturation was observed on the northwest side of the project area (SP-6). Sample point locations are shown on Figure 6, Page 3 of 8. Four drainage features are found within the subject property (see locations on Figure 3, page 8 of 8 on the included drawings). These drainage features are connected and ultimately drain to the northwest which carries water off of the property. Blocking these features within the project area will reduce the quantity of water leaving the bank site. These shallow surface features were constructed prior to 1991 and appear to be an attempt to drain surface water from the site to allow for agricultural production. A private drainage ditch is located adjacent west of the subject property that collects hydrology from the Page 2 of 4

3 Regulatory Branch (File No. MVP LSP) subject property and flows south into the Trunk Highway 11 roadway ditch. This adjacent private ditch is located on private land and will not be modified. There are no county or judicial ditches within or adjacent to the subject property. The major hydrology input for the project area is from precipitation events and spring snow melt. During normal or wetter than normal climatic conditions the project area is expected to retain adequate hydrology to support wetland functions, as hydrophytic vegetation is currently dominant throughout most of the project area prior to construction. CURRENT LAND USES: The applicant states that the entire parcel was enrolled in the Conservation Reserve Program (CRP) continuously from 199 to 216 when portions of the property were removed from the program. Some portions of the property remain in the CRP program and will continue to be enrolled in the CRP program after the construction of the bank site. These areas will be excluded from the wetland bank easement. A map depicting the areas within the property that will remain in the CRP program is included in the attached project drawings on Page 5 of 8. Prior to enrollment in the CRP program, the parcel appears to have been partially cleared and agricultural production was attempted. COORDINATION WITH RESOURCE AGENCIES: This project has been coordinated with the following members of the Interagency Review Team (IRT) and other resource agencies: U.S. Environmental Protection Agency, U.S. Fish and Wildlife Service, Minnesota Department of Natural Resources, Minnesota Board of Water and Soil Resources. 3. FEDERALLY-LISTED THREATENED OR ENDANGERED WILDLIFE OR PLANTS OR THEIR CRITICAL HABITAT None were identified by the bank sponsor or are known to exist in the action area. However, Kittson County is within the known historic range for the following Federally-listed species: Northern Long-Eared Bat Hibernates in caves and mines swarming in surrounding wooded areas in autumn. Roosts and forages in upland forests during spring and summer. Gray Wolf Utilizes a wide variety of habitats within its range which, in Minnesota, is generally the northern forested portions of the state. Dakota Skipper Unplowed native prairie on dry to mesic calcareous gravelly soils. Can occur in moderately grazed prairie pastures. Not known from the location of this proposal. This notice is being coordinated with the U.S. Fish and Wildlife Service. Any comments it may have concerning Federally-listed threatened or endangered wildlife or plants or their critical habitat will be considered in our final assessment of the described work. 4. 4 Regulatory Branch (File No. MVP LSP) This proposal is being reviewed in accordance with the practices for documenting Corps jurisdiction under Sections 9 & 1 of the Rivers and Harbors Act of 1899 and Section 44 of the Clean Water Act identified in Regulatory Guidance Letter HISTORICAL/ARCHAEOLOGICAL The Corps will review information on known cultural resources and/or historic properties within and adjacent to the project area. The Corps will also consider the potential effects of the project on any properties that have yet to be identified. The results of this review and the Corps determination of effect will be coordinated with the State Historic Preservation Officer independent of this public notice. Any adverse effects on historic properties will be resolved prior to the Corps authorization of the work in connection with this project. 6. PUBLIC HEARING REQUESTS Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearings shall state, in detail, the reasons for holding a public hearing. A request may be denied if substantive reasons for holding a hearing are not provided or if there is otherwise no valid interest to be served. 7.
