3 10.1 CITY OF BRAMPTON 29 CITY OF BRAMPTON To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and interfere with a wetland, at Norton Place Park located at 170 Clark Boulevard, in the City of Brampton, Etobicoke Creek Watershed, as located on the property owned by City of Brampton. The purpose is to redevelop Norton Place Park including construction of boardwalks, a woodchip trail, pedestrian paths, shade structure, viewing platforms and lookouts, and extension of the Norton Lake waterfront, located at 170 Clark Boulevard, in the City of Brampton. The Ministry of Natural Resources and Forestry (MNRF) warm water fisheries timing window will apply to this project unless otherwise specified in writing by MNRF CITY OF BRAMPTON NEWBY COURT To construct, reconstruct, erect or place a building or structure on Lot 227, Plan 970, (12 Newby Court), in the City of Brampton, Etobicoke Creek Watershed. The purpose is to recognize the construction of a 6.7 m by 3 m (22 ft by 10 ft) deck located at the rear of an existing dwelling within TRCA's Regulated Area of the Etobicoke Creek Watershed associated with a municipal building permit application. The deck was constructed without the benefit of TRCA or municipal permits. As such, an additional permit application fee of 100% was charged to the application for this "after-the-fact" permit CITY OF VAUGHAN VELLORE WOODS BOULEVARD To construct, reconstruct, erect or place a building or structure and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 2, Plan 65R-24694, (223 Vellore Woods Boulevard), in the City of Vaughan, Don River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Don River Watershed in order to facilitate the construction of a sq. m ( sq. ft.) in ground swimming pool at the rear of an existing residential dwelling associated with a municipal building permit. The proposal also includes the relocation of an existing 7.38 sq. m (79.43 sq. ft.) equipment shed and site alteration involving the placement of patio stones. The property is located on lands municipally known as 223 Vellore Woods Boulevard 10.4 CITY OF VAUGHAN 38 MOLISE KLEINBURG ESTATES SOUTH INC. C/O CASTLEPOINT INVESTMENTS INC. To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 22, 23, Concession 9, (Highway 27 and Nashville Road), in the City of Vaughan, Humber River Watershed as located on the property owned by Molise Kleinburg Estates South Inc. c/o Castlepoint Investments Inc.. The purpose is to allow development within a Regulated Area of the Humber River Watershed to facilitate grading and servicing in Phase 2C of a draft approved plan of subdivision (19T-06V14) west of Highway 27 and south of Nashville Road (former Kleinburg Golf Course), in the City of Vaughan. 3
4 10.5 CITY OF VAUGHAN 41 MONARCH CASTLEPOINT KIPLING NORTH DEVELOPMENT LTD. AND MONARCH CASTLEPOINT KIPLING SOUTH DEVELOPMENT LTD. C/O BLOCK 55 EAST LANDOWNERS GROUP To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, interfere with a wetland and alter a watercourse (Highway 27, Kirby Road, Kipling Avenue, Stegman's Mill Road & Teston Road), in the City of Vaughan, Humber River Watershed as located on the property owned by Monarch Castlepoint Kipling North Development Ltd. and Monarch Castlepoint Kipling South Development Ltd. c/o Block 55 East Landowners Group. The purpose is to allow development, interference with a wetland and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate the installation of external servicing for Block 55 East, in the City of Vaughan. These works will occur in the City or Regional road rightof-ways or on lands owned by Block 55 East, with some minor grading on TRCA lands. The works generally include: the installation of a trunk watermain on Kirby Road and Highway 27; the installation of a trunk watermain, a sanitary forcemain, a gravity sewer, a concrete box culvert and a municipal sidewalk on Stegman's Mill Road/Teston Road; and, the construction of proposed roadway intersection upgrades on Kirby Road, Kipling Avenue and Teston Road. The external servicing works also include the construction of a sanitary pumping station within Block 55 East, but these works are outside of TRCA's Regulated Area TOWN OF CALEDON CANADA INC. To construct, reconstruct, erect or place a building or structure on Lot 2, Concession 7, (0 Highway 50), in the Town of Caledon, Humber River Watershed as located on the property owned by Canada Inc.. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a 7, sq. m (84, sq. ft.) four (4) storey retirement residence with 124 units located at Highway 50 in the Town of Caledon associated with a municipal building permit and a municipal site plan application (Town File No. SPA ) TOWN OF CALEDON BRAMALEA ROAD To construct, reconstruct, erect or place a building or structure on, (13173 Bramalea Road), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Humber River Watershed in order to replace an existing septic leaching system at the rear of an existing dwelling associated with a municipal building permit application. 4
5 10.8 TOWN OF RICHMOND HILL RICHMOND STREET To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on, (311 Richmond Street), in the Town of Richmond Hill, Don River Watershed. The purpose is to recognize minor grading works conducted and restore a stream corridor within a Regulated Area of the Don River watershed at 311 Richmond Street in the Town of Richmond Hill. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate final grading operations and servicing within the Phase 3 subdivision lands associated with a municipal draft plan of subdivision application and zoning by-law amendment application to allow a residential development within the Vales of Humber Secondary Plan CITY OF MARKHAM FRED VARLEY DRIVE LIMITED To construct, reconstruct, erect or place a building or structure, change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Block E, Plan 7566, (20 Fred Varley Drive), in the City of Markham, Rouge River Watershed as located on the property owned by 20 Fred Varley Drive Limited. The purpose is to develop within the Regulatory Floodplain (Unionville Special Policy Area), to facilitate the construction of a new 108 unit, four storey mixed-use residential building with ground floor related commercial, and underground parking, associated with an OMB approved zoning bylaw and Council approved municipal site plan application. 5

To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 9, 10, Concession 9, south of Langstaff Road and east of Huntington Road, in the City of Vaughan, Humber River Watershed as located on the property owned by Squire Ridge Investments Ltd. The purpose is to conduct site grading in order to facilitate the construction of a stormwater pond and associated outfall to service the proposed Squire Ridge industrial subdivision, located in Planning Block 57/58 West, in the City of Vaughan CITY OF VAUGHAN 61 SQUIRE RIDGE INVESTMENTS LTD. To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 9, 10, Concession 9, south of Langstaff Road and east of Huntington Road, in the City of Vaughan, Humber River Watershed as located on the property owned by Squire Ridge Investments Ltd. The purpose is to conduct site grading in order to facilitate the servicing and development of an industrial subdivision on lands owned by Squire Ridge Investments Ltd., in Planning Blocks 57/58 West, in the City of Vaughan STANDARD DELEGATED PERMITS 63 Standard Permits, including Emergency Infrastructure Works permissions, are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard Permits, including Emergency Infrastructure Works permissions, are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A198/13, #A199/13 and #A103/15, respectively. All standard and emergency infrastructure works are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years of less. 11. RECOMMENDATION THE EXECUTIVE COMMITTEE RECOMMENDS THAT hectares (4.113 acres), more or less, of vacant land, located east of Bathurst Avenue and south of Regional Road 7, said lands being Part of Lot 34, Concession 1 and designated as Part 1 on Registered Plan 65R and Part of Lot 34, Concession 1 and designated as Part 1 on Registered Plan 65R-33238, be purchased from Igor Kotler (Owner); THAT the purchase price be $2.00; THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements; THAT the firm Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for Negotiations have been conducted with Claudio Brutto, President of Brutto Consulting, on behalf of the Owner. Access to the subject lands will be achieved through adjacent TRCA lands to the west of the property and TRCA is seeking an access easement from Infrastructure Ontario for access to Bathurst Street from TRCA s existing property. Attached is a plan showing the location of the subject lands. 7
8 Item7.1 RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for Through the review of Committee of Adjustment Application B016/15 to sever and create new lots for detached dwellings, TRCA staff established the limits of the open space land. TAXES AND MAINTENANCE Based on the value of TRCA land immediately to the west of the subject property the taxes are estimated to be around $1,700 per year. It is expected that the subject parcel of land will not significantly impact TRCA's maintenance costs since these types of lands require a low degree of maintenance. 11 Item 7.2 RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Petticoat Creek watershed as outlined in the approved Greenlands Acquisition Project for Through the review of Land Division Applications LD 022/15 and LD 023/15 to sever and create two new residential lots for detached dwellings, TRCA staff established the limits of the open space land. TAXES AND MAINTENANCE Based on TRCA s preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program and TRCA s own field data, it would appear that the subject property would be eligible for a tax exemption. It is expected that the subject parcel of land will not significantly impact TRCA's maintenance costs since these types of lands require a low degree of maintenance. 14 Item 7.3 RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for Infrastructure Ontario, in consultation with TRCA staff, has determined the development limit of the Infrastructure Ontario property. TRCA staff support the decision to maintain this portion of the provincial lands in public ownership to protect the features and functions of the Humber River watershed. TAXES AND MAINTENANCE This parcel of land will be turned over to the City of Toronto under the terms of the existing management agreement. 20 Item7.5 BACKGROUND The City of Brampton has formally requested the transfer of TRCA s permanent easements over properties, located north of Main Street and west of Queen Street West, with municipal addresses 58, 64 and 66 Main Street South in the City of Brampton, Ontario. The subject easements were acquired by the Etobicoke-Mimico Conservation Authority from Edith E. Cooper and F. Bernice Cooper on June 6, 1956 and the Roman Catholic Episcopal Corporation for the Diocese of Toronto on September 10, These easements were acquired to construct a storm sewer to deal with local drainage issues which resulted from the construction of the Brampton by-pass channel by the Etobicoke-Mimico Conservation Authority. The City of Brampton connected the Chapel Street storm sewer to the subject TRCA storm sewer in In 1997, the City of Brampton constructed a new storm sewer system picking up drainage from both the neighbourhood to the north and a portion of the St. Mary s Church property west of Chapel Street. As a result the TRCA storm sewer from Main Street to Chapel Street is no longer required and the section from Chapel Street to Mary Street is now only picking up private drainage from the church. St. Mary s Church is in the process of constructing an addition to its building and is required to address the easement as a condition of site plan approval. A plan illustrating the location of the permanent easement is attached. 24 Item 7.6 BACKGROUND The City of Toronto has formally requested a permanent easement for a new storm sewer, located west of Bathurst Avenue and south of Steeles Avenue, adjacent to its land at Harryetta Gardens with municipal address 170 Torresdale Avenue. The storm sewer is located within TRCA s regulated area and was part of the larger project to improve the storm water system in this Basement Flooding Area. The proposed project was identified during the Environmental Assessment study that was completed by the City of Toronto in The new storm sewer was approved under TRCA Permit No. C , issued on November 13, 2012, and construction has since been completed. All lands disturbed by construction have been stabilized and revegetated with native woody and herbaceous plant material as part of Permit. TRCA s land, which is directly to the west of the City of Toronto property, was acquired from the Governing Council of the University of Toronto on September 28, A plan illustrating the location of the permanent easements is attached. BACKGROUND The Regional Municipality of Peel has completed a Schedule B Class Environmental Assessment (EA) for the rehabilitation of The Gore Road from approximately 25m north of Patterson Side Road to Highway 9 in the Town of Caledon. The Class EA determined that the preferred alternative is a two-lane full reconstruction of The Gore Road. This alternative provides the opportunity to improve the condition of the road base and address the deteriorating pavement condition as well as providing an opportunity to improve road safety and drainage. The Regional Municipality of Peel has requested the conveyance of certain TRCA lands required for the rehabilitation of The Gore Road between Patterson Sideroad to Highway 9 for a nominal fee. Further, a hectares (0.009 acres) temporary easement will be required during construction. The subject lands form part of a larger acreage acquired by TRCA from Hilary and Henriette Stykolt on February 3, 1971; Winnifred Spinks, George and Luella Burns on June 28, 1977 and; M.J. Robinson and J.M Robinson on February 23, 1979 for the Palgrave Forest and Wildlife Conservation Area. FROM: RE: Carolyn Woodland, Senior Director, Planning, Greenspace and Communications APPLICATIONS FOR PERMITS PURSUANT TO ONTARIO REGULATION 166/06 Development, Interference with Wetlands and Alterations to Shorelines and Watercourses KEY ISSUE: Pursuant to Ontario Regulation 166/06, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected. RECOMMENDATION THAT permits be granted in accordance with Ontario Regulation 166/06 for the applications which are listed below: PERMIT APPLICATIONS ARE MAJOR APPLICATIONS - REGULAR Applications that involved a more complex suite of technical studies to demonstrate consistency with policies; applications that cover a significant geographic area (e.g. subdivisions, stormwater management ponds), extensive modifications to the landscape, major infrastructure projects, emergency infrastructure works, resolution of violations/after the fact permits, trail construction. CITY OF BRAMPTON 10.1 CITY OF BRAMPTON To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and interfere with a wetland, at Norton Place Park located at 170 Clark Boulevard, in the City of Brampton, Etobicoke Creek Watershed, as located on the property owned by City of Brampton. In the case of municipal or utility projects, where works may extend beyond lands owned or easements held by the municipality or utility provider, Landowner Authorization is required to the satisfaction of TRCA. 31
32 4. This permit is valid for a period of two years from the date of issue unless otherwise specified on the permit. The Owner acknowledges that it is the responsibility of the Owner to ensure a valid permit is in effect at the time works are occurring; and, if it is anticipated that works will not be completed within the allotted time, the Owner will notify TRCA Planning and Development staff at least 60 days prior to the expiry date if an extension will be requested. 5. The Owner shall ensure all excess fill (soil or otherwise) generated from the development will not be stockpiled and/or disposed of within any area regulated by TRCA (on or off-site) pursuant to Ontario Regulation 166/06 without a permit from TRCA. 6. The Owner shall install effective erosion and sediment control measures prior to the commencement of works and maintain such measures in good working order throughout all phases of development to the satisfaction of TRCA. 7. The Owner acknowledges that the erosion and sediment control strategies outlined on the approved drawings are not static and that the Owner will upgrade and amend the erosion and sediment control strategies as site conditions change to prevent sediment releases to the natural environment to the satisfaction of TRCA. 8. The Owner shall permanently stabilize all disturbed areas immediately following the completion of development and remove/dispose of sediment controls from the site to the satisfaction of TRCA. 9. The Owner shall implement the planting plan at Laurelcrest Park, approved as part of this permit (Drawing: Laurelcrest Park: Additional Future Planting, prepared by Baker Turner Inc., dated December 11, 2015), in The Owner shall notify TRCA project manager (Annette Maher) when the planting commences. RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The City of Brampton has proposed to redevelop Norton Place Park at 170 Clark Boulevard, in the City of Brampton. The overall purpose of the proposed redevelopment works is to address safety concerns at the park by opening sight lines and increasing pedestrian connectivity through the park. It is understood that the proposed works will include removal of an existing storage building and fencing; vegetation clearing; construction of primary and secondary boardwalks through the existing woodlot and wetland, and formalization of an existing trail along the western edge of the existing swamp woodlot; re-location and re-grading of the southern edge of Norton Lake to extend the lakefront to increase viewing capacity; installation of armour stone along the new lakefront; construction of two viewing platforms/wharfs and lookouts along the lakefront; re-grading of the existing playground area; concrete and asphalt paving of pedestrian paths, park entrances and playground area; and, installation of a 10 m by 10 m shade structure. Control of Flooding: The flood risk associated with the new structures (boardwalks, woodchip trail, shade structure, viewing platforms/wharfs and lookouts) will not increase risk to flooding, conveyance or storage of floodwaters when compared to existing conditions. 32
