2 THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS J. Grant Glassco donated 482 acres of land to Her Majesty the Queen in Right of Ontario on September 18, 1968; AND WHEREAS J. Grant Glassco and Willa Glassco entered into an agreement with her Majesty the Queen on September 17, 1968 whereby the parties agree to preserve, maintain and develop the lands in perpetuity in the same manner, to the same standard and for the same general purpose as lands vested in The Metropolitan Toronto and Region Conservation Authority, now Toronto and Region Conservation Authority (TRCA) and that Her Majesty the Queen has the right to assign its rights to the Ontario Heritage Foundation, now Ontario Heritage Trust (OHT); AND WHEREAS Willa Glassco, OHT and TRCA entered into an agreement dated July 23, 1969 for the development, maintenance and administration of the subject lands for a period of 25 years with the right to renew for an additional 25 years which expires on July 22, 2019; AND WHEREAS TRCA entered into the first rental arrangement with the Evans family in 1969 which has continued since that time; AND WHEREAS the Evans family has requested a longer term lease; THEREFORE LET IT BE RESOLVED THAT TRCA enter into a lease with the Evans family for approximately 136 acres of the former Glassco lands, in the City of Vaughan, for a four year term to expire on July 22, 2019; THAT the lease payments be at fair market value for the term of the lease; THAT the lease be on terms and conditions satisfactory to TRCA's solicitor, staff and OHT; THAT staff be directed to initiate discussions with OHT for the continued management of the subject lands by TRCA; THAT subject to successful negotiations with OHT, staff enter into discussions with the Evans family for a long term lease of the Glassco lands; THAT staff report back to the Executive Committee at a future date regarding the results of these discussions; AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and the signing and execution of documents. 3 CORRESPONDENCE (A) November 9, 2015 Dear Madame Chair and Members of the Executive Committee, I am writing to you regarding our relationship with the TRCA and particularly with respect to our plans to develop and strengthen our very long standing partnership together with aspirations to develop more opportunities for near urban agriculture activities and products at Upper Cold Creek Farm in Vaughan I am the granddaughter of Grant Glassco who donated nearly 500 acres in 1969 to the Ontario Heritage Trust. The TRCA was chosen by my grandmother and OHT to steward this property. My family has been actively farming both the lands we retained in ownership as well as the donated lands under lease with the TRCA. Collectively we call this Upper Cold Creek Farm. My grandfather first acquired Cold Creek Farm in 1937 and our family has been farming and raising livestock for almost 80 years. My father, Dr. John Evans, lived on the farm for 61 years, and delegated day to day management of farm operations to Mr. John Hayes over two decades ago. Together they provide/d considerable care, continuity and stewardship of the farm including the leased lands. We have enjoyed a strong and supportive relationship with the TRCA throughout the past 46 years. The leased lands, referred to as the Glassco Lands, to allow us to continue our cattle operation by providing pasture and winter feed harvesting. We are proud to have also participated with the TRCA in conservation projects on our property including tree planting, Cold Creek river bank erosion mitigation and protection of the Redside Dace. It has been a great model of cooperation and conservation as intended in the original OHT agreement. We understand from discussions with senior staff at TRCA that the programs promoting near urban agriculture at Black Creek Village and the Kortright Centre have been well received. We would like to learn more about ways in which Upper Cold Creek Farm might be able to participate as well. It is certainly our intention going forward to continue to be a good partner with TRCA and to carry on and indeed look to grow our livestock operation. We are excited about the possibilities to allow people coming out of agricultural programs at university and college the opportunity to begin the practice of farming. Giving access to land they wouldn t otherwise be able to afford could be an opportunity to apply their knowledge without having to purchase their own land. Before embarking on this path it is be important for us to establish a longer term lease of the Glassco lands and indeed increase the acreage we will rent in the future. You may be aware that we recently attended a lengthy OMB hearing concerning the protection of our farm from future residential development (and vice versa) where it was pointed out the short term nature of our lease and the imprudence of this from a business perspective (our case involves amending OPA 744 to require a mandatory Agricultural Impact Assessment ("AIA"), as is done elsewhere in Ontario. In addition, our agrologist has recommended a minimum 30-metre between our farm and the new residential development, which would result in a loss of 0.8 ha, from the total development of 240 ha.). We believe it is in both of our interests to ensure continuity in the lease arrangement for as long as practical. Therefore, I would like to request that TRCA enter into a longer term lease with my family recognizing the OHT agreement with TRCA is up for renewal in This will help provide us with the opportunity to have discussions with both TRCA and OHT to extend our respective relationships past the 2019 renewal date. 482

4 In closing this letter, I repeat that my family considers our relationship with the TRCA unique and one of mutual respect. My grandfather s gift to the OHT was the first of its kind in this province and we have all participated in working and conserving the efficacy of Upper Cold Creek Farm and the Glassco Lands. It is our intention going forward to strengthen our relationship with the TRCA working to develop near urban agriculture projects that demonstrate to the public and Province that farming continues in Ontario, is vital to supporting communities with food and is a treasured resource of Ontario s Greenbelt. 6 The subject property is located west of Regional Road 50 and north of Patterson Sideroad, in the hamlet of Palgrave, Town of Caledon. TRCA staff has been approached by Mr. Douglas Reddington regarding the donation of hectares (25.24 acres), more or less, of ecologically sensitive land which forms part of the Palgrave Cedar Forest Environmentally Significant Area (ESA). A certificate confirming the ecological sensitivity of the land, as required under the Ecological Gifts Program, was received from Environment Canada on August 28, TRCA staff has conducted negotiations with Douglas Reddington. As a result, Mr. Reddington has agreed to donate the subject property. Attached is a sketch showing the location of the subject lands. RATIONALE The subject property is part of a large natural area with high biodiversity of species and vegetation communities. The property is located within the Greenbelt Plan Area and considered a Natural Core Area under the Oak Ridges Moraine Conservation Plan (ORMCP). The property forms part of the Palgrave Cedar Forest Environmentally Significant Area (ESA) which consists of a large natural area with high biodiversity and is rich in rare flora / fauna species as well as rare vegetation communities. This ESA is connected to the Simcoe-Albion Forest ESA to the north which functions as a continuous corridor to the headwaters of the Humber River watershed. A tributary of the Humber River watershed also flows through the property which supports both warm and cold water aquatic communities. The property is classified as Existing Natural Cover according to TRCA s Terrestrial Natural Heritage System Strategy. There is also a wetland on site that has yet to be evaluated by the Ontario Ministry of Natural Resources and Forestry. The forest and riverine components of the property provide excellent terrestrial and aquatic habitat. The extent of natural area on site serves important hydrological functions as critical areas for groundwater recharge and discharge as well as sources of food and refuge for diverse communities of floral and faunal species. DETAILS OF WORK TO BE DONE Certification and approval of an appraisal is to be obtained from Environment Canada in compliance with the Ecological Gifts Program. TAXES AND MAINTENANCE Based on TRCA s preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program and TRCA s own field data, it would appear that the subject property would be eligible for a tax exemption. It is expected that the subject lands will not significantly impact TRCA's maintenance costs since these types of lands require a low degree of maintenance. RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Petticoat Creek watershed as outlined in the approved Greenlands Acquisition Project for Through the review of Land Division Application No. LD 086/2012 for consent to sever two residential lots, TRCA staff established the limits of the open space land (i.e. Part 3 on Draft Plan of Survey) which encompasses a portion of the Petticoat Creek valley corridor and the 10-metre buffer from the dripline of vegetation and long term stable top of bank. 490

Pursuant to Ontario Regulation 166/06, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. 16 10.4 STANDARD DELEGATED PERMITS Standard Permits, including Emergency Infrastructure Works permissions, are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard Permits, including Emergency Infrastructure Works permissions, are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13 and #A103/15, respectively. All standard and emergency infrastructure works are located within a Regulated Area, generally within or adjacent to the hazard or natural feature and in the opinion of staff do not affect the control of flooding, erosion, dynamic beaches, pollution or the conservation of land. CITY OF BRAMPTON ONTARIO INC. - Etobicoke Creek Watershed The purpose is to undertake works within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to facilitate the renovation of the existing industrial building, and expansion/formalization of a parking lot associated with a municipal site plan application and building permit application.
