To change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units and site grade on Part Lot 19, Concession 8, (9732 Highway 27), in the City of Vaughan, Humber River Watershed as located on the property owned by Ontario Ltd. The purpose is to permit development within a Regulated Area of the Humber River Watershed to facilitate minor grading works and interior and exterior modification and renovations to an existing restaurant (formerly the Salty Dawg) at 9732 Highway No. 27, in the City of Vaughan. The grading works include a new septic system as well as a comprehensive planting plan which includes new trees and shrubs. 2

3 10.2 STANDARD DELEGATED PERMITS 19 Standard Permits, including Emergency Infrastructure Works permissions, are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard Permits, including Emergency Infrastructure Works permissions, are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A198/13, #A199/13 and #A103/15, respectively. All standard and emergency infrastructure works are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years of less. RECOMMENDATION THE EXECUTIVE COMMITTEE RECOMMENDS THAT 11.2 hectares (27.8 acres), more or less, of vacant land, located east of Church Street North and north of Rossland Road West, said land being Part of Lot 14, Concession 3, designated Parts 1-4 on 40R-8952 Save And Except Part 1 On Plan 40R and Save And Except Part 1 on draft-m-plan by J.D. Barnes Limited, Reference No , dated September 28, 2017; and Blocks 4-5 on draft M-Plan by J.D. BACKGROUND Resolution #A161/15 at Authority Meeting #8/15, held on September 25, 2015, approved the Greenlands Acquisition Project for Negotiations have been conducted with Ian McCullough, Vice President of Land Development, Coughlan Homes, acting as agent for the owner. Access to the subject lands will be achieved through its frontage on Church Street North. Attached is a sketch illustrating the location of the subject lands. 5

6 Item 7.1 RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Greenlands Acquisition Project for Through the review of the Plan of Subdivision 18T-95036, TRCA staff established the limits of the open space land. TAXES AND MAINTENANCE Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that the subject property should be eligible for a tax exemption. While it is expected that the subject parcel of land will not significantly impact TRCA s maintenance costs at this location, an assessment of the aggregate acquisitions in the area will be undertaken and the results will be integrated into TRCA s land management program and associated budgets. CFN KEY ISSUE An exchange of land located west of Keele Street and south of Sheppard Avenue West, municipally known as Whitburn Crescent, in the City of Toronto, under the Greenlands Acquisition Project for , Flood Plain and Conservation Component, Humber River watershed. RECOMMENDATION THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Davpart Inc. for TRCA to enter into an exchange of lands with Davpart Inc., the owner of Whitburn Crescent, City of Toronto, in order to resolve an existing encroachment on the adjacent TRCA-owned lands; AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with Davpart Inc., in this instance and proceed with the land exchange; THEREFORE LET IT BE RESOLVED THAT TRCA enter into an exchange of lands with Davpart Inc. on the following basis: 1. Davpart Inc. will convey to TRCA a parcel of land containing hectares (0.09 acres), more or less, of vacant valley lands, located west of Keele Street and south of Sheppard Avenue West, said land being Part Block 1, PL 4503 North York as in TB215629; designated as Part 1 on sketch created on May 13, 2016 by MacNaughton Hermsen Britton Clarkson Planning Limited, municipally known as 117 Whitburn Crescent, in the City of Toronto; 2. TRCA will convey to Davpart Inc. a parcel of land containing 0.02 hectares (0.06 acres), more or less, of table lands with existing parking spaces, located west of Keele Street and south of Sheppard Avenue West, said land being Part Block 1, PL 4503 North York as in NY666347; designated as Part 2 on sketch created on May 13, 2016 by MacNaughton Hermsen Britton Clarkson Planning Limited, municipally known as 1651 Sheppard Avenue West, in the City of Toronto; THAT TRCA receive consideration in the sum of $275,880.00; all legal, survey and other costs to be paid by Davpart Inc.; 8

9 Item 7.2 THAT TRCA receive conveyance of the land free from encumbrance, subject to existing service easements; THAT Davpart Inc., is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from this exchange; THAT the firm Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid by Davpart Inc.; THAT said conveyance be subject to the approval of the Minister of Natural Resources and Forestry in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended, if required; AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction, including obtaining any necessary approvals and the signing and execution of documents. BACKGROUND Resolution #A161/15 at Authority Meeting #8/15, held on September 25, 2015, approved the Greenlands Acquisition Project for The proposed land exchange would involve the transfer of TRCA lands municipally known as 1651 Sheppard Avenue West in the City of Toronto, that have been developed by Davpart Inc. with parking spaces (existing), and in exchange Davpart Inc. is proposing to convey a portion of land at the rear of 117 Whitburn Crescent which is undeveloped and predominantly valley lands as well as pay consideration in the sum of $275, The subject TRCA-owned lands were acquired from D.B. Goodman, on January 13, 1960 under the W.C.-12 Black Creek Water Control Project. Negotiations have been conducted with Neil Robinson, Manager, acting as agent for the owners Carmen Colafella. Access to the subject lands will be achieved through its frontage on Sheppard Avenue West. Attached is a plan showing the location of the subject lands. RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for An analysis of the proposed exchange was conducted by a third party, MHBC Planning, Urban Design & Landscape Architecture on behalf of Davpart Inc. After a thorough exploration of relocating the parking spaces elsewhere within Davpart Inc. owned lands it was concluded that there was no other suitable location on the site for the parking. It is TRCA staff opinion that the proposed exchange and consideration is beneficial to both parties. 9

10 Item 7.2 The market value of the lands to be exchanged is based on an appraisal prepared by D. Bottero and Associates Limited on October 19, 2016 as well as an appraisal prepared by Wagner, Andrews, Kovac Ltd. on November 21, TAXES AND MAINTENANCE The parcel of land that is conveyed to TRCA will be turned over to the City of Toronto under the terms of the existing management agreement. 12 Item 8.1 Section II Items for Executive Action TO: FROM: Chair and Members of the Executive Committee Meeting #9/17, Friday, November 03, 2017 Nick Saccone, Senior Director, Restoration and Infrastructure RE: BLACK CREEK PIONEER MILL POND CLEAN-OUT AND RESTORATION PROJECT Award of Contract # for the Disposal of Stockpiled Sediments KEY ISSUE Black Creek Pioneer Mill Pond will be dredged mechanically to remove sediment that is inhibiting the operations of the mill at Black Creek Pioneer Village and negatively impacting Black Creek downstream of the pond. Accumulated sediment will need to be hauled and disposed of using a contractor operating under a Ministry of the Environment and Climate Change Environmental Compliance Approval. RECOMMENDATION THAT Contract # for the disposal of industrial/commercial pond dredgeate for Black Creek Pioneer Mill Pond, in the City of Toronto, be awarded to Ground Force Environmental Inc. for a total cost not to exceed $117,674.40, plus HST, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications; THAT TRCA staff be authorized to approve additional expenditures to a maximum of 15% of the total cost of the contract as a contingency allowance, if deemed necessary; AND FURTHER THAT authorized TRCA staff be directed to take the action necessary to implement the contract including obtaining any approvals and the signing and execution of documents. BACKGROUND TRCA has over 35 years of experience in the planning, design, construction, maintenance and monitoring of stormwater management pond (SWMP) projects. TRCA is ideally suited to carry out pond maintenance for the Black Creek Pioneer Village (BCPV) pond because of the full range of services and experience that can be offered internally including plan design, approvals, survey, public consultation, implementation and site restoration. Black Creek Pioneer Mill Pond, located south east of Steeles Avenue and Jane Street, within the boundaries of BCPV, is approximately.20 ha in size and drains to Black Creek. Due to years of sedimentation it has reached its capacity where the accumulated sediment needs to be dredged to improve function of the mill, as well as, the general aesthetics and historical/heritage value of Black Creek Pioneer Village. Cleaning out this pond will improve the thermal and sediment loading impacts to Black Creek downstream of the Black Creek Pioneer Mill Pond. The sediment was tested and meets industrial/commercial Ministry of the Environment and Climate Change (MOECC) guidelines. 12

13 Item 8.1 As part of the scope of work for this project, the industrial/commercial sediment accumulated in Black Creek Pioneer Mill Pond will be dredged, stockpiled and mixed with a polymer to make it easy to handle with machinery and taken off-site for disposal. The polymer is food grade and safe for use in aquatic environments. It has been used on multiple occasions by TRCA throughout the jurisdiction. Once the character of the sediment becomes like that of wet-cement, it is loaded into tri-axles for off-site hauling to an MOECC approved disposal facility operating with an Environmental Compliance Approval (ECA). In addition, a water control structure will be installed within the pond outlet to allow for increased water retention and improved water management within the pond. TRCA estimated that there is an accumulation of up to 1,000 m 3 of sediment to be removed from Black Creek Pioneer Mill Pond. RATIONALE The Request for Tender (RFT) # was publically advertised on the electronic procurement website on October 20, 2017 for the haulage and disposal of industrial/commercial sediment material from Black Creek Pioneer Mill Pond. The document was downloaded for review by 20 vendors. The quotations were received on October 27, 2017 and formally opened by TRCA staff (Lisa Moore, Judith Reda and Ryan Bolton) on the same day with the following results: Bidders Total (Plus HST) Loc-Pave Construction Inc. $125, Ground Force Environmental Inc. $117, The two bids received were evaluated and scored based on the bidder s price and has determined that the lowest bid is of reasonable value and also meets the requirements and deliverables as outlined on the contract documents. Ground Force Environmental Inc. is capable of undertaking the scope of work. In addition, this vendor has worked successfully with TRCA in the past for similar types of contracts. Based on the bids received, staff recommends that Ground Force Environmental Inc. be awarded Contract # for the disposal of stockpiled sediments at Black Creek Pioneer Mill Pond at BCPV for a total cost not to exceed $117, plus 15% contingency to be expended as authorized by TRCA staff, plus HST. This project is consistent with TRCA s Strategic Plan, specifically strategy #2 manage our regional water resources for current and future generations. FINANCIAL DETAILS The costs for Contract # are 100 % recoverable from the City of Toronto in account DETAILS OF WORK TO BE DONE Black Creek Pioneer Mill Pond will be dredged mechanically and restored upon completion. Only contractors operating under an MOECC ECA are eligible to undertake the disposal of the industrial/commercial sediment. 13

14 Item 8.1 TRCA will execute the contract, including: management of the awarded disposal contractor on site, certification of each load leaving the site, issuance of bills of lading to each truck, verification of the disposal site s MOECC ECA, and random checks to follow trucks from dredging site to disposal site. These activities ensure the chain of custody of the dredged sediment from the SWMP to the licensed disposal site operating under an MOECC ECA. Dredging is tentatively scheduled to commence in November at Black Creek Pioneer Mill Pond, upon receipt of all approvals and the availability of resources. Black Creek Pioneer Mill Pond will be de-watered during the dredging, and will be managed to ensure the pond is providing stormwater management function during this time period. 15 Section IV Ontario Regulation 166/06, As Amended TO: FROM: Chair and Members of the Executive Committee Meeting #9/17, November 3, 2017 Carolyn Woodland, Senior Director, Planning, Greenspace and Communications RE: APPLICATIONS FOR PERMITS PURSUANT TO ONTARIO REGULATION 166/06, AS AMENDED Development, Interference with Wetlands and Alterations to Shorelines and Watercourses KEY ISSUE Pursuant to Ontario Regulation 166/06, as amended, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected. Crozier & Associates Inc., dated January 18, 2017, received by TRCA on May 11, RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to permit development within a Regulated Area of the Humber River Watershed to facilitate minor grading works and interior and exterior modification and renovations to an existing restaurant (formerly the Salty Dawg) at 9732 Highway No. 27. The grading works include a new septic system as well as a comprehensive planting plan which includes new trees and shrubs. The Main Humber River traverses the rear of the subject property which is located on the flat valley floor, entirely within the Regional Storm Flood Plain. The Regional Storm Flood Elevation for the subject property is metres above sea level (m.a.s.l.). We note that the existing building already contains a number of openings well below the proposed drive-through window opening elevation. The existing building is already prone to flooding (the existing finished floor elevation of the building and existing entrances are located at m.a.s.l.) and confirmation from structural engineer confirms that the building can withstand the hydrodynamic and hydrostatic forces under the Regional Flood event and does not increase the risk to life and property. The proposed minor grading works include modifications to the already existing paved areas to accommodate formal drive aisles and additional parking spaces. There are no proposed new parking areas or an increase in impervious areas associated with the propose works. TRCA Water Resources Engineering staff are satisfied that these works will not have an adverse impact on the storage and conveyance of flood waters. Control of Flooding: The subject property is entirely within the Regional Storm Flood Plain. As the proposal does not involve the construction of any new structures or grading works that would impact the flood plain, impacts to flooding or the conveyance of floodwaters is not anticipated as a result of the proposed works. Pollution: Sediment control fencing (double silt fence) will be erected and maintained for the duration of construction to prevent the transport of sediment into the adjacent Humber River. 17

18 Dynamic Beaches: Not applicable Erosion: Impacts to slope stability and erosion are not anticipated as a result of the proposed works. Conservation of Land: As the adjacent watercourse (Main Humber River will not be impacted by the proposal, no fisheries concerns will result.
