4 SECTION I - ITEMS FOR AUTHORITY ACTION RES.#B2/13 - GREENLANDS ACQUISITION PROJECT FOR Flood Plain and Conservation Component, Etobicoke Creek Watershed Deepbrook Developments Inc., CFN Purchase of property located south of Mayfield Road, east of Colonel Bertram Road - Snelgrove, City of Brampton, Regional Municipality of Peel, under the "Greenlands Acquisition Project for ", Flood Plain and Conservation Component, Etobicoke Creek watershed. Moved by: Seconded by: Gloria Lindsay Luby Ben Cachola THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.06 hectares (0.16 acres), more or less, of vacant land being Part of Lot 17, Concession 1 EHS and designated as Blocks 25 and 26 on a Draft Plan of Subdivision prepared by Holdings Jones Vanderveen Inc., Ontario Land Surveyors, under their Job No MPLAN1, dated December 4, 2012, City of Brampton, Regional Municipality of Peel, located south of Mayfield Road, east of Colonel Bertram Road - Snelgrove, be purchased from Deepbrook Developments Inc.; THAT the purchase price be $2.00; THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the lands free from encumbrance, subject to existing service easements; THAT Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid; AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents. CARRIED BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for Negotiations have been conducted with Mr. Carl Brawley of Glen Scnarr & Associates, who acts as agent on behalf of the owner. TRCA owns the adjoining valleyland which has direct access from Mayfield Road. Attached is a plan showing the location of the subject lands. 2

5 RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Etobicoke Creek watershed as outlined in the approved Greenlands Acquisition Project for Through the review of Subdivision Application 21T-99018B for residential development, TRCA staff established the limits of the open space lands (i.e. Blocks 25 and 26 on Draft Plan of Subdivision) which are located in the Regulated Area and a portion of the valley corridor of a tributary of the Etobicoke Creek at this location. At the request of TRCA staff, the limit between the developable lands and the open space lands within the subdivision was determined by a geotechnical / slope stability report submitted by the owner's consultant, which was reviewed and accepted by staff. TAXES AND MAINTENANCE It is proposed that the lands be turned over to the City of Brampton for management. CARRIED BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for As a condition of the subdivision agreement, John Boddy Development Ltd. is required to transfer the lands (ie. Block 180 on draft M-Plan) to TRCA for the nominal consideration of $2.00. Negotiations have been conducted with Bruce Jennings, CA of Boddy Developments Ltd. Attached is a plan showing the location of the subject lands. RATIONALE The subject property (i.e. Block 180 on draft M-Plan) is a depressed kettle wetland connected to the valley system of the Carruthers Creek. It is part of the Carruthers Creek Wetland Complex, a Provincially Significant Wetland and the Shoal Point Wetlands Area of Natural and Scientific Interest. 5

8 TAXES AND MAINTENANCE Based on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2014 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location. Jack Heath Glenn De Baeremaeker THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Town of Richmond Hill for conveyance of land for the reconstruction and partial closure of Olde Bayview Avenue, south of North Lake Road, Town of Richmond Hill, Regional Municipality of York; AND WHEREAS it is in the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the Town of Richmond Hill in this instance; THEREFORE LET IT BE RESOLVED THAT a parcel of TRCA-owned land containing hectares (0.001 acres), more or less, required for the reconstruction and partial closure of Olde Bayview Avenue, said land being Part of Lot 6, Concession 2 EYS and designated as Part 2 on Plan 65R-33975, Town of Richmond Hill, Regional Municipality of York, be conveyed to the Town of Richmond Hill; THAT consideration be the nominal sum of $2.00, plus all legal, survey and other costs to be paid by the Town of Richmond Hill; 8

11 THAT an archaeological investigation be completed, with any mitigative measures being carried out to the satisfaction of TRCA staff, at the expense of the Town of Richmond Hill; THAT the conveyance of land be subject to a landscaping plan, subject to the approval of TRCA staff; THAT the Town of Richmond Hill is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from this sale; THAT said conveyance be subject to approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended; AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents. CARRIED BACKGROUND At Authority Meeting #10/12, held on January 4, 2013, Resolution #A240/12 was adopted, approving a request from the Town of Richmond Hill for an exchange of lands with TRCA in connection with the construction of a cul-de-sac for the partial closure of Olde Bayview Avenue, south of Lakeside Crescent. As part of the land exchange approval, the Town of Richmond Hill will convey a parcel of land (0.02 hectares / 0.04 acres), to TRCA and a parcel of TRCA property (0.03 hectares / 0.07 acres), will be conveyed to the Town of Richmond Hill (Attachment 1). When the original request for the land exchange was received from Town of Richmond Hill, it was indicated that only the cul-de-sac land was required, however, the Town has now indicated that Part 2 on Plan 65R is also required for the road reconstruction project. The subject lands form part of a larger acreage acquired by TRCA from S. C. and M. L. Snively on June 29, 1966 under the Lake St. George Conservation Area Project. The Town of Richmond Hill has conveyed lands to TRCA over the years for nominal consideration of $2.00 and has requested that the TRCA lands required for the reconstruction and partial closure of Olde Bayview Avenue, south of North Lake Road, be conveyed for the nominal consideration of $2.00. The former realignment of Bayview Avenue east of Lake Wilcox has created an opportunity to change the existing road network and allow improvements for pedestrian access to Sunset Beach Park as well as other recreational uses along the east side of the lake. The partial closure of Olde Bayview Avenue is required in order to construct a walkway and boardwalk along the lake frontage south of the proposed terminus of the travelled municipal road. TRCA staff is presently reviewing a permit application for the road reconstruction project which will be presented in a report at a future Executive Committee Meeting. Plantings: All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan will be prepared and form part of the permit pursuant to Ontario Regulation 166/06. 9

15 RES.#B6/13 - Moved by: Seconded by: SUPPLY OF OPERATED HEAVY CONSTRUCTION EQUIPMENT AND DUMP TRUCKS Tender RSD Award of Contract RSD13-01 for the supply of operated heavy construction equipment and dump trucks. Gloria Lindsay Luby Ben Cachola THE EXECUTIVE COMMITTEE RECOMMENDS THAT Toronto and Region Conservation Authority (TRCA) staff be authorized to have two vendors of record for the supply of operated heavy construction equipment and dump trucks for the period April 1, 2013 to April 1, 2014; THAT TBG Landscape Inc. be recognized as the primary supplier of operated heavy equipment and dump trucks during the contract period, it being the proposal that best meets the general requirements of TRCA at a competitive cost; THAT Sartor & Susin Ltd. be recognized as the supplier of operated heavy equipment and dump trucks on shoreline armouring, lakefilling and natural channel projects during the contract period, it being the proposal that best meets TRCA's requirements for this specialized work at a competitive cost; THAT Sartor & Susin Ltd. be permitted to continue to supply operated heavy equipment and dump trucks to projects already in progress until completion; THAT where the vendors of record are not available for a particular project, staff be authorized to use the next lowest bidder; AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents. 17 The hourly rates submitted by TBG Landscape Inc., Four Seasons Site Development and Sartor and Susin Ltd. were the most competitive, with TBG Landscape Inc. having the lowest hourly rates on the majority of the specified equipment. Although Four Seasons Site Development had the second lowest hourly rates overall, subsequent reference checks failed to demonstrate a history of similar work experience, making Sartor & Susin Ltd. the second lowest bidder overall meeting TRCA's requirements. In recent years TRCA has worked successfully with TBG Landscape Inc. on a number of projects. Further assessment by TRCA staff of TBG Landscape Inc. s experience and ability to undertake similar projects was conducted through reference checks and the receipt of a detailed portfolio of work, which resulted in positive feedback that TBG Landscape Inc. is generally capable of fulfilling the requirements of the contract. Some questions were raised by staff during the tender selection process however as to TBG Landscape Inc.'s experience with lakefilling operations, shoreline armouring and natural channel works. While TRCA has enjoyed a long and successful relationship with Sartor & Susin Ltd. over the past three decades, it will be to TRCA's advantage to cultivate additional suppliers that can meet the needs of TRCA's unique and specialized projects, particularly in light of the increasing volume of work in recent years. Staff therefore recommends awarding Contract RSD13-01 to TBG Landscape Inc. as the primary supplier of operated heavy construction equipment and dump trucks, it being the proposal that best meets TRCA's general requirements at a competitive cost; and to Sartor & Susin Ltd. as the supplier of operated heavy construction equipment and dump trucks for the aforementioned works, it being the proposal that best meets TRCA's special requirements at a competitive cost. It is noted that opportunities are to be provided to TBG Landscape Inc. during the contract period to gain experience with specialized works historically completed with the assistance of Sartor & Susin Ltd. To ensure consistency in technique and quality, staff also recommend that Sartor & Susin Ltd. be permitted to continue supplying operated heavy construction equipment and dump trucks to projects already in progress until completion. Where the vendors of record are not available for a particular project, staff also request authorization to use the next lowest bidder. FINANCIAL DETAILS The value of this contract is estimated to be approximately $4,500,000 based upon a review of projects scheduled for implementation during the contract period, which is estimated to be shared between the two vendors of record at approximately 50% each. An increase or decrease in workload will have an impact on the value of this contract. The contractor understands both the potential cost and resource implications associated with potential workload changes. The operated equipment is rented on an 'as required' basis with no minimum hours guaranteed. 15

Extension of sole source contract to provide professional services for the CTC Source Protection Region for the source protection plan implementation process. Ronald Chopowick Glenn De Baeremaeker THAT the contract with Thorpe & Associates, Beverley Thorpe be extended for a period of one year, commencing April 1, 2013, to provide professional services for the source water protection planning process for the CTC Source Protection Region - Toronto and Region Source Protection Authority (TRSPA), Credit Valley Source Protection Authority (CVSPA) and Central Lake Ontario Source Protection Authority (CLOSPA); THAT funding to Thorpe & Associates be capped at $125,000 per annum, plus a 10% contingency for fiscal year April 1, 2013 to March 31, 2014 plus HST; THAT the contract be subject to termination by Toronto and Region Conservation Authority (TRCA) or Thorpe & Associates, for any reason, upon 30 days notice; THAT this contractual obligation be binding on TRCA acting as lead source protection authority only to the extent that the Province of Ontario continues to provide funding; AND FURTHER THAT TRCA staff be authorized and directed to take such actions as necessary to implement the contract including the execution and signing of documents. 19 BACKGROUND At Executive Committee Meeting #2/05, held on April 8, 2005, by Resolution #B37/05, the principal of Thorpe & Associates, Beverley Thorpe, was hired to provide project management services in support of source water protection planning at the CTC Source Protection Region and TRCA. The initial contract was for one year with annual renewal in April, 2006 and 2007, ending in March, Upon successful completion of the first work assignment, an extension was authorized by Resolution #A297/07 at Authority Meeting #10/07, held on January 4, 2008, for annual renewal starting in April 2008, ending in March As source protection planning continued and the consultant's completion of assignments on time continued, a second extension was authorized by Resolution #A34/11 at Authority Meeting #2/11, held on February 25, 2011 for annual renewal starting in April 2011, ending in March The proclamation of the Clean Water Act, 2006 and promulgation of the regulations imposed legal and time line requirements on the source protection authorities created by regulation, particularly for the TRSPA as the lead source protection authority within the CTC Source Protection Region. The program has evolved from the 'no regrets' technical work focus to a legally mandated delivery program, including the creation of a source protection committee. The CTC Source Protection Committee (SPC) has been meeting since December 10, Coupled with these legal requirements the Province has been releasing evolving direction on requirements for technical work and source protection plan development which has increased the workload. In 2010 the CTC source protection team was restructured to assist the project manager in delivering mandatory communications and public consultation, to support program delivery and provincial reporting requirements. Further CTC source protection team restructuring occurred after January 31, 2013 when the Province introduced a new funding structure during a "transition phase" between source protection plan submission and approval. It is essential to ensure that the CTC Source Protection Region has the continuity in program management support in place to develop a framework for municipal implementation readiness while awaiting the Minister's approval of the CTC source protection plan and to put in place the reporting, record keeping and governance structure for the program beyond March 31, The work required with respect to source protection planning under the Clean Water Act, 2006 and associated regulations, including the project management services, is fully funded by the Ministry of the Environment through a transfer payment to TRCA as the lead for the CTC Source Protection Region. A Memorandum of Understanding amongst Credit Valley, Central Lake Ontario and Toronto and Region conservation authorities sets out the basis for cooperative work and transfer of funds to cover costs incurred by the partner authorities. TRCA has also entered into Memoranda of Agreement with several municipal partners to transfer allocated funds from the Province, where the municipality is leading a component of technical work. 17

20 RATIONALE Over the contract period to date, Beverley Thorpe has successfully executed her responsibilities. Some examples of the services provided include guiding the technical staff from the three participating conservation authorities (CAs) in preparing work plans, completing technical studies (including peer review), preparation and submission of the proposed source protection plan, representing the CTC Source Protection Region on the province-wide committee of project managers, providing advice and support to the CTC Management Committee of Chief Administrative Officers, making presentations to the CA boards, local councils and leading a municipal technical advisory committee comprised of representatives from the planning, works and health departments of all the upper, lower and single tier municipalities wholly or partially within the CTC Region. In addition, Beverley Thorpe, at the request of the Province and TRCA has presented papers on source water issues at a number of conferences and forums and was instrumental in assisting in the development of a near shore study for Lake Ontario. Although the source protection plan has been submitted, technical work is ongoing and will be reflected in further updates to the Assessment Reports for the Region. This work includes Tier 3 Water Budget work underway in both CVSPA and TRSPA and further modelling of scenarios on threats to Lake Ontario drinking water sources. These products require preparation of technical material and communication products, review and endorsement by the SPC, public consultation and review by the respective source protection authorities prior to submission to the Province. Other regulatory deliverables include conducting and reporting on the meetings of the SPC and maintaining a website for public access to the work completed and underway. New work for the 2013/14 period centres around supporting municipal implementers to achieve implementation readiness. The drinking water source protection process has broken new ground in water management and requires an experienced project manager. Beverley Thorpe has a wealth of experience, a well established network of senior managers within the Province and the project management skills to lead not only the CTC Region activities but also to be a resource for other CA's and source protection committees. The CTC SPC Chair and members greatly appreciate the consistent leadership that Ms. Thorpe has shown and benefit from the historical and technical knowledge that she has available to her. Beverley Thorpe has been and will continue to mentor some CTC staff over the next year to allow their professional development to meet the needs of the succession planning process. Senior staff at Central Lake Ontario and Credit Valley conservation authorities are also in support of this contract. In 2010, a geomorphic assessment of Mud Creek was commissioned by Toronto Water titled Mud Creek Geomorphic Systems Master Plan. Mud Creek was divided into six reaches, each separated by culverts. In the winter of 2012 TRCA implemented restoration works at the highest priority area, Reach 1, located at the most downstream limits of the creek adjacent to Evergreen at the Brick Works, using the design recommendations from the aforementioned Master Plan and funding from its 2012 erosion capital budget. Following the success of this project, Toronto Water and Parks, Forestry & Recreation (PF&R) staff asked TRCA to implement restoration works on behalf of the City of Toronto at additional priority areas, the next planned area being Reach 5, scheduled to commence in February

22 The proposed work for Mud Creek Reach 5 includes a 24 m extension of a perched 1800 mm diameter corrugated metal culvert, the removal of failed gabion basket walls and bank stabilization with armourstone retaining walls and a vegetated rock buttress. The channel grade will be maintained with a plunge pool, armourstone retaining weirs and stone riffle features throughout the length of the reach. The primary intent is to improve the bank stability along Reach 5 and improved flow management; however secondary objectives include invasive species removal and intensive plantings with native vegetation for improved terrestrial habitat conditions. The culvert extension will eliminate further erosion of the existing channel as part of the overall master plan. BACKGROUND The research vessel Aqualab (V5000) requires maintenance involving the reapplication of the hull treatment coating and new paint above the waterline. The vessel was last painted in The effects of heavy use and weather have worn down the old coatings. Throughout the last 10 years, The Aqualab has been used extensively across TRCA S jurisdiction as well as in neighboring jurisdictions. The boat is highly visible to the general public as well as TRCA S partners. The appearance of the Aqualab reflects directly on TRCA and the work we do. Keeping the vessel in good repair will help uphold the image of TRCA. Also, recoating the hull of the Aqualab is necessary to prevent fouling. Fouling of the hull results in deterioration of the metal as well as reduced fuel efficiency. Reapplying the hull treatment will extend the longevity of the boat and reduce operating costs. The Aqualab currently displays the old TRCA logo. The repainting process will remove the old logo, allowing the new corporate logo to be prominently displayed. The Aqualab fills a unique niche and has also been able to generate revenue by offering services to external agencies. These other agencies include conservation authorities, the Ontario Ministry of Natural Resources and Fisheries and Oceans Canada. The scope of work required to refinish the Aqualab is as follows: strip and refinish super structure, exterior and decks; refinish hull; renew hull antifouling coating. RATIONALE A Request for Quotation was issued to the following three companies: Bristol Marine; Heritage Marine; Henley Boats. Quotes were received from the three vendors and reviewed by TRCA staff (Brian Graham and Rick Portiss) on January 15, 2013 with the following results: 26
