Negotiations have been conducted with Law Clerk, Ms. Grace McNamara of Jeffrey P. Shankman, Barrister and Solicitor, representative of the owner. 6 RATIONALE The subject property falls within TRCA s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for Through the review of the subdivision, TRCA staff established the limits of the open space lands (i.e. Part 1 on 65R-34182) on the Oak Ridges Moraine which is comprised primarily of valleylands. The subject property also contains a tributary to the Little Rouge Creek. This tributary has been identified as potential Redside Dace habitat, a species protected under the Endangered Species Act, The tributary is also designated as a Hydrologically Significant Feature by the Oak Ridges Moraine Conservation Plan. TAXES AND MAINTENANCE Based on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2014 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location. CARRIED BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for Negotiations have been conducted with Mr. John Wright of Beard Winter LLP, Lawyers, who acts as agent on behalf of the owner. Since TRCA does not presently own any adjoining property, a temporary access easement over the adjoining industrial lot will be granted to TRCA as part of this transaction in order to periodically inspect and maintain the lands. Attached is a plan showing the location of the subject lands. RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Carruthers Creek watershed as outlined in the approved Greenlands Acquisition Project for Through the review of Site Plan Application SP20/12 and Land Division applications LD 057/2013 / LD 058/2013, TRCA staff established the limits of the open space land (i.e. Part 4 on Plan 40R-27898) which is comprised of a stream corridor of a tributary of the Carruthers Creek. The entire site is located within the Regulated Area. 196

11 RES.#B60/13 - Moved by: Seconded by: REGIONAL MUNICIPALITY OF PEEL Conveyance of Land and a Permanent Easement for the Gore Road Widening, City of Brampton, Regional Municipality of Peel, Humber River Watershed, CFN Receipt of a request from the Regional Municipality of Peel for conveyance of land and a permanent easement for road widening of Gore Road from Queen Street to Regional Road 50 in the City of Brampton, Regional Municipality of Peel. Michael Di Biase Ronald Chopowick THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Regional Municipality of Peel (Region of Peel) to convey certain lands and a permanent easement for the road widening of Gore Road from Queen Street to Regional Road 50; AND WHEREAS it is the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the Region of Peel in this instance; THEREFORE LET IT BE RESOLVED THAT TRCA-owned lands containing 0.70 hectares (1.74 acres), more or less, being Part of Lot 2, Concession 9, Northern Division (Geographic Township of Toronto Gore) designated as Part 7 on Part 43R be conveyed to the Region of Peel for the widening of Gore Road from Queen Street to Regional Road 50 in the City of Brampton, Regional Municipality of Peel; THAT a permanent easement containing a total of hectares ( acres), more or less, be granted to the Region of Peel for hydro pole anchor in connection with the widening of Gore Road from Queen Street to Regional Road 50 in the City of Brampton, Regional Municipality of Peel in the City of Brampton, Regional Municipality of Peel, being Part of Lot 2, Concession 9, Northern Division (Geographic Township of Toronto Gore) designated as Part 8 on Part 43R-34881; THAT consideration is to be the nominal sum of $2.00, plus all legal, survey and other costs; THAT archaeological investigation is to be conducted before any site disturbance with any mitigative measures required being carried out, all at the expense of the Region of Peel; THAT the Region of Peel be responsible for all legal, survey and other costs related to the land conveyance; THAT all permits pursuant to Ontario Regulation 166/06 be obtained by the Region of Peel prior to the commencement of construction; 199

12 THAT the Region of Peel is to fully indemnify and save harmless TRCA from any and all claims for injuries, damages or loss of any nature resulting in any way either directly or indirectly from this sale or easement or the carrying out of construction; THAT said conveyance and easement is subject to the approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended; AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to implement the conveyance and easement, including obtaining needed approvals and the signing and execution of documents. CARRIED BACKGROUND The Region of Peel s Long Range Transportation Master Plan identifies widening Gore Road from a two-lane rural road to a four-lane urban road to accommodate the needs of a growing city. The Region of Peel has requested a land conveyance of 0.70 hectares (1.74 acres) for the widening of Gore Road and a permanent easement of hectares ( acres) for a hydro pole anchor. Further, the Region of Peel requires approximately hectares (0.040 acres) for a temporary easement during construction. The subject TRCA-owned lands were expropriated from Christopher J. & Dorothy L.Graham on June 4, 1962 and Victor S. & Gladys A. Creech on December 11, 1963 for the Claireville Dam and Reservoir Project. Plantings All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material as part of TRCA staff review. A plan illustrating the land conveyance and permanent easement is attached. 14 RES.#B61/13 - Moved by: Seconded by: SWAN LAKE RESIDENCE RETROFIT AND RENOVATION PROJECT Tender PMO Award of Contract PMO13-04 for interior and exterior alterations at the Swan Lake Residence (1229 Bethesda Road), Town of Richmond Hill. Michael Di Biase Ronald Chopowick THE EXECUTIVE COMMITTEE RECOMMENDS THAT contract PMO13-04 for the interior and exterior alterations at the Swan Lake Residence (1229 Bethesda Road) be awarded to Berkim Construction Inc. at a total cost not to exceed $1,728,350.00, plus 20% contingency, plus HST, subject to receipt of all necessary approvals, permits and funding, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications; THAT the contract be subject to terms and conditions satisfactory to TRCA staff and, as necessary, solicitor; THAT should staff be unable to negotiate a mutually acceptable tender agreement with the above-mentioned contractor, staff be authorized to enter into contract negotiations with other contractors, beginning with the next lowest bidder meeting TRCA specifications; AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents; CARRIED BACKGROUND On July 31, 2008, TRCA acquired 1229 Bethesda Road (Swan Lake) from Ralph and Linda Hollander. The property consists of a hectares (50.54 acres) rectangular shaped parcel of land which includes a two storey, 6,000 square foot, stone exterior finished single family residence, triple detached garage and a nine acre kettle lake, said land being Part of Lot 5, Concession 2, Town of Richmond Hill, Regional Municipality of York. With its close proximity to the Lake St. George Field Centre (LSGFC) and being situated within the Oak Ridges Moraine, the potential uses for the property will meet various TRCA programming and operational needs. Currently, TRCA Education staff has engaged in discussions with potential partnership groups regarding the use of the Swan Lake building and lands for innovative teaching education programs; outdoor and experiential education teacher training; summer camp programs; laboratory schools (learning and application); and training facilities. The addition of TRCA staff resources and volunteers to support these uses will improve outdoor and environmental learning opportunities for elementary, secondary and post-secondary students within the Toronto region. The opportunity to partner with TRCA at Swan Lake, while still being able to access the amenities at LSGFC, will help expand TRCA's user groups and provide much needed outdoor classroom accommodations in the fast-growing community of Richmond Hill. 202

15 Presently TRCA's office accommodations at the Boyd Centre is over capacity requiring the use of a portion of the cafeteria as temporary office space. Additional office space at Swan Lake will aid in resolving this situation. The second floor of the building will be renovated for TRCA office space to accommodate 27 staff from Stewardship and Outreach Education and Education Services. This new office space will reduce crowding at a number of other TRCA office locations and allow for improved community/educational programming in this part of TRCA's jurisdiction. Two large meeting spaces will be made available and will provide new collaboration space for use by TRCA staff, as well as TRCA's wide range of public and private sector partners, and address increasing demand for meeting space at TRCA's other office locations and facilities, including Lake St. George Field Centre. The Centre for Innovation in Conservation will allow TRCA and partner organizations to access a unique environment away from the normal distractions of office meeting rooms and seek innovative, collaborative solutions to key challenges related to conservation and city building. In order to provide the accommodations and services required to carry-out these ventures, TRCA is proposing to conduct a complete building retrofit and renovation as part of a building change of use from its current single family residence to an educational classroom/training and office facility. The building will meet Ontario Building Code (OBC) requirements through upgrades, renovations and repairs to the building envelope (interior and exterior) and its operational systems due to its increase in occupancy. The major retrofit items include roof deficiencies (chimneys); windows and doors; safety features such as fire protection, emergency access routes; barrier free accessibility (washrooms); parking spaces; HVAC and septic systems; and broadband infrastructure. As part of the Swan Lake Residence retrofit, TRCA engaged MC Architects to lead a team of engineers to undertake a facility assessment and conceptual redesign of the Swan Lake Residence. The purpose of the assessment and design was to provide a framework for major renovations and system retrofits that meet OBC requirements for architectural, mechanical, structural and electrical upgrades to re-purpose this building from its historic residential usage to one that meets the current and future needs of TRCA. As part of these works, a magnitude of costs for the project was developed during the design development phase that determined a value of approximately $1.6 million for the proposed construction activities. At Authority Meeting #3/13, held on April 26, 2013, Resolution #A60/13 approved the renovation and retrofit of the Swan Lake residence and entering into an agreement with the York Region District School Board (YRDSB) and YMCA of Greater Toronto for the use of a portion of the building for the Swan Lake Outdoor Education Centre. RATIONALE Request for Pre-Qualification (RFPQ) for general contractors was advertised on-line with biddingo.com on April 10, 2013 and closed on April 24, The work includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment to perform the prescribed scope of work. The general contractor will coordinate all construction activities to facilitate this change in use. General contractors interested in pre-qualifying were advised of the criteria for evaluation, including: completeness of submission; past experience in the renovation of older buildings of similar size; 203

16 past experience with the proposed scope of work; ability to meet construction schedule milestones; ability to coordinate work by others; and experience dealing with projects with construction budgets in the range of $1 to $2 million. Bidders were required to submit a bid bond of 10% of the contract price at the time of the tender submission. The pre-qualifying documents were reviewed by the selection committee made up of TRCA staff that have extensive backgrounds in new building and retrofit construction projects. The proposals were evaluated using the following criteria being met in order to receive a tender package: CCDC 11 (Canadian Construction Documents Committee) Contractor's Qualification Statement; company experience and background in similar works; experience of suggested personnel for this project; project record over the past five years; and references focusing on firms history of project control and experience. Based on the evaluation process, tender documents were made available to the following nine general contractors: Ameresco Canada Inc.; Berkim Construction Inc.; P&C General Contracting; Pre-Eng Construction Ltd.; Silver Birch Contracting Ltd.; Steelcore Construction Ltd.; Struct-Con Construction Ltd.; Vema Corp; and W.S. Morgan Construction Ltd. All but one of the pre-qualified companies attended a mandatory site meeting on May 14, Tenders closed on May 23, 2013 and were opened by the Tender Opening Committee at the May 24, 2013 Authority Meeting with the following results: BIDDERS TOTAL (Plus HST) Berkim Construction Inc. $1,728, Struct-Con Construction Ltd. $1,792, Steelcore Construction Ltd. $1,797, Silver Birch Contracting Ltd. $1,890, Pre-Eng Construction Ltd. $2,195, Vema Corp $2,210, Ameresco $2,500,

17 Having previously pre-qualified the bidders, TRCA staff evaluated the tenders on the bid prices and the ability to complete the project within the specified construction window. The bids prices came in higher than the previously approved amount of $1.6 million. This was partially due to OBC requirements for fire access routes and new hydro services being revised during the late stages of the design phase and was not fully accounted for in the initial estimate. As opposed to new building construction, building retrofits of this magnitude can have unforeseen construction issues in meeting OBC requirements. Further, after analyzing the bid prices and conferring with bidders it was determined that the current construction market is very active with many construction projects being tendered for this summer. Having the three lowest bids being separated within approximately $70,000 of each other, staff is confident that the bids are still very competitive. Based on this evaluation, staff recommends that Contract PMO13-04 be awarded to Berkim Construction Inc. for the total cost not to exceed $1,728,350.00, plus a 20% contingency, plus HST, as they are the lowest bidder that meets TRCA specifications. FINANCIAL DETAILS Funds are available within TRCA's Major Facilities Retrofit budget from TRCA's municipal funding partners in account # with approximately $360,000 being contributed by YRDSB and YMCA for development of the outdoor education centre. General operating costs, including heat, hydro, grounds maintenance and IT services are estimated at $150,000 annually with $35,000 being recovered through shared cost arrangements with the YRDSB and YMCA and the remaining operating costs being available in future operating budgets from TRCA's municipal funding partners. CARRIED BACKGROUND As a founding partner of the CaGBC, TRCA has worked closely with the CaGBC on several initiatives since the Council was first established in The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City. The Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding (MOU) between TRCA and CaGBC. By entering into the MOU, TRCA agreed to work in partnership with CaGBC on various initiatives focused on increasing the uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows: THAT Toronto and Region Conservation Authority enter into a Memorandum of Understanding with the Canada Green Building Council. The purpose of the MOU was to formalize the working relationship between the two organizations and to establish priorities. Among the many roles and responsibilities outlined in the MOU, was the condition for TRCA to support and advocate for local funding opportunities and to work closely with the Greater Toronto Chapter (GTC). In 2010, 2011 and 2012, TRCA and GTC developed and executed annual work plan agreements which identified key activities and initiatives to be completed in each calendar year. At Executive Meeting #4/12, held on June 1, 2012, approval was granted for TRCA to carry-out the annual work plan agreement with the GTC. Resolution #B75/12 was approved as follows: THAT Toronto and Region Conservation Authority (TRCA) continue its existing agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to December 31, 2012; THAT TRCA continue to work with the Greater Toronto Chapter to deliver the initiatives in accordance with the signed Memorandum of Understanding (MOU) with the Canada Green Building Council (CaGBC); AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the agreement. RATIONALE The following is a list of initiatives that will be completed in 2013, in part, with the grant provided by TRCA to the Chapter. 206

Municipal Engagement and Knowledge Sharing Municipal Leaders Forum Ontario Green Policy Hub The Municipal Leaders Forum (MLF) brings together municipal leaders in the southern Ontario region (including Peel Region and the City of Toronto) to share knowledge on green building policy and practice issues at the municipal level. With the support of TRCA and the Ontario Power Authority (OPA), MLF created and launched the Ontario Green Policy Hub (OGPH), an online searchable resource of the most innovative and best policy practices that promote and develop sustainable built environments by Ontario municipalities. Successfully launched in 2012, the OGPH requires ongoing resources for its operation and maintenance in order to stay current and relevant. 2. Strengthening Green Building Knowledge and Awareness The Greater Toronto Chapter s principal goal is to serve the needs of its members and supporting organizations. In meeting this goal, the Chapter strives to deliver value in a variety of formats that include large annual events and smaller education events. In 2013 the Chapter will deliver: Annual Events Four large scale Chapter events ( attendees), whose focus is on networking/awareness amongst the green building community. Events will include: Spring Open a celebration of green buildings and launch of Green Doors Open (part of Doors Open Ontario). Summer BBQ to be held in a location with green building features that will allow for the incorporation of tours and discussion of the building s special green features. September Boat Cruise waterfront cruise offers both networking and an education opportunity with regard to waterfront developments. Fall Legacy Gala includes new awards program recognizing innovation in LEED (Leadership in Energy and Environmental Design) projects across southern Ontario. Education Events National Workshops (13 events) the Chapter is now responsible for the entire administration and delivery of national workshops requiring additional administrative, operational and marketing resources. Chapter Education: LEED Breakfast Series: the Chapter has created a new LEED Breakfast Series (4) starting in April of This series is focused primarily on issues related to LEED and is designed to engage and inform building owners, operators and managers. Educational Outreach: expanding Chapter partnerships within the GTA and across southern Ontario. 207

20 Webinars: the Chapter is setting up regular webinars on green building topics of interest for our Chapter Members and network. This new program requires content development and administrative support; especially as we redevelop our website to allow attendees to pay for and access recordings (Chapter Members will be able to access recordings for free). Topics may include: LEED Canada for Neighbourhood Development, Construction Waste Management and introductions to green building and LEED accreditation. As the Chapter strives to increase its educational capacity, TRCA funding will go toward the creation, coordination, marketing and delivery of these events, including content development and market research. Additional Green Initiatives Green Doors Open The goal of Green Doors Open is to promote awareness of specific green buildings in communities across Ontario and engage the public in the impact of green buildings and the benefits they provide. This in turn supports the goal of increasing the proportion of buildings in Ontario that integrate green energy, energy and water conservation actions, and other green features. This initiative requires the following support: an intern dedicated to the project; ongoing maintenance of an online interactive map showcasing green building projects and partners; incorporation of Green Doors Open into the Ontario Doors Open website; an increase in the inclusion of green buildings into Doors Open tours across Ontario for Thank You Campaign Launched in 2012, the Thank You Campaign is designed to applaud the efforts of individuals and organizations that have made a contribution to the sustainable built environment, and connect the Chapter to organizations that are making a difference. By sending out ed and printed Thank You cards, GTC will acknowledge individuals and companies for achieving their LEED credential or building green and welcome them to both our network and the Chapter. It is anticipated that the Chapter will achieve a number of objectives through the development and implementation of this campaign: opening of conversations between individuals and the Chapter on green mandates; increase brand identity; increase sponsor exposure. LEED Innovation Awards Currently in the research and development stage, the LEED Innovation Awards are designed to celebrate LEED certified projects that demonstrate an exceptional level of innovation and creativity. 208

Toronto Focus (SAB Magazine supplement) Toronto Focus In 2013, the Chapter will produce the 5th and 6th editions of their Toronto Focus supplement through SAB Magazine, the Chapter s primary publication. In this initiative, we engage sponsors, members and community at large to produce a page supplement that includes green building features and success stories from Toronto and the surrounding region. TRCA funding will go to supporting staff and funding a part-time intern to manage the writing and coordination of content, sponsorship promotions, advertisements, web-compatibility and distribution. CARRIED BACKGROUND Mud Creek, a tributary of the Don River, is sourced from two separate storm sewer systems south of Moore Avenue. Separated by a berm, Mud Creek continues along the western edge of the Don Valley Brick Works before entering a storm sewer, where it drains into the Don River. The City of Toronto and TRCA have been concerned with the erosion issues affecting Mud Creek for several years. In 2010, a geomorphic assessment of Mud Creek was commissioned by Toronto Water titled Mud Creek Geomorphic Systems Master Plan. Mud Creek was divided into six reaches, each separated by culverts where the creek has been piped underground to accommodate development. In the winter of 2012 TRCA implemented restoration works at the highest priority area, Reach 1, located at the most downstream limits of the creek adjacent to Evergreen at the Brick Works, using the design recommendations from the aforementioned Master Plan and funding from its 2012 erosion capital budget. Following the success of this project, Toronto Water and Parks, Forestry & Recreation (PF&R) staff asked TRCA to implement restoration works on behalf of the City of Toronto at additional priority areas, the next planned area being Reach 5, which commenced construction in March The 2-4 tonne stackable armourstone will be used in the construction of the retaining walls and weirs at Reach 5.
