To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on The Gore Road approximately 290 m north of Castlemore Road, in the City of Brampton, Humber River Watershed as located on property owned by the Region of Peel under franchise agreement with Enbridge Gas Distribution Inc. The purpose is to install a gas pipeline under The Gore Road tributary via Horizontal Directional Drilling approximately 290 m north of Castlemore Road. The warmwater fisheries timing window will apply to the watercourse in order to mitigate any adverse affects to the local fish communities. Enbridge Gas Distribution Inc. will be using the Fisheries and Oceans Canada (DFO) Operational Statement for High Pressure Directional Drilling

5 EX10.2 HABITAT FOR HUMANITY BRAMPTON To construct, reconstruct, erect or place a building or structure and site grade on Block H, Plan M-126, (0 Hoskins Square), in the City of Brampton, Etobicoke Creek Watershed as located on the property owned by Habitat for Humanity Brampton. The purpose is to undertake works within a TRCA Regulated Area and the Regulatory Floodplain of the Etobicoke Creek Watershed in order to facilitate the construction of a residential dwelling. 394 CITY OF PICKERING EX10.3 EX10.4 EX10.5 BROOKDALE CENTRE INC. To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 24, 25, Concession 1, (1105 Kingston Road), in the City of Pickering, Frenchman's Bay Watershed as located on the property owned by Brookdale Centre Inc.. The purpose is to construct an in-ground outdoor swimming pool behind the existing dwelling at 24 Ivor Road in the City of Toronto (North York Community Council Area). 397 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on, (Donino Court, Donino Avenue, Plymbridge Road, Maytree Road - near Yonge and York Mills), in the City of Toronto (North York Community Council Area), Don River Watershed as located on the property owned by City of Toronto. The purpose is to install a new storm sewer and reconstruction of Donino Avenue from the south end to the bridge across the Don River, on Plymbridge Road from #71 Plymbridge Road to Maytree Road, and on Maytree Road from Green Valley Road to the north end. The proposed works also include a new storm sewer outfall to the Don River at the Donino Avenue Bridge, a replacement storm sewer outfall at the dead end of Maytree Road, a replacement watermain on Donino Court with a connection to the storm sewer and watermain on Donino Avenue. A Letter of Advice will be written by TRCA staff on behalf of the Department of Fisheries and Oceans (DFO) BENNINGTON HEIGHTS DRIVE To change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units on Lot 17, Plan M-363, (36 Bennington Heights Drive), in the City of Toronto (North York Community Council Area), Don River Watershed. The purpose is to develop within a TRCA Regulated Area of the Don River watershed in order to facilitate the construction of a second and third storey addition to the existing two storey walk-out single family dwelling at 36 Bennington Heights Drive in the City of Toronto (North York Community Council Area) CAMPBELL CRESCENT To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 13, Plan 3510, (11 Campbell Crescent), in the City of Toronto (North York Community Council Area), Don River Watershed. The purpose is to construct a two storey replacement dwelling at 11 Campbell Crescent in the City of Toronto (North York Community Council Area)

The existing dwelling and detached garage are to be demolished. 399 CITY OF VAUGHAN EX10.15 EX PINE RIDGE AVENUE To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 8, Plan M-1116, (23 Pine Ridge Avenue), in the City of Vaughan, Humber River Watershed. The purpose is to conduct minor grading works and construct a dwelling within a Regulated Area of the Humber River watershed at 23 Pine Ridge Avenue in the City of Vaughan. 399 CITY OF VAUGHAN To construct, reconstruct, erect or place a building or structure, site grade and alter a watercourse west of Clarence Street, near Wycliffe Avenue, in the City of Vaughan, Humber River Watershed as located on property owned by City of Vaughan and Toronto and Region Conservation Authority. The purpose is to re-align a watercourse to provide long-term erosion protection to adjacent properties and infrastructure. The Ministry of Natural Resources (MNR) cold water fisheries timing window has been applied to this project. A TRCA Emergency Works Authorization Letter was issued on July 11, 2011 in order for the City of Vaughan to proceed with the works. A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO) for this project

9 EX10.17 EX10.18 CITY OF VAUGHAN To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Highway 7 east of Vaughan Valley Boulevard to Highway 27 and north on the west side of Highway 27 to Langstaff Road, in the City of Vaughan, Humber River Watershed as located on the property owned by City of Vaughan and York Region. The purpose is to construct a sidewalk/multi-use pathway, armourstone retaining walls and provide upgrades to surface drainage and street lighting, along the north boulevard of Highway 7 (east of Vaughan Valley Boulevard) and the west boulevard of Highway 27 (from Highway 7 north to Langstaff Road). A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). The Ministry of Natural Resources (MNR) cold water fisheries timing window has been applied to this project TAMI COURT To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 19, Plan , (12 Tami Court), in the City of Vaughan, Don River Watershed. The purpose is to construct an inground pool, cabana and patio area within a Regulated Area of the Don River watershed at 12 Tami Court in the City of Vaughan. 401 TOWN OF CALEDON EX10.19 EX SNEATH ROAD To construct, reconstruct, erect or place a building or structure on Part Lot 7, Concession 8, (65 Sneath Road), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of an inground swimming pool and two additions totalling square metres (2997 sq. ft.) to an existing single-family dwelling associated with a municipal building permit OLD SCHOOL ROAD To construct, reconstruct, erect or place a building or structure and site grade on Part Lot 23, Concession 5 EHS, (5318 Old School Road), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a replacement single-family dwelling associated with a municipal building permit

10 EX10.21 EX BELL AIR DRIVE To construct, reconstruct, erect or place a building or structure and site grade on Lot 160, Plan 876, (216 Bell Air Drive), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a replacement single-family dwelling associated with a municipal building permit CENTREVILLE CREEK ROAD To construct, reconstruct, erect or place a building or structure and site grade on Lot 37, Concession 2, (19350 Centreville Creek Road), in the Town of Caledon, Humber River Watershed. The purpose is to resolve an outstanding TRCA violation in order to recognize the installation of a geothermal heating system within a TRCA Regulated Area of the Humber River Watershed associated with a Niagara Escarpment Commission (NEC) permit. 402 TOWNSHIP OF KING EX NORMAN DRIVE To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 27, Plan 573, (134 Norman Drive), in the Township of King, Humber River Watershed. The purpose is to construct an inground pool within a Regulated Area of the Humber River watershed at 134 Norman Drive in the Township of King. 402 PERMIT APPLICATIONS EX EX10.43 ARE ERRATA ITEMS: CITY OF MISSISSAUGA EX10.24 ENERSOURCE HYDRO MISSISSAUGA To construct, reconstruct, erect or place a building or structure, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Plan 43R-9989, (Goreway Drive near Zahavy Way), in the City of Mississauga, Mimico Creek Watershed as located on the property owned by the Ministry of Transport (MTO). The purpose is to undertake installation of 11 new overhead poles and construct a new access gravel driveway to the new pole line by Enersource Hydro Mississauga. These works are proposed to facilitate construction of the proposed expansion of the Metrolinx Georgetown South rail service between Union Station and Pearson International Airport. The works will done on property owned by the Ministry of Transport (MTO), Metrolinx are currently processing land transfer from MTO. A Letter of Advice regarding mitigation of negative impacts will be written by TRCA staff on behalf of the Fisheries and Oceans Canada (DFO)

11 CITY OF PICKERING EX DUNBARTON ROAD To construct, reconstruct, erect or place a building or structure and change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units on Lot 26, Concession 1, (1008 Dunbarton Road), in the City of Pickering, Frenchman's Bay Watershed. The purpose is to construct a basement access, interior improvements and a rear-yard deck at a residence that is vulnerable to Regional Storm flooding associated with the Dunbarton Creek. 403 CITY OF TORONTO [ETOBICOKE YORK COMMUNITY COUNCIL AREA] EX TAYLORWOOD DRIVE To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on, (26 Taylorwood Drive), in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed. The purpose is to construct an inground pool, hot tub and associated hard and soft landscaping in the rear yard of the existing single family detached dwelling at 26 Taylorwood Drive in the City of Toronto (Etobicoke York Community Council Area). 404 CITY OF TORONTO [SCARBOROUGH COMMUNITY COUNCIL AREA] EX10.27 EX FALLINGBROOK WOODS To construct, reconstruct, erect or place a building or structure on Lot 18, 19, Plan 4304, (6 Fallingbrook Woods), in the City of Toronto (Scarborough Community Council Area), Waterfront Watershed. The purpose is to demolish a portion of the existing dwelling and construct a partial second storey addition and balcony above the existing attached garage. 404 PROLOGIS CANADA To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 16, Concession 4, (1251 Tapscott Road), in the City of Toronto (Scarborough Community Council Area), Rouge River Watershed as located on the property owned by Prologis Canada. The purpose is to regrade portions of the site for the purposes of constructing two new warehouse buildings and a stormwater management pond. A portion of Neilson Tributary will be realigned

12 CITY OF TORONTO [TORONTO AND EAST YORK COMMUNITY COUNCIL AREA] EX10.29 EX10.30 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lumsden Avenue where it intersects Eastdale Avenue, in the City of Toronto (Toronto and East York Community Council Area), Don River Watershed as located on property owned by the City of Toronto. The purpose is to reconstruct and re-align Lumsden Avenue where it intersects Eastdale Avenue. Works will include the re-grading of an existing slope, removal and relocation of the existing road surface, curbs, gutters and catchbasins. A new sidewalk will be constructed along the northern side of the roadway on top of the re-graded slope. No in-water works are associated with this project. 405 CITY OF TORONTO (PARKS FORESTRY AND RECREATION DIVISION) To construct, reconstruct, erect or place a building or structure and site grade on, 443 Arlington Avenue, in the City of Toronto (Toronto and East York Community Council Area), Don River Watershed as located on property owned by the City of Toronto. The purpose is to construct an outdoor ice pad primarily on an existing asphalt parking lot beside Phil White Arena within Cedarvale Park. Works will include the construction of a subsurface cooling system, boards, bleachers and the realignment of the existing storm sewer. There are no in-water works are associated with this project. 406 CITY OF VAUGHAN EX HUNTINGTON ROAD To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 13, 14, Concession 10, Plan 65R-17696, PART 2, (8934 Huntington Road), in the City of Vaughan, Humber River Watershed. The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed in order to facilitate the construction of an office condominium campus, including office buildings, parking, fencing, grading, patios, landscaping and two stormwater management outfalls, at 8934 Huntington Road in the City of Vaughan

13 TOWN OF CALEDON EX10.32 EX10.33 EX WOLF CRESCENT To construct, reconstruct, erect or place a building or structure and site grade on (4 Wolf Crescent), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within a Regulated Area of the Humber River Watershed in order to facilitate the construction of an in-ground swimming pool at the rear of an existing residential dwelling associated with a municipal site plan application. 406 POD LIFT EQUIPMENT INC. To construct, reconstruct, erect or place a building or structure on Part Lot 2, Concession 7, (12302 Albion Vaughan Road), in the Town of Caledon, Humber River Watershed as located on the property owned by Pod Lift Equipment Incorporated. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a 7.55 square metre (81.26 sq. ft.) storage room addition to an existing residential dwelling associated with a municipal building permit. 407 TOWN OF CALEDON To construct, reconstruct, erect or place a building or structure and site grade on Lot 11, 12, Concession 2, (6898 King Street), in the Town of Caledon, Humber River Watershed as located on the property owned by Town of Caledon. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a recreational sports park. 407 TOWN OF MARKHAM EX RAE CRESCENT To construct, reconstruct, erect or place a building or structure and site grade on Lot 138, Plan M-1714, (9 Rae Crescent), in the Town of Markham, Rouge River Watershed. The purpose is to resolve an outstanding violation within a TRCA Regulated Area of the Rouge River Watershed in order to restore an adjacent valley corridor and replace a failed retaining wall structure at the rear of an existing residential dwelling

VERENA COPTIC ORTHODOX CHURCH To construct, reconstruct, erect or place a building or structure and site grade on Block 1, Plan 65M-2445, Part Block 2, Plan 65M-2445, (1050 Rodick Road), in the Town of Markham, Rouge River Watershed as located on the property owned by St. Maurice & St. Verena Coptic Orthodox Church. The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of a place of worship, recreation centre, daycare centre and 300 parking spaces associated with a municipal site plan application. 408 TIMES GROUP CORPORATION To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 10, Concession 5, (southeast corner of Warden Avenue and Highway 7), in the Town of Markham, Rouge River Watershed as located on the property owned by Times Group Corporation. The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of stormwater infrastructure servicing related to an approved plan of subdivision within Markham Centre TOWN OF RICHMOND HILL EX10.38 EX10.39 BAIF DEVELOPMENTS LIMITED To site grade and interfere with a wetland on Part Lot 69, 70, Concession 1, (Yonge Street and Bloomington Road), in the Town of Richmond Hill, Rouge River Watershed as located on the property owned by Baif Developments Limited. RECOMMENDATION THAT the draft Oak Ridges Corridor Park East Management Plan dated August 2011 be approved in principle; THAT the draft Plan be circulated to the Town of Richmond Hill and the Regional Municipality of York requesting endorsement of the Plan; THAT following circulation, staff report to the Authority to confirm approval of the final Plan; THAT the lands referred to as "Oak Ridges Corridor Park East" and "Oak Ridges Corridor Park" respectively, be renamed and collectively referred to as the "Oak Ridges Corridor Conservation Reserve"; THAT Province of Ontario approval of the use of the name "Oak Ridges Corridor Conservation Reserve" for the provincial lands under management agreement be requested; AND FURTHER THAT the relevant stakeholders associated with the Oak Ridges Corridor Park and Corridor Park East lands be advised of Toronto and Region Conservation Authority's (TRCA) decision to use the name "Oak Ridges Corridor Conservation Reserve". BACKGROUND Oak Ridges Corridor Park East (ORCPE), is a 175 hectare (432 acre) parcel of land owned by TRCA and located on the Oak Ridges Moraine. The ORCPE property straddles the boundary between the Humber River and Rouge River watersheds. It is located in the Town of Richmond Hill, in the Regional Municipality of York. Its boundaries are Bethesda Sideroad to the north and Stouffville Road to the south and it is located between Bayview Avenue and Leslie Street to the west and east, respectively. The property was acquired in pieces between 2001 and

58 At Authority Meeting #3/07, held on April 27, 2007, the process to create a management plan for Oak Ridges Corridor Park East (formerly known as the Jefferson s Forest Management Tract) was approved via Resolution #A100/07 as follows: THAT staff be directed to establish an advisory committee, which would include members of the Humber Watershed Alliance, Rouge Park Alliance, interested community groups, business representatives, community residents, agency staff, municipal staff and area councillors, to assist with the development of the Jefferson s Forest Management Plan and to facilitate the opportunity for public input; AND FURTHER THAT the management plan be brought to the Authority for approval once completed. RATIONALE The Oak Ridges Moraine is one of Ontario s most significant landforms, stretching 160 km and providing clean, safe drinking water to over a quarter of a million people. It also provides an essential natural corridor for hundreds of plant and wildlife species that call the Oak Ridges Moraine home. As part of its strategy to protect these environmentally sensitive lands, the Province of Ontario reached an agreement in the early part of this decade to create the Oak Ridges Corridor Park, a 428 hectare nature sanctuary that stretches from Bathurst Street to Bayview Avenue and includes a 5 km spine trail. The Oak Ridges Corridor Park is enhanced by over 175 hectares of greenspace owned by TRCA to the east of Bayview Avenue. Referred to as the Oak Ridges Corridor Park East lands (ORCPE), these lands were acquired by TRCA between 2001 and ORCPE is dominated by forests and wetlands, and consists of many unique and sensitive natural areas. Within the site are over 80 vegetation communities, 471 plant species and 81 wildlife species. However, this site is under pressure. The population of Richmond Hill is projected to increase from approximately 170,000 in 2006 to over 240,000 by Rising urban populations will place increased pressure on the lands in a variety of ways, including increasing demand for access and recreation. Pending development to the east and west has the potential to impact the hydrology and natural systems of the site. These potential impacts underscore the need for careful planning, responsible management, and above all, restoration of the disturbed lands. This management plan lays out a series of management recommendations and actions that seek to protect the natural heritage system while also providing for enjoyable nature-based recreation opportunities for the local community and residents of Richmond Hill. Plan Process and Consultation Past experience has shown that residents and community groups have grown more concerned with the impact of land use change on the remaining natural landscapes within the Greater Toronto Area. At the same time, user groups, businesses and municipalities have expressed a growing interest in a variety of uses for public lands, including nature-based recreation, ecological restoration and community stewardship. The provision of public uses on TRCA-owned land must consider economic factors and the recreational needs of the community, while ensuring the natural landscape is protected and properly stewarded. 58

59 The objective of the management planning process is to develop a plan for the ORCPE property that protects its natural environment while exploring its potential for nature-based recreation. The management plan will guide future development and management of the area. The planning process was undertaken in three phases, as outlined below. Phase one included the establishment of technical and advisory committees and the development of the site securement and protection plan. Phase two included project start-up and the completion of the background report. Phase three included the development of the management plan document, including property management zones, identification of existing habitat restoration priorities and development of a trail plan. Phase One establish technical committee; develop site securement and protection plan. Phase Two natural and cultural heritage inventories of the property; establish technical steering and public advisory committees and host meetings; develop values and management principles that will guide management plan process; complete management plan background report; establish and circulate a study newsletter; host public meetings to review material. Phase Three develop management zones; review habitat restoration plans; develop trail plan; develop management recommendations that integrate watershed management recommendations; host advisory committee meetings; circulate a study newsletter update; host public meetings to review draft material; finalize all materials; obtain partners and TRCA board endorsement and/or approval of the plan. For the ORCPE Management Plan, TRCA established two committees: a Technical Steering Committee and a Public Advisory Committee. The Technical Steering Committee was comprised of representatives from the Town of Richmond Hill, the Regional Municipality of York, the Ontario Realty Corporation, Rouge Park and the Oak Ridges Moraine Foundation. The Public Advisory Committee was made up of representatives from community groups, agencies, local stakeholders, and area residents and landowners. The committees were provided with a terms of reference document that was used to guide the contributions of the two committees throughout the development of the management plan. TRCA staff prepared the management plan with guidance from the steering and advisory committees as well as input from a public consultation process. 59

60 Vision and Management Principles It is important that the vision and values for the ORCPE lands be integrated with those of TRCA, the Humber River and Rouge River watersheds, and the management plan for the adjacent Oak Ridges Corridor Park. The visions, goals and objectives of the following plans and strategies were reviewed and incorporated as part of the process for developing the ORCPE management plan; The Living City vision and objectives; TRCA s Terrestrial Natural Heritage System Strategy; Humber River Watershed Plan: Pathways to a Healthy Humber (2008); Rouge River Watershed Plan: Towards a Healthy and Sustainable Future (2007); Oak Ridges Corridor Park Management Plan (2006). Vision and Values During the management planning process for the Oak Ridges Corridor Park, a vision, goals and objectives were developed through an extensive consultation process. Given the intent to integrate the management of the two properties, it is logical that the management planning framework for the two documents be closely aligned. However, it is also essential to note that the ORCPE lands contain important natural heritage features that are unique to those lands. Additionally, the management plan framework should recognize that the ORCPE lands are currently surrounded by a predominantly agricultural matrix that is slated to be developed to medium density residential communities that will include approximately 2,020 residential units. Through consultation with the various committees, it was determined that the ORCPE Management Plan would follow the vision laid out in the Oak Ridges Corridor Park Management Plan, which reads as follows: The Oak Ridges Corridor Park will be a sanctuary for nature and an essential ecological linkage on the Oak Ridges Moraine where visitors can learn about ecosystem features and functions, wildlife and human influences, and enjoy activities that are compatible with the natural and cultural values of the park. Given the importance of recognizing the unique features of the ORCPE lands, the committees felt it was worthwhile to develop a series of value statements for the ORCPE Management Plan. These are titled the Values for Sustainability, and are as follows: Ecological - Recognize that protected natural heritage is essential to the health and future of the watershed and must be protected and enhanced so it can be used and enjoyed by future generations. Cultural - Value and protect linkages to the history and past uses of an area and use their lessons to help guide present and future actions. Social - Foster development and engagement of community members as a key to building a stewardship ethic. Recognize and value people s connections to land and provide recreation and experiential learning that is compatible with the natural and cultural values of the land. Economic - Encourage long-term economic vitality through strategic planning and partnership development. 60

61 In addition, the following goals exist for the management and use of all TRCA and partner-owned lands, and will guide the management planning process for the ORCPE lands: To conserve, protect and manage Authority lands in consultation with the public in a manner that values, respects and enhances the natural, cultural and heritage resources; and, To encourage uses that are compatible with healthy watersheds, respectful of the unique character of the lands and sustainable in environmental, physical and economic terms. Management Recommendations Management recommendations provide actions to achieve the vision and values. The key management recommendations include the following: Ecological Conduct regular inventory and monitoring of flora, fauna and overall condition of both the aquatic and terrestrial ecosystems. Protect groundwater resources including seepage and recharge zones. Monitor and manage invasive species. Protect species of concern and enhance habitat opportunities for these species. Restore habitat through wetland creation, habitat enhancements and reforestation. Resolve longstanding sediment control issue in the southwest corner of the property. Cultural Protect and conserve archaeological sites and explore opportunities to interpret these sites. Social Establish a formal trail system that will protect the natural system while providing nature-based recreation opportunities. Conduct regular property inventory and audit surveys to identify encroachments, unauthorized activities and safety concerns. Establish a stewardship committee and trail captain program to engage local residents in the care of the property. Maintain the fields south of Bethesda Sideroad for active agriculture or similar use (e.g. community gardens). Integration Rename Oak Ridges Corridor Park East and Oak Ridges Corridor Park under a single overarching name, "Oak Ridges Corridor Conservation Reserve". Develop an integrated plan for implementation projects proposed for the former Oak Ridges Corridor Park and Oak Ridges Corridor Park East. Establish one stewardship committee for entire complex. 61

62 Recent Initiatives Since 2010, TRCA has invested roughly $152,000 into priority projects at ORCPE that include site securement (fencing and gates), informal trail closures, dumping clean-up, restoration of forest habitat, wetland construction and community newsletter distribution. These projects have helped to secure the property from unauthorized and harmful uses, and have helped to lay the groundwork for implementation of the ORCPE Management Plan. Copies of the complete Oak Ridges Corridor Park East Management Plan will be made available at the Authority meeting. DETAILS OF WORK TO BE DONE The successful implementation of the management plan for the ORCPE will require the efforts of TRCA and its partners. TRCA will take the following actions: TRCA staff to publish and distribute the Draft Oak Ridges Corridor Park East Management Plan to relevant stakeholders and seek necessary consultation. For the provincial lands under management agreement with the Province, TRCA requires approval of the Province to use the name "Oak Ridges Corridor Conservation Reserve". TRCA to request that the Town of Richmond Hill and the Regional Municipality of York include the management plan in their respective jurisdiction s planning and land use policies and practices for the area. TRCA staff to extend the existing trail management agreement with the Oak Ridges Trail Association to include the spine trail through ORCPE. TRCA staff to establish a stewardship committee with appropriate representation from stakeholder groups to assist with the implementation of the management plan. FINANCIAL DETAILS The total cost to implement the Oak Ridges Corridor Park East Management Plan is estimated at $1,607,000 over five years. A summarized implementation budget for the management plan is shown on Table 1 (attached). These are preliminary estimates subject to discussion with the potential funding partners and refinement of project requirements. The five year time frame may also need to change. This estimated cost considers work recommended only for the ORCPE lands and does not include the Oak Ridges Corridor Park lands. An existing management plan was created for Oak Ridges Corridor Park in This 2006 plan has its own dedicated implementation budget, and TRCA is currently working to complete the implementation of this plan. Staff will be approaching the Town of Richmond Hill, the Regional Municipality of York, local community groups and other interested stakeholders to share in the cost of Plan implementation over the next five years. RECOMMENDATION THAT the Toronto and Region Conservation Authority (TRCA) land located on the west side of Weston Road, north of Highway No. 401, City of Toronto (Etobicoke York Community Council Area), be retained for conservation purposes. BACKGROUND A letter has been received from Mr. Guillaume Lavictoire of Rueter Scargall Bennett LLP, who is acting on behalf of Dulane Construction Company Ltd., Torch Investments Ltd. and Hillhurst Acres Ltd., requesting that the subject parcel of TRCA-owned land situated on the west side of Weston Road, north of Highway No. 401 be exchanged for the valleyland portion of his clients' neighbouring property to the north. At Executive Committee Meeting #10/09, held on December 11, 2009, Resolution #B180/09 was approved as follows: THAT the potential disposal of a parcel of land located on the west side of Weston Road, north of Highway No. 401, City of Toronto - Etobicoke York Community Council Area, be referred to Toronto and Region Conservation Authority (TRCA) staff for review and discussion in accordance with established TRCA policies; AND FURTHER THAT a report be brought forward to the Executive Committee at a future date recommending further action. RATIONALE This request was circulated to City of Toronto staff and TRCA staff for review and comment. The following comments have been received: 66

67 City of Toronto Staff Comments The City is not allowed to sell parkland; however, the City can exchange parkland provided that the exchange meets Parks, Forestry and Recreation Department (PF&R) objectives and meets policies set out in the Official Plan. Section of the Official Plan notes that: Parkland Cannot Be Sold: The policy prohibits the sale of city-owned land (not just parkland but any city lands) that are part of the Green Space System which means designated Parks and Open Space (POS). But it Can Be Exchanged: The policy recognizes that in some cases it would be acceptable to exchange City-owned POS land if the land to be exchanged is: nearby (i.e. within normal walking distance); equivalent or larger in area; and comparable or superior green space utility (i.e. does the exchange make the park the same or better). PF&R staff has said that this land exchange would comply with the Official Plan policies for land exchange involving areas designated as open space. TRCA Staff Comments Planning and Development staff does not support the request for disposal of TRCA lands at this location for the following reasons: The Valley and Stream Corridor Management Program (VSCMP) sets out the policy Framework for TRCA. The VSCMP defines the limits of stream/valley corridors to include a minimum of 10 metres inland from the top of valley bank, provided that the stream or valley is in a stable condition. In the case of the subject lands, the top of valley bank is located on the far eastern portion of the property near the road, placing the entire property within the valley and its 10 metre buffer. In addition, one of the principles in the VSCMP states: "the successful management of valley and stream corridors is dependent on good tableland management". Removing lands that are considered to be buffers from public ownership does not meet the notion of good tableland management. Finally, as part of day-to-day negotiations with the development industry and private property owners, staff always endeavors to obtain a buffer for the protection of ecological features/stream and valley corridors as well as to protect private lands. Executive Committee Referral September 9, 2011 Staff has had regular contact with the proponents since their initial request was received in November of The proponents were scheduled to appear before the Executive Committee on several occasions, however withdrew prior to each meeting. 67

At the Executive Committee, Mr. Dennis Seward, a representative of the proponent, appeared as a Delegation and requested that this matter be deferred until he and other representatives of the owners have been provided the opportunity to have another meeting with TRCA staff to discuss potential alternatives to staff's recommendation. After hearing the deputation by Mr. Seward, the Executive Committee granted a referral of the report to Authority Meeting #8/11, scheduled to be held on September 30, 2011, so that Mr. Seward and his colleagues could meet with TRCA staff. On September 21, 2011, a meeting between the proponents, TRCA's Conservation Lands and Property Services staff, and Planning and Development Division staff took place. Mr. Harvey Kalles and Mr. Dennis Seward presented various scenarios for acquiring the TRCA land; however, Planning and Development staff reiterated that, in accordance with the VSCMP, all the TRCA lands are comprised of the Humber River valley corridor. Accordingly, the staff recommendation as originally submitted to the Executive Committee remains unchanged; Mr. Kalles and Mr. Seward were satisfied with staff's position in this regard. A plan illustrating the location of the subject lands is attached. CONCLUSION While the City of Toronto's Official Plan policies do allow exchanges of park land in certain circumstances, the disposal of the subject parcel of land is contrary to TRCA's VSCMP policies as well as TRCA's mandate to conserve natural areas and protect adjacent land from natural hazards. RECOMMENDATION WHEREAS a local Conservation Authorities Act Section 28 'Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation' has been prepared in conformity with the provisions outlined in Section 28 of the Conservation Authorities Act and the amended Ontario Regulation 97/04, and as per the eligible amendments identified by the Ministry of Natural Resources; THEREFORE LET IT BE RESOLVED THAT Toronto and Region Conservation Authority adopt the proposed amendments to the subject regulation; AND FURTHER THAT the said regulation proposal with eligible amendments be submitted to the Ministry of Natural Resources for review, posting on the Regulatory Registry, and depending on the results of the registry posting, for subsequent consideration for approval by the Minister of Natural Resources. BACKGROUND The Ministry of Natural Resources (MNR) has issued 'Procedures for Amending Conservation Authorities Act Section 28: Development, Interference with Wetlands and Alteration to Shorelines and Watercourses Regulations'. This document outlines the procedures for conservation authorities (CAs) to amend their individual Section 28 regulations to conform to recent amendments to Ontario Regulation 97/04, the content regulation for all conservation authority Section 28 regulations, as well as some administrative and housekeeping amendments. These amendments do not extend the area that is currently regulated nor do they broaden the considerations used to make a decision on a permit. The proposed amendments deal principally with the permitting process and streamlining decision making. Proposed Amendments The amendments proposed to Ontario Regulation 166/06, TRCA's Section 28 regulation are identified in Attachment 1 (strikethrough are proposed deletions and bolding are proposed additions) and reflect prescribed wording provided by MNR. The proposed amendments include the following: 71

72 enable the Executive Committee to delegate permit approval authority to staff for applications that meet TRCA policies; the ability to extend the validity of a permit from 24 months, under certain conditions and criteria; and administrative and housekeeping amendments to provide clarity of the intent of the legislation and process (such as the addition of appropriate studies to the list of items required for a complete application, deletion of a clause that has led to legal interpretations of the regulation inconsistent with legislative intent, minor format restructuring for clarity, etc.). In order to advance to the next stage of the legislative amendment approval process, which involves posting of the draft amended regulation on the Ontario Regulatory Registry, MNR requires a resolution from the Authority adopting the proposed amendments, as per the recommendation of this report. RATIONALE The proposed amendments will result in streamlining opportunities for the implementation of TRCA's regulatory program. Staff will bring forward a report to the Executive Committee later this year outlining the administrative process to implement the proposed amendments. This will include the criteria and type of permit applications, (scale, complexity, compliance with policy, etc.), that staff would recommend to the Executive Committee be delegated to staff for approval. This would be an update and enhancement to TRCA's current minor works and routine infrastructure works streamlining protocols. Staff will also recommend the criteria and type of permits that should remain subject to the approval of the Executive Committee. Similarly, the report will also outline the criteria and administrative process for permit extensions. In general, a maximum period of 24 months for the validity of a permit is an appropriate time frame to accommodate most permits. However, it has been our experience that this time frame is not sufficient for large scale infrastructure permits associated with Environmental Assessment Act applications undertaken by our municipal partners. The construction timelines for these types of projects often exceed 24 months and can be constrained by the construction season or delayed by other regulatory requirements. In these exceptional situations, the ability to extend the validity of a permit approval up to 60 months would result in improved client service with our municipal partners. DETAILS OF WORK TO BE DONE The following outlines the process for approval of amendments to Ontario Regulation 166/06 to bring it into conformity with Ontario Regulation 97/04 as amended through Ontario Regulation 46/11: submission of TRCA board resolution adopting proposed amendments and draft amended regulation to MNR; MNR/Conservation Ontario Section 28 Regulations Committee reviews submissions from all 36 conservation authorities for conformity to eligible amendments and submits report to MNR; MNR will post all 36 draft regulations on the Ontario Regulatory Registry for a 45-day commenting period and consider any comments received; proposed regulations will be sent to Legislative Counsel for final drafting; 72

73 final version of the regulation will be sent back to TRCA and requires an additional TRCA board resolution of approval; TRCA resolution and signed original proposed regulation forwarded to MNR; MNR submits approval package to the Minister of Natural Resources for consideration; if approved, the Minister will notify TRCA in writing and the regulation will come into effect when filed and posted on e-laws (anticipated in early spring 2012). Consultation The amendments to Ontario Regulation 97/04 to ultimately facilitate the proposed amendments to the individual Section 28 regulations underwent a comprehensive review process led by MNR. This included consultation with and the support of the Conservation Authorities Liaison Committee, which includes municipal, building and development industry, Conservation Ontario/CA representatives, as well as public consultation through posting on the Environmental Bill of Right's Environmental Registry and the Regulatory Registry. The proposed amendments are intended to support CA compliance with the permit application decision timelines outlined in MNR's 'Policies and Procedures for Conservation Authority Plan Review and Permitting Activities'. Staff will circulate this report to TRCA's member municipalities and post it on the Planning and Development section of the TRCA website for information purposes. FINANCIAL DETAILS The proposed regulation amendments are required as part of TRCA's mandate under Section 28 of the Conservation Authorities Act. The services to be provided are part of the regular operating budget levy and fee recovery process. Summary The proposed amendments to the TRCA's 'Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation' presented in Attachment 1 of this report have been prepared in conformity with the provisions outlined in Section 28 of the Conservation Authorities Act and the amended Ontario Regulation 97/04, and as per the eligible amendments identified by the Ministry of Natural Resources. LAWRENCE CITIES INITIATIVE Call for Additional Great Lakes Funding KEY ISSUE Response to Town of Ajax resolution regarding Great Lakes funding levels and support for the Great Lakes and St. Lawrence Cities Initiative call for increased Canadian federal Great Lakes funding. RECOMMENDATION THAT Toronto and Region Conservation Authority (TRCA) advise the Prime Minister of Canada and federal Minister of the Environment of TRCA s support of the Great Lakes and St. Lawrence Cities Initiative and the Town of Ajax s request for $285 million per year of non-infrastructure Great Lakes funding; AND FURTHER THAT the Premier of Ontario, Ontario Minister of the Environment, Town of Ajax and Conservation Ontario be so advised. BACKGROUND On June 16, 2011, Mayors of the Great Lakes and St. Lawrence Cities Initiative (GLSLCI) issued a news release (Attachment 1) requesting that the federal governments of Canada and the United States maintain or enhance funding for non-infrastructure, local protection and restoration projects in the Great Lakes basin. The funding benchmark cited in the GLSLCI request was the 2010 United States Great Lakes Restoration Initiative (GLRI), for which $475 million was dedicated for non-infrastructure and restoration projects (i.e. climate change adaptation, shoreline protection, habitat restoration, etc.) in the Great Lakes region. On a per capita basis, this $475 million represented an investment of approximately $15 per U.S. resident residing in the Great Lakes basin ($15x32 million residents). The June 16, 2011 news release called for these funding levels to be maintained for the United States portion of the Great Lakes Basin, and to be matched by the Canadian government for the Canadian portion of the basin. Applying the $15 per capita funding formula to Canadian Great Lakes population yielded a request for $285 million per year of Great Lakes funding ($15x19 million residents). On June 27, 2011, the Town of Ajax passed a resolution supporting the GLSLCI call for additional funding for Canadian Great Lakes projects, and further called for the requested $285 million of Great Lakes non-infrastructure and restoration funding to be maintained for each of the next 10 years. Also included in the resolution was the clause that a copy of the motion be sent, with a request for reply, to a list of recipients among which was the Toronto and Region Conservation Authority (TRCA). 81

82 On July 14, 2011, TRCA was copied on a letter from the Town of Ajax to Canadian Prime Minister Stephen Harper. This letter included a copy of the June 27, 2011 resolution and the request for a TRCA response therein (Attachment 2). TRCA has consistently been an advocate for, and beneficiary of, federal and provincial Great Lakes program funding. The federal and provincial governments currently provide approximately $20 million (total) per year for program funds derived from the 'Canada-Ontario Agreement Respecting the Great Lakes Basin Ecosystem' (COA), with additional resources made available for specific issues or concerns (i.e. over $70 million has been identified to address contaminated sediments). Of these funds, TRCA has received $500,000 per year for governance and implementation of the Toronto and Region Remedial Action Plan (RAP), as well as project-specific funding through Environment Canada's Great Lakes Sustainability Fund (GLSF) and provincial COA funds; these latter funding amounts vary from year-to-year, but in recent years have collectively ranged between $200,000 and $500,000 per year. Collectively, the RAP, GLSF and provincial COA funds have supported TRCA programming to advance several of the Great Lakes needs and concerns cited in the Town of Ajax resolution of June 27, 2011, addressing, inter alia, nutrient management, research and implementation of Low Impact Design (LID) practices, habitat protection and restoration, and watershed planning and monitoring. Because it is not situated within the Toronto and Region Area of Concern, the Town of Ajax does not have access to RAP and GLSF funding for programs and initiatives. It is worth noting, however, that the Town accrues proximity benefits from Area of Concern investments; advances in areas such as outreach programming, research methodologies, and Best Management Practices within the AOC are often delivered throughout, or have direct relevance to, the broader TRCA jurisdiction. It is anticipated that Great Lakes resourcing and priorities will remain similar in the forthcoming revised Great Lakes Water Quality Agreement (GLWQA), the amendments to which are currently being negotiated by the Parties to the Agreement (Canadian and United States Parties); the final amended agreement is anticipated in Similarly, it is anticipated that new and continued priorities contained within the updated GLWQA will be reflected in the renewal of the Canada-Ontario Agreement (COA); the renewal of the COA is anticipated following the completion of the GLWQA negotiations. The Town of Ajax resolution appropriately notes that an increase in the quantity and consistency of Great Lakes resources would benefit the Great Lakes ecosystem and, in turn, its inhabitants. In recognition of these needs TRCA has previously advanced resolutions - " Funding for large-scale remedial actions in the next Canada-Ontario Agreement" and " Supporting Green Infrastructure" through the Great Lakes United 2010 Annual meeting; these resolutions requested increased federal and/or provincial support to remediate, maintain, and increase the sustainability of urban and Area of Concern locations around the Great Lakes. 82

83 The Town of Ajax resolution further acknowledges that economic benefit-cost studies on investments in Great Lakes protection and restoration have predicted a positive economic benefit in response to such investments. As noted in Item AUTH 7.4 of the TRCA Authority Meeting #7/11, held on July 29, 2011, an Ontario Ministry of the Environment study 'Assessing the Economic Value of Protecting the Great Lakes' applied a Total Economic Valuation methodology and reported overall net benefit of protective and remedial actions. Benefit-cost ratios of up to 2.4:1 are expected to result from implementation of sustainable management strategies in Lake Ontario watersheds in the Golden Horseshoe, and benefit-cost ratios of up to 35:1 were predicted for the protection and restoration of Toronto area wetlands. A comparable study conducted in the United States by the Brookings Institute reported that a $26 billion investment in the Great Lakes would provide a $50 billion return in economic benefit (a benefit-cost ratio of 1.9:1). These economic valuations provide quantitative monetary rationale for that which is already understood from an ecological perspective. Specifically, the benefits of front-end protection and remediation outweigh the long-term costs that result from negligence, degradation, and ensuing mitigation and recovery. The above-noted economic study findings, in combination with measured ecological outcomes from TRCA's successful ecological protection and restoration initiatives, lends support to the premise underlying the GLSLCI and Town of Ajax call for additional resourcing of Great Lakes protection and restoration programs. That is, that such additional funding would be of benefit to the Great Lakes region. As noted in the Great Lakes and St. Lawrence Cities Initiative (GLSLCI) news release of June 16, 2011, the requested $285 million in funding is intended to be complementary to major investments in water infrastructure upgrades. Investments in water infrastructure, such as the City of Toronto s Don River and Central Waterfront project, remain a cornerstone of the protection and improvement of the Great Lakes ecosystem and its residents quality of life. To this end TRCA has articulated support for the Don River and Central Waterfront Project in particular (TRCA letter to the City of Toronto Public Works and Infrastructure Committee dated September 6, 2011) and, as reported above, has advanced the resolution "Funding for large-scale remedial actions in the next Canada-Ontario Agreement" in which the creation of a $1 billion fund for the advancement of remedial projects, inclusive of infrastructure upgrades, is requested for Canadian Areas of Concern around the Great Lakes. 83
