1 RESOLUTION A RESOLUTION OF THE BOARD OF SUPERVISORS OF LAKEWOOD RANCH COMMUNITY DEVELOPMENT DISTRICT 5 APPROVING PROPOSED BUDGETS FOR FISCAL YEAR 2015 AND SETTING A PUBLIC HEARING TO ADOPT THE BUDGETS FOR FISCAL YEAR 2015 PURSUANT TO FLORIDA LAW AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Executive Director has heretofore prepared and submitted to the Board of Supervisors of Lakewood Ranch Community Development District 5 ( the Board ) prior to June 15, 2014 a proposed operating budget and debt service budget for Fiscal Year 2015; and WHEREAS, the Board has considered the proposed budgets and desires to set the required public hearing thereon; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE LAKEWOOD RANCH COMMUNITY DEVELOPMENT DISTRICT 5: 1. The operating and debt service budgets proposed by the Executive Director and as such may have been amended by this Board for Fiscal Year 2015 attached hereto as Exhibit A are hereby approved as the basis for conducting a public hearing to adopt said budgets. 2. The proposed Fiscal Year 2015 budgets are hereby approved for advertising and public hearing. The 3.5 mile design project also includes reconstructing the 1-75/ University Parkway interchange from the existing diamond design to a diverging diamond interchange (DDI) design, the first DDI in Florida to advance to the final design phase. The project wi ll widen about 3.5 miles of 1-75, from north of Fruitville Road to north of University Parkway, to an eight-lane highway with three through lanes and one auxiliary lane in each direction added to the interstate median. This project will widen 1-75 bridges over Erie Creek and replace 1-75 bridges over University Parkway. The project also includes widening about one mile of University Parkway from the Cattlemen Road/Cooper Creek Boulevard intersection to the Market Street/ Lake Osprey Drive intersection. A future ultimate 1-75 design project will widen the interstate from eight lanes to twelve lanes. The ultimate project includes two express lanes, three general use lanes, and one auxiliary lane in each direction within the project limits. Ultimate improvements are planned to extend acceptable level of service for 1-75 well beyond Construction is not currently funded in FDOT's five year work program. 3 DDl's are a unique and highly effective concept based on a standard diamond interchange with a shift in crossroad traffic within the interchange. Through traffic on University Parkway will cross paths twice as traffic shifts to the left side of oncoming traffic between the interstate ramps. The design allows left turn movements to occur without crossing oncoming traffic. The University Parkway DOI can handle future anticipated traffic while significantly reducing space and impacts required to implement the design. Public Involvement FOOT conducted a comprehensive public involvement program during the Project Development and Environmental (PD&E) study of 1-75 from south of SR 681 to north of University Parkway in Sarasota and Manatee counties. The program included public hearings in February and May Similarly, the department developed a Community Awareness Plan (CAP) that is implemented during the design phase to solicit input from the public, officials, agencies and other interested persons. In addition, FOOT project representatives are available to make a presentation about the project to community groups and orga nizations as requested. Corrmunity Development Districts Homeowners' Associations ADMINISTRATIVE POLICY NUMBER: D DATE: June 12, 2014 REVISIONS: APPROVED BY/AUTHORITY: SIGNATURE: Lakewood Ranch Community Development District #5 SUBJECT: Replacement of Canary Date Palm Trees PURPOSE: To establish a District policy regarding the replacement of Canary Date Palm Trees on District #5 property. POLICY: There has been a historic trend that Canary Island Date (CID) palms (Phoenix canariensis) have been lost to a myriad of diseases, many of which have been fungus related. This species of palm is not well suited for our South Florida climate and based on the basic horticultural principle of "right plant, right place," there has been a growing concern related to the continued replanting of the Canary Island Date palm. These palms are significantly at risk for disease and this is especially true for replacement palms. As a general policy, the District will begin replacing CID palms with an alternate species of specimen palm. In locations where there is no soilborne fungus found, alternate specimen palms should be considered, such as the 'Medjool' Date palm (Phoenix dactylifera 'medjoo/' ) and Sylvester Date Palm (Phoenix sylvestris ). Although these palms are also susceptible to disease and fungus, the likelihood of survival is greater. If a soilborne fungus is found, replacing the palm with a hardwood species of plant is highly recommended. Decisions related to replacement at neighborhood entrances should be made in conjunction with neighborhood landscape representatives. Regardless of considerations for initial cause of death, if a neighborhood wants to replace a CID palm with a like species of CID palm, then the following actions will take place: 1) Neighborhoods are to review replanting options as presented by the Operations Department. If neighborhoods select CID Palms as replacement palms, neighborhoods are to utilize the voting mechanisms available to them to make this determination with the understanding that initial differential install costs and all future replacement costs are to be borne by the neighborhood. (As an example a Sylvester Palm cost has been estimated at $ per clear foot of trunk and CID palm at $ per clear foot). 3) If the replacement CID palm should perish, cost to replace with any landscape palm or tree will be assessed to the neighborhood directly. 15 LAKEWOOD RANCH DISTRICT 5 EXECUTIVE SUMMARY SUBMIT DATE SUBMITTED BY BOARD MEETING DATE 6/10/14 Ryan Heise 6/12/14 ISSUE: Replacement of Vilamoura Palm at entryway BACKGROUND: There were 2 Canary Island Date palms located in the entrance median at Vilamoura. The front palm died and has since been removed, while the one in the rear appears to be declining. Down to Earth (DTE) tested the removed palm for disease and found it to have a fungus. DTE has agreed to replace the palm in the front. However, Vilamoura s contractor has errantly pruned the palm in the rear and it is highly unlikely that DTE will replace that palm when and if it should ever perish. Down to Earth has agreed to replace the front Date palm with a like palm, but does not recommend doing so based on the horticultural issues of maintaining a Date Palm in South Florida (Document attached). During my tenure in Lakewood Ranch I have witnessed as many as 20 Date Palms expire as a result of disease. As an alternate option DTE is recommending replacing both entrance palms with a Sylvester species, picture attached. Options considered: Having DTE replace with a Date palm at the entrance median Pros: They look great. Statement Palm that adds neighborhood value. Neighborhood has placed value in Date palm because of the contrast from street palms (Medjool) Cons: They have lost 2 Date palms in the last 6 years and each time there is significant down time between replacement (testing, debate with contractor, removal, replacement). Contractor not likely to replace the palm at their cost if it is to die in the future. District 5 community cost, and the palms are not suitable for SW Florida (info attached). DTE has proposed to replace both Date palms with Sylvester palms Pros: Higher likelihood of survival which equates to less frustration among neighborhood residents and less community expense for replacement. Cons: Does not make the same statement as the Date palm does. Palms will not match Canary Date located in far rear median. Staff recommendation is to request DTE replace the Date palms with the Sylvester species. Additional information: There has been a gradual shift away from the replacement of the Date Palm species with a like species. Within District 5 this has occurred at the Portmarnock entrance where Little Gem Magnolias were used in place of the Date Palms. At the Blythfield entrance a Medjool palm was utilized with amended soil and improved drainage. Generally speaking the developer (SMR) has transitioned away from utilizing the Date palm for future development projects. As a general policy recommendation to the Board it should be considered that alternate plant material be considered when replacing the Date palm species in District 5.
