Minor Projects Programmatic Categorical Exclusion (PCE) Other Laws and Regulations 2

Programmatic Categorical Exclusion Most Locally Administered Projects are categorically excluded from NEPA Document that the project is an approved CE action Perform a level of environmental investigation to verify there is no potential for significant project impacts 3

Other Laws and Regulations Section 4(f) Act Public Areas and Historic Resources Section 106 Historic Act Historic Resources SHPO Concurrence Section 7 Endangered Species Act Federally Protected Species 4

NCDOT Programmatic Categorical Exclusion Action Classification Form 5

Type I Categorical Exclusion Activities Construction of bicycle and pedestrian lanes, paths, and facilities Landscaping Installation of fencing, signs, pavement markings, small passenger shelters, traffic signals, and railroad warning devices Emergency repairs under 23USC 125 (Governor Declared Emergency) Replacement of Guardrail 6

Type II Categorical Exclusion Activities 7

PCE Form continued 8

PCE Form continued Ecological 1. Will the project have a substantial impact on any unique or important natural resource? 2. Does the project involve habitat where federally listed endangered or threatened species may occur? 3. Does the project involve water classified as Outstanding Water Resources (OWR) and/or High Quality Waters (HQW)? 4. Does the project involve any know underground storage tanks (UST s) or hazardous material sites. 9

PCE Form continued Permits and Coordination 1. If the project involves the acquisition of right of way, is the amount of right of way acquisition considered minor? 2. Will the project have an effect on structures /properties eligible for/or listed on the National Register of Historic Places? 10

Charlotte Regional Planning Organization October 18, 2016 Locally Administered Projects Overview Marta Matthews NCDOT Local Programs Management Office

Local Programs Management Office What you will learn from this Presentation: Overview of On-Line Local Project Management Tool Major Steps of Administering a Federal-aid Project by a Local Government Agency Typical Challenges Experienced by Locals on Federal-aid Projects 2

Federal-aid Project Delivery by Locals Federal-aid funding is cost-reimbursement Funding Authorization is required prior to each phase of work Local Government Agency (LGA) has the responsibility to deliver the project NCDOT has the responsibility to provide oversight to LGAs and ensure appropriate use of funds 3

Local Project On-Line Project Management Tool 9

Getting Access to Project Management Tool 10

Local Project On-Line Project Management Tool What Projects are in the New Project Management Tool? Locally-Administered Projects with funding from STP-DA, TAP-DA, or CMAQ through your MPO. What Projects will be managed in the future in the Project Management Tool? Projects funded with TAP funding directly from NCDOT, old SRTS funding, Municipal Bridge funding will be added in a future phase. Locally-Administered Projects with state funding will also be added in a future phase. What Projects are not managed in the Project Management Tool? DOT-let projects, even if LGAs are participating in costs. 11

Local Project On-Line Project Management Tool HELPFUL RESOURCES 12

Project Delivery Major Steps

Pre-Construction Steps (climb the mountain!) Final Plans, Specifications, and Estimate Right of Way Certification Right of Way (ROW) Authorization Right of Way Acquisition (and Utility Relocation) Right of Way Plans / Location & Design Approval Environmental Document Preliminary Engineering (PE) Authorization Procuring Professional Services Agreement Programming (includes Schedule) 14

Construction Steps (another mountain!) Maintenance Final Voucher Date Final Inspection and Project Acceptance Construction Engineering & Inspection Construction Construction (CON) Authorization Bidding, Letting and Awarding Construction Contract 15

Important Items to Remember The following slides illustrate the areas where we see challenges and the need to think ahead about certain issues. 16

Initial Project Idea Before You Ask for Funding Identify project scope from Long-Range Plan, citizen input, etc. Do Your Due Diligence: Environmental Concerns ROW issues Utility relocations Project delivery Budget/Schedule Work with your Division Office Identify funding source (i.e. MPO, NCDOT, etc.) and process for approval/allocation of funds 17

Professional Services All procurement must follow qualifications-based selection. The firm you choose needs to be pre-qualified by DOT in all the work codes listed OR have subs that are pre-qualified. Average length of time to sign a contract with a PEF once funding is authorized? 8 months. City holds the contract with the consultant, not NCDOT. 18

Funding Authorization No costs can be incurred prior to authorization. Certain deliverables need to be complete prior to requesting the authorization. Once funds are authorized, move quickly to incur costs and request reimbursement to keep project active. 19

Right of Way Acquisition All acquisition must follow the Uniform Act, even if you re not receiving reimbursement for Right of Way. Acquisition of Right of Way always takes longer than you think. 20

Contract/Bid Proposal Construction Must use NCDOT Standard Specifications (unless project is one that NCDOT does not have standards for). Construction Be familiar with NCDOT Construction Manual. Ask the Division for assistance in setting up records for consistent documentation. 21

Close-out Be aware of costs that LGA may need to reimburse to NCDOT. Keep all records in a safe place for future audits. 22
