Background The subject lands comprse an area of approxmately 268 hectares (662 acres) located n northeast Brampton. The Vales of Humber Secondary Plan Area s bounded by a trbutary of the West Humber Rver to the west, Mayfeld Road (Regonal Road No. 14) to the north, The Gore Road (Regonal Road No. 8) to the east, and Countrysde Drve to the south. A locaton map s attached as Appendx. The Vales of Humber communty s planned to be an upscale executve housng communty desgned to complement and respect the surroundng estate resdental neghbourhoods as well as the hstorc Hamlet of Wldfeld. The plan creates a compact, pedestran and cyclstfrendly communty that ntegrates, and protects the area's natural and cultural hertage features. A concept plan s attached as Appendx. Offcal Plan Amendment OP (attached as Appendx ll), mplementng the Vales of Humber Secondary Plan and Block Plan was approved by Cty of Brampton Councl through By-law on November 30, Appeals by the Town of Caledon and a prvate landowner were fled wth the Ontaro Muncpal ~oard on January 3, The appeal by the Town of Caledon s dscussed n more detal n sub-secton (b) below. The appeal by the prvate landowner s ste specfc and not of a Regonal concern. (See Appendx V) The Ontaro Muncpal Board s schedulng a Pre-hearng conference wthn the next 90 days. At that tme t s antcpated that the Landowners Group wll request that a moton be heard to dsmss the appeal. Regon of Peel staff wll seek drecton from Regonal Councl on ths matter. a) Cty of Brampton Secondary Plannng and Block Plannng Process The Vales of Humber was orgnally desgnated Estate Resdental n the OP and was redesgnated for urban resdental uses and dentfed as a new Upscale Executve Housng Area n Cty of Brampton staff began workng wth the landowners and ther consultants to carry out the requred techncal studes and to prepare a Secondary Plan for the area. Pror to proceedng wth a secondary plannng program for the Vales of Humber Area, the developers group prepared a Plannng Justfcaton Report. Followng the completon of the Plannng Justfcaton Report, the landowners group drafted Terms of References for fve background studes. These studes analyzed the development of the Vales of Humber for an executve housng communty contanng approxmately 1,500 unts and ncludng stes for schools, parks, places of worshp and commercal facltes. The plannng program for the Vales of Humber was separated nto two Phases. Phase One developed a plannng vson, related prncples and prepared the secondary plan land use concept for Councl endorsement. Phase Two focused on the fnalzaton of the secondary plan polces and the preparaton of the communty block plan concept plan and the block plan prncples to be ncorporated nto the secondary plan.

Addtonally, 2 east-west collector roads are dentfed on the concept plan. The Cty of Brampton held a number of open houses wth stakeholders between December 2003 and June 201 1, ncludng a statutory publc meetng. By-law was passed on November 30, to adopt Offcal Plan Amendment OP to mplement the Vales of Humber Secondary Plan and Block Plan. The fnal date for appeals was January 3, b) Town of Caledon Partcpaton n the Plannng Process The Town of Caledon has partcpated n the Vales of Humber Secondary and Block Plan plannng process as a commentng agency. At the start of the plannng process, the Cty of Brampton crculated the terms of reference for all of the background component studes. The Town of Caledon also receved copes of theses background studes as well as a draft offcal plan amendment for comment and revew. No comments were submtted by Town of Caledon.on the draft offcal plan amendment. However, Town of Caledon staff dd submt comments to Brampton staff on some of the background studes n August and December 2011 whch hghlghted ther concerns wth the proposed north-south collector roads ntersectng wth Mayfeld Road. The bass of ther concern was that the addtonal access ponts on Mayfeld Road, would compromse the role, functon and effcency of ths regonal road. On January 3, 2012 the Town of Caledon appealed sectons and 4.2.9, polces 6.1.6, and , and Schedule A, C and. F of Offcal Plan Amendment OP (attached as Appendx V) The Town of Caledon s concerned, as stated n ther appeal letter, that the proposed north-south collector roads ntersectng wth Mayfeld wll provde frequent access ponts, thereby compromsng the role, functon and operatonal effcency of a major boundary arteral road. The Town of Caledon states that Mayfeld Road has been dentfed as major road n the Regon of Peel Offcal Plan whch s antcpated to carry hgh volumes of traffc (both passenger and goods) performng long dstance travelsltrps effcently. The Town of Caledon states that the role and functon of the Regonal arteral roads s well documented wthn the Regonal Offcal Plan and also through varous studes such as the recently concluded Peel-Hghway 427 Extenson Area Transportaton Master Plan. Addtonally, the Town of Caledon states that t s antcpated that n the near future, Mayfeld Road wll assume even greater sgnfcance as t would cater to the traffc comng and gong fromlto Hghway 427 through the new proposed arteral road ntegrated wth Hghway 427. Caledon states ths wll not only add traffc volumes on Mayfeld Road but wll also change the nature of traffc and that there wll be hgher truck volumes as dentfedlanalyzed n the jont muncpal Peel-Hghway 427 Extenson Area Transportaton Master Plan Study.

4 March 14, 2012 VALES OF HUMBER SECONDARY PLAN AND BLOCK PLAN APPEALS TO THE ONTARO MUNCPAL BOARD cln OF BRAMPTON, WARD 10 The Town of Caledon concludes that n order to balance the land use objectves and to mantan the effcency of Mayfeld Road, t s proposed that the Cty of Brampton explore alternatve road desgns to accommodate north-south collector road system to satsfy transport demand emanatng from the Secondary PlanBlock Plan of Vales of Humber. c) Regon of Peel Partcpaton n the Plannng Process Throughout the plannng process noted above, Regon of Peel staff was nvolved n revewng the component studes, concept plans and polces to ensure the Vales of Humber Secondary Plan and Block Plan was consstent wth Provncal and Regonal polces. Regon of Peel staff provded comments on the Growth Management Phasng and Sequencng Strategy, nfrastructure Servcng Study, Master Envronmental Servcng Plan, Communty Desgn Gudelnes, and Transportaton Study Parts 1 and 2 & Collector Road Envronmental Assessment Phases 1-4 report. Regonal staff from varous departments were nvolved n the revew of ths Plan and assocated studes. Comments from the Peel Publc Health Department, Development Servces Dvson, Transportaton Dvson, Water Dvson, and Wastewater Dvson were provded to Brampton staff and the Vales of Humber Landowners Group. Consstent wth normal practce comments were orgnally only crculated to Cty of Brampton staff and the Landowners Group. Regon of Peel comments regardng the Transportaton Study Parts 1 and 2 & Collector Road Envronmental Assessment Phases 1-4 report were provded to Town of Caledon staff n response to ther comments n August Addtonally, a comprehensve revew of the proposed collector roads to Mayfeld Road and The Gore Road was conducted by Regonal staff n ther revew of the Secondary Plan and Block Plan. n the context of the Regon's Long Range Transportaton Plan, varous supportng documents were utlsed such as the Regon's Controlled-Access bylaw (as amended , ), the Vales of Humber Transportaton Study, the Peel-Hghway 427 Extenson Area Transportaton Master Plan, and sound plannng and engneerng prncples evaluatng the overall functonalty of the Regonal Road network were taken nto consderaton. Regonal staff have envsoned the greater mportance of the Mayfeld Road corrdor. Ths plan, as revewed and supported by Regonal staff, based on the studes and materals currently avalable, respects ths vson and does not compromse the ntended functonalty of Mayfeld Road. Addtonally, the forecast modelng used by Regon of Peel staff ncludes 2031 numbers. Regonal staff fnd the Transportaton studes and materals provded for revew as part of the Vales of Humber Secondary and Block Plan process to be satsfactory. Regonal staff recently hosted two meetngs n February and March 2012 wth Cty of Brampton and Town of Caledon staff to dscuss the Town of Caledon's concerns regardng Mayfeld Road. Staff dscussed the role and functon of Mayfeld Road, the revew done by Regon of Peel staff regardng the approved access ponts and dscussed some alternatve access ponts between McVean Drve and The Gore Drve. Regon of Peel staff wll contnue to work wth Cty of Brampton and Town of Caledon staff to examne varous optons.

The Long Range Transportaton Plan Update was conducted to provde a long term multmodal transportaton strategy whch comprses of polcy amendments and nfrastructure/servces mprovements, ncludng the fndngs from the Peel-Hghway 427 Extenson Area Transportaton Master Plan. The Regon also recently completed the Peel Actve Transportaton Plan to dentfy strateges to encourage a healthy lfestyle by promotng walkng and cyclng. Later ths year the Regon of Peel wll conduct, n consultaton wth the area muncpaltes, a Peel Strategc Goods Movement Network Study to support busnesses wth a transportaton system that moves goods and delvers servces quckly, effcently, and safely. Takng all of the above nto consderaton, the Regon wll ntate a Road Characterzaton Study, on consultaton wth the area muncpaltes to provde a set of desgn gudelnes for all Regonal Roads that establsh transportaton prortes, maxmze roadway effcency, balance the varous uses, and mprove connectvty to adjacent land uses. The Regonal Road system provdes mportant transportaton servce for nter-regonal and nter-muncpal travel. Mayfeld Road s one of the major east-west strategc corrdors that supports the communtes n a safe, effcent and sustanable manner, facltates the movement of people and goods, and offers a varety of moblty choces, ncludng transt, actve transportaton. t serves a dverse mx of commutng needs frontng a varety of land uses along the corrdor ncludng rural and agrcultural landscapes, suburban low densty settngs, more urbanzed and ntensve forms, and ndustral needs. n general, Mayfeld Road s desgned to provde a hgh level of ntermuncpal transportaton capacty and support all modes of travel.

The Road Characterzaton wll be ntated n Aprl and antcpated to be complete by approxmately the end of Before any prelmnary fndngs are dentfed from ths study, Regonal staff wll contnue to work wth Cty of Brampton and Town of Caledon staff to explore any vable soluton that are agreeable to all partes. The followng goals and objectves have guded the formulaton of the detaled polces of ths Chapter and are based on the Cty's ecosystem approach to land use plannng, and the desre to promote sustanable development and complete communtes. / Natural 1 and Cultural Hertage & Open Spaoe The Cty has undertaken a comprehensve approach to. dentfy and protect the Vales of Humber Communty's Natural Hertage System that s consstent wth the Provncal Polcy Statement (2005), through a combned landscape-scale and feature-based analyss that addresses the dversty, connectvty, and ecologcal features and functons and assocated lnkages of terrestral, aquatc and water resources. Natural Hertage dentfy, establsh and protect a sustanable natural hertage system that ncorporates ntegrates and connects natural features and functons to create a healthy, ecologlcally dverse Natural Hertage System Establsh Restoraton Areas as part of the Natural Hertage System as compensaton/mtlgaton for the loss of natural features that would have been part of the Natural hertage System Restore, enhance, manage and montor the dlversty and connectvty of natural features and ther long-term ecologcal functons to ensure a healthy Natural Hertage System, as part of creatng complete and compact communty n accordance wlh the polces of the Provncal Growth Plan dentfy, conserve and enhance the exstng urban tree canopy, to the greatest extent feasble, as determned through the Cty of Brampton Gudelnes for the Assessment of Exstng Tableland Vegetaton Ensure new development wll be effcent, envronmentally responsble, dverse and well balanced, to support the natural envlronment. Lots at the lower end of the range wll be located adjacent to the "Executve Transton" and "Low Densty Resdental" desgnatons; and, v) n the order of 690 lots shall be provded n the "Executve. Commercal development shall be themed n keepng wth the host executve resdental communty The lands desgnated "Nelghbourhood Retal" and "Convenence Retal" on Schedule SPSO(a) shall permt the range of uses and be developed n accordance wth the Local Retal polces of Secton of the Offlcfal Plan, as well as other relevant polces Development wthn Commercal desgnatons shal respect the followng prncples: ) no outdoor storage of goods or materals shall be permtted; ) ) v) only a hgh qualty bult-form wll be permtted, consstent wth the archtectural theme of ths upscale, executve housng communty; provson shall be made to mnmze adverse mpacts upon adjacent resdental uses through nose mtgaton measures, landscapng and buffer treatments; on-ste parkng and loadng areas shall be screened from the street edges through approprate placement of ntervenng bult-form, fencng and/or landscape elements; v) the llumnaton of parkng faclteslareas shall be drected away from nearby resdences and the natural hertage system n order to mnmze ntruson and glare upon resdental propertes and wldlfe habtat; v) common access arrangements and lnked parkng areas may be requred to serve multple land uses; v) adequate off-street parkng facltes shall be provded n accordance wth acceptable standards to satsfy the requrements of employees and customers, ncludng safety consderatons; v) commercal stes wll be desgned to be readly accessble to the communty va all transportaton modes, wth partcular attenlon gven to ntegratng pedestran, bcycle and transt nfrastructure networks and provdng safe and attractve lnkages that wll promote and encourage walkng, cyclng and transt; x) commercal stes wll provde bcycle storage; x) drve through facltes, gas bars and car washes shall only be permtted wthn the Neghbourhood Retal desgnaton located at the southeast corner of Mayfeld Road and McVean Drve n accordance wth the Cty's Development Desgn Gudelnes, specfcally the sectons "Automotve Servce. Centre Gudelnes" and "Drve-through Faclty Desgn Gudelnesn; and,

The boundares of the fnal "Natural Hertage System" have, for the most part, been establshed through the MESP; however where access was not permtted further

26 delneaton of the natural hertage system through addtonal envronmental studes and stakng of natural areas may be requred as part of the revew of draft plans : of subdlvslon Natural Hertage System Desgnaton The "Natural Hertage System" deslgnaton shown on Schedule SP50(a) s comprsed of Valleylands, Watercourse Corrdors, Wetlands, and Woodlands and assocated buffers, setbacks and lnkages, and Restoraton Areas that collectvely contrbute to the ecologcal ntegrty of the West Humber Rver watershed, as dentfed n the MESP. The NHS, ncludng buffers, setbacks and lnkages, shall be conveyed to the Cty n a condton satsfactory to the munlcpallty Mnor refnements to the boundares of the "Natural Hertage System" may be consdered to reflect the dfferences n scale and level of detal avalable through the preparaton of Envronmental mpact Studes (ES) and Functonal Servcng Reports (FSRs) at the draft plan of subdvson stage. However, mnor refnements to ts boundares shall not adversely mpact ts functons or result n any sgnfcant ncrease or decrease n the sze of the fnal "Natural Hertage System" The "Natural Hertage System" shall be zoned n a restrctve zonng desgnatlon to protect t from development and be restored and enhanced, n accordance wth the recommendatons of the Vales of Humber Master Envronmental Servcng Plan Lands desgnated "Natural Hertage System" shall reman prmarly n a natural slate, but the followng uses are permtted: fsh, wldlfe and conservaton; lmted nfrastructure ncludng roads and muncpal servces, crosslngs, stormwater management facltes and Low mpact Development measures; restoraton and enhancement works; passve recreatonal facltes and uses such as tralls, nterpretve dsplays and sgnage; and ste alteratons to accommodate the above uses, Urban land uses developed adjacent to the Natural Hertage System wll contrbute to the conservaton and enhancement of natural features and ecologcal functons, through the applcaton of sustanable best management practces for stormwater dranage, publc nfrastructure mantenance and management ste desgn, land use buffers and setbacks Small parcels of land created through the locaton of valley edge roads, whch may serve as vsta blocks, shall not be accepted as parkland dedcaton under the Plannng Act, f such parcels are not usable as parkland and nstead wll be naturalzed to the satsfacton of the Cty The "Natural Hertage System" and the "Recreatonal Open Space System" are both gven a hgh profle wthn the Vales of Humber Secondary Plan Area as vsble and accessble publc amentes. These areas are to be nter-

27 connected wth each other as well as school stes to the greatest extent possble through the creatlon of pedestran and cyclst lnkages at the detaled subdvson desgn stage, where t can be demonstrated that such connectons do not adversely mpact the functons of the "Natural Hertage System". Such lnkages have been dentfed through the concurrent Block Plan Process and may be further refned durng tha processng of Subdvson Plans ,8 The exstng urban tree canopy wll be dentfed, conserved and enhanced to the greatest extent feasble, as determned through the MESP together wth the Cty of Brampton Gudelnes for the Assessment of Exstng Tableland Vegetaton Restoraton and Enhancement Area The "Restoraton and Enhancement Area" desgnaton shown on Schedule SPSO(a) s comprsed of areas wthn the Natural Hertage System whch wll be restored to a natural state to compensate for the removal of local woodland, valleyland and wetland/pond features. Restoraton and Enhancement Areas shall be used to create and/or enhance habtat as recommended n the MESP. 29 5.5.2 Educat onal Facltes School Stes are dentfed on Schedule 50(a) n the general locatons as shown and shall be developed n accordance wth the polces of Secton 4.8 of the Offcal Plan and ths Chapter. Two new elementary school stes are desgnated on Schedule SP5O(a) to satsfy the antcpated long term requrements of the Peel Dstrct Publc School Board. Mnor locatonal varatons to school stes are permtted at the draft plan of subdvson or zonng approval stage n order to mprove development desgn, the centralty of the ste to ts servce area, or ts functonalty wthout an amendment to ths Plan. The need for a partcular school ste shall be confrmed by the School Board as part of the approval process of the draft plan of subdvson n whch each school ste s located. The tmng for whch the ste s reserved shall also be establshed at that tme, but such reservaton shall not exceed seven (7) years from regstraton. f any school ste s not requred by ether School Board or f the reservaton perod lapses, then t shall be released for resdental development based on the permssons of the adjacent resdental desgnatons. Relevant draft Plans of Subdvson shall nclude desgnated educatonal facltes as approprate wth a sze, shape and frontage satsfactory to the School Board. Stes shall be dual zoned and landowners shall be subject to submt at the draft plan of subdvson stage an alternatve lottng development should the school ste not be used for educatonal purposes. Pror to approval of plans of subdvson, the Cty shall requre landowners wthn the Vales of Hurnber Secondary Plan Area to enter nto agreements wth each other and the Peel Dstrct School Board for the purpose of provdng for the equalzaton of the costs assocated wth establshng school stes desgnated on Schedule SPSO(a), unless ths purpose s deemed to be satsfed by Educaton Development Charges or another effectve mechansm. t s antcpated that the St, Patrck Elementary School located wthn the Hamlet of Wldfeld wll need to expand to accommodate students from the Vales of Humber communty. n order to accommodate the expanson: ) the school ste needs to be connected to the Cty's water, santary and storm water system. 30 5.5.3 Places of Worshlp maxmcm of 800 buldng permts are permtted to be ssued wthn the Vales of Humber Secondary Plan Area before the constructon of a pedestran lnkage across the Natural hertage System to the St, Patrck Elementary School ste Places of Worshp shall be developed n accordance wth Secton of the Offcal Plan as well as the follawng polces f the event that the Place of Worshp ste s not requlred for such purposes, t may be developed for resdental development n accordance wth the polces of the "Low Densty Resdental" desgnaton. t shall also be dual zoned to permt both resdental uses and a place of worshp at the draft plan of subdvson stage. 5.6 SPECAL POLCY AREAS Specal Polcy Area 1 (Hamlet of Wldfleld) "Specal Polcy Area 1:' apples to lands adjacent to the Hamlet of Wldfeld wlthn whch development s to occur n a manner that protects the Hamlet through the establshment of a transton area n the form of approprate lot szes, buldng desgn, street patterns, landscapng and setbacks Development wthn "Specal Polcy Area 1" shall be, ' desgned n a manner that complements the "Natural Hertage System" contaned theren and mantans the vew corrdor along The Gore Road to the Hamlet Permtted uses wthn "Specal Polcy Area 1" shall be lmted to: "Executve Resdental" n accordance wth Sectons 5,l.l and of ths Chapter The use of reverse lottng adjacent to the arteral roads.. shall be avoded wthn "Specal Polcy Area 1" A pedestran lnkage across the Natural Hertage System wll be provded to offer pedestran access from the new communty to the exstng elementary school known as St. Patrck Elementary School. 6.0 TRANSPORTATON POLCES 6.1 ROADS Roads n the Vales of Humber Secondary Plan are ntended to develop and functon n accordance wth the desgnatons, polces and Schedules "B"' and 'Bn of the Offcal Plan, and wth the desgnated road classfcatons on Schedule SP50(a). 6,1.2 Collector Roads and Loca Roads shall be desgned to support and accommodate actve transportaton (walkng, bcyclng) and publc transt to the greatest extent practcal, ncludng the potental use of on-road bcycle lanes, sdewalks and mult-use paths, and

31 pedestran walkway lnkages to provde safe, convenent access to transt servces All roads wthn the Secondary Plan Area wll be located to avod andlor mnmze encroachments nto the "Natural Hertage System" and wll be desgned to elmnate, mnmze and/or mtgate mpacts to the envronmental hazards and ecologcal senstvtes of natural features and areas, and to facltate wldlfe passage, as approprate n order to contnue to fulfll the requrements of the Envronmental Assessment Act, all roads not consdered "Local Roads" and that are Collector Road projects assocated wth resdental development where the proponent s a prvate sector developer, as determned by the Cty of Brampton, shall requre the completon of an Envronmental Assessment or equvalent process as permtted n the Muncpal Engneers, Assocaton gudelnes document Muncpal Class Envronmental 'Assessment. The Envronmental Assessment or equvalent process shall be completed pror to or n tandem wth the approval of the Block Plan to ensure that approprate measures are ncluded to address the mpact of any proposed road works. Collector Roads shall be fnalzed at the Block Plan stage Road wdenngs to acheve the rght-of-way requrements dentfed n the Cty of Brampton and Regon of Peel Offcal Plans, are to be provded wthn or abuttng the Vales of Humber Secondary Plan Area and conveyed to the road authorty havng jursdcton, as a condton of development approval. The Regon of Peel has dentfed the need for addtonal properly requrement for Mayfeld Road beyond the 50 metre rght-of-way desgnaton n the Regonal Offcal Plan. Ths ssue must be further addressed at the subdvson stages of approval wth the Regon of Peel to determne f ths s stll a requrement for addtonal property beyond the desgnated rght-of-way n the Regonal Offcal Plan. 6 To protect the functon of Arteral Roads, t s the polcy of the Cty to restrct access to them from ndvdual propertes. Accordngly, 0.3 metre reserves or other measures, as approprate, shall be a condton of, development approval for lands abuttng Arteral Roads, except at approved access locatons. However, exstng resdence or buldngs wll contnue to have drect access untl such tme as access from an alternatve road becomes avalable or the property s redeveloped. C-\y Secton 6.1.6, above, drect access to Roads are permtted subject to detaled an amendment to ths Chapter The determnaton of any future road algnments shall avod small parcels of land whch are not proposed to be developed, wherever possble.

32 6.1.9 The locaton of roundabouts wll need to be confrmed through geometrc desgnlanalyss at the tme of draft plan processng. Should the mnmum roundabout geometrc parameters not be acheved, the locatons wll not be consdered for the development of roundabout ntersectons. Fnal declson on addton of the potental roundabouts wll be made at the draft plan stage of approval Specal alternatves to lot confguraton and zonng standards may be requred n order to mplement roundabouts Frontage, setback and drveway requrements for lots n the vcnty of roundabouts shall be prepared at the draft plan of subdvslon or rezonng stages, to the satsfacton of the Cty of Brampton. Roundabout lots shall be zoned n accordance wth the requrements for roundabout dwellngs, contaned n the Communty Desgn Gudelnes. J All proposed accesses or ntersectons on Regonal Roads wll be n accordance wth the Regon's Controlled Access By-Law 59-77, as amended, or as may otherwse O\L be approved by the Regon of Peel. 6.2 PUBLC TRANST Transt servces shall be provded n accordance wth Secton of the Offcal Plan and ths Chapter The major road system wthn and abuttng the Secondary Plan as shown on Schedule 50(a) conssts of Arteral Roads and Collector Roads that have been desgned wth suffcent flexblty to delver bus routes wthn 400 metres of most resdents and to convenently serve commercal and nsttutonal uses Subdvsons shall be desgned to mnmze walkng dstances to transt routes and provde safe, attractve and drect pedestran/cyclst access to transt stops Brampton Transt wll determne the type and level of ocal transt servce as well as bus shelters and transt stop locatons The ntroducton of transt servces to the Vales of Humber Secondary Plan Area wll be phased based on acceptable operatonal and functonal crtera n order to encourage greater use of publc transt wthn the communty, ocal road and block patterns should be desgned to accommodate pedestranlcyclst access to collector roads and transt stops, to the extent practcal. 6,2.7 Sdewalks along Arteral and Collector Roads that are expected to accommodate transt routes shall ncorporate bus pad wdenngs n approprate locatons n accordance wth the Cty of Brampton standards. 6.3 PEDESTRlANlCYCLlST LNKS

33 6.3.1 PedestranCyclst Lnks shall be provded n accordance wth Sectons and of the Olfcal Plan and the Pathways Master Plan to serve as a recreatonal, utlltaran and aesthetc amenty for the communty and to ntegrate the elements of the Resdental and Commercal Land Uses, Transportaton, Recreatonal Open Space and natural hertage system PedestranCyclqt Lnks shall be provded through, across or, where ths s not possble, along the edges of adjacent open space elements, ncludng parks, school stes, stream corrdors and natural areas.such as valleylands and woodlands, as deemed ecologcally approprate. Road allowances may also be utlzed and expanded to accommodate necessary lnkages where there s no other alternatve n accordance wth Secton 6.3.2, the MESP and block plan shall dentfy ecologcally approprate locatons for valleyland crossngs that wll mnmze and mtgate envronmental mpacts to natural features and functons, to ensure a well-connected pedestran and cyclst-frendly communty can be acheved Approprate Pedestran/Cyclst Lnks between open space elements shall be provded along sutably located roads, and block walkways Cyclng connectons to the Cty-wde pathways network wll be provded along Arterals Roads and Collectors, where approprate PedestradCyclst Lnks located outsde of a desgnated road rlght-of-way or outsde of the "Natural Hertage System" desgnaton shall be gratutously conveyed to the Cty of Brampton. SERVCNG & ENVRONMENTAL CONSDERATONS 7.1 Santary Sewage and Water Supply 7.1. Development wthn the Secondary Plan Area shall be on full urban muncpal servces n accordance wth Secton 4.7 and other relevant polces of the Offcal Plan Proponents of development shall be requred to enter nto approprate agreements to the satsfacton of the Regon of Peel and the Cty of Brampton to provde protecton for exstng prvate water supply systems n the area that are to contnue n use, should ther operaton be detrmentally mpacted through the process of developng the Secondary Plan Area n accordance wth Secton 4.11 and other relevant polces of the Offcal Plan, the Cty of Brampton and the Regon of Peel may requre senrcng or phasng agreements wth developers as condtons of approval to ensure that development only proceeds n a manner that optmzes the utlzaton of sewer and

34 water servces and does not,outpace the ablty of the Regon of Peel to fnance and construct new servces The detaled desgn and nstallaton of muncpal sewces wthn the Secondary Plan Area shall be undertaken n an ecologcally responsble manner wth regard, generally, for the recornmendafons of the approved Vales of. Humber Secondary Plan nfrastructure Servcng Study (Candevcon 2011). ' 7.2 Stormwater Management 7,2.1 n consderng optons for st~mwater management, the followng polces shall apply: ) Ranwater, snowmelt and stormwater wll be consdered as a resource, not a waste product; l) best management practces, ncludng low mpact development technques and measures, wll be ncorporated nto the stormwater management system, n accordance wth the recommendatons of the Master Env/ronmental Servcng Plan, as feasble and approprate; ) stormwater management faclltes wll be located and desgned to mantan the envronmental and ecologcal ntegrty of the Natural Hertage System to provde a net beneft to the envronmental health of communty; and, v) stormwater management facltes shall be desgned, wherever possble, to provde communty amentes such as vsual attracton and passve recreaton Stormwater management facltes shall be provded n accordance wth Secton and other relevant polces of the Offcal Plan, and ths Chapter Stormwater management facltes shown on Schedule SP50(a) are conceptual and are permtted n all land use desgnatons. Stormwater facltes wll be ntegrated wth adjacent land uses, as approprate, and subject to the recommendatons of an MESP, Storrnwater Management Report andlor Functonal Servcng Report to the satsfacton of the Cty of Brampton n consultaton wth lhe Conservaton Authorty Adjustments may be made to the sze, locaton and number of stormwater management facltes through the Subdvson Approval processes, wthout further amendment to the Plan but subject the concurrence of the Cty of Brampton n consultaton wth the Toronto Regon Conservaton Authorty A Stormwater Management Plan shall be undertaken for any development wthln the Secondary Plan Area, n general accordance wth the approved MESP. The Stormwater Management Plan shall address such concerns as low mpact development measures, flow attenuaton (quantty), water detenton (quantty and qualty), groundwater quantty/qual!y ssues and

35 eroson/sltaton control desgn requrements, as approprate A comprehensve Stormwater Management Montorng Program shall be developed whch s generally n accordance wth, and mplements the recommendatons of the MESP Pror to the alteraton of any'watercourse or wetland, the constructon of any stormwater management faclty, ncludng the commencement of any gradng or fllng, the necessary permts that may be requred shal be obtaned from the approprate agences havng jursdlcton. Ths may nclude, but s not lmted to, the Cty of Brampton, Toronto Regon Conservaton Authorty, he Department of Fsheres and Oceans, and the Mnstres of Natural Resources and Envronment Stormwater management facltes shal be desgned n complance wth the Cty's Stormwater Management Desgn Gudelnes. The fnal locaton of all stormwater management facltes shal be subject to the approval of the Cty of Brampton n conjuncton wth any other approprate approval authorty havng jursdcton n these malters Sedment and eroson control measures and montorng shall be undertaken n accordance wth the Greater Golden Horseshoe Area Consenraton Authortes, December 2006, Eroson and Sedment Control Gudelnes for Urban Constructon. Montorng of sedment controls s to be undertaken by a professonal certfed n eroson and sedment control as deemed approprate by the Cty of Brampton n consullalon wth the Consetvaton Authorty. 7.3 Nose Attenuaton Nose barrlers should be mnmzed through the use of lot and road layouts that mnmze the need for barrers, especally along The Gore Road, Countrysde Drve and McVean Drve Nose barrers, consstng of a combnaton of bermng and acoustcal fencng, wll be requred to be provded along all or portons of Mayfeld Road, The Gore Road, Countrysde Drve and McVean Drve n order to mtgate senstve uses from traffc nose along these roadways Addtonal ndvdual subdvson-based nose analyss reports prepared n accordance wth Secton 4.4 and other relevant polces of the Offcal Plan and ths Chapter shal be submtted, as necessary, at the draft plan of subdvson stage so that adequate nose attenuaton measures can be specfed and guaranteed at the tme of draft plan of subdvson approval. Stespecfc nose analyss reports wll be requred at the Ste Plan Approval Stage f t s determned that crcumstances warrant such a report Where development for whch nose attenuaton measures wlll be requred precedes the presence of the

36 nose source, the Cty wll requre that as a condton of development approval, sufflcent lands and facltes be provded for nose attenuaton n accordance wth the requrements of the relevant aulhorlty Where "Resldenlal" desgnatons nterface wth "Commercal" desgnatons on Schedule SP50(a), the Cty wll requre the mplementaton of approprate bufferng and mtgaton measures n accordance wth the Envronmental Management polces and other relevant polces of the Offcal Plan. 7.4 Potentally Contamnated Stes Where there s the potentlal that a ste may be contamnated due to the prevous use of the property, a sols study shall be prepared n accordance wth the provncal gudelnes for the decommssonng and cleanup of contamnated stes and submtted along wth any applcaton for development. Development for any contamnated ste shall not be permtted untl the ste s decommssoned or cleaned up n accordance wth provncal gudelnes. ' r 1!! 1 / 7.5 Publc Utltes and Communcatons / / Publc utltes and other facltes such as telecommuncatons/communcatons nfrastructure, swtchlng statons, hydro transformer statons, water and sanltary pumpng statons shall be provded n accordance wth Secton 4.7 and other relevant Sectons of the Offlcal Plan, These are permtted n any land use deslgnaton provded they are approprately ntegrated and all necessary approvals from the approprate authortes are obtaned The Cty shall pursue opportuntes for provdng all servces underground, where feasble, n the Secondary Plan Area. These servces shall be clustered or grouped nto a sngle utlty condut or trench, wherever possble, to mnmze vsual mpacts. Utlty provders wll also be encouraged to consder nnovatve ways of contanng nfrastructure f aboveground on or wlthn streetscapes The Cty shall ensure that the coordnaton of desgn and placement of servces (ncludng cable, hydro, gas, telecommuncatons, Canada Post, etc.) be requred for all parts of the Secondary Plan Area, pror to draft plan of subdvson approval and that all utltes be grouped nto a sngle utlty condut or trench where possble Wreless telecommuncaton tower applcatons shall follow the Cty Councl approved protocol for processng of such applcatons. CULTURAL HERTAGE

37 8.1 Conservaton of cultural hertage resources wthn the Vales of Humber Secondary Plan Area shall be undertaken n accordance wth Secton 4.9 and other relevant polces of the Offcal Plan. For the purposes of ths Chapter, cultural hertage resources shal nclude structures, stes, cultural landscapes, envronments and vegetaton, and artfacts, whch are of hstorcal, archtectural or archaeologcal value, sgnfcance or nterest. 8.2 The Cultural Hertage Map contaned n Secton 4.9 of the Offcal Plan dentfes those Cultural Hertage Resources warrantng preparaton of ndvdual Hertage mpact Assessments, as dentfed n the approved Cultural Herltage Resources Report, Bult Hertage & Cultural Hertage Landscapes. 8.3 The requred Assessments wll ndcate whether or not t s warranted and feasble from a structural, land use, programmng and fnancal perspectve, to preserve and conserve the resource. f t s not warranted or feasble to retan and conserve the resources on ther orgnal stes, then they may be relocated elsewhere, falng whch they may be demolshed n accordance Wth munlclpa requrements wthout the 'need for an amendment to ths Chapter. 8.4 The ntegraton of Cultural Hertage Resources worthy of retenton or conservaton nto new development s to be guded by preparaton of a sutable, Conservaton or Preservaton Plan for each property outlnng requrements for stablzaton, conservaton, restoraton, reuse or adaptve reuse, pror to development approval to the satsfacton of Cty Councl. 8.5 All development adjacent or ncorporatng a Cultural Hertage Resource should, from an urban desgn perspectve, be respectful of the resource havng regard for scale, massng setbacks, materals and desgn features. 8.6 All development n the Vaes of Humber Secondary Plan Area wll requre an archaeologcal assessment to be undertaken n accordance wth current techncal gudelnes and to the satsfacton of the Mnstry of Cullure: No gradng or other dsturbance shall take place on a property wth respect to archaeologcal resources pror to ssuance of a Letter of Clearance from the Mnstry of Culture, COMMUNTY BLOCK PLAN. SUSTANABLTY The Block Plan and ensung development applcatons shall have regard for the overall prncples of the Sustanable Cty concept set out n Secton 3.1 of the Offcal Plan. To ths end, development wthn the Secondary Plan Area should make wse use of non-renewable resources, strve to protect, enhance and

38 restore the natural hertage system for the enjoyment of future! generatons, consst of a varety of land uses, and foster a, communty that s walkable, pedestran orented and that \ promotes publc transt usage. 9.1 General Provslons Concurrent wth preparaton of the Vales of Hurnber Secondary Plan, a Communty Block Plan for Sub-Areas 50-1 and 50-2 has been prepared n accordance wth Secton 5.5 and other relevant pollces of the Offcal Pfan Communty Block Plan Areas 50-1 and 50-2 must meet the desgn objectves of the Offcal Plan and ths Chapter, and, nclude the requrements related to communty structure, the natural hertage system and open space network, road network, streetscapes, edges and gateways, transtonal buffers, ste plannng and bult form The Communlty Block Plan: 1) refnes a concept that ncludes an accurate layout of the transportaton network ncludng the arteral, collector and local roads, development blocks, Natural Hertage System ncludng envronmentat buffers and restoraton and enhancement areas, recreatonal open space, and storrnwater management facltes; ) ) v) dentfes land use desgnatons; overlays the exstng parcel fabrc; dentfes Specal Character Areas, as defned by the Development Desgn Gudelnes, and requrng detaled gudelnes to be prepared for these areas as part of the Communty Desgn Gudelnes whch wll address how these areas provde an enhanced mage and character for the Vales of Humber Communty; and, v) provdes addtonal polcy text and mappng, as necessary, to explan how the Block Plan mplements the polces of the secondary plan ncludng: 9.2 Desgn Objectves ' The desgn objectves shall be n accordance wth Sectons 4.10 and 5.5 and other relevant polces of the Offcal Plan whch set out the general crtera for the development of both the publc realm and prvate lands to create an attractve, safe and pedestran frendly envronment. 9.3 Communty Structure The communty structure shall be n accordance wth 11 Sectons 5.5 and and other relevant polcles of the Offcal Plan.

39 9.4 Open Space System A more detaled examnaton of elements of the open space network beyond what has been dentfed n the Vales of Humber Communty Desgn Gudelnes and Open Space Study shall be consdered durng the block plan stage of approval Street Network The street network shall be n accordance wth Sectons and 5.5 and other relevant polces of the Offcal Plan. 9.6 Streetscape The streetscape component of the Block Plan process shall be n accordance wth Secton 5.5 and other relevant polcles of the OHcal Plan and ths Chapter. Typcal street sectons shall be developed at the Block Plan stage to llustrate how the components of the streetscape combne to acheve a superor envronment. These shall llustrate: 1) Wdth of street rght-of-way; 11) Roadway pavement wdth; ) Boulevard wdths, boulevard landscapngltree locatons; v) Pedestran sdewalks; v) Mult-use paths/blcycle lanes; v) Streetlght locatons; v) Mnmum buldng setbacks and projectons; and, vll) Relatonshp to garages. All development applcatons submtted wthn the boundares of Block Plan Areas 50-1 and 50-2 shall be mplemented and staged n accordance wth the approved Growth Management Stagng and Sequencng Strategy Report for ths Block Plan, whch shall establsh the detaled tmng and stagng of development relatve to the sequental delvery of requred nfrastructure such as roads, parks and engneerng servces The growth management component of the Communty Block Plan ensures that growth and development s staged and sequenced n a manner that ensures coordnaton between the development that occurs and the nfrastructure requred to support that growth.
