1 " t RESOLUTON NO A RESOLUTON OF THE CTY COUNCL OF THE CTY OF EL PASO DE ROBLES AMENDNG TENTATVE TRACT MAP 2223 (FRANK ARCERO AND SONS) APNS: THROUGH 20 WHEREAS, on Aprl 22, 1987, the Cty Councl approved General Plan Amendment to the General Plan of the Cty of El Paso de Robles, establshng the requrement for a Specfc Plan to be prepared for the area bounded by Unon Road, Hghway 24, North Rver Road, and Prospect Avenue, referred to as the "Unon/46 Specfc Plan Area;" and WHEREAS, on March 1, 1988, the Cty Councl adopted the Unon/46 Specfc Plan; and WHEREAS, on February 18, 1992, the Cty Councl amended the Unon/46 Specfc Plan; and WHEREAS, the Unon/46 Specfc Plan contans specfc development and desgn standards for key segments of the Plan Area; and WHEREAS, on August 26, 1996, the Plannng Commsson of the Cty of El Paso de Robles n Resoluton approved Tentatve Tract Map 2223, the subdvson of an approxmately 40 acre ste nto 103 sngle famly resdental parcels, two detenton basns and open space area, generally located north of Unon Road, west of Prospect Avenue and south of Hghway 46 East; and WHEREAS, on Aprl 23, 1997, an applcaton to amend Tentatve Tract Map 2223 was fled by Frank Arcero and Sons n conjuncton wth an applcaton to amend Planned Development to Elmnate the requrement for ths development to nstall the full street mprovements of Mesa Road from Prospect Ave. to Golden Hlls Road. Add a gravel fre lane as a seconda:y emergency access. Change the desgn of the nose/prvacy wall along Hghway 46 to be a straght lne and elmnate the '~jogs." Add one resdental sngle famly lot by reducng the open space lot; and WHEREAS, at ther meetng of June 10, 1997, after consderaton ofpoblc testmony, the Plannng Commsson took the followng actons regardng the proposed amendment to Planned Development and Tentatve Tract 2223: a. Consdered the facts and analyss, as presented n the staff report prepared for the applcaton to amendment to Planned Development and Tentatve Tract 2223; b. Conduct a publc hearng to obtan publc testmony on the applcaton to amendment to Planned Development and Tentatve Tract 2223; C. Adopted Resoluton 9%029 approvng an amendment to Planned Development and adopted Resoluton approvng an amendment to Tentatve Tract 2223, and made fndngs as requred by the Cty of Paso Robles Zonng Code; and WHEREAS, a letter of appeal was been fred by Frank Arcero & Sons on June 19, 1997, appealng the Plannng Commsson's June 10, 1997, decson and requestng that the Cty Councl approve the amendment request as orgnally proposed; and WHEREAS, an Envronmemal mpact Report (ER) was prepared for the Unon/46 Specfc Plan area and the ER was certfed for adequacy by the Cty Councl n February of 1988; and WHEREAS, there has been no sgnfcant ncrease or change n the severty of dentfed effects of the Specfc Plan's buld out snce the preparaton and certfcaton of sad ER n 1988; and WHEREAS, there has been no sgnfcant change n land use patterns wthn the surroundng area to ths project, or sgnfcant changes to tmt~c crculaton crcumstances (wth the excepton of the nstallaton of a traffc sgnal at the Golden Tfll Road and Hghway 46 ntersecton whch has mproved the traffc c'trculaton crcumstances beyond that whch was ntally dentfed wthn the certfed ER); and WHEREAS, per Secton of the State's Gudelnes to mplement CEQA (Calforna Envronmental Qualty Act), ths resdental project s n complance wth the Specfc Plan for whch the aforementoned ER was prepared and wll therefore not requre any addtonal envronmental revew; and
11 WHEREAS, a publc hearng was conducted by the Cty Councl on July 1, 1997, and July 15, 1997, to consder facts as presented n the staffrcport prepared for ths project, and to accept publc testmony regardng ths proposed amendment to Tentatve Tract 2223 and assocated Planned Development NOW, THEREFORE, BE T RESOLVED, that the Cty Councl of the Cty of El Paso de Robles does hereby determne the followng based upon the facts and analyss presented n the staffreports, and publc testmony:. Fndngs The Cty Councl of the Cty of El Paso de Robles does hereby make the followng fndngs based upon the facts and analyss presented n the staff report, publc testmony recdved and subject to the condtons of approval lsted below as requred by Government Code Secton 66474:. As condtoned, the followng tems of the proposed amendment to the tentatve subdvson map s consstent wth the adopted General Plan for the Cty of El Paso De Robles. Develop Mesa Road to local rural standard from Prospect Ave. to Golden Hlls Road. Develop Prospect Ave. to local rural standards ~om Unon Road. to Mesa Road, ncludng a concrete sdewalk, natural gas lne and sewer lne. Add a gravel fre lane as a secondary emergency access. Change the desgn of the nose/prvacy wall along Hghway 46 to be a straght lne and elmnate the "jogs." Lmt depth of the landscapng along the Hghway 46 sde oftbe northern permeter wall to ten feet. Elmnate the mantenance road north of the northern permeter wall along Hghway 46 Lmt the landscapng along the mantenance road to hydro-seedng the areas where need for slope stablzaton. Elmnate the playground equpment from the detenton bas'm n Phase. Add one resdental sngle famly lot by reducng the open space lot.. As condtoned, the amendments lsted n Fndng 1 are consstent wth the Zonng Ordnance; 3. The ste s physcally sutable for the type of development proposed; 4. The ste s physcally sutable for the proposed densty of development;
12 4. The desgn of the subdvson wth the amendments lsted n Fndng 1 s not lkely to cause substantal envronmental damage or substantally and unavodably njure fsh or wldlfe or ther habtat;. The desgn of the subdvson wth the amendments lsted n Fndng 1 are not lkely to cause serous publc health problems;. The desgn of the subdvson wth the amendments lsted n Fndng 1 wll not conflct wth easements acqured by the publc at large, for access through or use of, property wthn the proposed subdvson;. The proposal to mprove Mesa Road to the local rural standard wll adequately serve the proposed project as a secondary access and s consstent wth the Unon/46 Specfc Plan whch requres street mprovements as part of the development process. The access would not be dsharmonous or a dsruptve dement to the surroundng area.. A straght nose/prvacy wall along Hghway 46 wth a landscapng area of ten feet deep along the wall's north sde would be consstent wth the Unon/46 Specfc Plan and would be senstve to the surroundng area. The polces and development standards contaned wthn the Unon/46 Specfc Plan emphasze the mportance of the Hghway 46 corrdor for affectng an mpresson of the communty of Paso Robles. A straght wall wth ten feet of landscapng on the north sde would satsfy the ntent of the Unon/46 Specfc Plan. 10. The request to elmnate the requrement to pave the sewage lft staton access road s nconsstent wth the Zonng Code, Chapter 21.16A (Planned Development Overlay Dstrct Regulatons) snce t s contrary to the publc health, safety and welfare. For long term mantenance, eroson protecton, and all-weather access to the lft staton, the access road should be paved for heavy equpment to access the faclty. 11. Lot 104 s consstent wth the Unon/46 Specfc Plan. Only one oak s located on Lot 104 and a resdental dwellng unt may be buld on the property wthout requrng the removal of one or more oaks. The furore home would not block the vew of the oak woodland. H. Tentatve Tract Amendment Annroval The Cty Counc'd of the Cty of El Paso de Robles does hereby amend Tentatve Tract Map 2223 as follows:. Prospect Ave. s amended to be dedcated as a publc easement and the street mprovements for Prospect Ave. are revsed to nclude a concrete sdewalk on one sde of the street, and the nstallaton of sewer lnes and natural gas lnes.. Mesa Road s amended to be mproved as a local rural street (standard A-7) east of the ntersecton wth Prospect Ave.
13 .. The landscapng adjacent to the north sde of the Hghway 46 nose/prvacy wall s revsed to be desgned wthout hgh mantenance ground cover that would necesstate a mantenance access road. The project landscapng adjacent to Hghway 46 shall be lmted to ten feet n depth and subject to fnal revew and acton by the Development Revew Commttee. The desgn of the nose/prvacy wall along Hghway 46 s revsed to be a straght lne wthout "jogs" as shown on Exhbt B.. The requrement for a mantenance road to the slope area adjacent to Hghway 46 s elmnated (Condton 14 of Resolnton ).. The requrement to nstall playground equpment n the detenton basn of Phase s elmnated. (Condton 23 of Resoluton ).. The landscapng for the mantenance access road to the sewage lt staton shall be lmted to hydroseedng where sol has been dsturbed.. The proposed fre lane located between the Harrs property ( ) and the Johnson property ( ) shall be mproved as a gravel all-weather road and gated at Prospect Avenue and "A" street; the wdth and desgn shall be subject to approval of the Chef of Emergency Servces. f not acceptable to the Chef of Emergency Servces, the applcant shall be requred to provde fre sprnklers as specfed n ste specfc condton no. 27 of Plannng Commsson Resoluton The tentatve tract map s amended to nclude Lot 104 as shown on Exhbt B. NOW, THEREFORE, BE T RESOLVED, that the Cty Councl of the Cty of El Paso De Robles, does hereby approve the amendment to Tentatve Tract Map 2223 subject to the followng condtons:. The applcant shall comply wth all Standard Condtons of Approval and Ste Specfc Condtons of Approval for Tentatve Tract Map 2223, Plannng Commsson Resoluton and except as specfcally modfed by ths resoluton.. The project shall be constructed so as to substantally conform wth the followng lsted exhbts and condtons establshed by ths resoluton: Exhbt B D F Descrnton Tentatve Tract Map (supersedng Ex_hbt B of Resoluton ) Cross Sectons (supersedng Exlu'bt D of Resoluton ) Slump Stone Wall (Detal)

Condton 3 of Resoluton s amended to read as follows: The applcant shall nstall full wdth of Mesa Road from Golden Hll Road per Cty Standard A-7-32 foot wde pavement, asphalt concrete berm on one sde and a dranage swale on the other. Mesa Road outsde ths tract's boundares shall be constructed wth phase one development. The cul-de-sac shall be constructed per Cty Standards and Specfcatons. An access easement west of ths cul-de-sac shall be offered for dedcaton. Condton 4 of Resoluton s amended to read as follows: The applcant shall nstall full wdth of Prospect Avenue wthn a 50-foot publc road easement Per Cty Standard A-7-32-foot wde pavement, concrete sdewalk and asphalt concrete berm on one sde and a dranage swale on the other. Ths road shall be constructed wth phase one development.. Condton 14 of Resoluton s amended to read as follows: The developer shall annex to the Cty's Landscape and Lghtng Dstrct for payment of the operatng and mantenance costs of the streetlghts, parkway landscapng, detenton bas'ms, open space, and slope landscapng along Hghway 46. Condton 22 of Resoluton s amended to read as follows: The project landscapng adjacent to Hghway 46 shall be desgned to the followng mnmum desgn requrements and shall be subject to fnal revew and acton by the Development Revew Commttee (DRC): a) Ten feet of landscapng shall be provded on the north sde of the wall and wrapped wth the wall along the northeast and northwest corners of the tract, wth the fnal desgn to be approved by the DRC, based on detaled cross sectons. (t s recognzed that Cal Trans would not permt trees or wall wthn 30 feet of ther travel lane and that portons of ths landscape strp would contan shrubs and ground cover only). b) Pror to DRC revew, the applcant shall provde verfcaton ofcal Trans' authorzaton, f necessary, for the landscapng encroachment and proposed palette. c) The sze and spacng of all landscape materals shall be such that there wll be ample coverage of planted areas wthn one growth season. d) Landscape materals (speces) shall be used whch wll create a vsual barrer and whch wll eventually fully screen the wall and the homes beyond. The palette would nclude large canopy trees such as London Plane and Cottonwoods.
15 The landscapng plan shall be desgned wthout hgh mantenance ground cover that would necesstate a mantenance access road. Addtonally, shrubs shall be planted wthn the drplne of trees to avod conspcuous bare spots, and clmbng vne materals shall be used on the wall. e) Access to the north sde of the wall, for mantenance purposes, shall be provded at ponts determned necessary by the Engneerng and Streets Dvsons. These access ponts shall be mnmzed (at least 1 pont) f possble. Fencng, gatng and aesthetc treatment of these access ponts shall be addressed for practcalty, appearance, as well as prvacy for adjonng parcels. 7. Condton 23 of Resoluton s amended to read as follows: The applcant shall provde detaled landscape plans for each of the detenton basns for revew and approval by the DRC. The expectaton for both basns s that the nteror shall be planted wth tuff, and the sloped sdes by planted wth a combnaton of shrubs, groundcover and trees. The phase two basn shall functon as a passve park and landscapng plans shall nclude the replantng of the dsturbed areas. Plantng west of the basn shall nclude trees and shrubs whch are drought tolerant and could be weaned n the future l~om rrgaton. 8. Condton 25 of Resoluton s amended to read as follows: The desgn of the nose/prvacy wall adjacent to Hghway 46 shall conform wth Exhbt F. 9. Standard Condtons, General Condton A.1. s amended to read as follows: Ths project approval shall expre on August 5, 1999, unless a tme extenson request s fled wth the Communty Development Department pror to expraton. 10.
