3 The importance of incusive design What is incusive design? According to the Disabiity Rights Commission, its goa is to create "beautifu and functiona environments that can be used equay by everyone, irrespective of age, gender or disabiity". That means creating buidings which are easy to use by anybody, and where there are no barriers to restrict access. It is a statement of equaity. The aternative is the od fashioned approach where design assumes an abe-bodied user, and the provision for disabed peope is at best an afterthought. However, this is short-sighted. There are approximatey 10 miion peope with disabiities in the UK: one person in five. Their tota spending power is estimated at 50 biion. Non-incusive design excudes disabed peope and deters their famiy and friends. It is therefore not ony questionabe from an ethica point of view; it makes bad business sense. It may aso be iega. The introduction of the Disabiity Discrimination Act (DDA) in 1995 made it unawfu to discriminate against disabed peope. The aw has subsequenty been extended by the Specia Educationa Needs and Disabiity Act (SENDA) 2001 and Disabiity Discrimination Act 2005 which fied in various oophoes and extended coverage to more organisations incuding education providers, transportation and pubic authorities. Part III of the DDA requires any organisation providing goods, faciities or services to the pubic to ensure that their premises are fuy accessibe. This might entai removing or atering physica features of the buiding or finding a way to circumvent them. The purpose of this brochure is to offer guidance to the specifier in meeting your ega requirements under the DDA and in promoting the goa of incusive design. 3

This British Standard gives detaied guidance on the design and specification requirements of buidings that can ensure that disabed peope can make fu use of them. BS 8300 does not have the force of aw itsef but compiance shoud ensure that the ega obigations imposed by the DDA are met. Approved Document M (ADM) - Access to and use of buidings is part of the buiding reguations. It provides guidance and information compementary to the more detaied BS ADM appies to new buid and refurbished premises in Engand and Waes, incuding both non-domestic buidings and dweings and buidings undergoing a change of use. The Buiding (Scotand) Reguations 2004 and Part R of the Buiding Reguations (Northern Ireand) 2000 contain simiar guidance. 4

5 How does this affect me? Parts III and IV of the DDA and SENDA make it iega for service providers to discriminate against disabed peope for reasons pertaining to their disabiity, uness it can be justified. The definition of disabiity is a broad one, covering any physica or menta impairment, restricted mobiity, earning difficuties or ack of dexterity among many others. It is necessary to consider a ikey probems that the design of a buiding may cause to users, not just those which are obvious. The responsibiity imposed on service providers is to make a reasonabe adjustments necessary to faciitate access. Reasonabe wi be evauated against a number of factors, incuding: Type of goods or service Size of service provider Avaiabe resources How effective the adjustment is at overcoming the barrier Practicaity of making the adjustment Cost of the adjustment Disruption to the buiding whie the work is carried out. Whie this does give some discretion over the exact changes to make, it is important to reaise that doing nothing is not an option. An access pan for the premises shoud be drawn up, to assess a the foowing areas: Any feature in or on the premises occupied by the service provider arising from the design or construction of a buiding Any approach to, exit from or access to such a buiding Any fixtures, fittings, furnishings, equipment or materias Buiding entrances and exits Interna and externa doors and gates Toiet and washing faciities Signage. 5

What is to be considered? BS 8300 and the Buiding Reguations provide detaied guidance enabing you to meet the requirements of the DDA.

Can ocks and furniture be distinguished from their surroundings? Ease of comprehension: are products simpe to operate, and is it ceary obvious how to open, cose and ock a door?

Does the cosing device aow sufficient time for those with reduced mobiity?

6 What is to be considered? BS 8300 and the Buiding Reguations provide detaied guidance enabing you to meet the requirements of the DDA. Ease of manipuation: can ocks be operated by those with imited dexterity? For exampe, can a door be opened using ony a cosed fist? Ready access: is there sufficient space to pass through a door? Does the cosing device aow sufficient time for those with reduced mobiity? Reiabiity: can the products used be guaranteed to provide continuous easy access under constant use, without jamming, breaking or wearing out? The foowing pages give detaied recommendations and advice for meeting the requirements of the standards and reguations. When work wi deviate from the guidance in Part M, the Access Statement shoud set out the reasons for departing from the guidance and the rationae for the design approach adopted. 14
